sec.34 Requirements for road compensation agreement— Act , s 94

This section prescribes, for section 94 (2) of the Act , the requirements for a road compensation agreement. The agreement must— state whether the agreement is for all or part of the compensation liability; and if the agreement is for part of the compensation liability, state— each part of the notifiable road use to which the agreement relates; and the period for which the agreement has effect; and provide for how and when the compensation liability will be met. The agreement must be signed by— the resource authority holder; and the public road authority. (sec.34-ssec.1) This section prescribes, for section 94 (2) of the Act , the requirements for a road compensation agreement. (sec.34-ssec.2) The agreement must— state whether the agreement is for all or part of the compensation liability; and if the agreement is for part of the compensation liability, state— each part of the notifiable road use to which the agreement relates; and the period for which the agreement has effect; and provide for how and when the compensation liability will be met.
