sec.88A AEMC must take into account form of regulation factors in certain cases
In addition to complying with sections 88 and 88B , the AEMC must take into account the form of regulation factors and any other matter the AEMC considers relevant— in making a Rule that— specifies an electricity network service as a direct control network service or negotiated network service; or confers a function or power on the AER to specify under a network revenue or pricing determination an electricity network service (to which the relevant determination applies) as— a direct control network service; or a negotiated network service; or in revoking a Rule that has been made or is in force that— specifies an electricity network service as a direct control network service or negotiated network service; or confers a function or power on the AER to specify under a network revenue or pricing determination an electricity network service (to which the relevant determination applies) as— a direct control network service; or a negotiated network service. s 88A ins 2007 No. 53 (SA) s 54
- (a) in making a Rule that— (i) specifies an electricity network service as a direct control network service or negotiated network service; or (ii) confers a function or power on the AER to specify under a network revenue or pricing determination an electricity network service (to which the relevant determination applies) as— (A) a direct control network service; or (B) a negotiated network service; or
- (i) specifies an electricity network service as a direct control network service or negotiated network service; or
- (ii) confers a function or power on the AER to specify under a network revenue or pricing determination an electricity network service (to which the relevant determination applies) as— (A) a direct control network service; or (B) a negotiated network service; or
- (A) a direct control network service; or
- (B) a negotiated network service; or
- (b) in revoking a Rule that has been made or is in force that— (i) specifies an electricity network service as a direct control network service or negotiated network service; or (ii) confers a function or power on the AER to specify under a network revenue or pricing determination an electricity network service (to which the relevant determination applies) as— (A) a direct control network service; or (B) a negotiated network service.
