Marine and Coastal (Prescribed Consents) Regulations 2025 (Victoria)

These Regulations (the Marine and Coastal (Prescribed Consents) Regulations 2025) create a catalogue of activities on marine and coastal Crown land that are treated as “prescribed consents” under the Marine and Coastal Act 2018. The instrument is made under s 80 of the Marine and Coastal Act 2018 (regulation 2) and supplies both the classes of activity that carry a prescribed consent and the standard conditions to which those consents are subject (see reg 1 for the stated objective). Mechanically, the Regulations do three things.

First, they identify actors who are automatically authorised to carry out specific low‑impact or urgent works without having to obtain an individual consent application from the Department, provided the activity falls within the tightly worded conditions set out in each regulation. Examples: Crown land managers, port managers, waterway managers, responder agencies, leaseholders under the Land Act 1958 or the Crown Land (Reserves) Act 1978, public utility providers and certain bodies such as the Victorian Fisheries Authority and Safe Transport Victoria are named across multiple provisions (see, for example, regs 4-3, 14-16, 18, 21).

Second, for each category of activity the Regulations set objective constraints and recurring conditions. Common constraints include limits to an existing footprint (for repairs), prohibition on excavation beyond works directly associated with the activity, obligations to “minimise any damage to the marine and coastal environment”, use of durable materials, and a requirement to avoid unreasonably blocking pathways or roads (see, for example, regs 4(1)(a)-(f), 7(1)(a)-(g), 15(1)(a)-(f)). Recurring conditions include leaving the work area “clean and tidy” and giving written notice to the Department where closure to the public is required (commonly at least 5 business days’ notice, e.g. regs 4(3)(b), 7(3)(b), 14(2)(b), 15(3)(b)). Specific time limits apply for temporary works: temporary event buildings are limited to events under 48 hours and must be removed within 24 hours of the event ending (reg 6); temporary fences and coastal protection must be removed within 12 months unless permanent consent is later obtained (regs 8(3)(b), 11(2)(b)); equipment installed for scientific research is limited to 12 months at rule 27(1)(b).

Version No. 001

Marine and Coastal (Prescribed Consents) Regulations 2025

S.R. No. 70/2025

Version as at
22 July 2025

1 Objective

The objective of these Regulations is to set out—

Prescribed consent (statutory authorisation without separate application)

The core legal device is the “prescribed consent”: a generally automatic authorisation conferred by these Regulations on specified persons for particular activities, subject to the listed eligibility rules and conditions (reg 1 objective; see each activity regulation). In short, compliance with the technical conditions in the relevant regulation equals the consent.

Specified persons and functional allocation of decision‑rights

Each regulation lists the persons who may rely on the prescribed consent. These are not generic classes but named functional actors: Crown land managers, port managers, waterway managers, leaseholders under specified Acts, responder agencies, Safe Transport Victoria, the Victorian Fisheries Authority, public utility providers and researchers (see, e.g., regs 4(2), 8(2), 14(2), 16(2), 27(2)). The Regulations therefore allocate practical authority to public managers and regulated infrastructure operators rather than to the general public.

Footprint and excavation limits

Many of the consents are conditional on works being within an existing footprint and not involving excavation beyond work‑related disturbance (see regs 4(1)(a),(c), 9(1)(c), 15(1)(a),(c)). This concept functions as a bright‑line test for routine repairs and maintenance as distinct from new constructions or major groundworks that would require ordinary consent channels under the Marine and Coastal Act or other regimes.

Minimisation of environmental harm and native vegetation/Aboriginal heritage constraints

Nearly all consents require minimisation of damage to the marine and coastal environment and, in many cases, prohibition on removing or damaging native vegetation and on harming Aboriginal places or objects (see regs 4(1)(d), 6(1)(b), 21(1)(a)-(b), 26(1)(a)-(b)). The Regulations thus borrow environmental and heritage constraints while leaving the operational standard (“minimise any damage”) undefined within the text.

Time‑limited and emergency pathways

There are two temporal design patterns: (a) time‑limited, pre‑authorised activities (temporary buildings, temporary beach matting, equipment for research limited to 12 months, temporary fences and temporary coastal protection limited to 12 months) and (b) urgent/emergency consents allowing rapid action where there is an immediate risk to public health, safety or the marine and coastal environment (e.g. regs 5, 8, 10, 11, 25). In the latter case, the Regulations commonly require after‑the‑fact written notice “as soon as practicable” (see regs 5(3), 10(2), 11(2)(d), 25(3)).

Coordination and approval requirements

Certain activities require pre‑work approvals from local authorities: equipment in local ports or managed waterways needs written approval of the local port manager or waterway manager; water‑based equipment outside managed waterways requires written approval of the Director, Safe Transport Victoria (reg 27(3)(a)-(c)). Swing moorings must be marked on the water (reg 18(3)) and testing requires backfilling of holes to natural ground level (reg 26(3)(b)). These provisions create an operational coordination obligation with third‑party managers.

Interoperation with other legal instruments

The Regulations frequently cross‑reference other statutory licences and regimes. For example, artificial opening of estuaries is only for persons authorised under a Water Act licence or Water Act by‑laws (reg 24(1)); aids to navigation may mark fisheries reserves or aquaculture sites and exclude the installation of fish aggregating devices within Commonwealth Sea Installations Act definitions (reg 17). The definitions section (reg 3) imports terms and examples from multiple Acts, so the meaning and limits of prescribed consents are conjoined to those separate regimes.

Standard conditions and recurring administrative steps

Recurring operational conditions are a defining structural element. The frequent administrative requirements are: leave the area clean and tidy; notify the Department in advance where public closure is required (commonly 5 business days); notify the Department as soon as practicable upon completion of emergency or demolition works; ensure temporary works are removed within stated periods; and use durable materials for repairs and replacements where stated (for example, regs 4(3)(a)-(b), 6(2)(b)-(c), 8(3)(a)-(b), 11(2)(a)-(b)).

Sunset and versioning

The instrument is a time‑limited delegated instrument: Version No. 001 and comes into force on 22 July 2025; it will sunset on 22 July 2035 under the Subordinate Legislation Act 1994 (Endnotes, para 1). The Table of Amendments records no subsequent amendments (Endnotes, para 2).

Named responsible actors carry the practical duties and the compliance costs created by the Regulations. The Regulations do not create broad public licences; permitted actors are mainly public managers, infrastructure operators and certain service bodies. Key affected groups are:

Crown land managers (recurring): Most repair, maintenance, temporary installation and vegetation management consents identify the relevant Crown land manager as the primary beneficiary of the prescribed consent (see regs 4(2)(a), 9(1), 11(1), 23(2)(a), 28(1)). That places routine operational responsibilities (and related costs) on Crown land managers for upkeep, emergency response and temporary interventions.
Port managers and waterway managers: Port managers are explicitly authorised for port facilities, jetties, piers, boat ramps, swing moorings and aids to navigation (regs 14-16, 18, 17). Waterway managers are named for jetties and aids to navigation and equipment approvals (regs 15(2)(b), 16(2)(b), 27(3)(b)). These operators will incur compliance tasks such as arranging and approving installations, marking moorings, and providing notices.
Responder agencies and public utility providers: Responder agencies are repeatedly specified where immediate risk or emergency response is relevant (regs 5(2)(b), 8(2)(b), 22(2)(b), 25(2)(a)). Public utility providers are specified for repair and restoration of infrastructure, service proving works and emergency restoration (regs 21(2)(b), 22(2)(a)). When emergencies occur, these entities can act under the prescribed consents and will bear costs and post‑action notice obligations.
Leaseholders under Land Act 1958 and Crown Land (Reserves) Act 1978: Leaseholders are included for building and fence works (regs 4(2)(b)-(c), 7(2)(b)-(c), 8(2)(c)-(d), etc.) and so lessees with statutory leases will have narrowly defined rights to conduct repairs and temporary works within the footprint constraints, subject to conditions.
Researchers, Safe Transport Victoria and sector regulators: Researchers have a prescribed consent for equipment and cameras used for scientific research, with a 12‑month limit and ancillary approvals required for certain locations (reg 27(2)(a), 27(1)(b), 27(3)). Safe Transport Victoria is given rights for aids to navigation and swing moorings and appears as a specified person for some activities (regs 16(2)(d), 17(2)(d), 18(2)(c), 27(2)(b)).
Victorian Fisheries Authority and lifesaving clubs: The Fisheries Authority is named for signage, aids to navigation and testing contexts (regs 12(2)(d), 16(2)(e), 17(2)(e), 26(2)), and Life Saving Victoria is included for temporary sign installation (reg 13(2)(h)). Lifesaving clubs are also specified for temporary beach matting (reg 30(2)(b)).
The Department (administrative recipient of notices): Throughout the Regulations the Department is the recipient of written notices triggered by many consents (e.g. regs 4(3)(b), 7(3)(b), 14(2)(b), 26(3)(c)). The Department therefore assumes a coordinating/regulatory oversight role in practice by receiving required notices and presumably exercising functions under the parent Act, even though the Regulations do not describe the Department’s subsequent action.

Who bears cost and compliance effort

The person carrying out the works is repeatedly the one who must meet the conditions (e.g. “the person who has a prescribed consent under subregulation (1) must ensure...” appears repeatedly, see regs 4(3)(a), 7(3)(a), 21(3)(a), 26(3)(a)). That clarifies the incidence of compliance costs: the actor entitled to the consent bears operational costs (labour, materials, remediation), administrative burdens (pre‑work notice where required, after‑the‑fact notification), and possible costs of obtaining third‑party approvals (local port manager, waterway manager, Director, Safe Transport Victoria per reg 27(3)).

Who the Regulations do not authorise

The Regulations do not entitle private members of the public generally to carry out works that fall outside the specified persons or the precise conditions , for example, a private beachgoer cannot install a temporary building for an event unless they are an authorised event organiser and have an authorisation under a local law or Crown Land (Reserves) regulation (reg 6(2)(a)). Commercial activity is expressly excluded in certain contexts (e.g. dead seagrass removal must not be for a commercial purpose, reg 28(1)(b)).

Indirectly affected stakeholders

Users of marine and coastal Crown land, such as recreational boat owners, businesses using port facilities and communities relying on public utilities, are indirectly affected by changes in maintenance practices, temporary closures and emergency interventions. The public also bears the de facto risk of variable standards, since “minimise any damage” and “does not unreasonably block” are qualitative tests with operational discretion residing in the named actors and the Department.

Rights conferred (what the named actor may do)

The Regulations confer a right to carry out a specified class of activity on marine and coastal Crown land without seeking an individual consent, provided the listed conditions are satisfied. Rights are activity‑ and actor‑specific: e.g., Crown land managers have a right to repair buildings (reg 4(1)-(2)), port managers to repair port facilities (reg 14(1)-(2)), waterway managers to maintain jetties and swing moorings (regs 15(2)(b), 18(2)(b)), researchers to install equipment for up to 12 months (reg 27(1)(b)-(2)(a)), and responder agencies to take emergency actions such as demolitions and temporary fencing (regs 5(2)(b), 8(2)(b)). The right is conditional and operationalised by compliance with the listed constraints (footprint, excavation, environmental minimisation, time limits).

Positive duties (recurring)

Leave the work area clean and tidy after completion: a near‑universal condition across repair, maintenance and installation consents (see regs 4(3)(a), 7(3)(a), 9(2)(a), 14(2)(a), 15(3)(a), 21(3)(a), 23(3)).
Provide written notice to the Department in several circumstances: generally at least 5 business days before works that require public closure (see regs 4(3)(b), 7(3)(b), 14(2)(b), 15(3)(b), 21(3)(b), 26(3)(c), 27(3)(f)); and “as soon as practicable” after completion of emergency or demolition works or installations where immediate risk authorised action was taken (regs 5(3), 10(2), 11(2)(d), 25(3), 13(3)).
Use durable materials for repairs and replacements where specified: e.g., buildings, fences, coastal protection structures, port facilities, jetties and signs (see regs 4(1)(e), 7(1)(f), 9(1)(f), 14(1)(e), 15(1)(e), 12(1)(f)).
Minimise damage to the marine and coastal environment, and avoid unreasonable obstruction of pathways and roads: repeating constraints across most activities (e.g., regs 4(1)(d), 7(1)(e), 9(1)(d), 14(1)(d), 15(1)(d)).
Specific technical obligations: backfill holes at completion of testing to natural ground level (reg 26(3)(b)); clearly mark swing moorings on the surface of the water (reg 18(3)); install temporary coastal protection within 30 days of identifying the risk and remove within 12 months unless permanent consent obtained (reg 11(2)(a)-(b)); and obtain written approvals from local port managers, waterway managers or Director, Safe Transport Victoria for equipment in certain locations (reg 27(3)(a)-(c)).

Reactive duties (notice and reporting)

For actions taken to address immediate risks (demolition, stabilisation, temporary signage, temporary fences, coastal protection), the Regulations commonly allow immediate action by the named actor but require an after‑the‑fact notification to the Department “as soon as practicable” (see regs 5(3), 8(3) does not include the “as soon as practicable” language but requires removal within 12 months, reg 10(2), 11(2)(d), 13(3)). The interplay of immediate action and after‑the‑fact reporting is a repeated administrative pattern.

Constraints that limit the right

Many activities are limited by the interplay of these Regulations with other statutory authorisations. For example, artificial opening of estuaries requires a Water Act licence or by‑law authorisation under s 67(1) or s 219 of the Water Act 1989 (reg 24(1)). Aids to navigation cannot be installed to create fish aggregating devices as defined by the Commonwealth Sea Installations Act 1987 (reg 17(1)(d)). The Regulations therefore do not replace or override other licensing systems; they operate in parallel and are expressed as conditional on compliance with other statutory regimes.

Record‑keeping and approval duties

The Regulations expressly require written approvals for some activities (equipment/camera installations) from local port managers, waterway managers or Director, Safe Transport Victoria (reg 27(3)(a)-(c)). The person relying on a prescribed consent must obtain and presumably retain those written approvals as evidence of compliance. The Regulations also require written notices to the Department in many circumstances (see earlier), and the party carrying out the activity is the obligated notifier.

Rights of third parties and public interest considerations

The text repeatedly conditions consents on not unreasonably blocking paths or roads and on minimising damage to public enjoyment (e.g. reg 27(1)(g) prohibits impact on the normal use and enjoyment of the land by the public). These clauses preserve third‑party interests as constraints on the exercise of rights by the named actors.

No penalties in the Regulations themselves

The Regulations set duties and conditions but do not specify penalties or enforcement mechanisms within their text. Enforcement and sanctions therefore must be located in the parent Act (Marine and Coastal Act 2018) or other statutes cited; the Regulations themselves are silent on fines or offences. Users must therefore consider enforcement provisions elsewhere when evaluating legal risk for non‑compliance.

What the Regulations say about penalties and enforcement

The Regulations do not set monetary penalties, specific offences or direct enforcement mechanisms within their own text. They set conditions and notice obligations but are silent as to the sanctions that follow from breach. This silence is dispositive within the instrument: no penal regime is stated here.

Where enforcement will come from (statutory context)

Because the Regulations are made under s 80 of the Marine and Coastal Act 2018 (reg 2), enforcement and penalty powers for breaches of the parent Act or associated directives are likely located in that Act or in the suite of cross‑referenced statutes (e.g. Aboriginal Heritage Act 2006, Fisheries Act 1995, Road Management Act 2004, Water Act 1989). The Regulations themselves set conditions that, if not met, will likely expose the actor to regulatory action under the parent legislation or the relevant complementary Act, but the text does not specify which enforcement provision attaches to each breach. Practitioners must therefore consult the Marine and Coastal Act 2018 and the other implicated Acts to identify applicable offences and enforcement processes.

Enforcement mechanisms implied by the Regulations

Administrative oversight by the Department is implied through repeated notice obligations: the Department receives 5 business days’ advance notice where works will close a work area to the public, and must be told “as soon as practicable” of emergency demolitions and other after‑the‑fact actions (see regs 4(3)(b), 5(3), 10(2), 11(2)(d), 13(3), 25(3)). Those notice obligations provide the Department the information needed to investigate compliance and to decide whether further action under the Marine and Coastal Act 2018 (or other Acts) is appropriate.

Coordination and local approvals as compliance checkpoints

Several provisions require written approvals from local port managers, waterway managers or the Director, Safe Transport Victoria (reg 27(3)(a)-(c)). Failure to obtain these approvals risks a loss of the protective path that the prescribed consent would otherwise provide. Those pre‑work approval steps operate as gatekeeper controls that a regulator or third party may call into question during enforcement.

Enforcement in emergency contexts

The Regulations allow immediate action in many emergency or immediate‑risk contexts (regs 5, 8, 10, 11, 25) but require after‑the‑fact notice. This pattern trades off prior approval for speed, and creates an enforcement post‑action reporting trigger. The existence of the after‑the‑fact reporting obligation gives the Department factual bases to review whether the immediate intervention complied with the conditions (for example, whether demolition was genuinely necessary to “minimise an immediate risk to public health or safety or the marine and coastal environment” in reg 5(1)(a)).

Potential compliance risks for operators

Because the Regulations use qualitative standards (“minimises any damage”, “does not unreasonably block”), enforcement will likely involve fact‑specific inquiries. Operators risk enforcement exposure if they act beyond the clearly specified technical constraints (e.g. by excavating outside the associated work area, failing to remove a temporary structure within the time limit, or harming an Aboriginal place). The Regulations’ silence on penalties means enforcement outcomes, including remedial directions, injunctions, fines or other sanctions, will depend on the substantive and procedural provisions of the parent or related legislation.

Implications for insurers and contractors

Contractors and insurers engaged by the specified persons should be aware that compliance with the Regulations is necessary but may not be sufficient if other statutory authorisations are required (for example, fisheries licences, Water Act licences, or approvals under the Aboriginal Heritage Act 2006). Where such cross‑authorisations are needed but not obtained, enforcement action could be pursued under the other statute rather than under these Regulations.

Extensive cross‑referencing and imported definitions

The Regulations expressly import meanings from a large set of Victorian and Commonwealth Acts: Aboriginal Heritage Act 2006, Fisheries Act 1995, Land Act 1958, Crown Land (Reserves) Act 1978, Marine Safety Act 2010, Port Management Act 1995, Road Management Act 2004, Rail Management Act 1996, Water Act 1989, Pipelines Act 2005, Offshore Petroleum and Greenhouse Gas Storage Act 2010, Traditional Owner Settlement Act 2010, Wildlife Act 1975, National Parks Act 1975 and others (see reg 3 definitions). These imports mean the scope of a prescribed consent is framed by the parallel rules in those Acts.

Heritage and native vegetation controls

Multiple consents are expressly conditioned on not harming an Aboriginal place or an Aboriginal object and, in several instances, on not removing or damaging native vegetation (regs 21(1)(a)-(b), 26(1)(a)-(b), 6(1)(b)). Reg 26(1)(d) specifically cross‑references the Aboriginal Heritage Regulations 2018 for the definition of “significant ground disturbance”. Where the Aboriginal Heritage Act and its Regulations apply, prescribed consents are explicitly subject to those obligations and likely require compliance checks with respect to cultural heritage.

Fisheries, aquaculture and marine installations

Aids to navigation, installation near aquaculture sites and marking of fisheries reserves are all cross‑linked to the Fisheries Act 1995 (reg 17(1)(a)(ii)-(iii)). The Regulations do not replace fisheries licences; rather they operate in combination: e.g., an aquaculture site is defined in terms of activities conducted under a Fisheries Act licence (reg 3). Installations that affect fish habitat or require fisheries licensing remain subject to the Fisheries Act permissions.

Water Act and estuary management

Artificial opening of estuaries is permitted only for persons authorised under a Water Act licence or by‑laws (reg 24(1)), so estuary management remains governed by the Water Act even where the prescribed consent applies. The Regulation places only a reporting condition back to the Department (reg 24(2)).

Roads, pathways and road reserves

Reg 19 incorporates the Road Management Act 2004 by importing the meaning of “pathway” and “road” and excludes regulated consent for road reserves wider than 20 metres (reg 19(4)). Works on substantial road reserves will therefore follow the Road Management Act processes rather than relying on these Regulations.

Pipelines, petroleum and offshore pipeline regimes

The definition of “pipeline” imports meanings from the Pipelines Act 2005 and the Offshore Petroleum and Greenhouse Gas Storage Act 2010 (reg 3). Works affecting pipelines will therefore be influenced by those statutory licensing regimes and safety obligations.

Port and marine safety frameworks

The Regulations frequently involve port managers and waterway managers and reference Port Management Act 1995, Marine Safety Act 2010 and Port Management (Local Ports) Regulations 2025 (for example reg 17(1)(a)(D) referencing mooring areas). That situates these consents within the existing port and marine safety regulatory apparatus. Equipment in local ports and managed waterways requires written permission from the relevant port or waterway manager (reg 27(3)(a)-(b)), and water‑based equipment outside managed waterways requires the Director, Safe Transport Victoria approval (reg 27(3)(c)).

Interaction with Traditional Owner Settlement processes

The Regulations make activities carried out under a traditional owner group agreement into a prescribed consent where they are “agreed activities” under the Traditional Owner Settlement Act 2010 and are carried out in accordance with that agreement and on land to which it applies (reg 29). This creates a direct statutory pathway for Traditional Owner group agreements to operate as prescribed consents for their agreed activities on marine and coastal Crown land.

Overlap and potential need for multiple approvals

Because many activities are the subject of multiple statutes (heritage, fisheries, water, pipeline safety, port safety), a person relying on a prescribed consent must check whether another statutory approval or licence is required despite the operation of the prescribed consent. The Regulations themselves often point to that possibility (e.g., reg 24 requiring a Water Act licence, reg 17 excluding fish aggregating devices under Commonwealth law). Where parallel regulatory requirements exist, compliance must meet all applicable statutory regimes.

No replacement of higher‑order licensing

The Regulations do not state that their prescribed consents displace higher‑order licences or approvals. The repeated cross‑references and express conditions (no damage to native vegetation, no harm to Aboriginal places, compliance with Water Act licences, etc.) show the intended interaction is complementary: these consents are facilitations for routine and emergency tasks, not a substitute for other statutory permissions.

Version, commencement and sunset

The Regulations are Version No. 001, made on 22 July 2025 and came into operation on the same date (Endnotes, para 1). They will sunset 10 years from the day of making, on 22 July 2035, pursuant to the Subordinate Legislation Act 1994 (Endnotes, para 1).

Table of Amendments and lack of subsequent changes

The Endnotes include a “Table of Amendments” section which, in this instrument, records that there are no amendments made to these Regulations by statutory rules, subordinate instruments or Acts (Endnotes, para 2). In the Explanatory details (Endnotes, para 3), two small historical cross‑references are noted (Reg 18(1)(a)(i): S.R. No. 36/2023; Reg 26(1)(d): S.R. No. 59/2018) which appear to be references to earlier subordinate rules that inform meanings in those sections; these are explanatory notes, not amendments to the present Regulations.

Practical consequence of versioning and sunset

Because the Regulation will sunset in 2035, stakeholders should factor the limited temporal scope into their compliance planning and into longer‑term asset management decisions. If activities or approvals will need to persist beyond the sunset date, operators should track whether the Department or Government will re‑enact a similar instrument or whether the Marine and Coastal Act 2018 processes will be relied upon after expiry.

No prior versions or amending instruments recorded

The instrument is presented as the original statutory rule (S.R. No. 70/2025) with a single version noted. The absence of recorded amendments means that the text as published is the authoritative baseline; any change will require a formal amendment instrument (statutory rule) recorded in the usual way.

Explanatory details and endnote references

The Explanatory details in the Endnotes (para 3) identify two specific cross‑references and statutory rule numbers for narrow interpretive footnotes but do not record any substantive change history. Practitioners should rely on the printed text for current compliance obligations and monitor the Victorian legislation website referenced in Endnotes (para 1) for any amending instruments.

No litigation recorded in the instrument

The Regulations themselves include no references to decisions, cases or litigation. The Endnotes’ Table of Amendments shows no amending instruments and contains no litigation annotations. The text names no judicial authorities.

Implication for practitioners

Because there is no litigation history recorded in the instrument, there is no settled judicial construction of its qualitative standards (for example, the meaning of “minimise any damage” or “does not unreasonably block a pathway or a road”). That absence creates legal uncertainty about enforcement thresholds and evidentiary burdens, which would normally be filled by administrative guidance, Departmental practice, or later judicial review.

Where legal disputes are likely to arise

Predictable areas for dispute, based on the text, include:
- Whether a work remained “within the existing footprint” or involved excavation beyond associated land (regs 4(1)(a),(c); 15(1)(a),(c)).
- What measures satisfy “minimises any damage to the marine and coastal environment” (recurring across regs).
- Whether an emergency demolition/stabilisation genuinely addressed an “immediate risk” (regs 5(1)(a), 10(1)(a)).
- Whether temporary installations were removed within the prescribed timeframes (regs 6(2)(c), 8(3)(b), 11(2)(b), 30(1)(b)).
- Compliance with Aboriginal heritage obligations under the Aboriginal Heritage Act 2006 and Aboriginal Heritage Regulations 2018 where the Regulations cross‑refer to those regimes (reg 26(1)(d), regs 21(1)(b), 26(1)(b)).

No cases named

The Regulations do not mention any cases, and the Explanatory details do not cite judicial authorities. If disputes occur, they will be decided under the enforcement and review routes of the Marine and Coastal Act 2018 and/or the other implicated statutes.

Practical consequence

In the absence of precedent, parties should document decision‑making and compliance steps thoroughly (approvals, notices to the Department, records showing footprint limits and environmental minimisation measures) because that documentation will be the evidentiary basis for administrative review or litigation if a dispute arises.

Who is actually authorised: narrow, person‑specific rights

The Regulations are not general permits for the public. A common misread would be to assume any user of the beach may carry out the listed activities; instead, only the persons specifically named in each regulation can rely on the prescribed consent (see, for example, regs 4(2), 7(2), 15(2), 27(2)). If an actor is not listed, they do not receive the benefit of the prescribed consent and must seek permission under other statutory processes.

Footprint and excavation constraints are strict but factual

Multiple consents allow only maintenance “within the existing footprint” and forbid excavation beyond that “associated with the repair or maintenance” (see regs 4(1)(a),(c), 15(1)(a),(c), 9(1)(c)). Practitioners should note that small expansions, regrading or underpinning often involve excavation that can take the work outside the prescribed consent. The text does not define “existing footprint” by measurement; assessment will be factual and factually risky.

Qualitative standards with little definition

Terms such as “minimises any damage to the marine and coastal environment” and “does not unreasonably block a pathway or a road” are used throughout without a defined metric. Those qualitative standards invite regulatory scrutiny and dispute. Operators should prepare records showing how environmental impacts were assessed and minimised.

Time limits and removal obligations are precise

Temporary works have concrete deadlines. Examples: event buildings limited to events up to 48 hours and removed within 24 hours after the event (reg 6); temporary fences removed within 12 months (reg 8(3)(b)); temporary coastal protection removed within 12 months unless a permanent consent is obtained (reg 11(2)(b)). Failure to remove on time may mean the work no longer fits the prescribed consent and could expose the actor to enforcement under the parent or other Acts.

Emergency actions permitted but must be reported

The Regulations permit immediate action in response to immediate risk (e.g. regs 5, 10, 11) and allow responder agencies and Crown land managers to act quickly. However, these actions trigger “as soon as practicable” reporting obligations (regs 5(3), 10(2), 11(2)(d)). Operators should plan for post‑action compliance reporting and keep contemporaneous records justifying the emergency response.

Third‑party approvals are mandatory and location‑sensitive

Equipment installations in ports or managed waterways require written approval from local port managers or waterway managers; outside managed waterways, approval from the Director, Safe Transport Victoria is required (reg 27(3)(a)-(c)). Lack of these approvals risks invalidating the reliance on the prescribed consent. These approvals are separate from the prescribed consent and must be obtained where required.

Heritage and native vegetation obligations may trigger other statutory processes

Several consents are qualified: do not remove or damage native vegetation; do not harm Aboriginal places or objects (e.g. regs 6(1)(b), 21(1)(a)-(b), 26(1)(b)). Where works are likely to engage Aboriginal heritage or permit significant ground disturbance, the Aboriginal Heritage Act 2006 and the Aboriginal Heritage Regulations 2018 will be relevant (reg 26(1)(d)). Operators should not assume the prescribed consent removes the need to consult or to secure approvals under heritage law.

Testing methods and backfilling obligations are specific

Testing (reg 26) permits certain drilling methods only and imposes a concrete backfilling obligation at completion (reg 26(3)(b)): holes must be backfilled to natural ground level with remaining material or with nearby comparable materials. Failure to comply creates an obvious remediation cost and potential enforcement exposure.

Overlap with other licences and operational duplication

The Regulations do not remove the need for other licences (e.g., Water Act licences for estuary openings (reg 24), Fisheries Act licences for aquaculture activities (reg 3 definitions, reg 17(1)(a)(ii))). Practitioners must check all relevant statutes to avoid operating under a mistaken single‑licence assumption.

Ambiguity over “clean and tidy” and “unreasonably block”

Phrases such as “left in a clean and tidy condition” and “does not unreasonably block a pathway or a road” are used as prescriptive requirements (for example regs 4(3)(a), 7(3)(a), 23(3)). These terms are operationally ambiguous and can be contested in enforcement contexts. Photographic records, works plans and traffic or access management plans are prudent mitigation.

No penalties specified here , enforcement will be elsewhere

The Regulations set duties but not penalties; consequences for non‑compliance depend on the parent Act and other applicable legislation. That creates practical uncertainty about sanctions. Parties should review the Marine and Coastal Act 2018 and other statutes to map enforcement risk.

Administrative timing traps

Several notifications require at least 5 business days’ notice to the Department where public closure is needed (see numerous regs). For planned works, failing to allow that lead time may breach the conditions and remove the benefit of the prescribed consent. Emergency exceptions exist but are narrow.

Traditional owner agreements are included but limited

Activities carried out under a traditional owner group agreement are prescribed consents only if they are agreed activities within the agreement and done in accordance with it and on land to which the agreement applies (reg 29). Practitioners should confirm the precise geographic and activity scope of each traditional owner group agreement before relying on this pathway.

Checklist approach (pre‑work)

Confirm you are a specified person for the activity: check the relevant regulation’s list of authorised persons (e.g. regs 4(2), 7(2), 14(2), 15(2), 18(2), 21(2), 27(2)). If your entity is not named, do not rely on the prescribed consent.
Confirm activity fits technical limits: is the work within the existing footprint? Will it involve excavation beyond associated works? Does it increase size or number of structures? Consult the precise subregulation for your activity (for example, reg 4(1)(a)-(c) for building repairs; reg 15(1)(a)-(c) for jetties).
Check for other statutory licences required: review Fisheries Act licences for aquaculture interactions (reg 3 definitions), Water Act licences for estuary openings (reg 24), Aboriginal Heritage Act obligations where heritage might be affected (reg 26(1)(d)), pipeline licensing and safety statutes (reg 3 “pipeline”). Do not assume the prescribed consent replaces those licences.
Environmental and vegetation constraints: ensure no removal or damage to native vegetation where prohibited (regs 6(1)(b), 21(1)(a)), and plan to “minimise any damage to the marine and coastal environment” with documented mitigation measures.
Heritage checks: conduct Aboriginal heritage due diligence where there is potential ground disturbance; if significant ground disturbance is possible, refer to the Aboriginal Heritage Regulations 2018 as required by reg 26(1)(d).

Operational steps during works 6. Use durable materials where required (see regs 4(1)(e), 7(1)(f), 9(1)(f)). Specify materials in procurement and contract documents. 7. Maintain footprint and excavation limits. Mark the authorised footprint on site plans and communicate to contractors. 8. Manage public access: design traffic and pedestrian management to avoid “unreasonably block[ing]” pathways; where closure is necessary, observe the advance notice requirement below.

Notice, approvals and recordkeeping 9. Advance notice to the Department: where works require the work area to be closed to the public, provide written notice to the Department at least 5 business days before works commence (common across regs, e.g. regs 4(3)(b), 7(3)(b), 15(3)(b), 21(3)(b), 26(3)(c), 27(3)(f)). Keep copies of sent notices and any Departmental responses. 10. Obtain required third‑party written approvals: for equipment/camera works in local ports or managed waterways, secure written approval from the local port manager or waterway manager; for water‑based equipment outside managed waterways, obtain written approval from the Director, Safe Transport Victoria (reg 27(3)(a)-(c)). Retain the approvals as documentary evidence. 11. Emergency actions: if acting under an immediate‑risk pathway (e.g. demolition, stabilisation, temporary coastal protection), record the factual basis for the emergency decision contemporaneously and notify the Department “as soon as practicable” after completion (regs 5(3), 10(2), 11(2)(d)). Document the decision process and the steps taken to minimise environmental harm.

Completion and remediation 12. Leave the work area clean and tidy: ensure contractual and operational arrangements provide for site remediation on completion (recurrent condition, e.g. reg 4(3)(a), 7(3)(a), 14(2)(a)). 13. Backfilling and restoration for testing: on completion of testing, backfill holes to natural ground level with remaining material or with nearby comparable materials (reg 26(3)(b)). Keep records showing the method and materials used. 14. Time limits for temporary works: track deadlines for removal: event buildings (remove within 24 hours of event end, reg 6(2)(c)); temporary equipment for research capped at 12 months (reg 27(1)(b)); temporary fences and temporary coastal protection must be removed within 12 months unless permanent consent obtained (regs 8(3)(b), 11(2)(b)). Maintain a removal schedule and issue removal notices to the Department where required.

Documentation and evidence 15. Maintain a compliance file: keep the site plan showing footprint, permits and approvals, pre‑work notices to the Department, written approvals from port or waterway managers or Director where needed, photographs before and after works, materials invoices showing use of durable materials, environmental mitigation plans, and heritage due‑diligence records. 16. Record communications: retain copies of all written notices and any Departmental correspondence related to the works. For emergency actions, contemporaneous logs and photographic evidence will be critical to demonstrate necessity and compliance with “minimise damage” obligations.

Contract drafting and procurement 17. Flow obligations to contractors: include specific clauses requiring contractors to follow the footprint, excavation, environmental and heritage rules, to obtain required third‑party approvals, to give the entity notice before any work that would close the work area, and to perform site remediation to the “clean and tidy” standard. 18. Insurance and indemnities: given the lack of penalty specification in the Regulations themselves and the potential for cross‑statute enforcement, ensure contracts require contractors to carry adequate public liability and environmental impairment insurance and to indemnify for breaches of statutory conditions.

Monitoring and maintenance 19. Ongoing monitoring: for equipment and temporary installations, implement inspection routines to ensure the site does not become a hazard or continue beyond permitted timeframes (especially for temporary coastal protection, temporary fences, and beach matting). 20. Coordination with Traditional Owner groups: where activities are in an area covered by a traditional owner group agreement, confirm that the activity is an “agreed activity” under that agreement (reg 29) and document conformity with the agreement’s terms.

Legal review and regulatory mapping 21. Cross‑check all applicable statutes: before relying on a prescribed consent, run a statutory map to identify whether other approvals are required (Aboriginal Heritage Act 2006; Fisheries Act 1995; Water Act 1989; Pipelines Act 2005; Marine Safety Act 2010; Port Management Act 1995). Do not assume the prescribed consent is exhaustive. 22. Seek Departmental clarification for borderline cases: where footprint, excavation, or “minimise damage” thresholds are factually uncertain, engage the Department in advance and obtain written guidance or approvals to reduce risk of after‑the‑fact enforcement.

By following the procedural checklist above and documenting compliance, the specified persons reduce the legal risk of relying on a prescribed consent under the Regulations, and provide the Department and other stakeholders with the records needed to demonstrate adherence to the instrument’s conditions.
