Machinery Regulation 1950

The regulation’s operating concepts are inspection and enforcement, occupier responsibility, prescribed technical standards, reporting and notification, exclusion and exemption, and appeal. Each concept has a distinct legal mechanism in the text.

Inspection and enforcement: Inspectors receive certificates of appointment from the Minister and may inspect machinery on premises at any reasonable time, including at night if machinery is operating (ss 7-8). Inspectors may require assistance and explanations from persons on the premises and may direct remedial measures in writing where machinery is dangerous (ss 9, 17). The occupier must facilitate entry and inspection (s 10). Where an inspector serves a written notice about defective or dangerous machinery, the occupier must comply and must not use the machinery until the inspector is satisfied (s 17(2)-(4)). The circular saw-specific provision allows an inspector to require immediate rendering of the saw incapable of use if it is dangerous (s 16(18)).

Occupier responsibility: Occupiers are central legal actors. The definition of occupier is broad and includes any person in apparent possession or having general management of machinery (dict). Occupiers must register ownership and details of machinery with the chief inspector within one month of taking occupation or the regulation’s commencement (s 12). Occupiers have a positively framed duty to securely fence dangerous parts of machinery and maintain fencing in good order; that duty is declared absolute and unqualified by other provisions (s 13(1),(3)-(4)). Occupiers are responsible for provision of loose pulleys, belt shifters, staging, ladders and belt hangers when required by an inspector (s 15). They are obliged to implement and enforce age restrictions and supervision requirements for minors around machinery (s 15(6)-(7), (20)). They must provide masks, gauntlets and guards in bottling operations (s 15(8)-(9)).

Technical standards and equipment: The regulation requires machinery and associated equipment to be “suitable, safe and adequately strong” and to be erected on adequate foundations with safe surrounding space (s 16(2)-(3)). Circular saws must carry a maker’s name and maximum safe working speed and must have speed control devices and stopping/starting appliances to prevent inadvertent starts (s 16(5)-(6), (12)). Noise obligations expressly incorporate Australian Standards for the calculation of daily noise dose and A‑weighted sound pressure levels and require measurement with specified types of instruments (s 22B(4)-(5)). Ear protection devices are defined by reference to Australian Standard 1270 (s 22A).

Reporting and notification: The regulation creates prompt reporting obligations. Accidents causing death or injury that is likely to incapacitate for more than 48 hours must be reported to the chief inspector within 24 hours, with specific particulars (s 19). Structural damage to machinery requiring structural repairs must also be notified within 24 hours (s 20). The duty to report unsafe conditions discovered in the course of work is placed on persons required to perform duties at or about machinery (s 21).

Exclusion and exemption: Section 5 lists machinery outside the regulation’s reach. Section 6 gives the Minister a discretional exemption power (in writing) where a regulation cannot reasonably be applied to particular machinery or a class of machinery; the instrument is notifiable (s 6(1)-(3)).

Appeal and adjudication: An occupier may appeal to the Magistrates Court against notices under the circular saw section or the defective machinery section within 21 days of service (s 18). The Magistrates Court may confirm, set aside or vary notices and make “any other order it considers just” (s 18(2)). The regulation also freezes use of the machinery until compliance or the appeal’s determination (s 18(3)).

Penalties and standards: Specific maximum penalties are set in the regulation for individual breaches (for example, s 13(4) 10 penalty units; s 14 5 penalty units; s 16 maximum 5 penalty units; s 22C 2 penalty units). The republication records the penalty‑unit monetary values at the republication date: $160 for an individual and $810 for a corporation (prefatory note). The regulation also states that it does not relieve a person from any civil or criminal liability that would exist without the regulation (s 23).

Definitions: The dictionary supplies operative meanings for engine, machinery, mechanical power, mill-gearing, occupier and premises, among others. The word “machinery” is defined to include engines, motors, shafting, belts, gearing and related appliances but expressly excludes machinery subject to inspection under certain other regulations (dict).

Taken together, the regulation combines prescriptive technical directions with discretionary inspection and remediation powers, supported by time-critical reporting and detailed obligations for occupiers, while deferring to Australian Standards for measurement in the noise regime.

Primary duty-bearers are occupiers of premises where machinery, excluding specified classes, is kept, worked or intended to be used (s 5; dict). The term occupier is broad. It covers the person in possession or apparent possession, agents, managers, supervisors and those apparently acting in general management or control of the premises or the machinery (dict). Consequently, businesses that own, control or manage workshops, factories, mills, bottling plants, timber yards, shipyards (non-self-propelled vessels) and farms with powered equipment will typically be affected.

Secondary actors include:

• Employees and other persons working at or about machinery: they are required to report unsafe machinery discovered in their duties (s 21) and to comply with instructions to wear ear protection devices when provided (s 22C).
• Persons under the age thresholds identified: the regulation restricts work by persons under 15 (no employment in working or assisting to work machinery) and under 18 (no cleaning machinery in motion) and sets supervision rules for under 18s near mill gearing and engines (s 15(6), (7), (20)).
• Inspectors appointed by the Minister: they are empowered to enter premises, demand assistance and issue notices (ss 7-9, 17).
• Makers and suppliers of equipment: where specifications must be legibly impressed on saws (maker’s name, maximum safe speed) and where equipment must comply with Australian Standards for ear protection and measurement instruments (s 16(5); ss 22A, 22B(4)-(5)).

Who pays: the occupier bears primary compliance costs. The regulation requires engineering works (fencing, guarding, staging, platforms, ladders), equipment (belt shifters, governors, speed controls), safety devices (masks, gauntlets, guards in bottling operations), maintenance (keeping saws in good condition, sharp teeth, balanced mounting), ongoing monitoring (noise measurement using specified instruments), administrative costs (the one‑month notice of ownership to the chief inspector under s 12, record keeping and training), and potential downtime for remedial works required by inspector notices (s 17). Penalties are financial (penalty units), and non‑compliance can include enforced cessation of machinery use (ss 16(18), 17(4)).

Who decides: Inspectors exercise operational judgment on safety, approval of contrivances and the imposition of remedial directions (ss 9, 15(3), 15(4), 15(15)-(17), 17). The Minister decides on ministerial exemptions (s 6), and the Magistrates Court adjudicates appeals against inspector notices (s 18). The definitions and references to Australian Standards tie certain technical determinations to those documents, but the regulation permits inspector approval where the text contemplates alternatives (“approved by the inspector”) (see e.g. s 15(3), 15(4), 15(16)-(17)).

Other affected entities: those supplying or certifying noise measurement instruments and ear protection devices to the ACT market will be affected indirectly because the regulation prescribes instrument types and standards for measurement (s 22B(4)-(5)) and defines ear protection devices by reference to Australian Standard 1270 (s 22A). Employers who contract out maintenance or operations retain legal obligations as occupiers if they fall within the definition (dict).

Who benefits: persons employed at premises with machines gain prescriptive protections, fencing, restrictions on hazardous exposures, limits on minors performing dangerous tasks, noise protections and reporting channels. Chief inspectors and inspection regimes gain statutory teeth to require remedial work and to prohibit further use until risk is mitigated (ss 17-18).

Potentially concentrated costs: operators of high‑noise, heavy engineering or timber industries are likely to bear concentrated compliance costs given detailed circular saw rules (s 16) and noise measurement and control obligations (pt 4).

Key duties rest primarily on occupiers. The regulation sets out duties that are either mandatory, conditional on an inspector’s direction, or absolute.

Mandatory and absolute duties

• Fencing of dangerous parts: occupiers must securely fence all dangerous parts of machinery on their premises and maintain the fencing in an efficient state; this duty is declared absolute and unqualified by other provisions (s 13(1), (3)-(4)). Maximum penalty applies (s 13(4)).
• Notification of ownership: within 1 month of commencement or becoming occupier, the occupier must send a written notice to the chief inspector stating owner name, maker’s name, identification marks, location, kind of machinery, motive power measure and business purpose (s 12). Maximum penalty: 1 penalty unit.
• Reporting accidents: occupiers must notify the chief inspector within 24 hours of fatal or seriously incapacitating accidents caused by or involving machinery, providing particulars including names of victims and probable damage to machinery (s 19). Maximum penalty: 10 penalty units.
• Reporting structural accidents: if an accident to machinery necessitates structural alteration or repairs, occupiers must notify the chief inspector within 24 hours with particulars, cause and probable repairs (s 20). Maximum penalty: 5 penalty units.
• Removal of safety devices: a person must not render inoperative any safety device governing engine speed or used with any machinery (s 22). Maximum penalty: 10 penalty units.

Conditional duties (inspector‑directed)

• Provision of loose pulleys, belt shifters, governors, platforms, ladders, belt hangers and fencing of specific parts may be required where mechanical power is used, but the requirement can only be imposed by an inspector and is subject to the inspector’s assessment (s 15(2)-(4), (15)-(17)).
• In some cases the inspector must not require particular devices (for example, loose pulleys for starting an engine if it has self-starting apparatus or where a clutch connects the load) (s 15(2)).
• Where an inspector directs, occupiers must maintain traffic ways at specified minimum widths and keep passageways clear (s 15(18)-(19)).

Worker duties

• Persons required to perform duties at or about machinery must use ordinary and reasonable precautions to ascertain machinery is safe and immediately report anything likely to cause injury to their manager or person in authority (s 21).
• Workers provided with ear protection devices must comply with instructions on wearing those devices while machinery is in use (s 22C). A defence exists if a medical certificate states the wearer should not use ear protection (s 22D).

Inspector rights and powers

• Inspectors must be issued a certificate of appointment and must produce it if required (s 7).
• Inspectors may enter premises and inspect machinery, including at night while machinery operates (s 8).
• Inspectors may require assistance, explanations and answers about compliance (s 9).
• Inspectors may serve written notices to occupiers where machinery is defective or ventilation is deficient; these notices may require repairs or alterations within a stated time (s 17).
• Inspectors can require immediate rendering of a dangerous circular saw incapable of use (s 16(18)).

Right of appeal and procedural protections

• An occupier dissatisfied with notices under the defective machinery or circular saw provisions may appeal to the Magistrates Court within 21 days of service; the Court may confirm, vary, set aside notices or make other orders it considers just (s 18). Use of the machinery is prohibited until compliance or resolution of the appeal (s 18(3)).

Rights preserved outside the regulation

• The regulation explicitly preserves other civil and criminal liabilities; it does not operate to relieve a person of liabilities that would exist absent the regulation (s 23). This means statutory duties under other laws and common law duties (for example, negligence) remain in force alongside the regulation.

Procedural and technical requirements

• Noise obligations are measured by reference to Australian Standards and require use of specified instruments, daily noise dose per Australian Standard 1269‑1983 and sound level per Australian Standard 1259‑1982 using instruments mentioned in Australian Standard 2399‑1980 (s 22B(4)-(5)). The regulation provides a defence where ear protection is provided, instruction given and wearing instructed, subject to additional precautions where ear protection itself impairs safety (s 22B(2)-(3)).

Penalties

• The regulation sets maxima in penalty units for breaches throughout the text (for example, s 13(4) 10 penalty units; s 14 5 penalty units; s 16 max 5 penalty units; s 22C 2 penalty units). The republication states the monetary value of a penalty unit at that date (prefatory note).

These duties form a mix of prescriptive, performance and inspector-directed obligations. Inspectors have substantial operational discretion in determining when and how prescribed rectification measures should be applied (see ss 15, 17). The regulation attaches criminal penalties to breaches and provides time-critical reporting and notification duties that create compliance and record-keeping obligations for occupiers.

The regulation uses a combined enforcement architecture of inspection, written notices, prohibitions on use of machinery, criminal penalties (penalty units) and a statutory right of appeal to the Magistrates Court. Enforcement mechanisms are deployed across safety, reporting, noise and employment provisions:

Inspection and notices: Inspectors are empowered to enter premises, inspect machinery and appliances, require assistance and explanations about compliance, and serve written notices requiring repairs or alterations where machinery or ventilation is considered dangerous (ss 7-9, 17). Notices can include timeframes for remedial works (s 17(1)-(2)). While inspectors possess broad powers, the regulation places responsibility on occupiers to comply with notices and to cease use of machinery until an inspector is satisfied (s 17(3)-(4)).

Immediate prohibition powers: In relation to circular saws, an inspector who considers a saw is dangerously defective may give notice requiring the saw to be immediately rendered incapable of further use as a circular saw (s 16(18)). Under s 18(3), until the appeal is decided, the circular saw, machinery or engine must not be used unless the notice’s requirements have been complied with.

Criminal penalties and pecuniary fines: The regulation lists maximum penalties in penalty units for contraventions. Examples include:

• Fencing dangerous machinery: maximum 10 penalty units (s 13(4)).
• Refusal to comply with an inspector’s requirement to assist or explain: maximum 10 penalty units (s 9(2)).
• Traversing carriage clearance breach (s 14): maximum 5 penalty units.
• Various safety contraventions (provision of pulleys, belt shifters, platforms, ladders, belt hangers, guarding, prohibited employment of minors, emery wheel speed restrictions, insulating steam pipes, proper pots for molten metal, catches for revolving appliances, maintaining traffic ways and passageways): typically maximum 10 penalty units across s 15 subsections.
• Circular saw failure to comply with the section’s requirements: maximum 5 penalty units (s 16).
• Failure to comply with a notice regarding defective machinery or ventilation: maximum 10 penalty units and prohibition on using machinery subject to notice (s 17(3)-(4)).
• Failure to notify accidents (s 19) maximum 10 penalty units; failure to notify structural repairs (s 20) maximum 5 penalty units.
• Removal of safety devices: maximum 10 penalty units (s 22).
• Duty to wear ear protection devices: maximum 2 penalty units (s 22C).

Monetary value of penalty units: The republished law records the value of a penalty unit at the republication date: $160 for an individual and $810 for a corporation (prefatory material). This is the monetary yardstick applied to penalty‑unit maxima unless and until the values are changed by statute. Practitioners must check the current value at the time of enforcement.

Enforcement process and judicial review: Occupiers may appeal notices to the Magistrates Court within 21 days of the notice (s 18). The court can confirm, vary or set aside the notice and make other just orders (s 18(2)); however, the regulation suspends permitted use of the machinery until compliance or appeal outcome (s 18(3)), creating both immediate operational impacts and a pathway for judicial review of inspector decisions.

Administrative instruments and transparency: The Minister’s exemptions under s 6 are notified instruments (s 6(3)), meaning prospective exemptions will be publicly recorded. Inspectors must carry and produce certificates of appointment and must serve notices in writing when exercising the remedial notice power (s 7; s 17 note on document service referencing Legislation Act pt 19.5).

Overlap with other liabilities: Section 23 is explicit: the regulation does not relieve persons from any civil or criminal liability they would face if the regulation had not been made. Enforcement under this regulation does not displace obligations under other statutes or common law duties, which means civil claims and other criminal exposures remain possible despite regulatory compliance or enforcement action.

Enforcement discretion and operational realities: Inspectors have significant discretion to approve contrivances (“other safe mechanical contrivance approved by the inspector” s 15(3); “approved by the inspector” s 15(4), (15), (16), (17)). That discretion allows adaptive remedies but also concentrates decision‑making power in inspectors, which raises practical questions for occupiers about predictability, documentation of approvals and administrative appeals.

Record‑keeping and evidentiary aspects: The regulation’s defence for noise obligations (s 22B(2)) requires the occupier to prove that ear protection devices were provided, instruction given in their correct use, and instructions to wear them. Similarly, the medical‑certificate defence for non‑wearers is personal to the worker and must be a written certificate from a doctor (s 22D). Both defences set an evidentiary burden on defendants in prosecutions and incentivise keeping training records, issue logs and medical certificates.

Overall, enforcement combines criminal penalties, remedial notice powers and civil preservation, with a route for adjudication in the Magistrates Court and ministerial exemption instruments that must be notified. The monetary consequences should be calculated by applying the then-current penalty‑unit value to the unit maxima listed in each provision.

The regulation is expressly subordinate to and made under the Machinery Act 1949. The dictionary instructs that terms used in the regulation have the same meaning as in the Machinery Act 1949 unless the regulation provides otherwise (dict; s 2 note). The regulation also cross‑references and excludes certain machinery from its operation when those machines are subject to inspection under other regulations or Acts.

Key statutory cross‑links and exclusions:

• Machinery Act 1949: The regulation is made under that Act and relies on definitions (for example, chief inspector, inspector) contained in the Act. The regulation’s enforcement and inspector powers are an implementation of the parent Act’s framework (preamble and dict note).
• Scaffolding and Lifts Act 1912: The definition of “machinery” excludes machinery that is subject to inspection under that Act (dict). This preserves separate regulatory regimes and inspection responsibilities for lifts and scaffolding.
• Regulations concerning boilers or engine‑drivers: Machinery subject to inspection under regulations made under the Act for boilers or engine‑drivers is excluded from the definition of machinery in this regulation (dict).
• Legislation Act 2001: The republication repeatedly cites the Legislation Act for drafting and operational matters such as the dictionary’s application across the regulation (s 2 notes), service of documents procedures (s 17 note referencing Legislation Act, pt 19.5), and the penalty‑unit value mechanism (prefatory note). The Legislative Act also governs notifiable instruments, editorial changes and republication procedures (prefatory material).
• Magistrates Court Act/Ordinance: The appeal route under s 18 is to the Magistrates Court. The legislation history notes amendments related to the Magistrates Court Ordinance 1985 (Ord1985‑67), indicating that the appeal process interacts with the relevant court procedural law (endnote 3).
• Australian Standards: The noise regime incorporates specific Australian Standards by reference for measurement and for ear protection devices (ss 22A, 22B(4)-(6)). Practically, compliance and defence depend on adherence to the versions of those Standards in force when the subsections took effect (s 22B(6)); this potentially freezes which versions are relevant unless the regulation or the subsection is amended.
• Occupational health and safety (OHS) frameworks: Although the regulation itself predates more modern OHS Acts, section 23 preserves civil and criminal liabilities outside the regulation, which may include obligations under ACT OHS law or national workplace health and safety regimes. Practitioners should cross‑check current OHS law for overlapping duties, reporting regimes and enforcement mechanisms.
• Historic instruments and conversions: The legislation history shows the regulation was originally an Ordinance and was converted into an ACT enactment on 11 May 1989 under self‑government transitional provisions, and it has since been renamed, revised and amended (endnote 3). That history affects interpretive context, but the operative cross‑law interactions are with current Acts and standards referenced above.

Practical consequences of interactions:

• Where machinery is within the scope of another inspection regime (for boilers, engine drivers, scaffolding and lifts), this regulation cedes competence to those regimes by exclusion (dict). Occupiers must identify which regime applies.
• The noise provisions require appointed measurement instruments meeting specified Australian Standards. That creates an operational intersection between the regulation and the rules of procurement, maintenance and calibration for measurement devices, potentially engaging suppliers and accredited testing bodies.
• The appeal route sits within the Magistrates Court’s jurisdictional framework; remedies and procedural rules will be shaped by that court’s rules and the Magistrates Court Ordinance (s 18; endnote 3).
• Ministerial exemptions are notifiable instruments (s 6(3)), so they are subject to the Legislation Act’s transparency and register requirements; however, the Minister’s satisfaction standard is administrative rather than judicial.

In sum, the regulation functions within an ecosystem of ACT and technical law: it relies on definitions and procedural mechanisms from the Machinery Act and Legislation Act, excludes machinery regulated elsewhere (Scaffolding and Lifts Act, boiler/engine‑driver regimes), incorporates specified Australian Standards, and leaves other civil and criminal liability intact, meaning occupiers must manage compliance across multiple legal instruments.

The republished regulation includes an annotated amendment history and a chronology of changes from its origin to the 2025 republication. Key historical points recorded in the endnotes:

• Origin and early identity: Originally called the Inspection of Machinery Regulations, made under the Commonwealth Machinery Ordinance 1949 No 11 (Cwlth) and notified 30 November 1950, the regulation commenced 15 January 1951 (endnote 3). Its early amendments include SL1969‑1 (1969) and later SL1974‑23 and SL1975‑21 (1974-1975).
• Conversion to ACT law: With self-government, the Machinery Ordinance 1949 and the Inspection of Machinery Regulations were converted into ACT enactments on 11 May 1989 under the Australian Capital Territory (Self‑Government) Act 1988 (endnote 3). The name was subsequently changed from Ordinance to Act terms by the Self‑Government (Citation of Laws) Act 1989 (endnote 3).
• Renaming and revisions: The regulation was renamed and revised by the Statutory Offices (Miscellaneous Provisions) Act 1994 (A1994‑97) and subsequent regulatory revisions including SL1980‑3 and SL1980‑14 and SL1986‑5 and SL1986‑8 (endnote 3). There were additional amendments at various points up to 2007 and 2025.
• 1990s-2000s updates: The regulation saw a sequence of technical amendments between 1980 and 1996, and later incorporated revisions to penalty structures and to definitions. The Regulations Revision (Penalties) Regulations SL1996‑8 (notified 6 June 1996) and other instrument revisions updated penalties and other provisions (endnote 3).
• 2004-2007 and later: The Criminal Code Amendment Act 2004 and Statute Law Amendment Act 2007 made further adjustments, including to the dictionary and reorganisation of definitions (endnotes 3-4). The 2007 amendments relocated many definitions to the Dictionary and made further drafting changes (endnote 4).
• Most recent change(s): The republication records that the Statute Law Amendment Act 2025 (A2025‑29) affected the regulation, with certain parts commencing 26 November 2025 (endnote 3). The amendment history section (endnote 4) indicates recent amendments to s 5 (machinery excluded from application), s 6 (exemption from application), and dictionary updates effected by A2025‑29 amendments (endnote 4: s 5 am A2025‑29 amdt 3.200; dict am A2025‑29 amdt 3.201, etc.).

Structural changes in drafting: The amendment history indicates several structural drafting changes: definitions were removed from earlier sections and relocated to the dictionary (A2007‑3), sections were renumbered and parts were retitled (for example, the noise part renumberings), and sections concerning service of notices and offences were amended or omitted over time (endnote 4). The endnotes specifically record relocations of definitions (engine, machinery, mechanical power, mill‑gearing, occupier, premises) into the dictionary in 2007 (A2007‑3 amdt 3.361) and subsequent insertions and amendments to the dictionary.

Notable insertions and renumberings: Part 4 Noise was modified across time and now contains ss 22A-22D dealing with ear protection and noise; these provisions originated in earlier insertions (SL1975‑21) and were reworked subsequently (endnote 4). The earlier edition included different part numbering (pt 3A/pt 4) that was rationalised in later amendments.

Republication and editorial changes: The Parliamentary Counsel’s Office notes that editorial amendments under the Legislation Act 2001, part 11.3 may be made to bring the law into line with contemporary drafting practice; such editorial changes do not change the law’s effect but take effect on the republication date (prefatory material). The republication includes amendments made under statute up to 26 November 2025.

Practical significance of amendment history: The history shows incremental adaptation: reorganisation of definitions, incorporation of standards, and adjustments to inspection and penalty provisions across decades. Recent amendments (2025) modified the machinery exclusion list and dictionary , these can alter scope and definitional reach and should be checked against the previous regimes to understand changes to applicability and compliance obligations.

For legal practitioners and compliance officers, the endnotes provide the authoritative amendment timeline. They should be consulted when tracing the provenance of particular obligations or when considering transitional issues arising from definition relocations and part renumberings.

The republished regulation and its endnotes do not cite or summarise any litigation decisions that have interpreted its provisions. The text provides statutory appeal routes and administrative mechanisms (notably appeal to the Magistrates Court under s 18), but it does not list reported cases or judgments arising under the regulation.

What the regulation does indicate about litigation pathways and remedies:

• Appeal mechanism: An occupier served with a notice under ss 16 (circular saw) or 17 (faulty or defective machinery) may appeal to the Magistrates Court within 21 days (s 18(1)). On appeal, the Court may confirm, set aside or vary the notice and make other just orders (s 18(2)). The regulation stays use of the machinery pending compliance or the appeal outcome (s 18(3)).
• Enforcement and prosecution: The Act creates specific offences with maxima in penalty units for non-compliance (multiple sections). Prosecutions for breaches would be brought in the appropriate territorial courts, which in practice would involve Magistrates Court processes for summary offences or other relevant tribunals depending on prosecuting agency practices.
• Evidence and technical standards: Noise and ear protection defences rely on compliance with specified Australian Standards and the use of certain instrument types for measurement (s 22B(4)-(5)). In any prosecution under the noise provisions, admissible measurement methodologies, calibration records for instruments and proof of training and device provision are likely to be contested evidentiary matters.
• Inspector notices and procedural fairness: The interplay between inspector discretion (for example, approval of contrivances) and procedural fairness in issuing notices could be a focal point for judicial review or appeal in particular factual contexts. The statute provides an explicit appeal avenue to the Magistrates Court and thereby an ordinary route for contesting inspector determinations (s 18).

Absence of reported cases in the republished text: Because the regulation does not set out case law, practitioners looking for judicial interpretation, evidentiary standards in prosecutions, or the scope of inspector discretion will need to search the reported decisions of the Magistrates Court and higher courts, or administrative review bodies, for relevant precedents. It is common for subordinate legislation of this vintage to be applied in prosecutions or regulatory actions without creating a large body of appellate jurisprudence, but actual litigation practice and outcomes are not documented in the text.

Practical note for litigators and advisers: Given the inclusion of prescribed measurement standards (s 22B) and a technical safety regime (s 16), disputes about compliance will often hinge on factual and technical evidence (calibration certificates, inspection records, maintenance logs, engineer reports, training records). The regulation’s silence on specific civil case law in the republication requires practitioners to conduct searches in ACT court databases, tribunal decisions and any prosecutorial guidance issued by the chief inspector or NT/ACT regulatory agencies to obtain litigation history and precedent.

In short, the statutory framework sets out the procedural and substantive pathways for administrative enforcement and appeal but does not itself include litigation history. Practitioners must therefore consult court records and enforcement agency files to assemble an operational litigation history.

This regulation contains specific provisions and drafting choices that create traps for the unwary. The following points identify practical pitfalls with section references and the mechanisms involved.

Absolute duties with no qualification (s 13(4)): The fencing duty is absolute. Unlike many other duties in the regulation that require an inspector’s direction, s 13 is not qualified by inspector approval; occupiers must proactively fence dangerous parts and maintain fencing. There is no “reasonable practicability” language in this provision. Failure exposes occupiers to the specified penalty without the availability of an inspector‑directed excuse.

Scope by definition (dict; s 5): The definition of “machinery” is broad but explicitly excludes machinery subject to inspection under certain other regimes (for example, boilers, engine‑drivers, Scaffolding and Lifts Act machinery) (dict). Misclassifying equipment can lead to double compliance or non‑compliance. Practitioners must carefully map which statutory regime governs a particular machine, rather than assuming this regulation applies universally.

Ministerial exemption as administrative instrument (s 6): The Minister can exempt machinery or classes of machinery in writing if a provision cannot reasonably be applied. The exemption instrument is notifiable (s 6(3)), but the decision is administrative. Occupiers who assume an exemption will be available or that an inspector must accept a substitute safety approach risk enforcement action if the proper process for obtaining an exemption is not followed.

Inspector discretion and “approved” contrivances (s 15(3), (4), (15-17)): Many remedial duties are triggered only when an inspector directs. The regulation simultaneously permits inspectors to approve alternative contrivances and to require particular equipment, producing variability in enforcement standards. This can make compliance planning difficult because occupiers might have to retrofit equipment to meet an inspector’s specific approval rather than rely on an industry standard unless that standard is acceptable to the inspector.

Noise standard versions frozen to commencement (s 22B(6)): The regulation references Australian Standards as “in force at the time the subsection takes effect” (s 22B(6)). That can freeze the applicable versions of the Standards to those in force when the subsection became effective, meaning subsequent updates to national standards may not apply unless the regulation is itself amended. Occupiers must check which versions are the operative ones.

Evidentiary burden for noise defence (s 22B(2)): The defence to being required to work in high noise areas requires proof that devices were provided, persons instructed in their correct use and instructed to wear them. The occupier bears evidentiary responsibility if prosecuted; robust training records, issue logs and supervision records are essential.

Medical‑certificate defence for ear‑protection non‑wearers (s 22D): This is narrowly defined , the certificate must be in writing by a doctor and not revoked. Employers should record and retain such certificates to rely on the defence; ad hoc or informal notes are unlikely to meet the statutory requirement.

Time‑sensitive reporting obligations (ss 12, 19-20): Notification duties have strict timeframes: one month for ownership notice (s 12) and 24 hours for accidents causing death or serious injury and for accidents requiring structural repairs (ss 19-20). Failure to timely notify is penalised. Practical compliance requires a robust incident response plan and an internal chain of communication to the chief inspector.

Prohibition on use pending compliance or appeal (ss 17(4), 18(3)): Notices may prohibit use of machinery until an inspector is satisfied; appeals do not permit use of the machinery pending determination unless notice requirements are complied with. This can immediately halt operations and has economic consequences; occupiers must budget for potential downtime.

Employing minors (s 15(6), (7), (20)): The regulation contains several age‑based prohibitions and supervision duties. The definition of “occupier” includes persons acting in apparent control; contractors or managers who exercise operational control may be captured. Employers must audit tasks and ensure age verification and supervision structures are in place.

Circular saw obligations and decommissioning (s 16): Circular saws must display the maker’s name and maximum safe working speed (s 16(5)), be guarded, kept in good condition and not used if defective (s 16(9)-(11)). An inspector can order immediate rendering of the saw incapable of use (s 16(18)), which is likely to cause significant disruption in timber and processing operations if compliance is not actively managed.

Removal of safety devices (s 22): The ban on rendering safety devices inoperative is broad and carries a 10 penalty‑unit maximum. Temporary disabling for maintenance or testing should be documented and conducted under safe procedures; unrecorded or unauthorised removal risks prosecution.

Interaction with other liabilities (s 23): The regulation does not displace other civil or criminal liabilities. Compliance with the regulation does not provide immunity from workplace health and safety prosecutions or civil claims. Occupiers must manage regulatory compliance and broader legal exposure.

Penalty unit valuations and corporate differentials (prefatory note): The monetary value of a penalty unit is specified in the republication preface for the republication date. The higher corporate penalty unit value ($810 at the republication date) produces markedly higher fines for corporate entities relative to individuals, which can have material fiscal consequences when calculating exposure. Practitioners must confirm the current penalty unit values at the time of an alleged offence.

Document service and process (s 17 note; Legislation Act references): Notices and services are subject to the Legislation Act procedures for service (s 17 note). Mistakes in service may cause procedural delay or affect appeal timeframes. Practitioners must ensure lawful service of notices and retain proof thereof.

In short, key “gotchas” are: absolute unqualified mandates; narrow defences that require documentary proof; inspector discretion that can affect predictability; strict timeframes that create exposure; interplay with other statutory regimes; and frozen references to particular versions of Australian Standards. Occupiers and advisers need to maintain proactive engineering, administrative and incident response systems to avoid regulatory and operational disruption.

This section provides a practical compliance checklist and evidentiary steps mapped to the regulation’s operative provisions. It focuses on what an occupier should do to minimise regulatory and legal risk.

1. Classify machinery and premises scope

   • Review the definition of “machinery” in the dictionary and s 5 exclusions to determine whether particular equipment falls within or outside the regulation (dict; s 5). If the equipment is subject to another inspection regime (e.g. boilers, scaffolding and lifts), document that attribution and retain supporting records.

2. Ownership notice (s 12)

   • Within one month of commencement of occupation or the regulation’s commencement, send a written notice to the chief inspector containing the owner’s name, maker’s name, identification marks, place of installation, kind of machinery, nature and measure of motive power and the business purpose (s 12).
   • Keep a copy of the notice, proof of service and a dated record of this filing.

3. Ensure fencing and guarding (s 13)

   • Conduct a risk audit of all dangerous parts and implement secure fencing in accordance with the regulation’s requirements. Maintain fencing in an efficient state and document inspections and maintenance.
   • Because s 13 is absolute, do not wait for inspector direction, implement an immediate audit and remediation schedule.

4. Implement pulleys, belt shifters and approved contrivances (s 15)

   • Where mechanical power is used, review systems for the need for loose pulleys, belt shifters, governors and clutches. Seek inspector guidance early if there is uncertainty, as many requirements are triggered by inspector direction (s 15(2)-(4)).
   • If fitting staging, platforms and ladders above 2.40m, obtain inspector approval for design and construction or adopt established standards and document the approval process (s 15(4)).

5. Circular saw compliance (s 16)

   • For circular saw installations: ensure the saw, bench and mountings are safe and adequate, are mounted on adequate foundations, are speed‑marked with maker’s name and maximum safe working speed, have speed control (governor), are in good condition, and have efficient stopping/starting appliances. Prevent idling and secure the saw against inadvertent starting when servicing (s 16(1)-(16)).
   • Provide adequate lighting and display a copy of s 16 in conspicuous places for workers (s 16(17), (19)).
   • Establish maintenance and inspection logs demonstrating sharpening, balancing, checks for cracks and alignment; keep records of remedial action.

6. Minors and supervision (s 15(6), (7), (20))

   • Implement age verification and task allocation policies: do not employ persons under 15 to work or assist in working any machinery, and do not permit persons under 18 to clean machinery in motion. Ensure direct supervision for under‑18 employees assigned to certain tasks (s 15(6)-(7), (20)).
   • Document supervision assignments and competency assessments for persons supervising engines or machinery.

7. Emery wheels, boilers, steam pipes, molten metal handling and revolving appliances (s 15(11)-(14))

   • Ensure emery wheels are guarded as approved, not run above manufacturer speed, and not run before entrances; insulate or guard hot pipes; provide correct pots/ladles for molten metal operations; and equip revolving/tilting boilers or vats with mechanical catches or safe appliances (s 15(11)-(14)).
   • Maintain inspection records and manufacturer specification compliance.

8. Traffic ways, passageways and housekeeping (s 15(18)-(19), s 16(4))

   • Maintain main traffic ways at not less than 1.2 m width and passageways at not less than 600 mm. Keep floors sound, level, non‑slippery and free of impediments and sawdust accumulation around saws (s 15(18)-(19); s 16(4)).
   • Implement a routine cleaning and housekeeping schedule with logs.

9. Training, PPE and bottling operations (s 15(8)-(9))

   • Provide masks, faceguards and gauntlets or hand/arm guards in bottling and similar operations and ensure continuous wearing during hazardous tasks (s 15(8)-(9)).
   • Train workers in correct use and enforce PPE policies; retain attendance and training records.

10. Noise measurement and ear protection (pt 4: ss 22A-22D)

    • Measure workplace noise using instruments specified by Australian Standards referenced in s 22B(4)-(5). Calculate daily noise dose per Australian Standard 1269‑1983 and A‑weighted levels per Australian Standard 1259‑1982. Use personal noise dosimeter instruments mentioned in Australian Standard 2399‑1980 (s 22B(4)-(5)).
    • If noise exceeds the thresholds (daily noise dose >0.33 or A‑weighted sound pressure level >115 dB) do not require persons to work in those areas unless ear protection devices (as defined in s 22A) are provided and correct instruction in their use has been given (s 22B(1)-(2)).
    • Maintain records of device issue, training, signage and instructions and keep calibration certificates for measurement equipment. Retain training registers and issue logs to support the s 22B(2) defence.

11. Medical exemptions (s 22D)

    • Keep written doctor certifications for workers who cannot wear ear protection devices for medical reasons; ensure certificates are retained and not revoked to rely on the statutory defence (s 22D).

12. Responding to inspectors and handling notices (ss 7-10, 17-18)

    • Ensure inspectors are provided certificates of appointment if on premises and be prepared to produce them (s 7).
    • Provide reasonable facilities for inspection and comply with lawful assistance requests; note the penalty for refusal (s 9(2); s 10).
    • If served with a notice requiring repair or alteration (s 17), comply within the time stated or prepare an immediate, documented appeal to the Magistrates Court within 21 days (s 18). During appeals, do not use the machinery unless notice requirements are complied with (s 18(3)).

13. Accident reporting and incident management (ss 19-21)

    • Implement an incident response plan that ensures reporting to the chief inspector within 24 hours for fatalities or injuries likely to incapacitate for more than 48 hours (s 19) and for structural accidents necessitating repairs (s 20).
    • Maintain internal incident logs, witness statements and immediate remedial actions to demonstrate good faith and compliance if investigated.

14. Avoid disabling safety devices (s 22)

    • Prohibit unapproved removal or rendering inoperative of safety devices. For maintenance, document the reason, safe procedure, authorised personnel and restoration time to demonstrate compliance.

15. Recordkeeping and evidence

    • Maintain an auditable compliance file with: ownership notices, inspection reports, maintenance logs, PPE issue records, training logs, measurement/calibration certificates, doctor certifications, incident reports, copies of notices served by inspectors and evidence of compliance with notices.
    • Document any approvals sought from inspectors to use alternative contrivances and retain written approvals.

16. Seek early engagement and legal advice

    • Where doubt exists about the applicability of a requirement or the suitability of alternative safety measures, engage the chief inspector or seek written approvals and keep records. For contentious inspector notices, consult legal counsel promptly given the strict appeal timeframes (s 18).

17. Exemption process (s 6)

    • If a provision cannot reasonably be applied to particular machinery, apply to the Minister for a written exemption, noting the instrument will be notifiable (s 6(1)-(3)). Ensure applications are supported by technical evidence explaining why the provision cannot be reasonably applied.

18. Cross‑check other regimes (s 23; dict)

    • Verify other applicable regulatory obligations (boilers, scaffolding and lifts, OHS legislation) and ensure compliance across regimes. Documentation showing cross‑regulatory compliance can be essential in enforcement contexts.

Following this checklist will not eliminate all regulatory risk, but it addresses the principal operational and documentary elements the regulation prescribes. Occupiers should integrate these points into routine safety management systems, update them as Australian Standards or statutory values (such as penalty‑unit monetary values) change, and maintain robust records to rely on statutory defences and to respond to inspector action.
