It does this by declaring that such property is not subject to the 1970 Act or Model Deed (s. 3) and by vesting that property in the Fund Trustees (s. 4).\n\nPractical consequences and implementation mechanics\n\n- Ownership and control: Property used for Fund purposes is formally transferred to (vested in) the Fund Trustees by statute. That changes who makes decisions about use, sale, investment and income from that property (s. 4).\n- Administrative step to record transfers: where the Property Trust has certified an interest, the Registrar will re-register title against the Trustees on production of the Certificate of Title or instrument and payment of $4 per document (s. 5). This is an administrative cost and step to reflect the statutory vesting on the land register.\n- Legal certainty: s. 6 avoids litigation over past acts by validating acts done by either body as if the other could lawfully have done them, reducing retrospective challenge risk.\n\nCosts, incentives, trade-offs and risks (mechanism-focused)\n\n- Who pays: the immediate, quantifiable cost in the statute is the $4 fee per Certificate of Title or instrument payable to the land registry when registration is sought (s. 5). Other costs are administrative (time and process) for the Trustees and the Property Trust to produce documents and obtain registrations.\n- Who decides: after vesting, the Trustees of the Fund hold statutory ownership and so decide how Fund property is managed (s. 4). The Property Trust loses (or does not acquire) control over those assets by virtue of the declarations in s. 3 and s. 4.\n- Incentives and behaviour change: the Act removes ambiguity about which corporate trustee manages Fund property; that centralisation of legal title in the Fund Trustees concentrates decision-making and any economic benefits (income, sale proceeds) in that smaller body rather than in the broader Property Trust. This may change investment, sale or leasing choices for that property.\n- Trade-offs: the Act trades off a potential administrative consolidation of control (clarity, speed of decision by the Fund Trustees) against removing any economies or coordination the Property Trust might have offered if it had remained the legal owner.\n- Implementation risk and compliance burden: low. The statutory vesting is automatic (s. 4) and the registration mechanism in s. 5 is straightforward, with a small registry fee. The mutual validation clause in s. 6 reduces litigation risk from past acts. The main operational burden is producing title documents and updating registers.\n- Effects on private enterprise and markets: limited and indirect. The Act reassigns ownership and control of specific trust property between church-related trustees. It does not create new commercial regulation, change taxation, or alter broader property law; any market effect will stem from different management choices made by the Fund Trustees versus the Property Trust (s. 4).\n- Concentrated benefits and potential for capture: the principal, direct beneficiaries are the Fund Trustees and, by extension, the Fund's intended recipients (supernumerary ministers and ministers' widows). That benefit is concentrated; costs (administration, changes in management) are diffuse or minimal.\n\nLegal clarity provided\n\n- The Act removes doubt about whether the Property Trust or Model Deed governed Fund property, makes the Fund Trustees the legal owners of that property (s. 3–4), provides the Registrar with a simple registration procedure (s. 5), and validates past acts to prevent retroactive challenges between the two trustee bodies (s. 6)."},"summary":{"complexity_score":2,"scope_assessment":{"changed":false,"description":"Based on the available information, there is no indication the scope changed from its original intent.
