This clause applies if— there is a pending old scheme no-coverage determination; and an application has not been made under section 38 of the old access law for a review of the determination within the time provided for under that section (whether or not that time expires on or after the commencement day). The pending old scheme no-coverage determination is deemed to be a decision not to make a coverage determination under section 93 on the day after the last day an application could have been made under section 38 of the old access law. (sch.3-sec.13-ssec.1) This clause applies if— there is a pending old scheme no-coverage determination; and an application has not been made under section 38 of the old access law for a review of the determination within the time provided for under that section (whether or not that time expires on or after the commencement day).
