sec.28ZE AER to inform certain persons of decisions not to investigate breaches, institute proceedings or serve infringement notices
If the AER is given information by any person in relation to a breach or a possible breach of this Law, the Regulations or the Rules by a person but— decides not to investigate that breach or possible breach; or following an investigation, decides not to— institute any proceedings in respect of that breach or possible breach under Part 6 ; or serve an infringement notice in accordance with Division 5 of Part 6 in respect of that breach or possible breach, the AER must notify that person of that decision in writing. This section does not apply if the person gave the information to the AER anonymously. s 28ZE ins 2007 No. 53 (SA) s 25 (sec.28ZE-ssec.1) If the AER is given information by any person in relation to a breach or a possible breach of this Law, the Regulations or the Rules by a person but— decides not to investigate that breach or possible breach; or following an investigation, decides not to— institute any proceedings in respect of that breach or possible breach under Part 6 ; or serve an infringement notice in accordance with Division 5 of Part 6 in respect of that breach or possible breach, the AER must notify that person of that decision in writing. (sec.28ZE-ssec.2) This section does not apply if the person gave the information to the AER anonymously.
- (a) decides not to investigate that breach or possible breach; or
- (b) following an investigation, decides not to— (i) institute any proceedings in respect of that breach or possible breach under Part 6 ; or (ii) serve an infringement notice in accordance with Division 5 of Part 6 in respect of that breach or possible breach, the AER must notify that person of that decision in writing.
- (i) institute any proceedings in respect of that breach or possible breach under Part 6 ; or
- (ii) serve an infringement notice in accordance with Division 5 of Part 6 in respect of that breach or possible breach,
- (i) institute any proceedings in respect of that breach or possible breach under Part 6 ; or
- (ii) serve an infringement notice in accordance with Division 5 of Part 6 in respect of that breach or possible breach,
