sch.3-sec.132 Decision-making process under Rules for approval of tender process
This clause applies if, before the commencement day, the AER— is deciding whether to make a tender approval decision; and has not made the decision. On the commencement day— the requirement to make the tender approval decision stops having effect; and the AER must stop deciding whether to make the tender approval decision. sch 3 s 132 ins 2022 No. 21 (SA) s 90 (2) (sch.3-sec.132-ssec.1) This clause applies if, before the commencement day, the AER— is deciding whether to make a tender approval decision; and has not made the decision. (sch.3-sec.132-ssec.2) On the commencement day— the requirement to make the tender approval decision stops having effect; and the AER must stop deciding whether to make the tender approval decision.
