What it does
This statutory instrument, the Local Government (Transfer of Land to Dorset Council) Order 2025 (s 1), effects the transfer of specified parcels of land, as recorded in the Tasmania Torrens register kept under section 33 of the Land Titles Act 1980, to the Dorset Council (s 3(1)-(14)). The Order takes effect on the day its making is notified in the Gazette (s 2). The instrument was notified in the Gazette on 3 December 2025 (publication note at end of text). The Order is administered in the Department of Premier and Cabinet (administration note at end of text). The instrument is displayed and numbered in accordance with the Rules Publication Act 1953 (display note).
Mechanically, the Order does three things in the text it contains. First, it provides a short title to refer to the instrument (s 1). Second, it fixes commencement to the day of Gazettal rather than to a particular calendar date or a retrospective date (s 2). Third, it lists 14 separate parcels, each identified by location (road/locality), and by the volume and folio number of the Register kept under s 33 of the Land Titles Act 1980, and states, in plain terms set out in subsections 3(1)-(14), that each parcel “is transferred to the Dorset Council”.
The Order does not, on its face, specify a transferor, any consideration, any conditions attaching to the transfer, or any treatment of existing registered interests such as mortgages, easements, leases, covenants or statutory liabilities. The Order likewise does not set out procedural instructions to the Registrar of Titles or other officers regarding updating the register, nor does it contain express savings, compensation, or transitional clauses. The only operational signals in the instrument beyond the transfer clauses are the commencement mechanism (Gazette notification), the display/numbering compliance with the Rules Publication Act 1953 and the administration by the Department of Premier and Cabinet.
