What it does
This instrument sets the dollar amounts payable to Trades Recognition Australia for particular skills-assessment and internal-review services connected to Australia’s migration framework. It is made by the Minister for Immigration, Citizenship and Multicultural Affairs under subregulation 5.40(1) of the Migration Regulations 1994, as stated at the head of the instrument. The operative mechanics are: it (a) prescribes a schedule of fees for a list of named assessment types (section 5 and its table); (b) prescribes a schedule of fees for internal reviews of certain assessments (section 6 and its table); (c) repeals the prior instrument LIN 21/023 (section 3); and (d) provides limited savings and transitional qualifications on which instrument’s fee applies to particular applications made or paid for before commencement (section 4).
Commencement is tied to registration: the instrument commences on the day after registration on the Federal Register of Legislation (section 2). The Minister signed the instrument on 21 March 2023. The fee table in section 5 lists 22 discrete assessment items, with amounts ranging from $75 (Job Ready Program Final Assessment, item 6) up to $2,845 (Job Ready Program Workplace Assessment, item 5), and specific program labels such as Migration Skills Assessment, Job Ready Program assessments, TSS Skills Assessment Program assessments, and Offshore Skills Assessment Program assessments. Section 6 lists nine internal-review fees with amounts (for example, Migration Skills Assessment internal review at $610, item 1; a general $700 internal review fee for many TSS and Offshore assessment matters).
The instrument does not itself create offences, nor does it specify methods of payment, refund, or administrative collection procedures. Its legal effect is to fix fee amounts for the purposes of paragraph 5.40(1)(a)-(c) of the Migration Regulations 1994, thereby altering the monetary cost of obtaining or seeking review of certain migration-related skills assessments undertaken through Trades Recognition Australia. It expressly repeals LIN 21/023 (section 3) but preserves certain prior-fee entitlements under narrow transitional conditions in section 4.
