sch.3-sec.11 Pending old scheme coverage determinations where no applications for review under old scheme
This clause applies if— there is a pending old scheme coverage determination; and an application has not been made under section 38 of the old access law for a review of the determination within the time provided for under that section (whether or not that time expires on or after the commencement day). The pending old scheme coverage determination is deemed to be a coverage determination on the day after the last day an application could have been made under section 38 of the old access law. (sch.3-sec.11-ssec.1) This clause applies if— there is a pending old scheme coverage determination; and an application has not been made under section 38 of the old access law for a review of the determination within the time provided for under that section (whether or not that time expires on or after the commencement day). (sch.3-sec.11-ssec.2) The pending old scheme coverage determination is deemed to be a coverage determination on the day after the last day an application could have been made under section 38 of the old access law.
- (a) there is a pending old scheme coverage determination; and
- (b) an application has not been made under section 38 of the old access law for a review of the determination within the time provided for under that section (whether or not that time expires on or after the commencement day).
