MISUSE OF DRUGS REGULATIONS 1990

The Regulations revolve around a small set of recurring operational concepts tied to the Act. These concepts organise the regulatory requirements and allocate responsibilities.

• Defined terms and prescribed lists: The Regulations supply two primary prescriptive lists. First, the Schedule 2 list of precursors is prescribed for the Act’s definition of precursor (r 2B; Schedule 2). Second, r 2A prescribes certain geographic areas as indigenous communities for the Act’s definition by reference to areas that had been prescribed under the Northern Territory National Emergency Response Act 2007 immediately before its repeal. Those prescriptive lists determine whether other Act provisions apply to particular substances or places.

• Drug premises identification and consequences: The Regulations implement the Act’s drug premises scheme by prescribing forms and notices used for (a) recording findings of dangerous drugs at premises (Forms 1-3 and later sequence forms for second and subsequent findings, Forms 5-12), (b) giving notices to owners, landlords, tenants and licensees (Forms 2, 4, 6, 8, 10, 12), (c) notice of a drug premises order (Form 13) and (d) the public notice to be affixed to identified drug premises (Form 14; r 11). The prescribed Form 13 summarises the practical legal effects of a drug premises order (for example search without warrant, searches of persons, seizure of objects, restraining orders and requirements to give name and address within 200 metres). The Form 14 notice is specified in layout and colour (r 11(2)).

• Electronic drug detection: The Regulations set limits on the use of electronic drug detection systems for persons and property. For people, particulate matter may be sampled only from the outside of clothing and the person’s hands, and a person cannot be required to remove, undo or rearrange clothing; care must be taken to avoid disturbing clothing (r 14(2)-(4)). Sampling may be by swabbing, wiping or otherwise touching a surface. For property, sampling may occur on the exterior and interior of vehicles and receptacles found in vehicles, and on the outside of other property. The definition of vehicle expressly includes caravan, trailer or anything else being towed (r 15(2)-(4)).

• Disposal procedures for syringes/needles: The Regulations mandate that a used hypodermic syringe or needle used in unlawful administration must be placed in a rigid, puncture-resistant container sealed so contents cannot injure a person, and then either placed in household or other refuse, or handed to a person referred to in s 12(2) of the Act (r 3). This operational prescription ties to s 12(5) of the Act.

• Standardised forms and recordkeeping: The Regulations prescribe exact forms and information fields for police to record findings at premises across the residential, commercial and liquor-licence contexts (Schedule 3). The forms capture type and quantity of drug, date/time/place found, names of occupants and others, reasons for suspicion of supply from the premises, and the identity of the police officer recording the finding.

• Offences of non-authorised action: The Regulations create a strict liability offence for unauthorised persons affixing a notice purporting to be a s 11Q notice (r 12(1)-(2)). The maximum penalty is specified at 17 penalty units. The requirement that licence-holders post the scheduled notice is also penalised (r 4; maximum 8 penalty units).

Each concept maps to practical choices for regulated persons: what to display and how; what sampling techniques police may use; how to dispose of used injecting equipment; and when certain statutory consequences flow from repeated findings of drugs at premises. The Regulations therefore function as the Act’s procedural annex, fixing forms and operational constraints that make the Act administrable in day-to-day policing and licensing contexts.

The Regulations affect a discrete set of actors whose roles and obligations are set out in the instrument.

• Police officers and the Commissioner of Police: Police are the principal executors of duties created or described in the Regulations. rr 7-13 prescribe the forms police must use for records and notices when they find dangerous drugs at premises (Forms 1-14). The Commissioner of Police may make applications under the Act’s drug premises provisions (Form 13 references an application under section 11D) and is the named issuer of the Form 14 notice (Form 14 ends with "Commissioner of Police"). Police carry the operational responsibility for sample collection under rr 14-15, for affixing notices under s 11Q as implemented by r 11, and for executing searches and seizures that follow from a drug premises order as described in Form 13.

• Licence-holders under the Liquor Act 2019: r 4 requires the holder of a licence under the Liquor Act 2019 for the sale and consumption of liquor on licensed premises to post and maintain a Schedule 1 notice in a specified physical form and location. The obligation is placed squarely on holders of such licences, with a maximum penalty of 8 penalty units for non-compliance. The Schedule 1 notice warns that unlawful supply or possession of dangerous drugs on licensed premises is an aggravating circumstance under s 37(2) of the Act.

• Owners, landlords, tenants, managers and licensees of premises: Many of the prescribed forms (Forms 1-12) are addressed to owners, landlords, tenants and, where relevant, licensees under the Liquor Act 2019. Those forms notify such persons when police have recorded findings of dangerous drugs at premises and put them on notice of the consequences of repeated findings, including the potential for the Commissioner of Police to apply for a drug premises order (Forms 2, 4, 6, 8, 10, 12). Owners and occupiers therefore face direct procedural and evidentiary exposure from police recordings and notices.

• Persons present at or associated with premises: The Form 13 notice of a drug premises order lists immediate practical consequences affecting persons on or near declared drug premises. Those include the possibility of search of a person, an application for internal search of the body, charging for possession if a dangerous drug is found on the premises at the time, seizure of objects relating to suspected offences, restraining orders, and requirement to give name and address if within 200 metres and a police member believes the person is associated with the premises.

• People subjected to electronic drug detection: rr 14-15 regulate how electronic drug detection systems may be used on people and property. Individuals subject to such detection will be affected by the limits in r 14(3), which prevent police from requiring removal, undoing or rearranging of clothing and require care to avoid disturbing clothing. Sampling is confined to particulate matter on the outside of clothing and on hands.

• Businesses and individuals handling seized property: Forms 15 and 16 (r 13) allow persons charged or owners of seized substances to apply to have samples released for analysis or examination. Form 15 requires that the specified person to have custody of a dangerous drug or precursor must be authorised under the Act or another law to have possession. Those seeking release must comply with the conditions set out in the form and the Act.

• Health services, waste services and householders: r 3 prescribes disposal of syringes and needles used in unlawful administration of dangerous drugs, requiring puncture-resistant containers and either disposal in household/other refuse or handing to persons referred to in s 12(2) of the Act. That creates obligations for households, waste contractors and authorised recipients (the latter referred to s 12(2)).

• Suppliers and shippers of chemicals: Entities that deal with chemicals listed in Schedule 2 will be affected because those substances are prescribed as precursors for the Act (r 2B). That may intersect with offences or controls in the Act concerning precursors, depending on the Act’s text.

Who pays: Administrative and compliance costs are primarily borne by licence-holders (r 4 posting and maintenance), premises owners/occupiers who face the risk of declining operations if premises become the subject of drug premises orders, persons required to change disposal practices for used injecting equipment (r 3), and regulated businesses that handle or transport precursor chemicals listed in Schedule 2. Police resource costs are implicated in conducting samplings under the specified techniques and in preparing and serving the prescribed forms. The Commissioner of Police may incur administrative burdens when applying for drug premises orders and affixing notices as required.

Who decides: The Police Commissioner and members of the Police Force decide when to make records, serve notices and apply for drug premises orders; police also decide whether and how to sample using electronic detection systems within the constraints the Regulations provide. Licence-holders decide how to comply with posting requirements. Owners and occupiers decide whether and when to apply for revocation under the Act, as the Form 13 notice explains that an owner, landlord or tenant may serve notice of an application under s 11P for revocation.

The Regulations place specific duties on certain actors and set out certain rights and procedural contexts. The duties are mostly administrative and procedural.

Duties

• Duty to post notice on licensed premises: r 4(1) obliges the holder of a Liquor Act 2019 licence for sale and consumption of liquor on the premises to cause a Schedule 1 notice to be posted and maintained on the premises in the manner set out in r 4(2). The notice must be affixed to flat, rigid material, encased behind durable transparent material, at least 200 mm by 300 mm, bear only the prescribed words in legible typewritten or printed form and be displayed in a public area so it can be easily read (r 4(2)(a)-(f)). Maximum penalty 8 penalty units (r 4(1)).

• Duty for safe disposal of syringes and needles: Under r 3, used hypodermic syringes or needles used in the unlawful administration of a dangerous drug must be deposited in a rigid walled and puncture-resistant container sealed so contents cannot cause injury. The container must then either be placed in a household or other refuse bin or handed to a person referred to in s 12(2) of the Act (r 3(a)-(b)).

• Duty to use prescribed forms and notices: rr 7-11 and r 13 prescribe the exact forms to be used for recording findings (Forms 1-3 for first findings, Forms 5-7 for second findings, Forms 9-11 for third or subsequent findings), notices of findings (Forms 2, 4, 6, 8, 10, 12), notice of making of a drug premises order (Form 13), and the notice to be affixed to drug premises (Form 14). Police must use these forms in the contexts mapped to sections of the Act as indicated in each regulation.

• Duty to adhere to sample-taking constraints: rr 14-15 constrain how electronic drug detection systems can be used and how samples of particulate matter may be taken. For people, sampling may be taken from the outside of clothing and hands; clothing cannot be required to be removed, undone or rearranged, and care must be taken not to disturb clothing (r 14(2)-(4)). For property, sampling may be taken from the exterior and interior of vehicles and receptacles within vehicles, and from the outside of other property (r 15(2)).

• Duty not to affix notices unless authorised: r 12(1) creates an offence for any person other than a police officer who affixes to a building, structure or other object a notice purporting to be a s 11Q notice. The offence is strict liability under r 12(2). Maximum penalty 17 penalty units.

Rights and procedural features

• Right to apply for release of seized property for analysis: Forms 15 and 16 set out existing procedural mechanisms under s 19C(2) and s 19PA(2) of the Act by which a person charged in relation to seized property (Form 15) or the owner of a seized substance other than a dangerous drug (Form 16) may apply to the Commissioner of Police for release of a sample for analysis or examination. Form 15 contains a note that the specified person to have custody must be authorised under this Act or another law to have possession (Form 15 note).

• Right to apply to revoke a drug premises order: Form 13 states that an owner, landlord or tenant may serve notice on the Commissioner of Police of an application under s 11P of the Act for revocation of a drug premises order, and that in that situation the affixation of the Form 14 notice will be delayed pending such an application (Form 13, warning). Form 13 also explains an appeal under s 19 of the Local Court (Civil Procedure) Act 1989 to the Supreme Court may not be lodged until such an application for revocation has been made and refused.

• Procedural constraints on sampling to protect modesty and privacy: rr 14(3)-(4) limit intrusiveness of sampling by disallowing requirements to remove or rearrange clothing and requiring care to avoid disturbing clothing. Those provisions create procedural protections for persons subjected to electronic detection sampling.

• Specificity of notices and records: The Forms include fields describing date/time/place, identities of occupants and others present, type and quantity of drug, place in the premises where found and reasons for suspicion that a dangerous drug has been supplied at or from premises. Those fields structure the evidentiary record that informs police applications for orders under the Act.

Who decides and enforcement

• Police members decide when to make records and serve notices using Forms and when to sample using electronic detection systems within the constraints at rr 14-15. The Commissioner of Police decides whether to apply for a drug premises order and to affix the specified notice under s 11Q, subject to the owner/landlord/tenant’s right to apply for revocation (Form 13). The legislative architecture therefore places investigatory discretion with police, and procedural duties on licence-holders, owners and occupiers.

Consequences for non-compliance

• Failure by a licence-holder to post the Schedule 1 notice attracts a maximum penalty of 8 penalty units (r 4(1)). Affixing a s 11Q style notice without authority attracts a maximum penalty of 17 penalty units and is strict liability (r 12(1)-(2)). The Form 14 text includes a statement that tampering with, defacing, removing, damaging or altering the notice while it remains in force is an offence; the Act likely provides the substantive enforcement, while the Regulation prescribes the notice form and physical attributes.

The Regulations include a small set of explicit penalty provisions and otherwise implement investigative and enforcement mechanics contained in the Act by prescribing forms and procedures.

Express penalties in the Regulations

• Non-posting on licensed premises: r 4(1) imposes a maximum penalty of 8 penalty units on the holder of a relevant Liquor Act 2019 licence who fails to cause the Schedule 1 notice to be posted and maintained on licensed premises as required by r 4(2). The offence is framed as an obligation on licence-holders.

• Unauthorised affixing of a drug premises notice: r 12(1) creates an offence if a person who is not a police officer affixes to a building, structure or other object a notice purporting to be a notice under s 11Q(1) of the Act. The maximum penalty is 17 penalty units. r 12(2) expressly makes this offence one of strict liability. The combination of a substantial penalty and strict liability reduces the evidentiary burden on the Crown, meaning that if the prohibited act is proved, absence of fault is not a defence in the regulation itself.

Other enforcement mechanisms reflected in the Forms

• Form 13 summarises practical enforcement powers that follow from a drug premises order made under s 11D of the Act. The prescribed notice of making of a drug premises order (Form 13) identifies the following powers and consequences, which stem from the Act but are summarised by the Form: premises may be searched at any time without a warrant; a person on the premises may be searched and an order may be sought authorising an internal search of the body of the person; a person on the premises at the time a dangerous drug is found on the premises may be charged with possession; objects on the premises relating to offences may be seized; a restraining order may be issued to a person who breaches the peace on these premises; and a person on the premises or within 200 metres may be required to tell a police officer their name and address if the officer believes the person is associated with the premises (Form 13).

• Form 14 includes the text that must appear on the notice affixed to drug premises under s 11Q(1) as implemented by r 11. The Form warns of the search and seizure consequences summarised above and states that it is an offence to tamper with, deface, remove, damage or alter the notice while it remains in force. The actual penalty amount for tampering is not stated in the Regulation text: enforcement and specific sanction details for tampering would be matters of the Act.

Operational enforcement implications

• Police workload and procedure: The Regulations prescribe exact forms and operational steps including sampling techniques and recordfields. That standardisation supports consistent evidence collection for applications under the Act but requires police to follow form protocols precisely. The obligation to avoid clothing disturbance when sampling people (r 14(3)-(4)) constrains sampling methods and may require alternative tactics if a sample from under clothing is desired.

• Strict liability exposure: The strict liability offence at r 12(2) means persons who affix a notice purporting to be a s 11Q notice will be liable irrespective of intent or knowledge that the notice was unauthorised. The maximum penalty of 17 penalty units may therefore pose a material compliance risk to private actors who handle signage, landlords or protestors who affix a notice without authorisation.

• Licensing enforcement: Liquor licence-holders face a direct enforceable obligation to post the Schedule 1 notice as part of maintaining the licence conditions for premises where liquor is sold and consumed. Failure attracts the specified penalty and may be actionable in a regulatory enforcement context under the Act or Liquor Act 2019 mechanisms.

• Release of seized property: Forms 15-16 provide the procedural mechanism for persons charged or owners to request release of seized property for analysis. The note in Form 15 that the specified person must be authorised under the Act or another law to have possession places a substantive constraint on who may receive custody, thereby affecting evidentiary and forensic strategies and potentially delaying access to samples for defence experts.

Interaction with other enforcement regimes

• The Regs expressly reference the Liquor Act 2019, the Misuse of Drugs Act 1990 sections that trigger Permissive powers and the Local Court (Civil Procedure) Act 1989 for appeal timing in Form 13. Where a drug premises order is made under the Act, its enforcement powers operate alongside these other statutes and court procedure rules.

In short, the Regulations create discrete regulatory offences and otherwise implement the Act’s enforcement mechanics by standardising forms and processes, constraining investigatory techniques and allocating procedural rights to affected parties. The most significant immediate enforcement exposure created by the Regulations themselves is the strict liability posting-offence for unauthorised affixation of a s 11Q-style notice (r 12).

The Regulations operate as subordinate instruments to the Misuse of Drugs Act 1990 and explicitly tie into several other statutes. The interaction points are mainly definitional, procedural and evidentiary.

Primary interaction with the Misuse of Drugs Act 1990

• Instrumental function: The Regulations supply the forms, procedures and technical particulars required to implement many parts of the Act. Each of rr 7-11 and r 13 states that a particular Form in Schedule 3 is prescribed "for the purposes" of a specified section of the Act (for example, r 7 prescribes Forms 1-4 for s 11E(1)-(4); r 8 prescribes Forms 5-8 for s 11F(1)-(4); r 9 prescribes Forms 9-12 for s 11G(1)-(4); r 10 prescribes Form 13 for s 11N(2)(b); r 11 prescribes Form 14 for s 11Q(1); r 13 prescribes Forms 15-16 for s 19C(2) and s 19PA(2)). The Regulations thereby operationalise the Act’s drug premises, seizure and release, and electronic detection provisions.

• Definitions: r 2A and r 2B supply prescribed definitions under s 3(1) of the Act. r 2A prescribes indigenous communities by reference to areas that were prescribed under the Northern Territory National Emergency Response Act 2007 immediately before its repeal. r 2B prescribes substances listed in Schedule 2 as precursors under the Act’s definition of precursor. Those definitions determine application of the Act’s substantive provisions, for example controls that relate specifically to "precursors" or to "indigenous community" areas.

Reference to Liquor Act 2019

• r 4 imposes a duty on the holder of a licence issued under the Liquor Act 2019 for sale and consumption of liquor on licensed premises to post the Schedule 1 notice. The duty is explicitly predicated on the licence existence under the Liquor Act 2019; in practice this links licensing compliance obligations to drug offence notice requirements.

Reference to Local Court (Civil Procedure) Act 1989

• Form 13 contains a "WARNING" that an appeal under s 19 of the Local Court (Civil Procedure) Act 1989 to the Supreme Court may not be lodged until an application under s 11P for revocation has been made and refused. That creates a procedural sequencing requirement between administrative revocation applications under the Act and judicial review or appeal to the Supreme Court.

Reference to other Acts and authorisations

• Form 15’s note specifies that a person proposed to receive custody of a dangerous drug or precursor for analysis must be authorised under the Misuse of Drugs Act, another Territory Act, or an Act of the Commonwealth, a State or another Territory to have possession of the dangerous drug or precursor. That cross-references the broader statutory regime governing authorised possession and evidentiary custody.

Operational interactions

• The Regulations standardise forms that will be relied upon as evidence and procedural steps in prosecutions and civil applications under the Act. That means forms prescribed by the Regulations will be used in court proceedings that arise under the Act and in related enforcement actions.

• Electronic detection constraints must be read alongside any privacy, search or other procedural rules in the Act or general law. The Regulations limit sampling techniques (for example not requiring removal of clothing, r 14(3)), but they are not a comprehensive privacy code. How those constraints align with broader search and seizure jurisprudence under the Act and common law is a matter for analysis of the Act and case law, not the Regulations alone.

• Waste management and public health laws: r 3 prescribes disposal methods for used syringes and needles. That will interact administratively with local waste management procedures, public health guidelines and any other statutory schemes that regulate clinical or sharps waste.

Scope and limits of the Regulations

• The Regulations do not create substantive drug offences beyond limited posting/affixation offences. The heavier enforcement powers summarised in the Forms (search without warrant, internal search orders, seizure of objects) are powers derived from the Act itself which the Regulations help to operationalise.

• The Regulations refer to and depend on definitions and powers in the Act. Any legal effect, such as the power to search without warrant or to label premises drug premises, rests in the Act; the Regulations constrain and prescribe form and procedure.

In sum, the Regulations are tightly integrated with the Misuse of Drugs Act 1990 and interlock with the Liquor Act 2019, the Local Court (Civil Procedure) Act 1989 and other authorisation regimes. They prescribe the forms and mechanics that will ordinarily be deployed when exercising powers under the Act and they define certain application boundaries such as the list of precursors and geographic areas captured by the Act’s indigenous community definition.

The Endnotes and List of Amendments in the Regulation text provide a timeline of the Regulations’ amendments and related instrument history. The Regulations were originally made as Misuse of Drugs Regulations (SL No. 43, 1990), notified 10 October 1990 and commenced on 1 November 1990 (r 1, s 2 Misuse of Drugs Act 1990). The key subsequent amendments and milestones recorded in the instrument are as follows, drawn from the document’s endnotes.

• 1995: Amendment of Misuse of Drugs Regulations (SL No. 15, 1995) notified 10 May 1995; commenced 10 May 1995. A r 5 was inserted in 1995 and later repealed in 2004 (see list of amendments).

• 2002: Amendments of Misuse of Drugs Regulations (SL No. 25, 2002) notified 1 August 2002; commenced 1 August 2002. These amendments inserted rr 7-11, r 12, r 13, Schedule 3 (forms) and Schedule 2 (precursors). The Schedule 1 was amended by No. 25, 2002 at r 4.

• 2004: Misuse of Drugs Amendment Regulations (SL No. 35, 2004) notified 24 November 2004; commenced 24 November 2004. Some earlier provisions inserted in 1995 were repealed by this instrument; Schedule 2 and parts of Schedule 3 received amendments under r 4 and r 5.

• 2005: Statute Law Revision Act 2005 (Act No. 44, 2005) made formal revisions; Endnotes note general amendments of a formal nature.

• 2010: Justice Legislation Amendment (Penalties) Act 2010 (Act No. 12, 2010) (assent 20 May 2010) amended r 4 and was implemented on 1 July 2010 for r 4 and other formal adjustments.

• 2012: Misuse of Drugs Amendment Regulations 2012 (SL No. 32, 2012) notified 3 August 2012; commenced 3 August 2012. r 6A was inserted 2012 and later repealed by Act No. 17, 2016.

• 2015: Misuse of Drugs Amendment Act 2015 (Act No. 31, 2015) (assent 8 December 2015) commenced 17 December 2015, and included insertion of rr 14-15 (electronic drug detection provisions) as recorded in the list of amendments.

• 2016: Multiple Acts in 2016 affected the Regulations. The Justice Legislation Amendment (Drug Offences) Act 2016 (Act No. 17, 2016) made significant amendments; its operative items include insertion of rr 2A-2B (definitions for indigenous communities and precursors) (s 40), and substitution/amendment of r 12 (s 42), as recorded under the list of amendments. The Local Court (Repeals and Related Amendments) Act 2016 (Act No. 9, 2016) also affected forms in Schedule 3 (s 160). The Justice Legislation Amendment (Drug Offences) Act 2016 commenced variously, with s 17 commencing 10 October 2016 (and other parts having different commencement as listed).

• 2018: The Interpretation Legislation Amendment Act 2018 (Act No. 22 of 2018) made general formal amendments to the Regulations of a formal nature to rr 1 and 4 and schedules 1 and 3, as recorded in Endnotes.

• 2020: Statute Law Revision Act 2020 (Act No. 26, 2020) (assent 19 November 2020) effected formal amendments; the Regulations are reprinted as in force at 20 November 2020. The Endnotes list Act No. 26, 2020 as an amender of sch 3 and r 4 in 2020.

The List of Amendments in the Regulations provides specific clause-level amendment references. For instance:

• rr 2A-2B were inserted by Act No. 17, 2016, s 40.
• r 4 was amended by No. 25, 2002 r 2; Act No. 12, 2010 s 3; Act No. 26, 2020 s 3.
• rr 7-11 and r 13 were inserted by No. 25, 2002 r 3.
• rr 14-15 were inserted by Act No. 31, 2015 s 11.
• Schedule 2 (precursors) was inserted by No. 25, 2002 r 5 and amended subsequently.

Practical implication of amendment history

• The major functional additions post-2000 are the introduction of an explicit precursors list (Schedule 2) and detailed, standardised forms and notices (Schedule 3) in 2002, and later the addition of electronic drug detection constraints (rr 14-15) in 2015. The 2016 Justice Legislation Amendment (Drug Offences) Act introduced further changes to definitions and to r 12.

• The Regulations have been periodically modernised to add procedural detail and to reflect wider legal developments, for example the introduction of electronic detection technology guidance. Users should consult the most current reprint to ensure they apply the current forms and penalty figures, especially as penalty unit values may change under separate penalty unit legislation.

The Regulation text supplied includes no court decisions, no case citations and no litigation record. The document’s Endnotes do not list any judicial rulings or cases that interpret these Regulations. The instrument is an administrative subordinate regulation that prescribes forms, definitions, procedural constraints and limited offences for operational use of powers in the Misuse of Drugs Act 1990.

What the Regulations themselves show about litigation risk

• The Regulations place evidentiary structure around police findings and notices by prescribing exact forms and fields. That creates a standardised record that will be deployed in prosecutions and in applications under the Act (for example, applications for drug premises orders under section 11D). Litigation that arises will turn on the Act’s substantive provisions, the accuracy and proper completion of the prescribed forms, compliance with the procedural limits in the Regulations and the validity of police powers exercised in accordance with both the Act and Regulations.

• The Regulation creates a strict liability offence for unauthorised affixation of a notice (r 12). Strict liability offences often attract judicial scrutiny about constitutionality, fairness and the appropriate use of strict liability. The Regulation text does not record any litigated challenges to r 12, but any prosecution under r 12 could raise issues on strict liability defences and proportionality of penalty.

• Electronic detection limitations in rr 14-15 may be litigated where sampling technique, privacy expectations or search powers are contested. The Regulations limit what police may compel (for example they cannot compel removal of clothing, r 14(3)(a)), but they do not exhaustively resolve questions about the interplay of such sampling with the Act’s search powers or human rights frameworks. Those issues would be litigable matters in appropriate cases.

Practical notes for litigators and practitioners

• Defence practitioners and regulatory lawyers should consider whether police complied with the procedural and evidentiary prescriptions in the Regulations when preparing or challenging prosecutions or applications based on the record of findings and notices. For example, the Forms require reasons for suspicion that drugs have been supplied at or from premises; challenges may focus on the sufficiency of those reasons as recorded.

• The Form 13 warning that appeals under s 19 of the Local Court (Civil Procedure) Act 1989 to the Supreme Court cannot be lodged until an application under s 11P for revocation has been made and refused may give rise to procedural litigation over whether appeal time-limits and rights to judicial review are properly engaged. The Form itself records the procedural sequencing claimed by the enforcement agency.

Because the Regulation text provides no case law or litigation chronology, practitioners must consult court records and case law databases for binding authorities that interpret the Act and its regulatory instruments.

The Regulations contain several technical details, procedural traps and drafting features that can produce practical surprises. The following points are extracted directly from the text and describe likely operational or compliance "gotchas" based on the instrument as written.

• Physical specification of the licensed-premises notice is exacting and restrictive (r 4(2)): The required notice must be affixed to flat, rigid material, encased behind glass or other durable transparent material, not less than 200 mm by 300 mm, bear only the prescribed wording and be displayed so it can be easily read in a public area. The requirement that it "bear no other words" (r 4(2)(e)) prevents supplementary explanatory material or translations being added to the same notice. A licence-holder should ensure a separate notice is used for any supplementary messages. The maximum penalty for non-compliance is 8 penalty units (r 4(1)).

• Form 11Q notice physical dimensions anomaly: r 11(2) requires the notice prescribed for s 11Q(1) to consist of black lettering on a fluorescent green sign that is "not less than 1 metre in height and 500 cms in width." The text uses "500 cms" which, as printed, equates to five metres in width. The Regulation does not correct or comment on that unit expression. Practitioners should confirm the intended dimension with the Commissioner of Police or the responsible administrative authority prior to producing or contesting a notice to avoid non-compliance allegations or disputes about signage scale.

• Strict liability affixing offence: r 12(2) makes the unauthorised affixing offence strict liability. That eliminates mens rea as a defence under the Regulation itself. Landlords, tenants, contractors, or third parties who affix a sign purporting to be a s 11Q notice, even believing they had authority, may be liable. The maximum penalty is 17 penalty units. Actors should verify police authorisation before affixing any such notice.

• Form content creates procedural condition precedents: The Forms require police to record specific matters such as reasons for suspicion that a dangerous drug has been supplied at or from premises and the identities of persons present. Omissions or inaccuracies in completing these fields may affect the legal sufficiency of a subsequent application under the Act. Defence or civil challenges could contest the adequacy of the record, but whether that undermines an otherwise valid order depends on Act provisions and judicial assessment.

• Electronic detection scope and modesty constraints: rr 14-15 permit sampling of particulate matter by swabbing or wiping the outside of clothing and hands, and prohibit requiring removal or rearrangement of clothing (r 14(3)). That means certain kinds of detection that require more intrusive access may not be lawful under the Regulation. Police must take care to comply with r 14(4) to avoid evidence collection challenges. Conversely, the Regulation permits sampling of vehicle interiors and receptacles within vehicles (r 15(2)(a)). Practitioners should be aware of differential sampling allowances for people versus property.

• Custody of released seized drugs constrained: Form 15 requires that the person specified to have custody of released samples must be authorised under the Act or another law to have possession of the dangerous drug or precursor. That restricts who can be designated to hold samples for defence analysis and may delay testing if an appropriate authorised custodian is not readily available.

• Procedural sequencing for appeals: Form 13 warns that an appeal to the Supreme Court under s 19 of the Local Court (Civil Procedure) Act 1989 may not be lodged until an application under s 11P for revocation has been made and refused. This sequencing may be unfamiliar and it delays the lodging of higher appeals. Parties should take note of timing and the requirement to pursue the administrative revocation route before initiating certain judicial proceedings.

• Interaction with Liquor Act 2019 licensing obligations: r 4 ties the posting duty to licence-holders under the Liquor Act 2019. Changes to a licence-holder’s circumstances or to the licensed area could create an unnoticed posting breach. A licence-holder should integrate the posting requirement into routine compliance checks.

• Precursors list breadth: Schedule 2 lists a wide range of substances, including some common chemicals and elements (for example, iodine, lithium, magnesium, potassium, palladium and thorium "and salts" in some entries). Entities dealing with these chemicals need to check whether other statutory controls apply because the list treats these substances as prescribed precursors for the Act. The presence of common items on the list may create compliance requirements not intuitively obvious to suppliers or users.

• Forms are mandatory templates: The Regulations prescribe exact form templates for various stages. Deviating from the prescribed template or omitting required entries could create procedural disputes about validity. Police and enforcement officers must ensure forms are complete and accurately filled.

• Ambiguities in wording: Some texts in Forms, such as references to "persons associated with the premises" within 200 metres, leave discretion to a police officer’s belief. The Regulations summarise powers; precise legal thresholds remain in the Act and may be litigated. Practitioners should scrutinise the Act’s text alongside the prescribed Forms to assess legal thresholds.

These "gotchas" are procedural and drafting-derived. They are not speculative. They flow directly from how the Regulations prescribe precise formats, sample-taking constraints, strict liability for unauthorised affixation, and the precise lists and dimensions set out in the Schedules and rr 3-15.

The Regulations prescribe concrete compliance tasks for different stakeholders. Below are actionable steps and checks tied to the relevant provisions.

For Liquor licence-holders (r 4; Schedule 1)

• Obtain the Schedule 1 notice in the exact wording provided in Schedule 1. Do not add words to that notice. r 4(2)(d)-(e) requires the notice bear only the prescribed words and nothing more.

• Produce the notice on flat rigid material of minimum dimensions 200 mm wide by 300 mm long. Encapsulate it behind durable transparent material such as glass or equivalent. Display in a public area of the premises so it can be easily read by patrons and staff (r 4(2)(a)-(c), (f)). Keep a record of installation date and maintenance checks.

• Integrate the posting obligation into licence management systems so that any relocation, renovation or change in the premises does not lead to inadvertent breach. Non-compliance attracts a maximum penalty of 8 penalty units (r 4(1)).

For owners, landlords, tenants and licensees dealing with possible drug premises notices (Forms 1-14; r 11; Form 13 warnings)

• If a police officer issues Form 2, 4, 6, 8, 10 or 12 (notices of finding), promptly review the record of finding (Forms 1, 3, 5, 7, 9, 11) and the stated reasons for suspicion. Note dates when subsequent findings must be considered for potential cumulative action within 12 months as the warnings in those forms explain.

• If you receive Form 13 (notice of making of a drug premises order), note the practical effects listed on the form: possible search without a warrant, searches of persons, charging for possession if a dangerous drug is found at the time, seizure of objects, restraining orders, and name and address requirements within 200 metres. Form 13 also warns that a Form 14 notice will be affixed within 7 days unless an owner, landlord or tenant serves notice of an application under s 11P for revocation. To prevent affixation or to preserve appeal rights, consider immediately serving the requisite revocation application under s 11P within the timeframes specified by the Act.

• Keep contemporaneous copies of all notices and records received from police, and log dates for potential appeals and application windows, including any statutory limitations on appeals referenced in Form 13.

For police and investigators (rr 7-15; Schedule 3)

• Use the prescribed Forms exactly as set out in Schedule 3 when recording findings at premises and issuing notices. Complete all required fields including type and quantity of drug, dates, times, places found, names of occupants and reasons for suspicion that drugs have been supplied at or from the premises. Accurate and complete forms will underpin applications under the Act.

• For electronic drug detection on persons, comply with r 14: only sample particulate matter from the outside of clothing and the person’s hands; do not require the person to remove, undo or rearrange clothing; take care to avoid disturbing a person’s clothing. Use permitted sampling methods such as swabbing or wiping, and document the sampling technique used.

• For electronic detection on property, comply with r 15: sample exterior and interior of vehicles and receptacles found within vehicles, and the outside of other property. Document vehicle identity, location, and receptacles sampled. Remember the Regulation’s definition of vehicle includes caravan, trailer or anything else being towed (r 15(4)).

• For disposal of syringes and needles (r 3): ensure used injecting equipment allegedly used in unlawful administration is placed in rigid, puncture-resistant containers sealed so contents cannot cause injury, then either placed in household/other refuse or handed to a person referred to in s 12(2) of the Act. Keep chain-of-custody records where handing to an authorised recipient occurs.

For persons seeking release of seized property or samples (Forms 15-16; r 13)

• When making an application under s 19C(2) or s 19PA(2) for release of samples, use the prescribed Form 15 (for persons charged) or Form 16 (for owners). Include the details requested such as description of seized property, the location of seizure and the identity and address of the applicant.

• Where custody of a released dangerous drug or precursor is to be given to a specified person, ensure that person is authorised under the Misuse of Drugs Act or another law to possess the substance. Form 15 states this explicitly in the Note. If an authorised custodian is not available locally, plan logistics early to avoid delays.

For businesses handling substances listed in Schedule 2 (precursors)

• Check Schedule 2 carefully and identify any chemicals used in your operations that appear on the list (for example ephedrine, pseudoephedrine entries, iodine, solvents, metal catalysts and other named substances). If you handle items on the list, ensure your compliance systems reflect any obligations under the Act that apply to precursors, including record-keeping, reporting, suspicious transaction monitoring and lawful supply routes. The Regulations (r 2B) treat these substances as prescribed for the Act’s definition of precursor.

• Consider contacting regulators or legal advisers to confirm whether any licensing, reporting or permitted use conditions apply under the Misuse of Drugs Act or other chemical control regimes.

Administrative and procedural practices across actors

• Maintain audit trails: Keep copies of all prescribed forms when issued or received. For police, maintain a contemporaneous log of sampling methods, chain of custody for seized items, and the rationale recorded for suspicions of supply at premises. For private actors, keep copies of notices, any correspondence with police and dates of any revocation application under s 11P.

• Verify authorisation before affixing notices: Do not affix any notice purporting to be a s 11Q notice unless explicitly authorised by the Commissioner of Police. Unauthorised affixation is a strict liability offence with a maximum penalty of 17 penalty units (r 12(1)-(2)).

• Factor timing into decisions: Form 13 indicates a 7-day window before a Form 14 notice is affixed unless an application for revocation is filed. Make use of this time to prepare any administrative steps including applications under s 11P and to seek legal advice about appeal sequencing and judicial review options.

• Training and standard operating procedures: Police agencies and licence-holders should train staff on the precise format and display requirements for notices, the constraints on sampling, safe sharps disposal practices, and the procedural forms. For police, ensure officers understand the limitations on clothing disturbance when sampling to avoid procedural evidence issues.

• Confirm dimensions and display requirements: Where the Regulations specify physical dimensions of signs (r 4(2) and r 11(2)), confirm the measurements and the agency’s preferred practice if the Regulation language appears ambiguous, for example the "500 cms in width" phrase in r 11(2). Obtain written guidance from the Commissioner of Police or the NT regulatory authority to avoid contestable non-compliance.

Following these steps will align practical behaviour with the Regulations’ mandatory prescriptions. Keep the Act and the current reprint of the Regulations to hand when implementing any compliance steps, and consult legal advice for contested or ambiguous matters.
