Marine Order 73 (Ratings) 2014

Marine Order 73 organises competency regulation around a set of tightly defined legal concepts. These are the statutory building blocks practitioners must map into compliance and rostering decisions.

Grades of certificate and permitted duties. The Order defines specific grades of seafarer certificate for ratings and ties each grade to explicitly described permitted duties or functions in Schedule 1. The permitted duties derive from the STCW Code competencies for navigational watch ratings (A‑II/4), engine room watch ratings (A‑III/4), able seafarer duties (A‑II/5 and A‑III/5), and combined duties for integrated ratings (Schedule 1; s 7).

Qualifying seagoing service. The Order defines what counts as qualifying seagoing service for each certificate and for revalidation in Schedule 3 and requires that qualifying service comply with the general rules in that Schedule (s 9(1)-(2); Schedule 3). Schedule 3.1 specifies the capacity in which service must have been performed (deck rating, trainee deck rating on vessels ≥24 m, engine room rating or trainee, or equivalent engine watchkeeping including periodically unattended machinery spaces with propulsion ≥750 kW). Schedule 3.2 provides the arithmetic: an 8‑hour or longer duty day counts as a whole day; shorter duty days are the actual hours plus 25% (Schedule 3, clauses 3.2-3.3).

Approved programs, courses and approvals. The Order repeatedly conditions eligibility and revalidation on completion of “approved” programs or courses that comply with specific STCW Code sections (for example, vocational training complying with A‑II/4 or A‑III/4, basic safety training A‑VI/1, security awareness A‑VI/6). The Order does not itself list providers; AMSA retains control over approval and interpretation (s 8(1)(b) and repeated references across Schedules).

Steering certificate and medical fitness. The Order contains a bespoke statutory definition of “steering certificate” allowing either a master’s certificate after 10 hours steering on a vessel at least 24 m (including 4 hours conning) or a certificate from an approved training organisation requiring 2 hours practical conning plus 8 hours on a steering simulator (s 4 definition). “Certificate of medical fitness” is referenced by cross‑link to Marine Order 76 (Health , medical fitness) 2017 (s 4 definition), so medical fitness requirements are not reproduced in MO73 but form a mandatory eligibility element.

Revalidation pathways and options. Schedule 4 sets two revalidation options: Option 1 is recent documented qualifying sea service thresholds (12 months in 5 years or 3 months in the last 6 months) plus maintenance of relevant STCW competencies and medical fitness; Option 2 allows persons without the service to revalidate by completing approved refresher courses within a 5‑year window and holding medical fitness. Different competency sets apply depending on grade (Schedule 4).

Transitional architecture. Division 3 and Schedule 5 provide conversion rules for older certificates issued under Marine Order 3 (Seagoing qualifications) 2004 and an explicit expiry date for those older certificates (s 12 and s 13; Schedule 5). AMSA may also require additional training before issuing a new certificate under the transitional arrangements (s 13(3)).

Regulatory powers and cross‑references. The Order is made under the Navigation Act powers listed in s 3 and is to be read with Marine Order 70; it gives effect to STCW and cross‑references other instrument regimes (s 2(2); s 3). AMSA’s scope for approval, revalidation, and delegation is therefore central to how these concepts are operationalised.

The Order expressly applies to two categories of people: a person performing or intending to perform duties or functions as a rating on a regulated Australian vessel, and a person who holds a seafarer certificate as a rating (s 5). That identification gives immediate boundaries to the regulatory population: the Order governs ratings on regulated Australian vessels rather than all persons who ever work at sea.

Primary individuals. Seafarers who work as ratings , deck ratings, engine room ratings, able seafarers (deck and engine), integrated ratings and chief integrated ratings , are the direct subjects. For each grade the Order prescribes minimum age (generally 18) and specific training/service conditions (Schedule 2). The Order also affects holders of legacy AMSA certificates issued under earlier Marine Orders: Division 3 and Schedule 5 provide their transition and conversion pathways (s 13; Schedule 5).

Employers and vessel operators. Owners and operators of regulated Australian vessels will be affected operationally because the Order sets the rule for who may perform the duties of a rating on board (s 6; s 7). Section 6 declares that, for the purposes of s 35 of the Navigation Act, a person is qualified to perform rating duties if they hold the requisite certificate as required by the Order. Section 7 mandates that a person must hold the correct grade set out in Schedule 1 to undertake corresponding duties. Operators therefore have to ensure that crewing and rostering produce the required certified personnel for the vessel’s operations. The instrument does not provide a separate employer duty to check documents beyond these provisions, but sections of the Navigation Act referenced in the Order include offences for operating with unqualified persons (note to s 3 referring to Navigation Act ss 34-37).

AMSA and approved training organisations. AMSA is the issuer and regulator: it issues, revalidates, may revoke or vary certificates and sets approval criteria for programs and courses (s 8(1)(b); s 10). “Approved seafarer training organisations” appear in the text as those that can issue steering certificates and approved courses for revalidation (s 4 definition of steering certificate; Schedule 4 Option 2). Masters have a limited, statutory role: the master may issue a steering certificate after observing 10 hours steering and 4 hours conning (s 4 definition). Thus the regulatory responsibilities fall primarily on AMSA and approved training organisations, with masters having a narrow delegable capacity.

Medical and training service providers. Because the Order makes completion of medical fitness and specified courses mandatory for many certificates (Schedule 2; Schedule 4), providers of medical exams, basic safety training, advanced firefighting, survival craft training and security awareness courses are indirectly affected, as their certification becomes a prerequisite for seafarer certification.

Regulated vessels and operating areas. The Schedule 1 descriptions notably say permitted duties are authorised “on vessels of any size in any operating area” for each grade. That broad wording means the certificate grades are not conditional on a particular vessel size or operating area unless otherwise constrained by the qualifying service rules (Schedule 3) which do require certain service on vessels ≥24 m for deck ratings (Schedule 3.1).

Indirectly affected parties. Crewing agencies, unions, insurers and auditors will be affected by the revalidation and documentation requirements, since compliance requires retention and production of records of qualifying seagoing service, course completion and medical fitness as set out throughout Schedules 2-5 and in the cross references to Marine Order 70 for record calculations.

The Order creates a defined set of legal duties for individuals and administrative bodies and corresponding statutory rights to be issued or revalidated for a certificate if criteria are met.

Duty to hold the correct certificate to perform duties. Section 7 makes it mandatory that a person holds the grade of seafarer certificate detailed in Schedule 1 to perform the permitted duties stated for that grade. Section 6 further operationalises this by stating that for s 35 of the Navigation Act a person is “qualified” if they hold the certificate required by the Order and the certificate permits the duties in Schedule 1 (s 6(a)-(b)). Practically, an individual is prohibited from performing rating duties on a regulated Australian vessel unless they hold the correct certificate.

Eligibility duties and preconditions. Section 8(1) sets criteria for AMSA to issue a rating certificate: competency in English sufficient to understand directions and documents (s 8(1)(a)) and satisfaction of the specific eligibility requirements in Schedule 2 (s 8(1)(b)). Schedule 2 enumerates minimum age, training course completion, documented qualifying seagoing service, basic safety training, security awareness training and additional certificates such as a steering certificate and certificate of medical fitness for many grades.

Duty to maintain competencies and revalidate. Section 10 and Schedule 4 impose revalidation duties: certificate holders must either maintain specified levels of qualifying seagoing service (Option 1 thresholds) or undertake approved refresher courses (Option 2), and for most grades must maintain specified STCW Code competencies such as fire prevention and fighting, survival craft proficiency and security awareness (Schedule 4 clauses). Certificate holders seeking revalidation must hold a certificate of medical fitness (s 10(2)(b); Schedule 4).

AMSA’s administrative rights and discretions. AMSA has the statutory competence to issue and revalidate certificates subject to those criteria (s 8(1); s 10). Section 10(1) also authorises AMSA to revalidate a certificate so that it expires before 1 January 2017 where it is satisfied the person has maintained the STCW Code required standard of competence in security awareness. Section 13(3) gives AMSA the right to require further training as a condition of issuing a new certificate to a holder of an older AMSA certificate. The Order’s repeated references to “approved” programs and to AMSA being satisfied about competencies indicate substantive discretion by AMSA over approvals and evidence sufficiency.

Rights to issue and conversion under transitional arrangements. Section 13(1) treats a person holding certain old certificates issued under Marine Order 3 (2004) as if they hold a seafarer certificate of proficiency as rating (s 13(1)). Section 13(2) and Schedule 5 provide rights for holders of older AMSA certificates to be issued the next grade of certificate if they meet the eligibility in Schedule 5; these rights, however, are conditional and AMSA may require additional training (s 13(3)).

Documentation and proof. The Order indicates that seagoing service must be documented and sets the rules for counting service days (Schedule 3). It also references Marine Order 70 for general rules on calculating service, including evidence methods (s 9 note referring to Subdivision 3.1 of Marine Order 70). Thus the practical right to be issued or revalidated depends on providing the documentary evidence AMSA accepts.

Narrow special rights. Masters may issue a steering certificate in specified circumstances under the steering certificate definition (s 4); an approved seafarer training organisation may issue a steering certificate if it runs the specified course. Those two limited issuance powers create an alternative path for completing an eligibility requirement.

In short, the Order imposes a duty on individuals to hold the correct certificate and to maintain specified training/service standards, gives AMSA principal administrative control over approvals and evidence, and creates conditional rights for issuance and conversion under transitional arrangements.

Marine Order 73 itself is a regulatory rulebook giving standards and eligibility criteria; the Order does not list criminal or civil penalties directly but explicitly links to the enforcement regime in the Navigation Act and to AMSA’s administrative powers.

Offences under the Navigation Act. The Order’s s 3 explanatory note points practitioners to the Navigation Act Chapter 2, Part 2, Division 3 for offences relating to seafarer certificates: falsely representing that a person holds a kind of certificate (Navigation Act s 34), performing duties or functions without the appropriate seafarer certificate (s 35) and breaching a condition of a seafarer certificate (s 37). Marine Order 73 operationalises s 35 by specifying the certificate grade required to perform duties (s 7) and by defining when a person is “qualified” for s 35 purposes (s 6). The Order therefore translates statutory offences into operational compliance triggers for ratings.

AMSA’s administrative enforcement and certificate control. The Order sets AMSA as the issuing and revalidation authority (s 8, s 10), which implies administrative enforcement levers: refusal to issue or revalidate; imposition of conditions; and the potential for AMSA to require further training before issuing a replacement or upgraded certificate (s 13(3)). Section 3 of the Order lists the Navigation Act powers under which these functions sit, including s 314 on application and issue criteria, variation and revocation, renewal, suspension and surrender of certificates (s 3(1)(e)-(h)). These Navigation Act powers provide the statutory machinery for AMSA to suspend or cancel certificates where non‑compliance is established, although the Order itself does not spell out procedural steps for suspension or appeal.

Evidence and inspection. The Order’s detailed documentation requirements (Schedules 2-4 and Schedule 3’s sea service calculation rules) create evidentiary expectations for AMSA to verify. The Order cross‑refers to Marine Order 70 for general rules about the calculation and proof of qualifying seagoing service (s 9 note). That cross‑reference indicates that AMSA will apply the Marine Order 70 procedures for verifying service, which in practical enforcement means employers, masters and seafarers must retain verifiable logs, endorsements and course completion documents.

Delegation and decision‑making. The Order’s note 4 in s 4 points readers to AMSA’s website for delegation of AMSA’s powers under the Order. Delegation allows AMSA to allocate administrative enforcement responsibilities internally or to authorised agents; the Order does not itself set the scope of delegation other than by reference to AMSA’s administrative arrangements.

Timing and transitional enforcement. Section 12 gives a fixed expiry date of 1 January 2017 for a suite of previously issued certificates; non‑renewal or non‑conversion after that date would expose persons to the Navigation Act offences if they continued to perform duties without the new or revalidated certificate. Section 10 also allows AMSA to revalidate certificates to expire before 1 January 2017 under specific conditions, which creates a potential calendar risk where AMSA‑controlled expiry dates determine when a person must revalidate to avoid falling into non‑compliance.

What the Order does not do in penalties. The Order does not set monetary fines, pecuniary penalties, or administrative penalty notices; enforcement sanctions and penalty levels are those provided by the Navigation Act and by AMSA’s administrative powers under the Act. Practitioners should therefore treat the Order as the substantive rule set for duties and rely on the Navigation Act and AMSA’s published enforcement policy for details on penalty quantum and procedural recourse.

Marine Order 73 is constructed as an implementing instrument under the Navigation Act 2012 and repeatedly cross‑links to other Marine Orders and international instruments, creating a multi‑layered compliance architecture.

Primary statutory parent: Navigation Act 2012. Section 3 of MO73 identifies the specific Navigation Act provisions that authorise the Order (s 28, s 29(1)-(3), s 314(1), s 314(3)-(5), s 339(1), s 342(1)). Those provisions empower AMSA to prescribe seafarer certificates, competencies, evidence methods, conditions and procedural rules for applications and the issue, variation, suspension and revocation of certificates. The Navigation Act also contains the offences (ss 34-37) referenced in MO73’s explanatory note; MO73 therefore operates as the detailed regulatory expression of the Act’s powers on ratings issues.

Marine Orders. MO73 is designed to be read with Marine Order 70 (Seafarer certification) 2014 (s 2(2)). MO70 contains general rules on seafarer certificates, calculation of seagoing service, forms and application procedures, and the Order explicitly refers readers to it for general service calculation rules (s 9 note referencing Subdivision 3.1 of MO70). Marine Order 76 (Health , medical fitness) 2017 is also linked: MO73’s definition of “certificate of medical fitness” points to s 4 of Marine Order 76 and uses that term as an eligibility requirement in Schedule 2 and Schedule 4 (s 4 and cross references). Practitioners must therefore apply MO73 together with MO70 and MO76 rather than in isolation.

International law: STCW Convention and Code, SOLAS. The Order explicitly gives effect to the STCW Convention and repeatedly requires compliance with specific STCW Code tables and paragraphs (s 2(1)(b); Schedule 2 and 4 references to STCW Code sections and tables). The Order’s eligibility and revalidation criteria are therefore conditioned on international competency standards. The Order also notes other international instruments in definitions and notes, such as SOLAS and the IMO publications, which frame maritime safety obligations that interact with seafarer competency regimes.

AMSA Act and administrative law. The Order’s note 4 in s 4 directs readers to AMSA’s website for information on delegation of AMSA powers under the Order, linking MO73 to AMSA Act administrative arrangements for delegation and decision‑making. Administrative law principles (natural justice, reasoned decisions, review rights) under the Administrative Decisions (Judicial Review) Act 1977 and other general administrative law frameworks will typically apply to AMSA’s certificate decisions, although those statutes are not named in MO73.

Other regulatory instruments and industry standards. MO73’s repeated references to “approved” programs and training mean that other regulatory approvals, standards and accreditation criteria will operate alongside MO73. The Order does not set out the approval process for training organisations, leaving that process to AMSA under MO70 powers and AMSA’s approvals regime.

Consequential and transitional links. The Order was amended consequentially by Marine Orders Amendment (Marine Order 76 , consequential changes) Order 2017 and by Marine Order 75 (Seafarer certification amendment) 2016 (see the amendment table). These amendments demonstrate that MO73 interacts dynamically with other Marine Orders and that changes to one instrument produce consequential changes to MO73’s definitions and cross‑references.

In practice, compliance requires an integrated application of MO73 with:

• the Navigation Act (for enforcement and administrative powers, s 3 cross‑references);
• Marine Order 70 (procedural and service calculation rules, s 2(2) and s 9 note);
• Marine Order 76 (medical fitness requirements referenced in s 4 and Schedules);
• STCW Convention and Code (substantive competency standards referenced throughout Schedules);
• AMSA’s approvals, delegation and administrative policies.

Failure to consider this web of interactions risks incomplete compliance (for example, meeting MO73 training content requirements without meeting MO76 medical fitness requirements).

The compilation accompanying this Order identifies three discrete Marine Orders instruments that created and amended MO73 since its initial issue. The Order’s own “Table of Orders” lists the origin and two amendment instruments with registration dates and commencement dates. The sequence is:

• Marine Order 73 (Ratings) 2014 (MO 2014/5), registered 25 February 2014, commenced 1 April 2014. This is the parent instrument establishing the Ratings Order (Table of Orders).
• Marine Order 75 (Seafarer certification amendment) 2016 (MO 2016/5), registered 9 June 2016, commenced 10 June 2016. The table and the “How affected” column show MO2016/5 as responsible for several amendments to MO73 (see Table of amendments entries).
• Marine Orders Amendment (Marine Order 76 , consequential changes) Order 2017 (MO 2017/9), registered 18 December 2017, commenced 1 January 2018, introduced consequential changes related to Marine Order 76 (Table of Orders).

The “Table of amendments” in the compilation gives more granular signals about which provisions were changed by later instruments:

• Provision 1A was repealed (entry: "1A ... rep. Legislation Act 2003, s.48D").
• Section 2 was amended by MO2016/5 (entry: "2 am. MO 2016/5").
• Section 4 was amended by MO2016/5 and by MO2017/9 (entry: "4 am. MO 2016/5, am. MO 2017/9").
• Section 9 was repealed and substituted by MO2016/5 (entry: "9 rs. MO 2016/5").
• Section 10 was amended by MO2016/5 (entry: "10 am. MO 2016/5").
• Section 11 was repealed by MO2016/5 (entry: "11 rep. MO 2016/5").
• Schedule 1 was repealed and substituted by MO2016/5 (entry: "Schedule 1 rs. MO 2016/5").
• Schedule 2 was amended by MO2016/5 (entry: "Schedule 2 am. MO 2016/5").
• Schedule 3 was amended by MO2016/5 (entry: "Schedule 3 am. MO 2016/5").
• Schedule 4 was amended by MO2016/5 (entry: "Schedule 4 am. MO 2016/5").

The compilation further records the date of the compilation (1 January 2018) and that it was prepared on 22 December 2017 taking into account amendments up to MO2017/9. Those entries mean the text presented reflects the law as at 1 January 2018 inclusive of MO2016/5 and MO2017/9. Practitioners should therefore treat the present text as post‑2016 and post‑2017 amendments.

The amendment table shows that MO2016/5 effected substantial structural changes (repeals, substitutions and multiple schedule updates). Clause‑level references indicate that rule content such as qualifying seagoing service rules (s 9), eligibility requirements (Schedule 2), and the duties permitted per grade (Schedule 1) were specifically targeted for revision by MO2016/5. MO2017/9 produced consequential amendments tied to changes in Marine Order 76 (health/medical fitness), which is consistent with the cross‑references to medical fitness in MO73 (see s 4 definition).

Note the compilation also lists an administrative repeal under the Legislation Act 2003 for provision 1A, showing that some housekeeping or formalising changes have been made. The table entries use shorthand markers (ad., am., rep., rs.) that identify where text was added, amended, repealed, or repealed and substituted.

For due diligence, practitioners should consult:

• the individual amending instruments (MO2016/5 and MO2017/9) for the amending schedules and explanatory notes to see policy intent behind changes, and
• the current AMSA website / FRLI to confirm whether further amendments have occurred after 1 January 2018.

The compilation provided contains no references to judicial decisions, case law or tribunal determinations concerning Marine Order 73. The instrument’s notes and schedules reference statutes, Marine Orders and international instruments but do not cite or summarise any court or tribunal authority. Accordingly, within this compilation there is no litigation history recorded and no decided cases are named.

Practitioners should be aware of two implications of that absence in the compilation:

• absence of precedent in the instrument does not mean there is no case law elsewhere. Judicial interpretation of related Navigation Act provisions (for example, s 35’s prohibition on performing duties without an appropriate certificate, or s 314 procedural powers) may exist in external case law not recorded in this compilation; that material is outside the textual content provided here and should be searched in legal databases where precedent may have interpreted AMSA’s powers or the meaning of “qualified” in particular factual contexts; and

• administrative review cases (judicial review, merits review where available) may exist concerning AMSA decisions on approvals, revalidation or suspension. The compilation does not summarise any such cases.

Where a practice point depends on how courts or tribunals have interpreted the Navigation Act, Marine Orders or STCW implementation in Australia, reliance solely on the text in this compilation is insufficient. For litigation‑level analysis, obtain and review any relevant decisions applying the Navigation Act, Marine Orders 70, 73 and 76, and cases dealing with AMSA administrative actions. The Order’s internal cross‑references to the Navigation Act and to Marine Order 70 suggest that legal challenges are more likely to involve the parent Act or administrative decisions rather than the content of MO73 alone.

No litigation history is cited in MO73 itself; a comprehensive litigation review therefore requires external case law research beyond this instrument.

Marine Order 73 contains several technical traps where administrative discretion, timing and evidentiary mechanics can produce compliance failures if overlooked. The following concrete pitfalls derive directly from the Order’s text and schedules.

Expiry and transitional timing. Section 12 fixes the expiry on 1 January 2017 for a list of older certificates issued under Marine Order 3 (2004), including Chief Integrated Rating, Integrated Rating, Deck Rating, Able Seaman, Engine Room Rating and certificate of safety training. That fixed calendar expiry creates a cliff; holders of those older certificates had to convert or revalidate in line with the transitional rules of s 13 and Schedule 5. Section 10(1) also authorises AMSA to revalidate a seafarer certificate so that it expires before 1 January 2017 if satisfied the certificate‑holder has maintained security awareness competence. Practitioners must watch AMSA’s revalidation decisions and expiry dates because the Order permits AMSA to determine expiry dates for revalidated certificates in specific transitional contexts (s 10).

“Approved” and “appropriate” are AMSA‑dependent. Multiple eligibility items require completion of “approved” programs, courses or training that “comply with STCW” or specify an “appropriate vessel” for vocational training (s 4 definition of appropriate vessel; Schedule 2 entries). The text leaves substantive determinations of approval and appropriateness to AMSA (s 8(1)(b) and recurring references). That places the burden on applicants and employers to confirm AMSA approvals in advance rather than assuming compliance by completing arbitrary courses.

Steering certificate has two different pathways. The Order’s statutory definition of steering certificate allows either a master’s endorsement after 10 hours steering (with at least 4 hours conning) on vessels at least 24 m, or a certificate issued by an approved seafarer training organisation after 2 hours practical conning plus 8 hours on a steering simulator (s 4). Employers and trainees must ensure the chosen pathway matches the eligibility requirement for the targeted certificate; a steering certificate issued by a master under one standard will be different in evidentiary format from a course certificate issued by an approved organisation.

Sea service arithmetic is non‑intuitive. Schedule 3 treats any day on which a person performs rating duties for at least 8 hours in a 24‑hour period as a whole day, but for days under 8 hours the time counts as actual hours plus 25% (Schedule 3.2(a)-(b)). That 25% uplift can make short‑hour patterns count materially more than raw hours would suggest. Practitioners must apply those rules when calculating qualifying service for eligibility and revalidation; the Order also directs readers to Marine Order 70 for general calculation rules (s 9 note).

Certificate‑grade scope may be broader than expected. Schedule 1 states that each grade permits duties “on vessels of any size in any operating area.” That broad authorisation can permit a certificate‑holder to perform duties on a wider set of vessels than their prior sea service was performed on, but the qualifying seagoing service rules in Schedule 3 do require service on particular vessel types or sizes for some grades (for example, deck service on vessels ≥24 m). The interplay between Schedule 1’s broad permitted duties and Schedule 3’s qualifying service constraints is a precise point to verify for fit‑for‑purpose deployment.

Medical fitness cross‑reference. “Certificate of medical fitness” is defined by cross‑reference to Marine Order 76 (s 4). MO73 requires medical fitness for many certificates and for revalidation (Schedule 2, Schedule 4). Practitioners must obtain the MO76 definition and ensure the correct type of medical certificate is produced; a generic medical report will not suffice.

Revalidation windows and differing requirements. Schedule 4 sets Option 1 service thresholds (12 months in 5 years or 3 months in 6 months), and Option 2 requires approved courses completed within 5 years of application. The two alternatives have different competency and timing consequences. For certain grades (Chief Integrated Rating), Option 1 requires maintenance of advanced firefighting competence and others (Schedule 4 clauses). Not observing which competencies must be evidenced for which grade and revalidation option will cause revalidation refusals.

AMSA may require further training on conversion. Under s 13(3), AMSA may require a holder of an older AMSA certificate to undertake further training appropriate to the new grade before issuing a new certificate. Conversion from legacy certificates is therefore not automatic even where Schedule 5 lists entitlement; the practical risk is that conversion will be subject to AMSA discretion.

Documentation and evidence burden. The Order repeatedly requires “documented qualifying seagoing service” (Schedule 2, Schedule 4). Because the Order cross‑refers to the calculation rules in Marine Order 70 (s 9 note), and because sea service is the currency for many eligibility and revalidation pathways, incomplete logs, unsigned statements or missing master endorsements will be material compliance failures.

Narrow replacement issues. The Order treats a certificate of recognition as a kind of seafarer certificate (note to s 7 referencing Marine Order 70 s 7(2)); practitioners dealing with foreign certificates or recognition processes must consult MO70 and AMSA policy to determine whether a foreign or recognition certificate satisfies the MO73 criteria.

These “gotchas” are technical, document and timing risks embedded in the Order’s text. The remedy is procedural: confirm AMSA approvals, maintain accurate service records using the Schedule 3 rules and MO70 guidance, secure the correct form of steering certificate and medical fitness certificate, and plan revalidation windows well in advance of expiry.

Compliance under Marine Order 73 requires an operational checklist translating the statutory eligibility, service calculation and revalidation rules into recordkeeping and training actions. The following practical steps align directly with the Order’s requirements and schedules.

1. Identify the grade required for the duties to be performed. Use Schedule 1 to map job descriptions to certificate grades (Navigational Watch Rating, Engine Room Watch Rating, Able Seafarer , Deck, Able Seafarer , Engine, Integrated Rating, Chief Integrated Rating). Confirm that the employer’s intended duties fall within the permitted duties in Schedule 1 and, if in doubt, check with AMSA because Schedule 1 duties reference STCW competencies.

2. Verify minimum age and preconditions in Schedule 2. Ensure each candidate is at least 18 years old where required (Schedule 2) and understand whether their pathway is vocational training plus 2 months sea service or direct sea service (the Schedule 2 alternatives for watch rating grades).

3. Complete the required courses and obtain certificates. Arrange completion of:

   • approved vocational training programs complying with the STCW sections specified in Schedule 2 (A‑II/4, A‑III/4, A‑II/5, A‑III/5 as applicable);
   • approved basic safety training complying with STCW Code A‑VI/1 paragraph 2 (Schedule 2);
   • approved security awareness training complying with STCW A‑VI/6 paragraph 4 (Schedule 2);
   • survival craft and rescue boats proficiency where required (Schedule 2);
   • advanced firefighting for Chief Integrated Rating (Schedule 2 for Chief);
   • steering certificate (see step 4);
   • certificate of medical fitness as defined by Marine Order 76 (obtain the correct form from authorised medical examiners and ensure it matches MO76’s requirements , s 4 cross‑reference).

4. Obtain a steering certificate if required. For deck or integrated credentials that require a steering certificate (Schedule 2), follow one of the two statutory paths in the definition (s 4): either the master’s endorsement following at least 10 hours steering on a vessel ≥24 m with 4 hours conning, or an approved training organisation’s certificate based on the prescribed simulator and practical hours. Ensure the steering certificate is in the form exactly expected by AMSA.

5. Document qualifying seagoing service per Schedule 3 and Marine Order 70. Maintain day‑by‑day records consistent with Schedule 3.2 arithmetic (an 8‑hour or longer duty day counts as a whole day; under 8 hours counts as actual hours plus 25%). Keep supporting evidence: ship’s logs, signed endorsements from masters, voyage records and employer certifications. Consult Subdivision 3.1 of Marine Order 70 for the general rules on proof and formats.

6. Plan revalidation early. For revalidation under Schedule 4 Option 1, ensure candidates can evidence either 12 months’ qualifying service within the last 5 years or 3 months’ qualifying service within the last 6 months. For Option 2, ensure the required courses are completed within the 5‑year window before application. For Chief Integrated Rating and other grades, verify the specific STCW competencies that must be maintained or refreshed (Schedule 4 clauses).

7. Maintain medical fitness currency. Obtain and renew the certificate of medical fitness per Marine Order 76; Schedule 2 and Schedule 4 require medical fitness for issue and revalidation. Ensure medical certificates are kept within the validity window AMSA requires for each certificate class.

8. Use approved providers and confirm AMSA approvals. Only use vocational training and revalidation courses that AMSA has approved and that comply with the referenced STCW sections. Contact AMSA or consult the AMSA approvals register to confirm provider approval status before enrolment.

9. If converting legacy certificates, follow Schedule 5. Holders of older AMSA certificates should consult Schedule 5 for the relevant entitlement and ensure either 12 months documented qualifying sea service after 1 January 2007 or completion of an approved revalidation course within 12 months before application, plus medical fitness (Schedule 5 items). Note AMSA may require additional training under s 13(3).

10. Keep a compliance file for each seafarer. File items should include: identity and age proof, certificates of course completion with course codes referencing STCW tables, steering certificate, medical fitness certificate with expiry date, day‑by‑day sea service logs calculated by Schedule 3 rules, employer or master endorsements, and copies of any AMSA approvals or correspondence. These documents will be required for AMSA’s review or for inspection under the Navigation Act enforcement regime.

11. Monitor expiry dates and AMSA notifications. Certificates can be issued, revalidated and in some transitional cases revalidated to expire before a fixed date (see s 10(1) and s 12). Track expiry dates and apply for revalidation or refresher courses well before expiry to avoid s 35 Navigation Act exposure for performing duties without the appropriate certificate.

12. Build administrative processes into rostering and training budgets. Employers should plan crew rotations and training budgets to ensure seafarers can accrue qualifying sea service and attend required courses without creating coverage gaps on vessels. Because Schedule 3 requires particular vessel types for certain service, employers must ensure placements match qualifying service requirements.

13. Seek AMSA pre‑application confirmation in edge cases. Where the approval status of a course, the appropriateness of a vessel for vocational training, or the sufficiency of sea service is unclear, obtain written confirmation from AMSA to reduce conversion or revalidation risk. AMSA’s discretion appears in multiple provisions (s 8, s 10, s 13), and pre‑confirming reduces the likelihood of refusal.
