What it does
These regulations, the Long Service Leave Regulations 2017 (SA), implement specific procedural and recordkeeping requirements under the Long Service Leave Act 1987. Mechanically they (a) prescribe the form and minimum content of employer records about workers’ long service leave (Form 1 in Schedule 1); (b) prescribe two standard notices to workers , one to be given when long service leave is granted (Form 2) and one to be given when a payment is made by agreement instead of leave (Form 3) (s 4(3)-(4) and Schedule 1); (c) permit employers to use alternative wage, leave or similar records provided the required information is promptly and accurately recorded in those records instead of using the prescribed Form 1 (s 4(2)); and (d) revoke the earlier Long Service Leave Regulations 2002 (Schedule 2). The regulations commence on 1 September 2017 (s 2) and define “Act” for the regulation text as the Long Service Leave Act 1987 (s 3).
The operational effect is to standardise what must be recorded and what must be communicated to workers in relation to long service leave entitlements for the purposes of the Act. The schedules list the precise fields employers must capture if they use the prescribed forms: worker identity and commencement date, employer name and occupation, whether the right to leave is determined by reference to the Act (and, if not, the award/agreement/scheme and SAET determination date), business acquisition details, termination details (date, notice period, reason, entitlement in weeks/hours, payments and dates), projected entitlement date, absence records with effect on entitlement date, and worker information recorded each anniversary and when leave or payment in lieu occurs (rate of pay, normal/usual hours, average hours if no usual pattern, and leave days taken or paid in lieu) (Schedule 1, Form 1). Forms 2 and 3 set out the information employers must provide to workers prior to long service leave commencing, and when payment by agreement is made instead of leave, and they require that a copy of the notice be retained with the worker’s service record (Schedule 1, Forms 2 and 3).
