sec.67 Conduct in breach of more than one civil penalty provision
If the conduct of a person constitutes a breach of 2 or more civil penalty provisions, proceedings may be instituted under this Law against the person in relation to the breach of any one or more of those provisions. However, the person is not liable to more than one civil penalty under this Law in respect of the same conduct. Clause 39 of Schedule 2 to this Law sets out further provisions in relation to double jeopardy. s 67 amd 2011 No. 7 (SA) s 34 (sec.67-ssec.1) If the conduct of a person constitutes a breach of 2 or more civil penalty provisions, proceedings may be instituted under this Law against the person in relation to the breach of any one or more of those provisions. (sec.67-ssec.2) However, the person is not liable to more than one civil penalty under this Law in respect of the same conduct. Clause 39 of Schedule 2 to this Law sets out further provisions in relation to double jeopardy.
