sec.83 Conduct in breach of more than one civil penalty provision
If the conduct of a person constitutes a breach of 2 or more civil penalty provisions, an infringement notice may be served on the person under this Division in relation to the breach of any one or more of those provisions. However, the person is not liable to pay more than one infringement penalty in respect of the same conduct. Clause 39 of Schedule 2 to this Law sets out further provisions in relation to double jeopardy. s 83 amd 2011 No. 7 (SA) s 41 ; 2020 No. 37 (SA) s 24 (sec.83-ssec.1) If the conduct of a person constitutes a breach of 2 or more civil penalty provisions, an infringement notice may be served on the person under this Division in relation to the breach of any one or more of those provisions. (sec.83-ssec.2) However, the person is not liable to pay more than one infringement penalty in respect of the same conduct. Clause 39 of Schedule 2 to this Law sets out further provisions in relation to double jeopardy.
