Motor Vehicle Repairers Regulations 2007 (Western Australia)

These regulations prescribe the operational framework, fees, qualifications and administrative detail that implement Part 3 of the Motor Vehicle Repairers Act 2003. They do this by (a) defining the universe of “repair work” and related terms (regulation 3), (b) listing the classes of repair work that require certification and business licensing (regulation 5), (c) setting the fees, durations and forms for business licences and repairer certificates (regulations 7A, 7E, 7F, 7 and 11), and (d) prescribing ancillary obligations such as premises standards for autogas work, notification duties when qualified staff change, infringement notice procedures and modified penalties (regulations 7D, 7G, 13 and Schedule 1).

Mechanically, the regulations do the following things that change behaviour and costs for businesses and individuals in the motor repair sector:

Define the scope of regulated activity. Regulation 3 supplies detailed definitions of more than 50 terms used throughout the Act and regulations, and regulation 5 prescribes 23 distinct classes of repair work (for example air conditioning work, brake work, engine reconditioning work, light vehicle work, heavy vehicle work, tyre fitting work). Those classes form the basis for who must hold particular certificates and what business licences must cover (regulation 5).
Exclude particular vehicles and activities. Regulation 4 removes certain vehicles (for example vintage vehicles, Segways and power assisted pedal cycles) from the Act’s definition of motor vehicle. Regulation 6 lists specific activities that are not “repair work” for the Act, such as washing a vehicle to improve appearance and certain work on refrigeration units in trailers (regulation 6).
Set fees and licence terms. Regulation 7A prescribes the application fee structure for business licences, which combines a base amount ($288 as at the version provided) plus a scale component tied to the number of repairers the applicant employs (the Table in r.7A). Regulation 7F sets a similar fee structure for renewal, while regulation 7E prescribes a 3 year licence period. Regulation 7C, 7 and 11 set fees for duplicate licences, repairer certificates ($111) and certified copies ($73).

Part 5 — Transitional provisions

Transitional provision for Commerce Regulations Amendment (Motor Vehicle Dealers and Repairers) Regulations 2021 39

The regulations rest on a set of discrete legal building blocks that determine who needs what credential, and what conduct is captured.

Classes of repair work. Regulation 5 lists 23 prescribed classes of repair work. Each class is a unit of regulatory competence for the purposes of Part 3 of the Act. The list is the operational core: the regulation ties training package qualifications and statutory certificates to those classes (see Schedule 2 and regulation 8). A practitioner must first identify which class or classes apply to a person or business, because certification, business licence scope and training requirements hinge on that identification (regulation 5; Schedule 2).
Detailed operational definitions. Regulation 3 is a dense definitional section that maps commonly used phrases to regulatory treatment. It does several specific, consequential things:
- It splits fuel systems into non‑gas fuel systems and gas fuel systems and treats gas fuel systems distinctly (see the definition of gas fuel system and r.3(2)(d), (fa)). That affects whether certain “fuel system” references include gas conversions; converting to or from gas fuel systems can be captured as autogas work or subject to separate permits.
- It expressly includes electric motors in references to engines and propulsion systems (r.3(2)(a)), bringing hybrid/electric work within many definitions.
- It defines “number of repairers” for licensing fee calculations and includes contractors engaged under services contracts, but excludes apprentices (definition in r.3(1)). That affects fee bands under r.7A and r.7F.
- It separates “service”, “repair”, “overhaul” and “install” to cover diagnostic, maintenance and reconstruction activities. Subregulation (3) further clarifies what “work required in connection with” a thing or system includes (inspecting, disconnecting circuits, removing and refitting), broadening capture.
Qualifications regime. Regulation 8 ties the classes listed in regulation 5 to specific training package qualifications. Schedule 2 provides an itemised mapping from each class to one or more AUR training package codes and specific qualification titles. For air conditioning work, regulation 8(3) adds a Commonwealth licensing overlay by requiring an automotive air conditioning licence under the Ozone Protection and Synthetic Greenhouse Gas Management Regulations 1995.
Business licence architecture. Part 2A establishes fees, duration and conditions for business licences. Regulation 7A prescribes a two‑part fee: a base fee plus a scale component determined by the number of repairers. Regulation 7E sets a three year licence term. Regulation 7D prescribes conditions and restrictions such as the AS 2746‑1999 premises standard and the Class E permit requirement for autogas work.
Administrative register and particulars. Regulation 9 prescribes the particulars to be entered in the register for each licence and certificate, including the make/model/registration for mobile premises and the addresses for fixed premises. The register entries create a public record of licence scope, expiry dates and conditions.
Enforcement and sanctions. Regulation 13 lists the Act provisions that are infringement notice offences and sets modified penalties for individuals and bodies corporate. It also prescribes the forms for issuing and withdrawing infringement notices (regulation 14 and Schedule 1). Separate penalties apply in the regulations themselves, for example the $2 000 fine for failing to notify the Commissioner when a qualified repairer ceases or becomes attached to the licensee (regulation 7G).
Transitional continuity. Regulations 16 and 17 preserve the continuing effect of repairer’s certificates on the commencement of specified amendment regulations and provide a limited 12 month window for persons who were part way through prescribed qualifications before a regulatory change to apply for certificates under the old rules (regulation 16(3)-(5)).

These concepts together turn the Act’s licensing and certification policy into defined administrative duties, fees and eligibility rules. The definitional architecture in regulation 3 and the Schedule 2 mapping are particularly consequential because they determine regulatory capture of evolving vehicle technologies, who counts in fee calculations and which training credentials suffice for statutory certification.

The regulations affect defined groups in concrete ways: individual repairers, repair businesses, apprentices, training providers, authorised officers and the Commissioner who administers the register and fees.

Repair businesses and licensees. Any person or firm carrying on the business of performing prescribed repair work will generally require a business licence under the Act and the regulations. The regulations set the upfront and renewal fees for licence applications (regulations 7A and 7F), prescribe the licence duration (three years at r.7E), require certain premises standards for autogas work (regulation 7D(a)), and require licensees to notify the Commissioner when qualified repairers join or leave the business (regulation 7G). Licensees must ensure that the public register entries (regulation 9(1)) accurately reflect premises, mobile premises details and licence conditions.
Individual repairers. Individuals performing prescribed classes of repair work must hold a repairer’s certificate where the Act requires it. Regulation 7 prescribes the certificate fee ($111 regardless of number of classes). Regulation 8 and Schedule 2 set the qualifications needed for each class (AUR training package qualifications or specified Certificate III for locksmithing). Regulation 8(3) adds an additional Commonwealth licence requirement for air conditioning work. Regulation 8A prescribes unit‑level examinations for wheel alignment, steering and suspension work.
Apprentices and trainees. Apprentices are defined by cross reference to the Vocational Education and Training Act 1996 s.60A and are explicitly excluded from the “number of repairers” calculation used to set business licence fee bands (definition of number of repairers in r.3(1)). The exclusion directly affects the fee schedule in regs 7A and 7F because employer size for fees is calculated on full‑time equivalent qualified repairers and excludes apprentices.
Businesses using mobile premises. The regulations treat mobile premises as a distinct category. For a licensee authorised to operate from mobile premises, regulation 9 requires recording make, model and registration and normal storage address. Regulation 12 prescribes fees for adding or substituting particulars of mobile or fixed premises when updating authorised premises. The fees are per premises at $141 in the version provided.
Autogas and gas fuel system practitioners. The regulations impose dual regulatory overlays for autogas work. Regulation 7D requires premises used for autogas work to comply with AS 2746‑1999 and requires that the person performing autogas work hold a Class E permit or be supervised by someone who holds a Class E permit, a permit defined by reference to the Gas Standards (Gasfitting and Consumer Gas Installations) Regulations 1999. This means businesses that modify fuel systems to gas or service gas fuel systems must comply with a combination of state regulation and the separate gasfitting permits regime.
Training providers and credential holders. The regulations reference specific AUR training package releases and codes and permit certain releases (AUR99, AUR05, AUR12, AUR, with release numbers indicated in definitions), tying statutory qualifications to nationally recognised training products. Training providers delivering those qualifications supply the credential evidence individuals must produce for certificates under the Act (regulation 8 and Schedule 2).
The Commissioner and authorised officers. The regulations assign administrative powers to the Commissioner (fees collection, register maintenance, refunds under regulation 15) and establish forms and procedures for authorised officers to issue infringement notices and withdrawal notices (regulation 14; Schedule 1). The Commissioner is the decision maker on refunds where applications are withdrawn (regulation 15(2) and (4)).

Who pays. The regulations make licensees and applicants the payers of fees: business licence applicants (r.7A), certificate applicants (r.7), duplicate licence requestors (r.7C), applicants changing authorised premises (r.12), and applicants seeking certified copies (r.11). Infringement and modified penalty payments are payable by the alleged offender under the Act and regulations (regulation 13 and Schedule 1 Forms).

Who decides. The Commissioner is the administrative decision maker for issuing licences and certificates, accepting qualifications, entering particulars in the register and refunding fees in specified circumstances (regulations 9, 15). Authorised officers issue infringement notices on behalf of the Commissioner using the prescribed form (regulation 14; Schedule 1).

Overall, the regulations principally affect operators and workers in the automotive repair market by imposing credential and premises standards, a fee architecture tied to business size, notification obligations, and an enforcement regime that includes infringement notices and monetary penalties.

This section translates the statutory text into concrete duties businesses and individuals must perform, and rights the regulatory framework preserves.

Key duties

Obtain the correct certificate for each class of repair work. Regulation 8 and Schedule 2 prescribe the qualifications that make an individual “sufficiently qualified” for a class of repair work. Air conditioning work carries an additional Commonwealth licence requirement (regulation 8(3)). Regulation 8A prescribes the unit examinations for wheel aligning, steering and suspension work.
Apply for and maintain a business licence that covers the classes of repair work performed. A business licence application attracts a prescribed fee comprising a base amount and a scale component linked to the number of repairers (regulation 7A). Licences are to be issued or renewed for three years (regulation 7E). Renewal applications attract fees under regulation 7F.
Ensure premises used for autogas work comply with AS 2746‑1999. If a licensee carries out autogas work, premises must comply with the Australian Standard AS 2746‑1999 (regulation 7D(a)).
Ensure autogas work is performed by suitably authorised persons. A licensee must not permit a repairer to carry out autogas work unless the repairer holds a Class E permit or is supervised by someone who holds such a permit and is authorised under that permit to supervise (regulation 7D(b)).
Notify the Commissioner within 14 days of gain or loss of a qualified repairer. Regulation 7G requires written notification specifying the person’s full name and the date on which they became or ceased to be a qualified repairer. The provision fixes a penalty of $2 000 for non‑compliance.
Maintain and submit accurate register particulars for licences and certificates. Regulation 9 prescribes a detailed list of particulars to be recorded (licence number, issue and expiry dates, business name, addresses of fixed and mobile premises with vehicle details where relevant, conditions and restrictions). For certificates, regulation 9(2) prescribes particulars including application day, grant day, class(es) of work and any conditions.
Pay fees for administrative changes. Fees for adding or substituting authorised premises particulars are prescribed in regulation 12, with a per‑premises fee for mobile and fixed premises.
Use the prescribed infringement notice and withdrawal forms. Regulations 13 and 14 require use of Schedule 1 Forms 1 and 2 for issuing and withdrawing infringement notices and set modified penalty amounts in the table in regulation 13.

Key rights

Right to a refund on withdrawal or refusal in specified circumstances. Regulation 15 requires the Commissioner to refund certain fee components where an applicant withdraws or where an application is refused for specified application types. The regulation excludes transitional or replacement applications from its scope.
Right to continuity of existing certificates on amendment commencements. Transitional regulations 16 and 17 preserve the continuing effect of repairer’s certificates that were in force immediately before relevant amendments took effect.
Right to obtain duplicate documents and certified copies. Regulation 7C prescribes a fee ($35) for duplicate business licences and regulation 11 prescribes a fee ($73) for certified copies of certificates.
Opportunity to contest enforcement via court process instead of paying a modified penalty. The infringement notice form (Schedule 1 Form 1) informs alleged offenders that payment of the modified penalty avoids prosecution, but provides the option to submit the matter for prosecution in court.

Additional operational features with duty‑like effects

The “number of repairers” definition affects fee bands and thus creates an obligation on applicants to calculate full‑time equivalent repairers (including contractors engaged under service contracts) but excluding apprentices. That definition is in regulation 3(1).
“Repair work” capture is intentionally broad because regulation 3(3) includes inspection, testing, disconnecting electrical circuits and removal and refitting as part of work required in connection with a thing or system. That expands the set of activities that may require certification.

Enforcement and consequences

Breaches attract either specific regulatory penalties (for example the $2 000 penalty in r.7G) or modified penalties set out in regulation 13. The modified penalty table in regulation 13 specifies different amounts for individuals and bodies corporate for a set of Act provisions. Schedule 1 prescribes the procedural form of the infringement notice and the associated information on how to pay, seek an extension or elect court prosecution.

Taken together, the regulations allocate responsibility for credentialing, premises compliance, record keeping and timely notification to businesses and individuals. They also provide administrative remedies (refunds, certified copies, duplicates) and a specific enforcement architecture based on infringement notices and modified penalties.

The regulations establish a mixed enforcement architecture that uses infringement notices and specific regulatory penalties to secure compliance, and prescribes forms and fee amounts associated with enforcement.

Infringement notices and modified penalties

Regulation 13 implements the Act’s infringement notice regime (Act s.98). It lists specific Act provisions (by section number) as offences for which an infringement notice may be issued under Act s.100. Regulation 13(2) sets the modified penalty payable in respect of each prescribed provision. The table in regulation 13 allocates distinct monetary amounts for individuals and bodies corporate. Examples from that table include: section 39(2) has a modified penalty of $500 for individuals, section 39(3) is $500 for individuals and $2 500 for a body corporate, and section 57 is $500 for individuals and $2 500 for a body corporate (see regulation 13 Table).
The infringement notice form and the withdrawal form are prescribed in Schedule 1 Forms 1 and 2 under regulation 14. Form 1 includes statutory information about payment within 28 days, the option to elect prosecution in court, and enforcement consequences pursuant to the Fines, Penalties and Infringement Notices Enforcement Act 1994 (Form 1 text). The form lists where to pay and how to apply for an extension of time.

Specific regulatory penalties

Regulation 7G creates a specific regulatory penalty for failure by a licensee to notify the Commissioner in writing within 14 days of a qualified repairer ceasing to be, or becoming, a qualified repairer of the licensee. The penalty is a fine of $2 000 (regulation 7G(3)).
The regulations also embed financial obligations that, if not paid, will subject a person or business to enforcement actions through the infringement/penalty regime under the Act. For example, not maintaining proper registration details or operating without the required certificate or licence may trigger an infringement notice under the Act sections listed in the Table to regulation 13.

Administrative enforcement procedures

The Commissioner is the recipient of notifications, fees and refund requests. Regulation 15 prescribes when refunds must be provided and delegates discretion to the Commissioner to refund part of base fee components where an application is withdrawn. That discretion implies administrative review and potential monetary adjustment by the Commissioner.
Schedule 1 Form 1 describes enforcement consequences under the Fines, Penalties and Infringement Notices Enforcement Act 1994, listing possible enforcement mechanisms: suspension of driver’s licence, suspension or cancellation of vehicle licence, disqualification from holding licences, immobilisation of vehicles, publication of details on a website, garnishment of earnings or bank accounts and seizure and sale of property. The form does not itself create those powers but indicates the enforcement pathways available under the separate Fines Act once an infringement becomes a fine that is not paid.
Withdrawal of infringement notices is completed by issuing the prescribed Form 2 (Schedule 1). The withdrawal form also prescribes refund procedures where a modified penalty has been paid.

Practical enforcement implications

The modified penalty table in regulation 13 differentiates penalties by offender type. For many provisions the penalty for a body corporate is double or substantially higher than for an individual (see regulation 13 Table), reflecting a statutory approach that treats corporate breaches as potentially more serious or that seeks to deter corporate non‑compliance.
The combination of administrative discretion over refunds (regulation 15) and the Commissioner’s control of the register (regulation 9) creates points at which administrative decisions will determine the practical penalty burden on applicants and licensees.
The regulations also prescribe procedural protections, such as the right to opt for prosecution (Schedule 1 Form 1) rather than paying the modified penalty, preserving access to judicial determination.

In summary, enforcement under the regulations uses a two‑tier monetary system: specified penalties for particular regulatory duties in the regulations themselves (for example r.7G), and a broader set of infringement notice offences under the Act that the regulations identify and quantify (regulation 13 and Schedule 1). The Commissioner administers the fee, register and refund processes and authorised officers issue infringement notices on the prescribed forms. The enforcement architecture thus combines fixed‑sum remedies with administrative discretion and court options.

The regulations explicitly cross‑refer to, and rely upon, a number of other legislative instruments and standards. Those cross‑references create legal interlocks that expand the compliance perimeter beyond the text of the regulations.

Vocational training and national qualifications

The regulations tie statutory competence to nationally recognised training products by referencing AUR training packages and specific qualifications (regulation 3 definitions of AUR, AUR05, AUR12, AUR99; regulation 8 and Schedule 2 mapping). That cross‑reference makes the content and currency of national training packages relevant to statutory certification. Any change to the authorised training packages, their release numbers or qualification titles can therefore affect who is eligible for statutory certificates under the Act as implemented by these regulations.

Commonwealth environmental licensing for air conditioning

Regulation 8(3) imposes a federal overlay for air conditioning work by requiring the person to hold an automotive air conditioning licence under Subdivision 6A.2.2 of the Ozone Protection and Synthetic Greenhouse Gas Management Regulations 1995 (Commonwealth). The practical effect is that, for air conditioning work, a practitioner needs both the AUR qualification and the Commonwealth licence. This is a direct interaction between state regulatory licensing and Commonwealth environmental controls.

Gasfitting and gas fuel system regulation

For autogas work, the regulations require either that individual repairers hold a Class E permit or that they operate under the supervision of a Class E permit holder. The “Class E permit or authorisation” is defined by reference to the Gas Standards (Gasfitting and Consumer Gas Installations) Regulations 1999. Therefore the gasfitting regulatory regime supplies the competence and supervisory rules for autogas work performed under the Motor Vehicle Repairers Regulations.

Road and vehicle licensing laws

The definition of “vintage vehicle” and the identification of the “relevant authority” for gross vehicle mass draw on the Road Traffic (Vehicles) Act 2012 (see reg 3 definitions and reg 4 exclusion list). Determination of gross vehicle mass and vehicle classification for “heavy vehicle” and “light vehicle” can therefore be affected by the Road Traffic Act’s definitions and administrative practices.

Fines enforcement regime

The infringement form (Schedule 1 Form 1) explicitly references enforcement options under the Fines, Penalties and Infringement Notices Enforcement Act 1994 (Form 1). That Act supplies the enforcement levers (for example garnishment, licence suspension, immobilisation) which can be activated where a modified penalty goes unpaid. The practical enforcement capabilities in the schedule therefore depend on this separate statute.

Standards Australia and technical standards

Regulation 7D(a) requires that premises used for autogas work comply with Australian Standard AS 2746‑1999, Working areas for gas‑fuelled vehicles. This is a standards‑based requirement that imports technical premises expectations into the licence condition.

Commerce regulations and fee schedules

The compilation table shows a history of amendments made by Commerce Regulations Amendment instruments that adjust fees and other regulatory detail. Fee amounts are therefore responsive to separate fee instruments that amend the Commerce Regulations. Regulation 7A and 7F fee amounts have been amended multiple times by those Commerce Regulations Amendments (see compilation table and individual amendment notes).

How these interactions operate in practice

Credential and licensing eligibility is mediated by external instruments. For example, a practitioner seeking an air conditioning certificate must meet both the AUR qualification in Schedule 2 and the Commonwealth automotive air conditioning licence. Similarly, autogas work requires compliance with AS 2746‑1999 and Class E gasfitter permits under gasfitting regulations. That multiplies compliance steps and paperwork and requires businesses to coordinate across state, Commonwealth and standards regimes.
Regulatory change in external instruments can alter statutory eligibility. Because the regulations reference specific releases and codes of AUR training packages, changes in training package structures, qualification codes or titles can create transitional issues (the regulations include transitional provisions to address some of these changes, see regs 16 and 17). Practitioners therefore need to monitor both the regulations and the named external instruments.
Enforcement and remedies are triangular. An unpaid modified penalty under the Motor Vehicle Repairers Act and these regulations may be enforced using powers in the Fines Act. That means strategic choices about contesting an infringement notice will often require attention to enforcement consequences available under a different statute.

In sum, compliance under the Motor Vehicle Repairers Regulations is not a standalone exercise. It requires attention to national training packages, Commonwealth environmental licences, gasfitting permits, Australian Standards and the Fines Act. The regulations are therefore one node in a web of regulatory instruments that collectively govern motor vehicle repair activity.

The regulation text includes a detailed compilation table and amendment notes that set out the legislative history and tranche of changes that have affected the text since 2007. Key points from the compilation and amendment record in the material provided are:

Original enactment and commencement. The Motor Vehicle Repairers Regulations 2007 were published on 9 February 2007 and commenced on 19 March 2007 (see Compilation table).
Major structural and content amendments. There have been multiple amendment instruments that altered definitions, added Part 2A (licensing of motor vehicle repair businesses), introduced fees, adjusted prescribed classes of repair work and updated qualifications references. Notable amendments and insertions include:
- 2008 amendment instruments which, among other things, added Part 2A and introduced fee structures and registers (Motor Vehicle Repairers Amendment Regulations 2008 and No. 2 2008; see Gazette 24 Jun 2008; inserted headings and regs such as Part 2A and regs 7A etc).
- 2014-2015 amendments that made multiple targeted changes (see several 2014 instruments with commencement dates in mid to late 2014 and 2015).
- 2019 and 2020 amendments that updated qualification references and administrative matters (see Motor Vehicle Repairers Amendment Regulations 2019 and SL 2020/121).
- 2021 and 2022 amendment instruments delivered under broader Commerce Regulations Amendment packages that adjusted fees and added regulatory detail. The Commerce Regulations Amendment (Motor Vehicle Dealers and Repairers) Regulations 2021 (SL 2021/164) and Commerce Regulations Amendment (Motor Vehicle Dealers and Repairers) Regulations 2022 (SL 2022/161) specifically amended the Motor Vehicle Repairers Regulations and introduced transitional provisions (regulations 16 and 17).
- Fee amendments continued annually through Commerce Regulations Amendments to 2025, with the compilation table listing Commerce Regulations Amendment (Fees and Charges) Regulations in 2016, 2017, 2018, 2019, 2021, 2022, 2023, 2024 and 2025 affecting fee amounts and other items.
Insertions and deletions of specific provisions. The notes indicate several discrete deletions and insertions:
- Regulations such as 7AA and 7B were inserted and later deleted (see insertion and deletion notes).
- Regulation 5 (the Table prescribing classes of repair work) was inserted by SL 2022/161 r. 9 indicating a material recasting of what is treated as repair work in that amendment. Transitional provisions (regulation 16 and 17) were included to prevent abrupt loss of certificate effect for persons holding certificates or in progress towards qualifications.
Evolution of qualifications references. The definitions in regulation 3 list specific AUR release numbers (AUR99, AUR05, AUR12 and AUR) and Schedule 2 maps classes of repair work to a set of AUR qualification codes and titles. The inclusion of these multiple release versions recognises the evolving nature of national training packages and ties the regulations to particular release versions to manage continuity. The 2022 amendments expanded Schedule 2 and added regulation 8A (exams for wheel aligning, steering and suspension) under SL 2022/161.
Fee adjustments. The fee tables in regs 7A and 7F have been adjusted multiple times by Commerce Regulations Amendment instruments, as the compilation table documents. The 3 year licence duration in regulation 7E was inserted by a 2014 amendment (Gazette 18 Nov 2014 p. 4321).
Transitional arrangements. The regulations include two transitional provisions targeted at managing change when the regulation text was altered by the Commerce Regulations Amendment instruments in 2021 and 2022 (regulations 16 and 17). Regulation 16 provides a 12 month window for certain individuals who were part way through qualification requirements to apply for certificates under previous rules. Regulation 17 preserves the continuing effect of repairer certificates on the commencement day for the 2022 amendments and confirms that regulation 16(5) continues to operate.

Practical reading of the amendment history

The compilation table in the materials is granular and shows ongoing adjustments to fees and technical requirements across nearly two decades. Practitioners should therefore treat the regulations as a dynamic instrument where fee schedules, qualification mappings and small procedural details can be updated by Commerce Regulations Amendments that reference or amend these regulations.
The explicit transitional provisions suggest the drafters anticipated qualification mapping changes across AUR releases and wanted to protect people who were mid‑qualification. That is visible in regulation 16’s 12 month application window.
Because the regulations reference external instruments and specific release numbers, any subsequent change to training package codes or external regulations may require further amendment or administrative interpretation to ensure that previously acceptable qualifications remain recognised.

Overall, the amendment history shows iterative adjustments to the licensing, fee and qualification architecture, with repeated fee updates and occasional structural changes to preserve certificate continuity when mapping to training packages changes.

The regulations themselves do not contain case law or judicial determinations and the compilation provided does not list or summarise litigation concerning the Motor Vehicle Repairers Regulations 2007 or the Motor Vehicle Repairers Act 2003. The text does not identify any precedent or appeals decisions, nor does the compilation table include references to litigation.

What the regulations do show that is litigation-relevant

The regulatory instruments create a record of legally enforceable duties, penalties and administrative discretions against which disputes or prosecutions could arise. For example, non‑compliance with notification duties (regulation 7G) is a prescribed offence with a monetary penalty and could plausibly be litigated if contested.
The infringement notice architecture (regulation 13, Schedule 1) creates a pathway from administrative notices to court prosecution. The infringement notice form expressly gives the alleged offender the right to elect prosecution in court instead of accepting the modified penalty (Schedule 1 Form 1). That procedural right ensures that litigation remains an option where a recipient contests liability.
Because the regulations cross‑reference federal licensing requirements for air conditioning and gasfitting permits for autogas work, litigation could peripherally involve interpretation or interaction of state and Commonwealth regulatory regimes. For example, disputes concerning whether an individual’s Commonwealth licence satisfies the regulation 8(3) requirement for an air conditioning certificate could end up in judicial or tribunal review.

How practitioners should approach litigation history given the absence in the instrument

Search external sources. The regulations do not provide litigation history. Practitioners seeking precedent or administrative determinations should search WA tribunals, District and Supreme Court decisions, the State Administrative Tribunal (if it has jurisdiction for some licensing disputes), and published decisions or determinations of the Department of Mines, Industry Regulation and Safety (Consumer Protection division) and other tribunals.
Check administrative review and appeal pathways. The regulations create a framework of administrative decisions (licence refusals, conditions, refunds, register entries). Disputes about those decisions will depend on the Act’s review provisions and the general administrative law framework. The regulation text does not set out appeal procedures; those are in the Act or other statutes.
Monitor enforcement outcomes. Because many enforcement outcomes will be handled by infringement notices that can be paid or contested, decisions about contesting a notice may produce reported or unreported litigation. There is no litigation history recorded in the regulations, so practitioners must rely on independent case law databases.

In short, the regulations contain rules, penalties and forms that give rise to enforceable obligations, but they do not themselves record any litigation outcomes. Any judicial or tribunal treatment of disputes generated by these regulations will be found in external case law and tribunal records, not in the regulations’ text or compilation table provided here.

Several provisions in the regulations create traps for the unwary or operational frictions that materially affect cost and compliance. These are specific, concrete points that frequently generate disputes or compliance failures.

Qualifications mapped to specific AUR releases. Regulation 3 defines AUR, AUR05, AUR12 and AUR99 as specific release families. Schedule 2 then maps each class of repair work to particular AUR codes and qualification titles. The mapping to specific releases means that a practitioner relying on a later or differently named qualification must verify that the qualification release and code are covered by the regulations or that the Commissioner accepts equivalence. If training package codes change, transitional protections are finite and limited (see regs 16 and 17), so workers partway through qualifications may need to act within specified time windows.
Two‑step credentialing for air conditioning. Air conditioning work requires both the AUR qualification in Schedule 2 and an automotive air conditioning licence under Commonwealth ozone protection regulations (regulation 8(3)). Omitting the Commonwealth licence is an easy compliance failure that may not be obvious when only state qualifications are considered.
Autogas work premised on a Class E permit and premises standard. Regulation 7D(a) imposes AS 2746‑1999 on premises where autogas work is carried out. Regulation 7D(b) requires Class E permits for those performing autogas work or supervision by a Class E permit holder. Businesses converting fuel systems or retrofitting gas systems need to manage at least three separate compliance items: premises standard, Class E permitting and the motor repairer certificate mapping for autogas work. The three separate regimes add time and capital costs (premises upgrade), paperwork and supervisory requirements.
Fee calculation includes contractors but excludes apprentices. The “number of repairers” definition (r.3) includes persons engaged under a contract for services but excludes apprentices. That can increase licence fee bands for businesses that contract out specialist work but employ apprentices in-house, and it may encourage businesses to structure labour arrangements to influence fee bands. The definition requires calculating full‑time equivalents, which can produce disputes about part‑time or contractual arrangements.
Mobile premises particulars and fee per premises. Mobile premises must be entered in the register with vehicle make, model and registration (r.9(1)(i)). Adding or substituting particulars of a mobile or fixed premises attracts a fee of $141 per premises (regulation 12). Businesses operating multiple mobile units should factor recurring administrative fees into operational costs and ensure accurate vehicle details are maintained.
Narrow non‑repair exclusions. Regulation 6 lists activities that are not repair work, but the wording is narrow. For example, installing refrigerator units in trailers is excluded (r.6(b)), but installing fixtures normally associated with human habitation that are permanently fitted is excluded only when they are “normally associated with human habitation” (r.6(c)). The line between a custom accessory that is “normally associated with habitation” and a specialised unit that affects vehicle performance may be fuzzy and invite regulator scrutiny.
Strict notification timeline and monetary penalty. Regulation 7G requires written notification within 14 days of a qualified repairer starting or ceasing. The pecuniary penalty is $2 000 for non‑compliance. The short time window can catch businesses that change personnel frequently without administrative processes to track and notify in time.
Refund discretion is partial. Regulation 15 allows the Commissioner to refund “so much (if any)” of base fees when applications are withdrawn. That language provides administrative discretion and uncertainty about recoupment of costs, particularly where applicants have paid base fees and scale components.
Divergent penalties for individuals and corporations. The modified penalty table in regulation 13 frequently assigns different amounts to individuals and bodies corporate. For example, section 39(3) is $500 for an individual but $2 500 for a body corporate. Corporates therefore face materially different financial exposure, which has implications for entity structuring and enforcement risk.
Public register specificity. Regulation 9(1)(h) and (i) require specific premises particulars to be recorded. Errors or omissions may lead to non‑compliance findings. For mobile premises, the requirement to list the normal storage address can be operationally awkward for businesses that rotate vehicles between depots.
Exclusion of apprentices from repairer numbers but not from supervision requirements. Although apprentices do not count towards repairer fee bands, they still require supervision and appropriate certified repairers on site. The regulation does not exempt apprentices from oversight; therefore, businesses using apprentices need both a strategy for supervision and to ensure enough qualified repairers are retained to cover classes of repair work performed.
Cross‑jurisdictional licence dependencies. Because air conditioning and autogas work require compliance with Commonwealth or other State regulations and Australian Standards, a business cannot rely solely on a state certificate. The combined compliance burden is a practical gotcha: being certified under Schedule 2 is necessary but sometimes not sufficient.
Prescribed forms must be used. Infringement and withdrawal notices must use Schedule 1 Form 1 and Form 2 (regulation 14). Procedural errors in issuing notices on incorrect forms could create administrative challenges and potential litigation over procedural fairness, but the regulations do not provide a grace period for form errors.
Transitional windows are limited. Regulation 16(5) provides a 12 month window for some individuals part way through qualifications prior to the 2021 amendment. Those transitional windows are finite and conditional. Practitioners relying on transitional provisions must track commencement dates closely.

These “gotchas” create concrete compliance costs (training, premises upgrades, fees, documentation), operational constraints (supervision, staff counting, premises management), and legal uncertainty (qualification equivalence, cross‑jurisdictional licences). The regulation text supplies specific citations for these risks: see regs 3, 5, 6, 7A, 7D, 7F, 7G, 8, 8A, 9, 11, 12, 13 and 15 and Schedule 2.

This is a practical, step‑by‑step checklist for businesses and individuals based on the regulations’ text, with citations to the relevant provisions. It assumes a business or individual is starting or maintaining motor vehicle repair activity in Western Australia and seeks to operate within the regulatory framework set out in the Motor Vehicle Repairers Regulations 2007.

Identify the activity and match to classes of repair work. Consult regulation 5, which prescribes 23 classes of repair work. Determine which class or classes your business or individual activity falls within (e.g. light vehicle work, tyre fitting work, autogas work).
Check whether the vehicle or activity is excluded. Verify that the vehicle is not one of the exclusions listed in regulation 4 (for example vintage vehicles, Segways, power assisted pedal cycles). If the activity might be excluded from the definition of repair work, consult regulation 6 which lists kinds of work that are not prescribed repair work (e.g. washing, certain refrigeration unit work).
Confirm qualifications required. For each class of repair work identified at step 1, consult regulation 8 and Schedule 2 to find the prescribed qualification(s) and their AUR codes. If the class is wheel aligning, steering and suspension, refer to regulation 8A for required unit examinations. For locksmith work, note regulation 8(4) prescribes MEM30819 , Certificate III in Locksmithing.
For air conditioning work, obtain the Commonwealth licence. If doing air conditioning work, secure the automotive air conditioning licence required by the Ozone Protection and Synthetic Greenhouse Gas Management Regulations 1995 in addition to the AUR qualification, per regulation 8(3).
Apply for a repairer’s certificate if required. Once you hold the required qualification(s), apply for a repairer’s certificate under the Act. Regulation 7 prescribes the certificate fee ($111 at the date shown). Ensure you can supply qualification evidence that matches the AUR codes and releases cited in Schedule 2.
Decide on business licensing and scope. If operating a repair business that carries out prescribed repair work, apply for a business licence. Determine the number of repairers for fee band calculation per the “number of repairers” definition in regulation 3(1), which includes full‑time equivalents and contractors engaged under a contract for services but excludes apprentices. Use that number to compute the application fee under regulation 7A (base fee plus scale component) and renewal fee under regulation 7F.
Ensure premises compliance for autogas work. If your business intends to carry out autogas work, ensure premises comply with AS 2746‑1999 (regulation 7D(a)). Confirm that personnel who will perform autogas work hold a Class E permit under the Gas Standards Regulations or work under supervision by a Class E permit holder as required by regulation 7D(b).
Complete register particulars accurately. On grant of licence or certificate, ensure the Commissioner’s register entries are accurate per regulation 9. Include business name, addresses of fixed premises, vehicle make/model/registration for mobile premises, licence number and expiry, and any conditions.
Establish internal notification processes. Implement procedures to notify the Commissioner within 14 days whenever a qualified repairer becomes or ceases to be a qualified repairer of a licensee, as required by regulation 7G. The failure to notify attracts a $2 000 penalty.
Maintain staff training and certification records. Keep personnel qualification certificates, AUR unit evidence and any Commonwealth licences (for air conditioning) on file to demonstrate compliance in case of an audit or enforcement action.
Keep mobile premises information up to date and budget for change fees. For mobile premises, enter make, model, registration and normal storage address on the licence register. If you add or substitute premises particulars, pay the per‑premises fee ($141 as prescribed in regulation 12(2)).
Use correct forms for infringement and withdrawal notices. If issuing or responding to an infringement notice, ensure the prescribed forms in Schedule 1 are used (Form 1 for infringement notice; Form 2 for withdrawal).
Understand refund and withdrawal rules. If you withdraw an application for a business licence, certificate or premises change, consult regulation 15. The Commissioner must refund certain scale components of fees but has discretion to refund part or none of the base component. Plan finances accordingly.
Manage apprentices and contractor arrangements. Since apprentices are excluded from repairer counts (r.3(1)), but contractors under service contracts are included, structure labour arrangements consciously and document headcount and full‑time equivalents to support fee calculations.
Monitor legislative and qualification changes. Because the regulations map to specific AUR releases and external instruments, stay alert to amendments (the compilation table shows frequent Commerce Regulations Amendments). Where changes occur, check transitional provisions (regs 16 and 17) and act within any windows provided.
Keep an enforcement response plan. Know that the infringement process allows payment of modified penalties within 28 days or election to contest in court (Schedule 1 Form 1). For unpaid modified penalties, enforcement powers under the Fines, Penalties and Infringement Notices Enforcement Act 1994 may apply. Have legal contact details ready and a plan to decide whether to contest or settle an infringement notice.
Document and archive register entries and communication. Maintain copies of all register entries, notifications to the Commissioner, licence certificates, invoices for fees paid, and certified copies requested (regulation 11 prescribes a $73 fee for certified copies). These records assist in audits and disputes.
Seek clarification where training package codes or qualification titles differ. If a qualification you hold appears under a different release or code than those listed in Schedule 2, consult the Commissioner for acceptance or check transitional provisions, rather than assume automatic equivalence.

This compliance checklist maps directly to the regulatory provisions: identify classes (regulation 5), confirm definitions (regulation 3), secure qualifications (regulation 8 and Schedule 2), obtain certificates (regulation 7), secure business licences (regulations 7A, 7E, 7F), ensure premises and autogas compliance (regulation 7D), keep the register up to date (regulation 9), notify changes promptly (regulation 7G) and follow the infringement procedure (regulations 13-14 and Schedule 1). Implementing these steps will align operational practice with the written requirements of the Motor Vehicle Repairers Regulations 2007.
