sec.118AE Registered participant must comply with mandatory operation direction

A Registered participant who receives a mandatory operation direction must comply with— the direction; and the Rules obligations. This subsection is a civil penalty provision: See the definition of civil penalty provision in section 2AA (1) . A Registered participant does not incur liability for breach of contract, breach of confidence or another civil wrong by complying with a mandatory operation direction, including the Rules obligations. Despite subsection (1) , the Rules may prescribe— circumstances in which a Registered participant is not required to comply with a mandatory operation direction; and the information a Registered participant who is not required to comply with a mandatory operation direction must give the AER. s 118AE ins 2024 No. 62 (SA) s 6 (sec.118AE-ssec.1) A Registered participant who receives a mandatory operation direction must comply with— the direction; and the Rules obligations.
