What it does
These regulations implement operational rules under the Motor Accidents (Liabilities and Compensation) Act 1973 (the Act) for premiums, records, evidence, refunds, jurisdictional application, and the schedule of benefits payable by the Board for motor-accident injuries. Mechanically, the instrument:
- Prescribes the short title and commencement date (regulations cited as the Motor Accidents (Liabilities and Compensation) Regulations 2020; commencement 17 February 2020) (regs 1-2).
- Directs the Registrar to issue a certificate of premium paid when a premium is paid under s 30 of the Act and defines the periods for which that certificate remains in force for registered and unregistered vehicles (reg 4(1)-(2)).
- Requires specific particulars to be recorded when a premium is paid, including the class of motor vehicle (reg 5(2)), permits electronic record-keeping and requires the Registrar to provide copies of records to the Board (reg 5(3)).
- Confers evidentiary weight on certified extracts of records kept under s 33(4) of the Act, and specifies who may certify such extracts (reg 6(1)-(2)).
- Sets out the process and formula for refunding premiums on surrender of vehicle registration and authorises deduction of a reasonable administrative fee, including a no-refund rule when the calculated refund does not exceed the fee (reg 7(1)-(2)).
- Directs the Registrar to remit to the Board all premiums received on the Board’s behalf less refunds (reg 8).
- Prescribes other Australian jurisdictions for certain Act provisions (reg 9).
- Fixes the scheduled benefits that the Board is to pay under s 23(1), (1A) and (2) of the Act by reference to Schedule 1 of these regulations (reg 10(1)), sets claim notice and limitation periods and gives the Tribunal power to extend those periods up to five years (reg 10(2)-(4)).
