MUD CRAB FISHERY MANAGEMENT PLAN 2006

The Plan is built on a small set of recurring legal and biological concepts, each anchored to defined terms and precise measurements.

• “Mud crab” and related biological tests. Mud crab is defined to include all life stages and parts of genus Scylla (cl 6 definition). Important regulatory tests include the carapace width minima (cl 18 for commercial, cl 38 for amateurs) and the Schedule 2 visual/physical test for “commercially unsuitable” crabs (cl 19; Sch 2). The Plan also bans “berried” females (egg-bearing) and requires immediate return to water where appropriate (cl 13(1)-(2)).
• Licensing and units of entitlement. Licences are numerically limited (cl 14(1)); two units of entitlement attach to each licence by default (cl 14A). A unit equates to an entitlement to 30 complying pots (cl 6 definition unit of entitlement). Transfers of units are allowed only between licence holders, require an application and Director approval and must be for at least 30 days (cl 14B).
• Gear and “complying” standards. The Plan uses “complying” as the baseline regulatory concept for pots and holding cages. Complying commercial holding cages are prescribed in cl 7 (capacity 1-2 m3 and minimum mesh size 65 mm x 45 mm). Complying floats for cages and pots have minimum sizes and marking requirements (cl 9 and cl 10); complying pots are defined by reference to Fisheries Regulations 1992 (cl 6 note). Escape vents in rigid pots are specified for retention/escape size (cl 28A).
• Spatial restrictions and mapping standards. “Closed waters” are waters landward of straight lines connecting listed coordinates in Schedule 1 (cl 6 definition; Sch 1). Maps are specified as those in the National Topographic Map Series Australia 1:100 000, AGD 1966 (cl 11). Special zones are set out in Schedules 3 and 4 and affect where certain gear (e.g. restricted bait nets) may be used (cl 33-34; Sch 3-4).
• Handling and market integrity requirements. The Plan requires specific handling practices before sale or holding: restraint of chelipeds (cl 21), keeping carapace and abdomen intact while held or until sale (cl 22), and limiting processing (cl 23). Holding cages must be kept within 200 m of the nominated place and no crab can be kept >7 days (cl 29(2)-(3)); feeding in holding cages is prohibited (cl 29(4)).
• Administrative roles and decision points. The Director has operational authority to approve transfers, give permission to use more than one vessel, and grant approvals for possession of restricted bait nets in prohibited areas (cl 14B, cl 24(3)-(4), cl 34(3)-(4)). Several Director decisions are “prescribed provisions” under the Fisheries Act (cl 24(5), cl 34(5)). The Minister must consult stakeholders when conducting reviews (cl 5(2)).
• Compliance thresholds and review triggers. The Plan sets quantitative thresholds that trigger a Director review: e.g. a 50% reduction in total catch by licensees or a 10% reduction in two consecutive years, a 10% per-year increase in total effort for two consecutive years, specific changes in median size and by-catch quantities (cl 5(1)(a)-(f)). Also, licensees must not fish if fewer than two units are attached (cl 14(3)), creating an operational entitlement threshold.

These concepts combine biological protection (size limits, berried female protection), capacity and access controls (licence cap, units/transfer rules), gear/handling standards (complying floats, escape vents, holding-cage rules), spatial management (closed waters, Mary River zone, bait-net prohibited areas), and administrative processes (Director approvals, prescribed decisions, review triggers). Each concept links to enforceable offences with specified penalty-unit maxima, so compliance is policed by criminal/administrative sanctioning rather than merely advisory instructions.

The Plan creates distinct obligations for several actor groups. The text itself identifies the intended stakeholder groups (cl 4(b)(i)-(iv)) and then allocates specific duties or limitations.

• Licensees (commercial operators). The primary regulated party is the holder of a Mud Crab Fishery licence (cl 6 definition licence, licensee). Licence-holders are subject to the most detailed and numerous operational obligations: limits on number of vessels, units of entitlement rules, permitted number of pots, restrictions on gear types, float and holding cage requirements, size and condition rules for captured crabs, rules about abandoning pots, restrictions on use and possession of restricted bait nets, and processing limits (cl 14-34). Licence-holders must nominate a nominated place to which several rules refer (cl 15). Licence-holders face the broadest range of maximum penalties (many at 40 penalty units, vessel and closed waters breaches at 85 units).
• Prospective licence applicants and transferees. The Plan limits licences to 49 total (cl 14(1)) and specifies transfer mechanics for entitlement units (cl 14B-14C). People wishing to enter the fishery must either obtain an available licence or receive a transferred unit from an existing licensee. Transfers are subject to Director approval and minimum duration. The Plan therefore affects market entry and market for entitlements within the licence-holder cohort.
• Amateur fishers. The Plan contains a separate Part (Part 5) directed to amateur fishers (cl 37). Amateur fishers face distinct size minima (cl 38), limits on daily take (10 crabs per day, cl 39), possession limits (cl 40 with tiered penalties), gear restrictions and a limit on pot use (not more than five pots, cl 41-42). The Plan excludes amateur-caught crabs lawfully purchased from licence-holders from certain possession calculations when a receipt exists (cl 40(2)).
• Indigenous people and other stakeholder groups. The objects clause (cl 4(b)(i)) explicitly includes indigenous people as a stakeholder group for whom fairness, equity and access are intended to be promoted. The Plan does not create a separate statutory regime for indigenous fishers but their status as stakeholders is recognised in the object and in the requirement that the Minister consult with stakeholder groups during reviews (cl 5(2)).
• Director and Minister (public decision‑makers). The Director has significant procedural and discretionary roles: approving transfers (cl 14B(4)), giving vessel-use approvals (cl 24(3)-(4)), granting possession approvals for restricted bait nets in the prohibited area (cl 34(3)-(4)), receiving nominated-place nominations (cl 15), and being required to undertake reviews when triggers are met (cl 5(1)). The Minister must consult stakeholders during a review (cl 5(2)) and must undertake the five-year review (cl 43(1)-(2)). Where the Plan refers to “prescribed provision” decisions under section 4 of the Fisheries Act, that imports statutory administrative law procedures for those Director decisions (cl 24(5), cl 34(5)).
• Buyers, retailers and exporters. The processing restrictions (cl 23) and the constraint that processing other than cooking, freezing or chilling is prohibited unless on the premises of a person licensed to buy and sell fish mean that market participants must ensure purchased mud crabs are not illegally processed by licensees, and licensed buyers/processors have their own obligations under separate licences referenced in cl 40(7).
• General public and vessel operators. The Plan affects any person who might fish in non-tidal waters (prohibited, cl 12), anyone using watercraft in areas where holding cages might pose a navigation hazard (holding cage must not pose hazard, cl 29(2)(b)), and persons who may possess restricted bait nets in the prohibited area (cl 34).

Who pays and who decides: commercial licence-holders bear most compliance and economic cost of gear and handling requirements, limits on pots and vessels reduce productive capacity for licensees, and transfer rules affect ability to lease capacity. The Director and Minister make key administrative choices subject to the Act’s processes. Amateur fishers face per-person limits and gear constraints which affect recreational practice. The Plan assigns clear regulatory actors and duties to each group and uses schedules and definitions to convert technical standards into enforceable obligations.

The Plan converts objectives into a network of enforceable duties for commercial licensees and amateur fishers and confers limited administrative rights to seek approvals and transfers.

Commercial licence-holder duties and conditional rights:

• Licence cap and entitlement duty: no more than 49 licences may be issued (cl 14(1)). Each licence has two units of entitlement attached unless transferred (cl 14A). Licence-holders must not fish under a licence with fewer than two units attached (cl 14(3)). The right to fish is therefore conditional on units being attached to the licence.
• Transfer rights and constraints: units may be transferred only to a person who holds a licence, transfers must be at least 30 days, are subject to Director approval and are not effective until written approval is given (cl 14B(1)-(4)). Transfers terminate on expiry date, on transferee ceasing to hold a licence, or at financial year end (cl 14C). The transfer regime is an administrative right to trade capacity within the licensing cohort.
• Nominated place duty: licence-holders must nominate one place as the nominated place; nomination must be the approved form and cannot be a vessel or part of a vessel (cl 15(1)-(3)). Many compliance duties reference the nominated place, for example holding cages must be within 200 m of it (cl 29(2)(a)), and licensees are deemed not to have taken certain undersize crabs if they return them to the water before returning to the nominated place (cl 20).
• Gear and vessel duties: licence-holders must use only permitted gear: complying pots and complying commercial holding cages (cl 25). They must not use more than the permitted number of pots tied to their units of entitlement (cl 26). They must not abandon pots (cl 27), must not possess more than the permitted number of pots while fishing (cl 28) but may have specified exceptions for spare pots at residences or in transit (cl 28(2)). A licensee must not use more than one vessel to catch mud crabs unless the Director approves in writing and conditions may be attached (cl 24(1)-(4)); the approval must be kept on the vessel (cl 24(6)).
• Float and marker duties: complying floats must be attached to pots and holding cages and must meet size, colour and marking requirements; floats must be above water level while gear is in use (cl 9, cl 10, cl 13A). Floats must be marked legibly and indelibly with licence or unit numbers as applicable.
• Handling duties: prior to sale or placement in a holding cage, licensees must restrain chelipeds (cl 21), must keep carapace and abdomen intact while held or until sold (cl 22), and may only process crabs by cooking, freezing or chilling except at premises of licence to buy and sell fish (cl 23).
• Holding-cage duties: comply with construction specs (cl 7), keep cages within 200 m of the nominated place and where they do not pose navigation hazards (cl 29(2)), do not retain crabs in cages for more than 7 days (cl 29(3)) and do not feed crabs in cages (cl 29(4)). Possession of holding cages cannot exceed total 4 m3 internal capacity (cl 30).
• Bait net duties and species exclusions: licensees may use restricted bait net, cast net, scoop net or hook and line to take bait but are prohibited from certain areas and must comply with deployment and unattended restrictions (cl 31-34). Licensees must not take or possess several specified species (barramundi, black jewfish, golden snapper, Spanish mackerel, king threadfin) (cl 32).
• Reporting/administrative compliance: where a licensee leaves a pot unattended and cannot remove it, the licensee must inform the Director within 24 hours with location and reason and comply with Director’s instructions (cl 27(3)). Approvals and transfers must be kept on vessels or near nets when in prohibited areas as required (cl 24(6), cl 34(6)).

Amateur duties and limited rights:

• Size and daily limits: amateurs must not take or possess crabs under smaller size thresholds than commercial rules (cl 38), must not take more than 10 mud crabs per day (cl 39), and must not possess more than 10 crabs except at a permanent residence or within specified exceptions (cl 40).
• Gear and pot limits: amateurs may use only listed gear types (cl 41) and may not use more than five pots (cl 42). Floats for amateur pots must be marked with the full name and telephone number of the person using the gear (cl 10(1)(b)).
• Evidentiary and receipt rights: a person’s possession count can exclude mud crabs lawfully acquired from a licensee if the person has a receipt or other proof of acquisition (cl 40(2)). Fishing parties can apportion crabs among members for possession calculations if properly demonstrated (cl 40(3)-(4)).

Rights to approvals and administrative decisions:

• Right to apply for Director approvals exists in several places: for more than one vessel (cl 24(3)), possession of restricted bait nets in prohibited areas (cl 34(3)), and transfers of entitlement units (cl 14B(3)). These rights are contingent on Director discretion and conditions, and the Plan makes those decisions prescribed provisions under the Fisheries Act for administrative law purposes (cl 24(5), cl 34(5)).

Enforceable prohibitions and protections:

• The Plan creates per-offence maximum penalties for contraventions across the matrix of duties, providing a clear compliance cost if prosecuted (see next section for penalty detail). Several obligations include de minimis exceptions or deeming provisions (e.g. returning undersize crabs immediately and with minimal injury removes possession for enforcement purposes, cl 13(2) and cl 20).

Collectively, duties constrain the scale and conduct of commercial effort, impose biosecurity and handling constraints for market integrity, limit recreational take, and create an administrative framework for transfers, exceptions and operational approvals administered by the Director under the Fisheries Act.

The Plan sets criminal/penal sanctions in penalty units for contraventions of obligations and ties enforcement to Director and Ministerial administrative functions.

Penalty structure:

• Higher-level offences attract up to 85 penalty units: fishing in non-tidal waters (cl 12), fishing in closed waters by licensees (cl 17), and possession of very large numbers of mud crabs by amateurs (possession of 21 or more crabs incurs a maximum penalty of 85 penalty units plus per-crab fines under cl 40(1); the specific per-crab $50 figure is stated in the Plan but expressed alongside penalty units) (cl 40(1)).
• Common operational offences often carry a maximum penalty of 40 penalty units: taking or having possession of berried females (cl 13(1)), failing to attach complying floats or having floats below water (cl 13A), taking undersize crabs (commercial cl 18; amateur cl 38), taking commercially unsuitable crabs (cl 19), restraint and carapace intact requirements (cl 21-22), processing outside permitted methods by a licensee (cl 23), use of unpermitted gear (cl 25), possession/use of restricted bait nets outside rules (cl 33-34), and many other operational breaches.
• Some specific, lower-order requirements carry a smaller penalty of 17 penalty units: failing to keep a holding cage within 200 m of the nominated place or keeping a crab in a holding cage for more than 7 days or feeding in a holding cage is a maximum 17 penalty units (cl 29(2)-(4)). Also, possession limits for complying commercial holding cages (total capacity >4 m3) incurs 17 penalty units (cl 30).
• Tiered penalty plus per-crab fines apply to amateur possession over 10 crabs: possession of 11-20 crabs attracts 40 penalty units and an additional $50 for each crab in excess of 10; possession of 21 or more results in 85 penalty units plus $50 per excess crab (cl 40(1)). The Plan therefore combines a fixed penalty-unit sanction with an additional per-crab monetary charge for certain possession breaches.

Enforcement mechanisms and administrative checks:

• Director approvals and prescribed provisions: several operational permissions (e.g. use of more than one vessel, possession of restricted bait net in prohibited area, transfers of units) are subject to Director approval; cl 24(5) and cl 34(5) expressly describe certain Director decisions as “prescribed provision” for the Act, making them subject to the Fisheries Act administrative decision rules and appeal/review mechanisms in that Act. The Plan requires approvals and copies to be kept on vessels or near the nets while in question (cl 24(6), cl 34(6)). This creates an evidentiary and compliance checkpoint during inspections.
• Deeming and defensive provisions: the Plan contains express deeming exceptions that reduce enforcement exposure if the operator returns undersize crabs immediately and with minimal injury, or returns berried females promptly (cl 13(2), cl 20). These provide a defence to possession-based enforcement by preventing possession where immediate return occurs. Similarly, receipts for legally purchased crabs from licence-holders are to be disregarded when counting crabs in possession for amateur limits (cl 40(2)), creating an evidentiary safe harbour for purchasers who retain proof.
• Operational record and location obligations: the Plan requires licensees to inform the Director if a pot is unremovable and to comply with Director’s instructions (cl 27(3)). The Department can direct removal and the licensee must retain approvals on the vessel for inspection (cl 24(6), cl 34(6)). These obligations help enforcement locate and remove abandoned or hazardous gear and provide a compliance trail.
• Technical compliance checks: the Plan is heavily prescriptive on equipment dimensions and markings , float sizes, float colour and marking with licence/unit numbers, holding cage mesh and volume, escape-vent dimensions for rigid pots , and on map/datum standards (cl 7, cl 9, cl 10, cl 28A, cl 11). Enforcement thus can rely on physical inspections and measurements to determine compliance.
• Spatial enforcement: closed waters and prohibited areas are mapped by coordinates in Schedule 1 and Schedule 4 and by descriptive boundary in Schedule 3 for the Mary River zone. Enforcement therefore involves geolocation against those schedules and map series standards (cl 6, cl 11; Sch 1-4).

Enforcement burdens and practicalities:

• The Plan disperses many offences across multiple clauses with varying maxima. Prosecutions will require proof of factual elements (e.g. the size of the crab, presence of eggs, float marking, possession counts, location relative to nominated place, whether a pot was “abandoned” by being unattended for more than 48 hours). The deeming provisions in cl 13(2) and cl 20 mean timing and immediacy of returns are factually significant defences.
• Administrative decisions by the Director are integrated into the enforcement regime and are subject to the Fisheries Act’s procedural rules for prescribed provisions, which can affect timeliness and contestability of approvals.

Finally, the Plan records many offences as strict statutory breaches with specified penalty units; the value of penalty units is not given in the Plan text and enforcement practice will be under the criminal or regulatory enforcement mechanisms provided by the Fisheries Act and NT criminal law. The Plan emphasises measurable technical compliance points to assist enforcement (floats, sizes, coordinates, cage capacity, pot counts) to facilitate inspections and prosecutions.

The Plan is a subordinate statutory instrument operating under the Fisheries Act 1988 and explicitly links to other legislative and regulatory frameworks.

• Fisheries Act 1988: The Plan is made under the Fisheries Act 1988 (statement at head and cl 1). Several clauses reference “prescribed provision” and decisions under section 4 of the Act (cl 24(5), cl 34(5)), signalling that certain Director decisions under the Plan are to be treated as prescribed administrative decisions under the Act. That interaction imports the administrative law framework of the Fisheries Act for how approvals and conditions must be handled and potentially reviewed or appealed.
• Fisheries Regulations 1992: The Plan relies on definitions and technical terminology from the Fisheries Regulations 1992. For example, the definition of “complying pot” references complying marine pots and dilly pots defined in regulation 4 of the Regulations; the Plan states those definitions apply by virtue of section 27(3) of the Act (cl 6 note). That means operational gear standards are jointly determined by the Plan and the Regulations, and compliance requires consulting both instruments.
• Commonwealth environmental law: cl 5(1)(g) requires the Director to review management where licensees or agency officers identify a significant effect of the fishery on an ecosystem component, particularly a species or community listed under the Environment Protection and Biodiversity Conservation Act 1999 (Cth) (EPBC Act). The Plan thus acknowledges potential interaction with Commonwealth environmental listings and triggers management review if fishery operations materially impact EPBC-listed entities. This creates an inter-governmental check where federal environmental law can prompt administrative review under the Plan.
• Topographic mapping and datum standards: The Plan prescribes the National Topographic Map Series Australia 1:100 000, AGD 1966, as the base for map references (cl 11) and uses AGD 1966 as the geodetic datum for coordinates (cl 6 definition). Enforcement and compliance checking against Schedules 1-4 will require interpreters to use that datum and map series; differences in datum or GPS systems require transformation to AGD 1966 for legal compliance checks.
• Local and marine navigation rules: the Plan requires holding cages to be kept in places that do not pose hazards to navigation (cl 29(2)(b)) and refers to vessel registrations when marking floats for pots attached to vessel registrations (cl 10(1)(b)(i)). That means the Plan interacts practically with marine safety and vessel registration systems overseen by other Commonwealth or NT agencies; compliance with the Plan may therefore require coordination with marine safety requirements.
• Statutory repeal and amendment framework: Part 7 repeals earlier Mud Crab Fishery management plans (cl 44) and the Endnotes list the instrument history, indicating the Plan supersedes prior plans and is itself amended by subsequent subordinate legislation. The interaction with amendment law is direct: the Plan is subject to the NT instrument-making regime and to formal amendment entries recorded in the Endnotes (Endnotes 2-4, List of Amendments).
• Licensing frameworks for buyers/processors: cl 23(2) exempts processing on premises of a person licensed to buy and sell fish; cl 40(7) references Fish Trader/Processor licence, Fish Retailer licence or Aquaculture licence when defining licensee for possession exemptions. Compliance therefore requires actors to be aware of and, where relevant, obtain separate licences under the Fisheries Act or Regulations to operate as buyers/processors.

Practical consequences of these interactions:

• Compliance assessments need cross-referencing with Regulations and the Fisheries Act to confirm definitions and administrative appeal rights. For example, whether a pot meets the “complying” standard may turn on the Fisheries Regulations’ machinery, not the Plan alone (cl 6 note).
• Reviews prompted by EPBC-listed effects create a federal overlay that can result in tighter controls even where the Plan does not itself list those species (cl 5(1)(g)). Licence-holders and stakeholders should monitor federal listing changes for potential impacts on Plan operation.
• The Plan’s geographic references use an older datum (AGD 1966). Users and enforcement must apply appropriate coordinate transformations where modern GPS systems (e.g. GDA94/GDA2020) are used in practice to avoid position errors in enforcement or compliance determinations (cl 6, cl 11).

The Plan, therefore, must be read and applied as part of a networked legal framework including the Fisheries Act and Regulations, federal environmental law, and practical mapping/navigation rules that affect operational compliance.

The Plan includes an explicit amendment history in its Endnotes and a table of amendments identifying which clauses were amended and when. The Plan as provided is a consolidated instrument "as in force at 25 July 2018" and records successive subordinate legislation that altered text and mechanics.

Key chronological entries (from Endnotes and List of Legislation):

• Original: Mud Crab Fishery Management Plan (SL No. 12, 2006), notified 26 April 2006, commenced 1 May 2006 (Endnotes 2).
• Amendment 2010: Mud Crab Fishery Management Plan Amendment 2010 (SL No. 9, 2010), notified 30 June 2010, commenced 1 July 2010. This amendment amended many operational clauses (see list in Endnotes 4).
• Amendment 2012: Mud Crab Fishery Management Plan Amendment 2012 (SL No. 7, 2012), notified 8 February 2012, commenced 13 February 2012. This amendment changed definitions (cl 6), added clause 13A (float must be attached), amended structural clauses across Part 4 and parts, and updated Schedules (Endnotes 4).
• Amendment 2017: Mud Crab Fishery Management Plan Amendment 2017 (SL No. 4, 2017), notified 22 March 2017, commenced 22 March 2017. This amendment altered parts of Division 2 Subdivision 4 heading and other clause text (Endnotes 4).
• Amendment 2018: Mud Crab Fishery Management Plan Amendment 2018 (SL No. 21, 2018), notified 25 July 2018, commenced 25 July 2018. This consolidated instrument is stated “as in force at 25 July 2018” (header) and several clauses (cl 20, cl 28, cl 28A, cl 42A, etc.) were inserted or amended by that instrument (List of Amendments in Endnotes 4).

Specific clause-level amendment snapshots (Endnotes 4):

• Clause 4 (objects) amended by No. 21, 2018, cl 4.
• Clause 6 (definitions) amended several times by No. 9, 2010; No. 7, 2012; No. 4, 2017.
• Clauses 14A-14C (unit of entitlement and transfer mechanics) were inserted by No. 9, 2010, cl 8, establishing the current unit transfer framework.
• Clause 13A (Float must be attached to gear) was inserted by No. 7, 2012, cl 6.
• Clause 28A (Use of escape vents in pots) inserted by No. 21, 2018, cl 9.
• Clause 42A (Mud crab to be left intact for amateurs) inserted by No. 21, 2018, cl 11.
• Parts and subdivisions were redrafted and headings amended at various times (see Endnotes 4 for precise clause references).

The Endnotes also record that general formal amendments of a non-substantive nature were made by the Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018) to cl 1, cl 6 and cl 44 (Endnotes 3).

Practical reading tip: the Plan’s amendment history demonstrates that key operational features (units of entitlement, float attachment, escape vents, amateur and commercial size differentials) have been the subject of iterative change across 2010-2018. For legal advice or compliance verification, practitioners should check the consolidated text and the specific amending instruments referenced in the Endnotes to trace exact textual changes, transitional arrangements and any savings or repeal provisions contained in the subordinate instruments (the Endnotes list the SL numbers and commencement dates).

The Plan itself contains no citations to judicial decisions and the text does not record any litigation or judicial interpretation. The instrument is silent on case law and does not name any judicial decisions.

Implications for practitioners and researchers:

• Absence of named cases in the Plan means that statutory interpretation questions will rely on general principles of administrative and statutory construction, the Fisheries Act regime, and any judicial decisions that may have subsequently interpreted its clauses. The instrument does not provide authoritative administrative guidance on contested facts such as what constitutes “immediately” returning a crab for the purpose of the deeming provisions (cl 13(2), cl 20) or the particular method by which chelipeds must be restrained (cl 21).
• Because Director decisions under certain clauses are “prescribed provisions” (cl 24(5), cl 34(5)), administrative decision-making under the Plan is likely subject to internal review or merits review mechanisms in the Fisheries Act or subordinate rules. If disputes arise, practitioners should examine the Fisheries Act judicial review and merits review pathways and any decisions applying them to fishery administrative actions.
• If litigated, key likely areas for judicial determination would include: whether equipment meets “complying” standards where definitions reference external Regulations (cl 6 note), the exact temporal and factual meaning of return-with-as-little-injury-forpossession-defences (cl 13(2), cl 20), and geographical boundary determinations using AGD 1966 (cl 6, cl 11; Sch 1-4). Given these technical elements, disputes are likely to require evidence from fisheries experts, surveyors (for coordinates), and gear inspectors.

Practical step: search NT court and tribunal databases, and administrative review decisions under the Fisheries Act, for post-2010 decisions referencing the Mud Crab Plan. Because the Plan is highly technical, litigation may be fact-intensive and node-specific; absence of case law in the instrument means each contested fact will matter in enforcement and defence.

This Plan contains multiple traps for the unwary operator that arise from tightly prescriptive technical standards, intersectional definitions, and administrative formalities.

1. Licence and unit mechanics can suspend fishing rights:

   • Each licence carries two units by default but licence-holders must not fish under a licence if fewer than two units are attached (cl 14A; cl 14(3)). A licence-holder who transfers one unit (legal under cl 14B) becomes unable to fish under that licence until the unit reverts or another unit is acquired. Transfers also terminate on end of financial year or if transferee loses licence (cl 14C), so operators need calendar control.

2. Licence cap and permanent reduction risk:

   • The total number of licences the Director may issue is capped at 49 and the number reduces by one if a licence is cancelled or not renewed (cl 14(1)-(2)). That reduction is not temporary; cancellation/non-renewal permanently reduces available count under the Plan text, affecting market entry dynamics.

3. Float marking and position minutiae:

   • Floats must be orange and of minimum diameter and length, and marked legibly and indelibly with licence or unit numbers (cl 9(1), cl 10(1)). For amateur pots the float must bear the full name and telephone number (cl 10(1)(b)). Marks must be easily read at all times (cl 9(3), cl 10(3)). Enforcement can stop a vessel for an inadvertently faded painted number or an illegible inscription.

4. Strict technical gear specs:

   • Complying holding cages must have internal capacity between 1 m3 and 2 m3 and minimum mesh size 65 mm x 45 mm (cl 7). A licensee may not possess cages with total internal capacity over 4 m3 (cl 30). Simple mis-sizing of mesh or cumulative capacity across cages triggers offences with penalty units (cl 29-30).

5. Abandonment defined by time and notice:

   • A pot is taken as abandoned if left unattended >48 hours (cl 27(2)). However, the exception requires the licensee to inform the Director before the end of 24 hours with specific details and to comply with Director’s instructions (cl 27(3)). Failure to notify within 24 hours removes the exception and triggers a potential offence; operators must be proactive in communications.

6. Spatial/geodetic confusion:

   • Closed waters and prohibited areas are defined by coordinates using AGD 1966 and map sheets in the National Topographic Map Series (cl 6, cl 11; Sch 1-4). Modern GPS devices default to GDA94/GDA2020 which differ numerically; failure to transform coordinates may result in inadvertent incursions into closed waters or prohibited bait-net areas.

7. Inconsistency between commercial and amateur size limits:

   • Commercial minimum sizes are larger than amateur minimums (commercial female 150 mm vs amateur female 140 mm; commercial male 140 mm vs amateur male 130 mm) (cl 18 vs cl 38). A licensee selling to an amateur must ensure purchaser’s possession threshold exemptions (cl 40(2)) are supported by receipts; otherwise the amateur may unknowingly possess more than permitted or possess undersize crabs.

8. Processing restrictions and buyer licences:

   • Licensees may only process by cooking, freezing or chilling (cl 23(1)), except on premises of persons licensed to buy and sell fish (cl 23(2)). A licensee who gifts or transfers crabs to a processor without appropriate premises or licences may be contravening the processing rule.

9. Escape vent technicalities:

   • Pots made of wire, steel or rigid materials must have escape vents meeting precise dimensions (cl 28A). Small manufacturing variations could render an otherwise used pot noncompliant.

10. Possession accounting complexities for fishing parties and vessels:

• Possession calculations for amateurs can aggregate among party members and on vessels (cl 40(3)-(5)), with strict rules on receipts excluding some crabs (cl 40(2)). Where parties are together or vessels carry more than three persons with over 30 crabs, each person is taken to possess all crabs, exposing all to penalties. This makes record-keeping and receipts essential.

11. Deeming timing and “immediate” return defences:

• The “not regarded as having taken” provisions require immediate return and with as little injury as possible (cl 13(2), cl 20). The Plan does not define “immediate” or “as soon as practicable” precisely; these are potential evidentiary battlegrounds in enforcement.

12. Prescribed provisions and administrative risk:

• Director approvals (units transfers, multi-vessel approvals, restricted bait net possession) are prescribed decisions under the Fisheries Act (cl 24(5), cl 34(5)), which may attract internal review, formal conditions and greater procedural requirements; operators relying on oral approvals or incomplete paperwork risk noncompliance.

13. Tiered penalties with per-crab monetary charges:

• Amateur possession penalties combine penalty units and a $50 per-crab amount beyond thresholds (cl 40(1)). The Plan therefore creates a potentially large monetary exposure in addition to the statutory penalty units.

Knowing these “gotchas” allows operators, compliance officers and advisers to focus on administrative processes, measurements, record-keeping, marking and geolocation accuracy to reduce enforcement exposure.

This section is a practical compliance checklist derived directly from the Plan’s clauses. It is structured by actor (licensee/commercial operator and amateur fisher) and then by recurring operational themes (equipment, handling, records, spatial compliance, and administration).

For licensees (commercial compliance checklist):

• Licence and entitlement management:

  • Confirm the licence is one of the capped 49 and that two units of entitlement remain attached if you intend to fish (cl 14(1), cl 14(3), cl 14A).
  • If transferring a unit, apply to the Director in the approved form and obtain written approval before the transfer is effective; transfers must be at least 30 days and transfers terminate on expiry, loss of transferee licence, or end of financial year (cl 14B(2)-(4), cl 14C).
  • Keep a calendar of transfer expiry dates and ensure a unit is attached at all times when fishing.

• Pot and gear compliance:

  • Ensure number of pots in use does not exceed permitted number attached to units (cl 26). Count pots and maintain inventory records showing pots associated with entitlements.
  • For pots in use, attach a complying float meeting cl 10 minimum diameter/length (100 mm), mark legibly and indelibly with the unit of entitlement number in Arabic numerals and ensure float remains above water (cl 10(1)(a),(b); cl 13A).
  • For pots made of rigid materials, verify escape vents meet cl 28A dimensions (single vent ≥46 mm x 240 mm, or multiple vents ≥46 mm x 120 mm each).
  • Avoid exceeding possession limits while fishing; spare pots may be stored at permanent residence (any number) or up to 30 excess pots at nominated place/in transit by direct route (cl 28(2)). If using a second vessel not used to harvest, do not keep more than 15 spare pots on that vessel (cl 28(3)).

• Holding cages and floats:

  • Use complying commercial holding cages (internal capacity 1-2 m3; mesh ≥65 mm x 45 mm) (cl 7).
  • Keep holding cages in water within 200 m of the nominated place and avoid navigational hazards (cl 29(2)). Maintain a record of nominated place and GPS coordinates, and ensure holding cages’ location is recorded and auditable.
  • Do not hold crabs for more than 7 days in cages and do not feed crabs in cages (cl 29(3)-(4)). Maintain date-of-capture/holding logs to demonstrate days held.
  • Ensure total internal capacity of complying cages does not exceed 4 m3 (cl 30).

• Handling and biological compliance:

  • Do not take or possess berried female mud crabs (cl 13(1)). If a berried female is captured, return it immediately to the water with as little injury as possible; retain evidence of immediate return where possible (cl 13(2)).
  • Measure carapace widths before retaining: female ≥150 mm and male ≥140 mm for commercial take (cl 18). If undersize, return to water as soon as practicable and before returning to the nominated place to avoid possession charges (cl 20).
  • Use the Schedule 2 test for “commercially unsuitable” and do not take or possess such crabs (cl 19; Sch 2).
  • Before placing crabs in a holding cage or at nominated place, restrain chelipeds so minimal movement at the elbow joint is possible (cl 21). Ensure methods and tools used for restraint are documented and demonstrable.

• Processing and sales:

  • If processing for sale, limit processing on-board or at premises to cooking, freezing or chilling (cl 23(1)). For other processing methods, only use premises of a person licensed to buy and sell fish (cl 23(2)). Maintain buyer licences and receipts.
  • Keep accurate sale and dispatch records and issue receipts to purchasers; such receipts assist purchasers to demonstrate lawful acquisition and can be used to exclude purchased crabs from amateur possession counts (cl 40(2)).

• Vessel operations and approvals:

  • Use only one vessel for harvesting unless you obtain written Director approval under cl 24(3)-(4). Keep the approval or a copy on the vessel (cl 24(6)).
  • If you must leave a pot unattended and cannot remove it, notify the Director before the end of 24 hours with identification and location and follow Director instructions (cl 27(3)).

• Bait nets and by-catch:

  • Use restricted bait nets only in the area seaward to 3 nautical miles and not in the Mary River part or prohibited area (cl 33(2)-(3); Sch 3-4). Do not leave restricted bait nets unattended, ensure they are not fixed except at one end and are in not less than 30 cm of water when clearing catch, and do not fix both ends (cl 33(4)).
  • Do not take or possess the species listed in cl 32 (barramundi, black jewfish, golden snapper, Spanish mackerel, king threadfin). Monitor by-catch and retain accurate logs.

• Records and location standards:

  • Use maps and geodetic references consistent with AGD 1966 and National Topographic Map Series 1:100 000 as the legal reference for coordinates (cl 11; cl 6 definition AGD 1966). Maintain GPS logs transformed to AGD 1966 when necessary.
  • Keep all Director approvals, transfer documentation and nominated-place forms in approved format available for inspection (cl 15(2), cl 24(6), cl 34(6)).

For amateur fishers (recreational compliance checklist):

• Daily and possession limits:

  • Do not take more than ten mud crabs in any one day (cl 39).
  • Do not possess more than ten crabs other than at your permanent residence, unless you can show you are part of a fishing party and that apportionment would leave no member over 10 (cl 40(1), cl 40(3)-(4)). Be cautious on vessels: if more than three persons are present and more than 30 crabs onboard, each person may be taken to possess all crabs (cl 40(5)).
  • Retain receipts when purchasing crabs from licence-holders; purchased crabs with receipts are excluded from possession counts (cl 40(2)).

• Size and gear:

  • Adhere to amateur minimum sizes: female ≥140 mm, male ≥130 mm (cl 38). Return undersize crabs to the water immediately and with minimal injury; as soon as practicable procedures for measurement should be minimised (cl 38(2)).
  • Use only permitted gear: hand or complying pot, dilly pot, hand-spear, hand-held hook, hook and line, scoop-net, cast-net or amateur drag net (cl 41) and do not use more than five pots (cl 42).
  • Mark amateur floats with full name and phone number in Arabic numerals and ensure floats meet the minimum size in cl 10(1)(a) if the float is used for a complying pot.

Shared compliance practices and risk mitigation for both cohorts:

• Measurement protocol: adopt a standard caliper measuring to the widest carapace width and maintain dated photographs or logs for borderline cases to support a return defence (cl 18, cl 38).
• Receipts and chain of custody: issue and retain clear receipts for sales/purchases that include seller’s licence details and buyer’s name to assist amateur possession exemptions and enforcement checks (cl 40(2)).
• Map and position practice: transform GPS coordinates to AGD 1966 before relying on boundary lines; maintain logs of GPS tracks and time-stamped photographs of location for disputed closed-water incidents (cl 6, cl 11; Sch 1-4).
• Marking maintenance: ensure permanent and legible marking on floats (incising preferred to paint where practical) and maintain a spare pool of compliant floats to replace weather-faded units quickly (cl 9(2), cl 10(2)).
• Inventory and storage: keep an up-to-date inventory of pots, holding cages and cages’ internal capacities to demonstrate possession limits (cl 28, cl 30).
• Training and procedures: train crew on cheliped restraint procedure (cl 21), immediate return protocols for berried or undersize crabs (cl 13(2), cl 20), and abandonment notification obligations (cl 27(3)).
• Director approvals and documentation: apply for and obtain all necessary approvals in writing before acting (cl 14B, cl 24(3), cl 34(3)), and keep approvals on board or in proximity to the equipment as the Plan requires (cl 24(6), cl 34(6)). Ensure transfer paperwork is complete and approved before transferring fishing rights (cl 14B(3)-(4)).

Administrative housekeeping:

• Monitor regulatory and environmental triggers for review and potential management change: cl 5 lists numeric thresholds that can trigger reviews (catch decreases of ≥50% or two consecutive ≥10% years, increases in effort, median size declines ≥5 mm over two years, by-product/by-catch thresholds, or identification of significant ecosystem effects, cl 5(1)). Keep records of catch, effort and by-catch to participate in any consultation and to document compliance.
• Stay up to date with amendments: the Plan has been amended several times (Endnotes 2-4). Subscribe to agency notifications and check the consolidated text frequently.

This checklist maps directly to the Plan’s operative clauses. Practitioners should ensure both physical compliance and documentary evidence to support compliance-defence positions given the Plan’s emphasis on tangible measurements, marked gear, and place/time constraints.
