What it does
This short Act (Methodist Church of Australasia Supernumerary Ministers and Ministers' Widows Fund Act 1975) operates to resolve legal doubt about the ownership and legal treatment of property that is held for the purposes of the Methodist Church of Australasia Supernumerary Ministers and Ministers' Widows Fund (“Fund purposes”). The Act does three discrete things, all by operation of statute:
-
It declares that the Methodist Church (Victoria) Property Trust Act 1970 (referred to in this Act as “the Act”) and the Methodist Model Deed do not apply to property in Victoria which was or is devised, given, granted or held for Fund purposes (s 3(a)-(b)). The preamble sets out the legislative reason for that declaration: doubts had arisen whether particular provisions of the 1970 Act (notably sections referred to in the preamble, such as ss 14, 15 and 18 of that Act) applied to property held for Fund purposes.
-
It vests, by statutory operation, all property held by any person for Fund purposes in the Trustees of the Fund (s 4). The wording “shall by virtue of this Act be vested in the Trustees” effects legal vesting without requiring transfer formalities at common law; the property is vested by statute.
-
It provides an administrative pathway for title registration: where property is registered in the name of the Property Trust and the Property Trust certifies under seal that, by virtue of this Act, that property has been vested in the Trustees, the Registrar of Titles must, on production of the Certificate of Title or instrument and on payment of a fee of $4 per Certificate or instrument, register the Trustees as proprietors in the Register Book (s 5). The Act thereby facilitates registration under the Transfer of Land Act 1958 processes.
