Plain English Summary

1/10 complexity

What this does This instrument sets a 3-year time limit on how old an English language test result can be when an employer nominates someone for a Subclass 457 (temporary skilled work) visa.

Who it affects

Employers sponsoring overseas workers for Subclass 457 visas
Visa applicants who must prove their English skills through approved tests (like IELTS or equivalent)

The key rule English test results must have been obtained within the 3 years immediately before the nomination date. If the test was taken earlier than that, the nomination will not satisfy the English language requirements.

When it applies This applies to nominations made on or after 1 July 2017, including nominations that were already lodged but not yet decided ('not finally determined') at that date.
