sch.3-sec.143 Greenfields price protection determinations
Despite section 109(2)(a) an application for a greenfields price protection determination may be made after a pipeline is commissioned if— the pipeline was commissioned during the transition period; and the application is made within 90 days after the commencement day. This clause does not apply to a pipeline for natural gas. sch 3 s 143 ins 2023 No. 36 (SA) s 66 (sch.3-sec.143-ssec.1) Despite section 109(2)(a) an application for a greenfields price protection determination may be made after a pipeline is commissioned if— the pipeline was commissioned during the transition period; and the application is made within 90 days after the commencement day. (sch.3-sec.143-ssec.2) This clause does not apply to a pipeline for natural gas.
- (a) the pipeline was commissioned during the transition period; and
- (b) the application is made within 90 days after the commencement day.
