Monitoring of Places of Detention by the United Nations Subcommittee on Prevention of Torture (OPCAT) Act 2022

Purposes and scope. The Act’s stated main purposes are to facilitate visits by the Subcommittee in accordance with the Optional Protocol, to provide access to information for the Subcommittee’s functions, and to provide safeguards so detaining authorities can preserve privacy, security, good order, welfare and safety during visits (s 1). Those three purposes frame the rest of the statutory design and determine how the Act balances inspection rights against operational considerations.

Place of detention. The Act adopts a broad functional definition of "place of detention" in s 4. That definition explicitly covers prisons, police gaols, remand centres, youth justice and youth residential centres, parts of designated mental health services where patients are detained, residential treatment facilities under the Disability Act 2006 and Serious Offenders Act 2018, treatment centres under the Severe Substance Dependence Treatment Act 2010, vehicles primarily used to transport detainees, and places where people are detained under specified public health powers (s 4(1)(a)-(p)). Subsection 4(2) provides a carve‑out so that people required to isolate or quarantine are not treated as "detained" for the purposes of s 4(1)(n) simply because they are required to isolate or quarantine. Subsection 4(3) explicitly excludes courtrooms from the meaning of place of detention. The definition therefore reaches many institutional settings where liberty is restricted beyond traditional prisons and includes some treatment and health settings.

Access to places and parts. The statutory phrase "enter and visit" and "have unrestricted access to any part of the place of detention" appears in parallel duties imposed on relevant Ministers and detaining authorities (ss 5-6). The term "unrestricted access" is not further defined in the Act. Two statutory mechanisms authorise temporary limitation of access: (a) responsible Minister objection on listed public interest grounds where the Minister reasonably believes there is an urgent and compelling reason to temporarily prevent the visit (s 7); and (b) detaining authority temporary prohibition or restriction where the authority reasonably believes access would impede security, good order and management, health and safety, or essential operations (s 8). The detaining authority’s restriction must be for the shortest period reasonable and must be recorded in writing (s 8(2)-(3)).

Information access. The Subcommittee has an entitlement to "unrestricted access" to all information in the possession or under the control of relevant Ministers or detaining authorities that is relevant to the Subcommittee purpose, except for "excluded information" (s 12). The Act lists examples of relevant information (s 12(3)) including numbers and locations of places of detention, numbers of detainees, treatment and conditions of detention. "Excluded information" is defined to include Cabinet documents and information subject to legal professional privilege or client legal privilege (s 3). Personal information and health information are treated specially: identifying information may only be provided to the Subcommittee if the Subcommittee visits or has visited the place of detention (s 13). The Subcommittee may retain or copy non‑identifying information, and may retain identifying information about a detainee only with that detainee’s consent (s 14).

Interviews and privacy. The Subcommittee may interview any person at a place of detention during a visit and other persons it believes may provide information relevant to detention, provided the person consents (s 9(1)-(2)). Interviews may be conducted in person or by electronic communication and may involve an interpreter (s 9(3)-(4)). A nominated support person may be present only if the Subcommittee agrees (s 10). Interviews must occur in private, with no other persons present except an accompanying expert, an interpreter or an agreed support person (s 11). Nominated officials may assist the visit but must not be present during interviews (s 17(3)-(4)).

Protections against reprisal. The Act creates a criminal offence for taking "detrimental action" against a person because they gave or disclosed information to the Subcommittee or because someone is believed to have done so (s 15). The statutory definition of "detrimental action" is comprehensive and includes physical injury or loss, onerous changes to detention conditions, intimidation, discrimination in employment, dismissal, prejudice in employment and disciplinary proceedings (s 15(2)). The Act further clarifies that a court finding of guilt for the s 15 offence does not prevent other regulatory or disciplinary action against the person in relation to the same conduct (s 16).

Administration and subsidiary instruments. The Act provides for nomination of one or more persons by the relevant Secretary to facilitate a Subcommittee visit (s 17). The responsible Minister may issue guidelines after consultation (s 18). The Governor in Council may make regulations for any matter required or permitted by the Act (s 19), including exemptions and differential application by time, place or circumstance (s 19(2)).

Definitions and cross‑reference points. Key defined terms in s 3 include "Subcommittee purpose", "excluded information", "personal information", "health information", "nominated official", "detaining authority", "relevant Minister" and "relevant Secretary". Several of these definitions import existing statutes: "Cabinet document" is defined with reference to s 28 of the Freedom of Information Act 1982, "health information" refers to the Health Records Act 2001, and "personal information" refers to the Privacy and Data Protection Act 2014. The Act repeatedly uses language such as "ensure" for duties on Ministers and "must ensure" for detaining authorities (ss 5-6, 12), which imposes an obligation to take steps within their powers. The Act also uses reasonableness standards (ss 7(1), 8(1)) for when access may be delayed or restricted, and requires written reasons for detaining authority restrictions (s 8(3)). The statutory design therefore mixes bright‑line entitlements with qualified, reasoned exceptions. The Act does not set out administrative procedure or timelines for information requests, nor does it create a statutory complaint mechanism or oversight body within the text; it instead relies on existing administrative structures, criminal penalties for reprisal and the subordinate instruments that may be made under s 19.

Direct duty‑bearers. The Act imposes statutory obligations on two principal classes of actors: relevant Ministers and detaining authorities. A "relevant Minister" is defined in relation to a place of detention and is the Minister responsible for that place of detention (s 3). A "detaining authority" is the person or entity for the time being in charge of the place of detention (s 3). Relevant Ministers must ensure the Subcommittee and accompanying experts or interpreters are permitted to enter and have unrestricted access to places of detention (s 5). Detaining authorities must guarantee the same access (s 6) and may, in limited circumstances, temporarily prohibit or restrict access for specified operational reasons (s 8). Relevant Secretaries (Department Heads) also have a role: the relevant Secretary may nominate one or more persons to facilitate a Subcommittee visit (s 17).

The Subcommittee and its personnel. The Subcommittee, its selected experts and interpreters, and any accompanying experts are central actors whose rights are created by the Act. The Subcommittee is permitted to visit and to seek information relevant to its mandate under the Optional Protocol (s 1, s 3). The Act enables the Subcommittee to interview persons (s 9) and to retain non‑identifying information it is given (s 14), subject to safeguards on identifying information (s 13-14).

Detainees and individuals. Detainees, defined as persons in a place of detention deprived of liberty (s 3), are directly affected. Their capacity to be interviewed, to consent to the Subcommittee receiving identifying information about them, and to obtain protection from reprisals are all provided for (ss 9, 13-15). The Act’s protections against reprisal (s 15) cover "any other person" who may give information, so persons who are not detainees but who disclose information (for example staff, visitors, family members or contractors) are also covered against detrimental action taken because they gave or were believed to have given information to the Subcommittee.

Operational staff and nominated officials. Staff of detaining authorities, custodial officers, health practitioners working in detention settings and other operational personnel must facilitate visits and information access unless a lawful and recorded temporary restriction or Minister objection applies (ss 5-8, 12). Relevant Secretaries may nominate officials to facilitate a Subcommittee visit; those nominated officials may accompany or assist during visits but are prohibited from being present during interviews under s 17(4).

Employers and disciplinary bodies. The protection from reprisal contains specific sub‑categories of detrimental action, including dismissal, prejudice in employment and disciplinary proceedings (s 15(2)(d)-(f)). Employers, disciplinary bodies, and regulatory agencies that have roles in supervising staff in detention settings are therefore directly implicated: actions they take against employees could fall within the statutory offence if motivated wholly or partially by the employee's disclosure (or alleged disclosure) to the Subcommittee (s 15(1)(b)).

Ministers and departments. Responsible Ministers (a term used in s 7) may take the decision to object to a particular visit on specified grounds; the Act requires the Minister to give notice specifying the reason to the Subcommittee before the visit (s 7(1)-(3)). The responsible Minister and relevant Ministers therefore have decision‑making authority to delay access on public interest or security grounds. Departments that hold relevant information are obliged to provide it to the Subcommittee unless excluded by the Act (s 12). The Act references "relevant Secretary" (the Department Head) in definitions (s 3), making departmental executive officers part of the chain of responsibility.

Other affected actors. Interpreters, experts selected under Article 13 of the Optional Protocol (defined in s 3), and support persons (where permitted by the Subcommittee) are stakeholders. Third‑party contractors whose records are held by detaining authorities may be indirectly affected when those records are requested under s 12. Courts and criminal justice agencies may be called upon to adjudicate alleged reprisals under s 15.

Who pays and who decides. Decisions about permitting or restricting access are taken by responsible Ministers (for Ministerial objections; s 7) and detaining authorities (for temporary prohibitions; s 8). The Act does not specify funding or resourcing arrangements for hosting visits, providing interpreters, or accommodating experts; those operational costs and logistical arrangements will be borne by the relevant Departments and detaining authorities unless provided for elsewhere. The Act also permits the Governor in Council to make regulations (s 19), and the responsible Minister may issue guidelines (s 18), so implementing bodies retain scope to allocate responsibilities and potentially funding through administrative mechanisms outside the Act.

Indirect and systemic effects. The Act’s reach into multiple statutory regimes via the definition of place of detention (s 4) means a wide set of public sector agencies will be affected, including corrections, police, youth justice, mental health services, disability services, drug treatment centres, and public health authorities. Private operators are affected only to the extent they operate or control places that fall within the statutory definition (s 4(1)(p) permits prescribed places other than private residences). The Act does not enumerate private providers, but the "detaining authority" definition may capture non‑government entities that run facilities for the State.

Duties to permit entry and access. The core duties are placed on "the relevant Minister" and the "detaining authority" for each place of detention. Subject to the Act’s exception clauses (ss 7-8), both the relevant Minister and detaining authority must ensure the Subcommittee and any accompanying experts or interpreters are permitted to "enter and visit" and to "have unrestricted access to any part of the place of detention" (ss 5-6). Those are mandatory provisions framed by "must ensure" and "ensure", signalling positive obligations to take necessary steps within their respective powers.

Limited grounds to prevent visits. Two specific statutory avenues allow temporary prevention or restriction of access:

• Ministerial objection: the responsible Minister may object to the Subcommittee visiting on particular day(s) where the Minister reasonably believes an urgent and compelling reason exists on one of four grounds , national defence, public safety, natural disaster, or serious disorder at the place of detention (s 7(1)). The Minister must give notice to the Subcommittee specifying the reason before the visit (s 7(2)-(3)). Once notice is given, the relevant Minister and detaining authority are not required to allow entry for the specified day(s) (s 7(4)). The statutory standard is reasonableness informed by urgency and compulsion.

• Detaining authority temporary prohibition/restriction: the detaining authority may temporarily prohibit or restrict access to the whole place or a part of it if the authority reasonably believes allowing access would prevent security, good order and management, health and safety (including of Subcommittee members), or the conduct of essential operations (s 8(1)(a)-(b)). Any such restriction must be for the shortest period reasonable and the detaining authority must record in writing the reasons for the restriction (s 8(2)-(3)).

Information access and excluded information. The Act obliges relevant Ministers and detaining authorities to ensure the Subcommittee has "unrestricted access" to all information in their possession or control relevant to the Subcommittee purpose, except for "excluded information" (s 12(1)-(2)). The Act lists illustrative categories of relevant information (s 12(3)). "Excluded information" is defined in s 3 to include Cabinet documents and information subject to legal professional or client legal privilege, and may include prescribed kinds of information. The duty to provide information is broad but subject to these discrete limits.

Special rules for personal and health information. Identifying information, including personal information and health information, is subject to an additional constraint: the Subcommittee must not be given access to identifying information unless it visits or has visited that place of detention (s 13). The Subcommittee may retain or copy non‑identifying information (s 14(1)); identifying information may be retained or copied only if the detainee consents (s 14(2)). The Act imports the meanings of "personal information" and "health information" from the Privacy and Data Protection Act 2014 and the Health Records Act 2001 respectively (s 3).

Interviewing rights and consent. The Subcommittee may interview any person at a place of detention during a visit, and other persons believed to hold relevant information, but only with that person’s consent (s 9(1)-(2)). Interviews may involve interpreters and may be conducted in person or by electronic means at the Subcommittee’s discretion (s 9(3)-(4)). A person to be interviewed may nominate a support person but their presence requires the Subcommittee’s agreement (s 10). The relevant Secretary may nominate one or more persons to facilitate Subcommittee visits; nominations must be in writing, specify the place of detention and the period the nomination is effective (s 17(1)-(2)). Nominated officials may accompany or assist during visits but must not be present during interviews (s 17(3)-(4)). The responsible Minister may issue guidelines to assist detaining authorities to meet the Act’s requirements, and may consult other Ministers in doing so (s 18). The Governor in Council may make regulations for any matter required or permitted by the Act and may create exemptions and differing applications by time, place or circumstance (s 19).

Procedural duties and record‑keeping. The Act requires written recording of reasons when a detaining authority temporarily prohibits or restricts access (s 8(3)). The responsible Minister must cause notice to be given to the Subcommittee specifying the reason when the Minister objects to a visit under s 7(2)-(3). Beyond these specific obligations, the Act does not prescribe timelines for compliance, formats for information provision, or complaint procedures within the text.

Limits on legal obligations. "Excluded information" (s 3) is not to be provided. The Act does not override legal professional privilege or Cabinet confidentiality. It does not expressly displace other legal obligations such as freedom of information regimes or privacy laws; rather, it references those regimes in its definitions and creates tailored constraints on the Subcommittee’s access to identifying information (s 3; s 13).

Primary criminal offence and penalty. The Act creates one express criminal offence in s 15. A person commits the offence if the person takes detrimental action against another and the action is taken wholly or partially because the other person has given or disclosed information to the Subcommittee, or because the person believes the other has done so (s 15(1)(a)-(b)). The statutory penalty for that offence is 120 penalty units or one year’s imprisonment (s 15(1)). The Act defines "detrimental action" comprehensively to include injury, loss, onerous changes to detention conditions, intimidation, harassment, discrimination or disadvantage in employment, dismissal or prejudice in employment, and disciplinary proceedings (s 15(2)(a)-(f)). The belief clause (s 15(1)(b)(ii)) means that action taken on suspicion that a person gave or disclosed information is treated the same as action taken because of an actual disclosure, for the purposes of criminal liability.

Interaction of criminal conviction with other proceedings. Section 16 declares that a court finding of guilt for the offence in s 15 does not prevent other regulatory or disciplinary action being taken against the person in relation to the conduct that constituted the offence. That is, criminal liability under s 15 is without prejudice to administrative or disciplinary processes that may run in parallel or subsequently (s 16).

Enforcement bodies and jurisdiction. The Act does not itself establish a specific enforcement agency, ombudsman oversight or inspectorate for compliance with the Act’s access provisions. Criminal enforcement would be a matter for the ordinary criminal justice processes in Victoria. The Act therefore relies upon prosecutors and courts to enforce s 15. The Act requires certain administrative acts such as written reasons for detaining authority restrictions (s 8(3)) and notice to the Subcommittee for Ministerial objections (s 7(2)-(3)), but it does not outline civil remedies for breach of access duties nor administrative review mechanisms within the Act.

Record keeping and procedural evidentiary elements. The detaining authority’s duty to record reasons for temporary prohibition or restriction is a statutory record‑keeping obligation (s 8(3)), which could be relevant evidence in any subsequent administrative or judicial review of the legality of a restriction. The responsible Minister’s obligation to cause notice to be given to the Subcommittee when objecting to a visit (s 7(2)-(3)) likewise creates a required administrative step. The Act does not specify particular time limits for such notices or the format in which information must be provided.

Regulatory scope and subordinate legislation. Section 19 gives the Governor in Council power to make regulations for any matter required or permitted by the Act. The regulations may provide exemptions, differential application by time, place or circumstances, and specific cases or classes of cases for exempting persons or things from provisions of the regulations (s 19(2)). That regulatory power is the primary mechanism within the Act for adding further procedural or enforcement detail. Until regulations are made, the Act’s operative enforcement mechanisms remain relatively limited: the preventive mechanisms in ss 7-8, the information access duties in s 12, the privacy safeguards in ss 13-14, the obligations to record and notify, and the criminal offence in s 15.

Absence of express civil remedies or administrative sanctions for access denial. The Act does not expressly provide civil remedies, injunctions or administrative sanctions for failing to comply with duties to allow access (ss 5-6, 12). Where a relevant Minister or detaining authority fails to "ensure" access, the Act does not prescribe a specific remedial pathway such as an appeal to a tribunal or a mandatory reporting obligation, other than the discrete criminal offence for reprisal and the delegated power to make regulations. Those enforcement gaps could matter in practice when access is blocked or information is withheld and may be addressed through regulations or other administrative mechanisms outside the Act.

Evidence and admissibility issues. The Act allows the Subcommittee to retain, copy or take notes of any information other than identifying information (s 14(1)), and to retain identifying information with detainee consent (s 14(2)). The Act does not address admissibility of such records in Victorian courts or administrative proceedings, nor does it provide explicit protections for the Subcommittee’s notes against disclosure in other processes. Those evidentiary and confidentiality issues thus remain governed by general law and by any regulations or guidelines.

Privacy and health record regimes. By defining "Cabinet document" by reference to the Freedom of Information Act 1982 and by authorising access to "all information (other than excluded information)" relevant to the Subcommittee purpose (s 12), the Act establishes a specific access right for the Subcommittee that sits alongside but is narrower than the general public FOI regime, because the Act protects privileged and Cabinet material. The Act does not create a general public right to information; it is specific to the Subcommittee’s mandate under the Optional Protocol.

Criminal law and employment/disciplinary frameworks. The s 15 offence interacts with criminal law procedures for charging, prosecuting and sentencing offenders. The Act’s definition of detrimental action includes employment and disciplinary measures (s 15(2)(d)-(f)), and s 16 preserves employers’ ability to take disciplinary action even where criminal liability is found. That preserves the independence of administrative disciplinary frameworks while creating a criminal deterrent to retaliatory acts motivated by perceived disclosures to the Subcommittee.

Health and public health law. The Act’s inclusion of persons detained under public health orders, pandemic orders, or pandemic management powers in s 4(1)(n) draws facilities and regimes established under the Public Health and Wellbeing Act 2008 into the definition of place of detention, subject to the exclusion in s 4(2) which clarifies that persons are not "detained" merely because they are required to isolate or quarantine. This creates a nuanced intersection: public health detention regimes may attract Subcommittee visits where legal custody is involved, but ordinary community isolation does not by itself create "detention" under the Act.

Administrative law and reasonableness standards. The Act uses reasonableness standards for both Ministerial objections (s 7(1) requires the Minister reasonably believes an urgent and compelling reason exists) and detaining authority restrictions (s 8(1) requires reasonable belief that access would prevent security, good order or essential operations). Those standards are typical of administrative law and may be subject to judicial review on legality and reasonableness grounds under common law principles or the Administrative Law Act if applicable. The Act mandates written reasons for detaining authority restrictions (s 8(3)) and notice to the Subcommittee for Ministerial objections (s 7(2)-(3)), which are procedural protections that will feed into reviewability.

Regulations and delegated instruments. Section 19 gives the Governor in Council broad powers to make regulations to give effect to the Act, including exemptions and differentiated application by time, place or circumstance (s 19(2)). The regulations could therefore be used to clarify operational interfaces with other statutes, to set procedures for information requests, to address confidentiality and handling of the Subcommittee’s notes, or to specify how the protections in ss 13-14 operate alongside privacy laws. Until regulations are made, agencies must rely on the Act’s text and existing administrative practice.

Contracts and third‑party records. The Act applies to information in the possession or control of relevant Ministers and detaining authorities (s 12). Where records are held by third parties under contract to a detaining authority, the detaining authority is the obligation‑bearer to ensure access to the Subcommittee; contractual arrangements may therefore need to be revisited to permit compliance with s 12. The Act does not itself alter private contract law, but it creates compliance obligations that can affect contracting parties indirectly.

International law and the Optional Protocol. The Act operationalises Victoria’s obligations under the Optional Protocol by granting statutory authority to permit visits and to provide access to information to the Subcommittee (s 1). The Act defines the Subcommittee and the Subcommittee purpose (s 3), and implements access and protection mechanisms in domestic law. The Act does not purport to amend or displace federal treaties, but it provides statutory mechanisms to facilitate compliance with the Optional Protocol at the State level.

Dates of assent and commencement. The Endnotes record that the Monitoring of Places of Detention by the United Nations Subcommittee on Prevention of Torture (OPCAT) Act 2022 was assented to on 27 September 2022 and came into operation on 11 October 2022 (Endnotes: General information). Section 2 sets the general commencement rule that the Act comes into operation on proclamation, but that if a provision does not come into operation before 2 August 2023 it comes into operation on that day (s 2(1)-(2)).
