### 37 Witnesses > > (1)  [*\[Section 37 Subsection (1) amended by No. 6 of 2003, s. 41, Applied:01 Jul 2003\]*](/view/html/inforce/2003-07-01/act-2003-006#GS41@EN) A person served, as prescribed by the rules of court, with a summons to appear as a witness at a hearing must not, without reasonable excuse– > > > > > > (a) fail to attend as required by the summons; or > > > > > > > (b) fail to attend from day to day unless excused or released from further attendance by the magistrate; or > > > > > > > (c) refuse or fail to produce a document that the person was required to produce by the summons. > > > (2)  A person who contravenes [subsection (1)](#GS37@Gs1@EN) is guilty of an offence and is liable on summary conviction to a fine not exceeding 10 penalty units.
