What it does
This Act retroactively corrects numerical errors in the differential-rate percentages used by the Katherine Town Council for two discrete financial years, and declares the corrected levy amounts to have been validly imposed. The Act has five operative provisions. Section 1 gives the short title. Section 2 states the purpose: to change incorrectly specified percentages and ensure the validity of rates levied by the Katherine Town Council for the financial years ending 30 June 1998 and 30 June 1999. Section 3 fixes terminology by importing definitions from the Local Government Act 2008 for any word or expression used in this Act (see s 3). Sections 4 and 5 operate in parallel to treat the two financial years.
Mechanically, s 4(1) treats the Council resolution of 28 July 1997 (published Gazette No. 32, 13 August 1997) as if each percentage shown in column 1 of Schedule 1 had been substituted by the corresponding percentage shown in column 2. Section 4(2) then declares that the general rates levied under section 76 of the Local Government Act 2008 for the 1997/98 year are validly levied, and that the amount to be paid is the amount calculated in accordance with the resolution as if the column‑1 percentages had been replaced by the column‑2 percentages. Section 5 performs the same legal work for the resolution of 27 July 1998 (published Gazette No. 30, 5 August 1998) using Schedule 2 for 1998/99 (see s 5(1)-(2)).
Schedules 1 and 2 provide the exact numeric substitutions: each lists the originally specified percentage (column 1) and the percentage to be treated as if it had been specified (column 2). The numeric pattern in the Schedules shows that the column‑2 figures are larger than the column‑1 figures (for example Schedule 1 maps 0.0178% to 0.178%), so the Act operates to treat the higher percentages as the operative rates for calculation of amounts owing for those years. The Endnotes record the Act’s assent and commencement date (19 May 1999) and note formal amendments of a technical nature to ss 3-5 by the Interpretation Legislation Amendment Act 2018 (see Endnotes 2-3).
