Liquor Control (Kunawarritji Restricted Area) Regulations 2011

The regulations operate by invoking and applying the concept of a “restricted area” under the Liquor Control Act 1988. The core legal constructs are geographic definition, a tailored offence definition, exemptions, administrative notice requirements, and enforcement mechanics.

Geographic definition: The Kunawarritji Aboriginal Community is declared a restricted area measured as up to 50 kilometres radius from a fixed telecommunications aerial coordinate on Lot 333, specified by two GDA2020 coordinates (regulation 3(a)-(b); regulation 5). The definition uses precise geodetic coordinates rather than ad hoc textual boundaries, making the spatial scope objectively determinable from the text. The instrument also defines Well 33 camping grounds with separate GDA2020 coordinates (regulation 3).

Offence design: Regulation 7 creates the substantive criminal prohibition. Two distinct acts are prohibited: bringing liquor into the restricted area and having liquor in one’s possession in the restricted area (regulation 7(1)(a)-(b)). The offence is bifurcated for penalty purposes: associated persons connected to licensed premises (licensee, manager, or director of a licence-holding body corporate) face a higher fine ($5,000) while other persons face a lower fine ($2,000) (regulation 7(1), (2)).

Targeted exemptions: The instrument carves out a narrow exception for “tourists” meeting five conjunctive criteria (regulation 3; regulation 7(3)). Those tourists must be staying at least 50 kilometres from their usual residence for at least one night, intend to stay away for less than 12 months, not be on a regular journey between residence and work/education, be travelling for leisure/business/visiting or similar reasons, and not usually be a resident in a community already declared a restricted area under s 175(1a) of the Act (regulation 3). Even where the “tourist” criteria are met, the tourist must not consume the liquor while in the restricted area and must “continuously maintain” possession until they have left the community to qualify for the exemption (regulation 7(3)). Separately, regulation 8 introduces an additional exception allowing tourists using the Well 33 camping grounds to possess and consume alcohol while on those grounds.

Administrative notification: The Director of Liquor Licensing must take “all reasonable steps” to post notices at every place where a “customary access route” enters the community, describing the offences and penalties (regulation 6(1)). The text does not define “customary access route” within the regulations, creating an operational concept that will be populated in practice by knowledge of local entry points. Importantly, non-compliance with the posting duty does not invalidate the declaration (regulation 6(2)).

Enforcement mechanics: Regulation 9 authorises a police officer to seize and “as soon as is practicable, dispose of” any opened or unopened container of liquor reasonably suspected to be the subject of an offence under regulation 7, and the provision operates “despite” sections 155(4) and (5) of the Act. Those sections in the Act are therefore displaced as to the power to dispose of seized containers for the purposes of these regulations (regulation 9).

Temporal limitation: The regulations are explicitly time-limited; they operate until the close of 3 May 2028 unless sooner repealed (regulation 10). The compilation table shows the instrument has been amended several times since 2011.

Operational legal concepts present here include objective geodetic boundaries, a multi-part statutory definition of an exempt class (tourist), an asymmetrical penalty regime based on role, administrative duties phrased as “all reasonable steps”, an express non-invalidity clause for notice failures, and an explicit displacement of certain Act provisions to permit prompt disposal by police. Each of those elements shapes incentives for behaviour, compliance obligations for public officers and private actors, and practical enforcement decisions.

Individuals and entities within, entering, or travelling through the specified 50 kilometre radius around the Kunawarritji telecommunications aerial are directly affected. The regulations single out several actor classes by name and by operational role.

Residents and usual community members: Persons who are “usually a resident in a community declared a restricted area under section 175(1a) of the Act” are excluded from the “tourist” exemption (regulation 3, definition of tourist). The regulations therefore treat usual residents of declared restricted areas differently from visiting tourists: the prohibition applies to possession and bringing in liquor (regulation 7(1)), with no specific positive permission for residents contained in the text.

Tourists: The instrument creates a narrowly defined category of “tourist” (regulation 3) who can lawfully carry liquor into the community provided two further conditions are met: they must not consume the liquor in the community and they must continuously maintain possession until they leave (regulation 7(3)). Tourists who use Well 33 camping grounds are treated differently: regulation 8 allows tourists on those grounds to possess and consume alcohol while on the grounds.

Licensees, managers, and corporate directors: Regulation 7(2) applies a higher penalty where an offence under regulation 7(1) is committed by a licensee, a manager of licensed premises, or a director of a body corporate that holds a licence. That creates a specific, elevated exposure for persons and entities involved in the licensed supply of alcohol, including corporate officers.

Director of Liquor Licensing: The Director bears an administrative duty to take “all reasonable steps” to cause notices to be posted and to be kept posted at each customary access route entering the community (regulation 6(1)). The Director’s obligations are procedural and continuous for the duration that the declaration continues by operation of regulation 5.

Police: Members of the Police Force are given a specific enforcement power to seize and dispose of containers of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7, and the provision expressly operates despite sections 155(4) and (5) of the Act (regulation 9). Police officers therefore have both detection and prompt disposal authority under the instrument.

Visitors and travellers generally: Any person who brings liquor into, or has liquor in possession in, the restricted area is criminalised unless they fall within the tourist exemption or the Well 33 exception (regulation 7). The definition of “tourist” is fact‑sensitive and multi-factorial, so ordinary travellers, contractors, freight carriers, or visitors on regular journeys may not meet the tourist criteria and thus remain subject to prohibition.

Businesses and carriers: The prohibition on “bringing liquor into” the community captures any act that results in liquor entering the restricted area, which can include transporters, couriers, commercial suppliers, and private individuals transporting goods. The higher penalty for licensees, managers and corporate directors (regulation 7(2)) specifically affects businesses with liquor licences.

Landholders and neighbouring communities: While not directly named, landholders whose property contains customary access routes into the declared area may be affected operationally by the posting requirement (regulation 6) and by any enforcement activity at those entry points.

Regulatory actors: The Liquor Control Act 1988 is invoked by the regulations (regulation 5 referencing s 175(1a) of the Act), so relevant administrative or judicial actions under the Act may have interdependence with these regulations. The compilation table shows the regulations have been revised multiple times, a relevant fact for those tracking compliance obligations and operational timelines.

Temporal effect: All persons and entities must observe that the instrument has an expiry date (regulation 10); the declaration and associated restrictions are effective only until the close of 3 May 2028 unless earlier repealed. That creates a limited term of application relevant to planning by businesses and enforcement agencies.

In short, the regulations affect multiple actors: private individuals (residents, tourists, visitors), commercial operators in the liquor supply chain (licensees, managers, directors), administrative officers (Director of Liquor Licensing), and police. Each actor class faces specific duties, exemptions, or enforcement roles spelled out in the text (regulations 3, 5, 6, 7, 8, 9 and 10).

The regulations allocate a small number of discrete duties, administrative obligations and enforceable rights, each stated in relatively plain terms.

Director of Liquor Licensing , posting duty: The Director must take “all reasonable steps” to cause to be posted, and while the Kunawarritji area continues to be a restricted area to be kept posted, at each place where a customary access route enters the community, a notice describing the offences in regulation 7 and specifying the penalties (regulation 6(1)). The phrase “all reasonable steps” frames the duty as an ordinary administrative standard of effort rather than an absolute guarantee. The posting obligation is ongoing for the duration of the declaration. Notably, regulation 6(2) expressly states that failure to comply with the posting duty does not invalidate the declaration made in regulation 5, so the legal effectiveness of the declaration is not contingent on strict compliance with notice posting.

Police , seizure and disposal power: A member of the Police Force may seize and, “as soon as is practicable, dispose of” any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7 (regulation 9). The provision operates “despite section 155(4) and (5) of the Act”, which signals that the normal constraints or procedures otherwise applicable under those subsections are displaced for purposes of these regulations. The statutory trigger for police action is a reasonable suspicion that the container is connected to an offence under regulation 7.

Persons generally , prohibition and exceptions: The general duty on persons is negative: do not bring liquor into, or have liquor in possession, within the Kunawarritji Aboriginal Community, unless an exception applies (regulation 7(1)-(3)). The exception for tourists is conditional and narrow: a person must meet the various criteria in the definition of “tourist” (regulation 3) and must not consume the liquor and must continuously maintain possession until they have left the community (regulation 7(3)). The additional exception for tourists using the Well 33 camping grounds permits both possession and consumption while on those grounds (regulation 8). The right to carry and consume on Well 33 is thus explicitly created for tourists at that location.

Licensed persons and corporate officers , elevated penalty exposure: A licensee, manager of licensed premises, or director of a body corporate that holds a licence commits an offence subject to a higher maximum fine ($5,000) if they breach regulation 7 (regulation 7(2)). The regulation thereby imposes heightened financial exposure on persons tied to licensed liquor provision. The text does not create any specific positive permission for those actors; it increases penalty severity if they are found to have brought liquor into or to possess liquor in the area.

Temporal right/limitation: The regulations create rights and obligations that operate only for a stated period; they expire at the close of 3 May 2028 unless sooner repealed (regulation 10). Actors can therefore plan around a defined regulatory term.

Operational discretion and burden: The posting duty uses the discretionary standard “all reasonable steps”, implying administrative judgement on what steps suffice. The police seizure power is dependent on a reasonable grounds threshold , again a standard applied by officers in the field. For tourists, the requirement to “continuously maintain possession” is a behavioural duty with evidentiary consequences; it creates an operational burden on travellers if they wish to rely on the exemption (regulation 7(3)). The requirement that a tourist’s stay be at least one night and less than 12 months creates a definitional threshold that travellers must satisfy to obtain the exemption (regulation 3).

Penalties: The regulations assign fixed monetary penalties for contraventions of regulation 7: $5,000 for licensee/manager/director contraventions and $2,000 for other persons (regulation 7(1)(a), (b) and (2)). These are the immediate legal consequences for non‑compliance.

In summary, duties are primarily negative obligations on private persons (no bringing in or possession), a procedural and ongoing posting duty for the Director, a seizure/disposal power for police, and elevated penalty exposure for persons connected with licensed premises. Rights created include the narrow tourist exemptions and the permissive consumption right on Well 33 for tourists.

The regulations set out a concise enforcement framework combining pecuniary penalties and police seizure/disposal authority.

Monetary penalties: Regulation 7 prescribes fixed fines based on the class of offender. A person who brings liquor into or has liquor in possession in the Kunawarritji Aboriginal Community commits an offence. The financial penalties are expressly graduated: if the offender is a licensee, manager of licensed premises, or a director of a corporate licence holder, the applicable fine is $5,000 (regulation 7(1), (2)). For all other persons, the fine is $2,000 (regulation 7(1)). The regulations do not specify alternative sentencing options, imprisonment, or infringement notices in lieu of these fines within their text; the instrument is limited to stating these penalty amounts.

Enforcement agency and powers: The member of the Police Force is the primary enforcement actor indicated by the text for on-the-ground control of liquor containers (regulation 9). That member may seize and, as soon as is practicable, dispose of any opened or unopened container of liquor reasonably suspected to be the subject of an offence under regulation 7. The “as soon as is practicable” qualification creates an operational standard for the timing of disposal and suggests that disposal should not be unduly delayed. The regulation expressly operates “despite section 155(4) and (5) of the Act”, thereby removing or modifying whatever protections or procedures are contained in those subsections in the principal Act for the purposes of these regulations (regulation 9).

Evidence and suspicion: The seizure and disposal power is triggered by a “reasonable grounds” standard , an evidential and legal threshold that must be satisfied by the officer at the time of action. The instrument does not provide a statutory definition of “reasonable grounds” (that concept remains a legal standard applied in context), nor does it provide procedural safeguards for affected persons within the text.

Notice and procedural safeguards: The Director of Liquor Licensing must take all reasonable steps to post notices at customary access routes that describe the offences and specify the penalties (regulation 6(1)). Notices are therefore part of the enforcement regime, providing public notification of the criminal exposure. However, the regulation also states that failure to comply with the posting duty does not invalidate the restricted area declaration (regulation 6(2)). That means a person could be prosecuted for an offence under regulation 7 even if notices were not posted at every customary access route, though lack of notice might be relevant in proceedings (the regulation itself removes invalidity as a basis to challenge the declaration).

Scope of police disposal: Regulation 9 allows disposal “as soon as is practicable” , the disposal can be of opened or unopened containers. The instrument thus grants police the capacity to eliminate evidence or contraband promptly, which operationally limits the time during which containers remain available for contest or claim by their owners.

Temporal enforcement window: The regulations have a specified expiry date (regulation 10). Enforcement and penalty risk exist only while the regulations are in force up to 3 May 2028 unless earlier repealed. The compilation notes amendments to the regulations, but the penalties and seizure powers are as stated.

No internal appeal or review mechanism is prescribed in these regulations: they do not create a statutory appeals process against seizure or fines within their text. Enforcement in practice will therefore operate through the normal criminal justice channels and any applicable administrative review or appeal mechanisms under the Liquor Control Act 1988 or general criminal procedure law.

In practical enforcement terms, the critical points are: the creation of defined monetary penalties, heightened exposure for liquor industry actors, an express and immediate police power to seize and dispose of containers on reasonable grounds, notice requirements that do not affect validity if imperfectly complied with, and no express restrictions in these regulations on the scope or method of prosecution under the Act or other procedural steps.

The regulations are a subordinate instrument made under the Liquor Control Act 1988 and are explicitly framed to operate “for the purposes of section 175(1a) of the Act” (regulation 5). That reference places these regulations within the statutory architecture of the Liquor Control Act and signals that the operation of the restricted area is an application of the powers and processes conferred by the Act.

Displacement of Act subsections: Regulation 9 expressly operates “despite section 155(4) and (5) of the Act” to authorise police seizure and disposal of containers suspected on reasonable grounds to be involved in a regulation 7 offence. The regulations therefore modify how particular Act provisions apply in this specified restricted-area context , permitting disposal of seized containers “as soon as is practicable” without regard to the procedures that would otherwise apply under section 155(4) and (5). The instrument’s specific displacement of those subsections is a direct interaction with the Act’s enforcement regime.

Reference to section 175(1a): The declaration of the Kunawarritji Aboriginal Community as a restricted area is expressly made under section 175(1a) of the Act (regulation 5). The regulations do not reproduce the text of s 175(1a), but they do implement a measure that falls under that provision’s scope. Any matters governed by the Act generally, such as prosecution, evidentiary rules, or licence conditions, will be applicable to proceedings or administrative actions taken under or in relation to the regulations, subject to the specific displacements the regulations create.

Overlap with other restricted-area regimes: The definition of tourist in regulation 3(e) makes express reference to persons who are “usually a resident in a community declared a restricted area under section 175(1a) of the Act”, so the regulations contemplate interaction with other restricted-area declarations made under the Act. That cross-reference affects who may qualify for the tourist exemption and acknowledges a broader legal framework of multiple restricted-area declarations under the Act.

Administrative law and governance: The Director of Liquor Licensing’s duty to take all reasonable steps to cause notices to be posted (regulation 6) will interact with the administrative standards under general public law regarding reasonableness, due process and procedural fairness, though these regulations do not create a standalone administrative appeals mechanism. The regulation’s statement that failure to post does not invalidate the declaration (regulation 6(2)) shapes the legal relationship between procedural notice obligations and substantive legality.

Criminal procedure and evidentiary law: Enforcement under regulation 7 will proceed through criminal law processes established under the Act and general criminal law. The regulation’s seizure and disposal power will intersect with criminal evidence rules where disposal of containers may affect the availability of physical evidence , regulation 9’s displacement of s 155(4) and (5) directly interacts here.

Property and civil law: The regulations do not specify compensation or claim rights for disposed containers. Because regulation 9 permits disposal “as soon as is practicable”, property rights in the containers may be extinguished without an express statutory compensation regime within these regulations. Any civil action related to wrongful seizure or disposal would proceed under general tort or administrative law principles, but the regulations’ displacement provision may bear on such claims.

Temporal interaction: The explicit expiry (regulation 10) limits the regulations’ operational period, interacting with ongoing obligations under the Act that may otherwise be indefinite unless declared for a period. Any licences or commercial arrangements affected by the restricted area will have to take this temporal limitation into account.

Coordination with local laws and land use: The regulations do not directly address local government by-laws or Indigenous land rights statutes. The use of geodetic coordinates and reference to “customary access routes” signals potential operational intersections with land tenure, access rights and local governance regimes that govern roads, tracks and entry points. The text does not modify those regimes; it overlays the liquor prohibition on the defined territory.

In short, the instrument is expressly integrated into the Liquor Control Act 1988 framework (regulation 5), modifies specific enforcement provisions of the Act (regulation 9), cross-references other restricted-area declarations (regulation 3(e)), and leaves other procedural and civil law interactions to the general legal framework outside this instrument.

The compilation table incorporated in the instrument records successive amendments and provides dates of publication and commencement. The regulations were originally published as the Liquor Control (Kunawarritji Restricted Area) Regulations 2011. Key entries in the compilation table and marginal notes within the instrument identify the following amendments:

• 2014: Liquor Control (Kunawarritji Restricted Area) Amendment Regulations 2014, published 2 May 2014, with most provisions commencing on 3 May 2014 (Compilation table).

• 2015: Liquor Control (Kunawarritji Restricted Area) Amendment Regulations 2015, published 10 April 2015, with most provisions commencing on 11 April 2015 (Compilation table).

• 2018: Liquor Control (Kunawarritji Restricted Area) Amendment Regulations 2018, published 13 April 2018, with most provisions commencing on 14 April 2018 (Compilation table).

• 2021: Racing and Gaming Regulations Amendment (Liquor Control) Regulations 2021, Pt. 3, published as SL 2021/18, commenced 3 February 2021 (Compilation table). The marginal note notes that regulation 3 was amended (SL 2021/18 r. 8) and regulation 4 was deleted (SL 2021/18 r. 9). Regulation 10 was inserted by SL 2021/18 r.10 (see Notes).

• 2024: Racing and Gaming Regulations Amendment (Liquor Control) Regulations (No. 2) 2024, Pt. 3 (SL 2024/46), published 17 April 2024, commenced 18 April 2024. The marginal note indicates an amendment to regulation 10 (SL 2024/46 r. 6).

• 2025: Racing and Gaming Regulations Amendment (Liquor Control) Regulations 2025, Pt. 2 (SL 2025/54), published 16 April 2025, with commencement 17 April 2025 (Compilation table). The marginal note indicates an amendment to regulation 10 (SL 2025/54 r. 4).

Within the body of the regulations, amendments are noted in situ: regulation 3 is marked as amended (Regulation 3 amended: SL 2021/18 r. 8), and regulation 4 is recorded as deleted by SL 2021/18 r. 9. Regulation 10 was inserted by SL 2021/18 r. 10 and subsequently amended by SL 2024/46 r. 6 and SL 2025/54 r. 4; the Notes reiterate the expiry at close of 3 May 2028 (regulation 10; Other notes). The compilation table lists the instruments that have altered the regulations’ text since 2011 and gives their publication and commencement dates.

The recorded amendment pattern indicates periodic updates to the regulations, including deletion and insertion of provisions (for example, deletion of regulation 4). The presence of multiple Racing and Gaming Regulations Amendment instruments suggests the regulations have been incorporated into omnibus amendments to liquor control-related subordinate legislation at various times. The marginal amendment notes identify the specific statutory instruments that effected the changes but the compilation table does not set out the textual content of those amendments beyond the marginal indications.

Practitioners should note the instrument’s explicit expiry date (regulation 10), which has itself been inserted and amended across the 2021-2025 amendments, indicating a legislative choice to maintain a time-limited regulatory regime and to update the expiry date by subsequent amendments. The compilation table records the amendments through 2025 and the Notes restate the expiry (Other notes).

For chronological tracking and compliance planning, the act of amendment is recorded in the compilation table and marginal notes, but the regulations’ substantive text as currently in force must be read in light of those amendments; the document provided already includes the amendments up to and including the 2025 instrument as incorporated text (see marginal notes referencing SL 2021/18, SL 2024/46, SL 2025/54).

The regulations as presented do not record any judicial decisions, prosecutions or case law arising under them within the instrument text. The compilation table and notes list statutory amendments and publication details but contain no entries for court judgments, appeals or litigation outcomes. The regulations do not themselves include a schedule or annex listing cases or legal challenges.

Because the instrument is a regulation under the Liquor Control Act 1988 and creates criminal offences and enforcement mechanisms, litigation could reasonably arise in a variety of contexts, including prosecutions for breaches of regulation 7, civil claims arising from seizure and disposal under regulation 9, or judicial review proceedings challenging administrative actions taken under regulation 6. None of those potential proceedings are recorded in the instrument.

Where litigation were to occur, relevant legal issues emerging from the text could include interpretation disputes over the meaning of “continuous” possession required for the tourist exception (regulation 7(3)), the definition of “tourist” as a multi-part test (regulation 3), the legal sufficiency of posting notices at “customary access routes” and whether the Director took “all reasonable steps” (regulation 6), the lawfulness of seizure and disposal “as soon as is practicable” despite s 155(4) and (5) of the Act (regulation 9), and the constitutional or statutory validity of enforcement actions taken without full compliance with posting obligations given regulation 6(2). None of these theoretical litigation issues are adjudicated within the instrument itself.

The compilation table’s record of amendments provides a legislative history but not litigation history. Practitioners seeking a database of cases, prosecutions, or judicial decisions involving these regulations will need to consult court records, criminal registries, or legal databases outside this instrument; the regulations do not supply that material.

In short, the instrument contains no embedded litigation history. It is silent on any cases, and the text and compilation table only record statutory amendment activity up to 2025 and the regulations’ temporal expiry. Any litigation-related analysis must therefore be developed from external sources beyond the regulations as published here.

There are multiple practical and legal pitfalls in the text that create compliance, enforcement and evidentiary risk. These “gotchas” follow directly from the wording of the regulations.

Narrow tourist definition: The tourist exemption is conjunctive and detailed (regulation 3). A traveller must be staying at a place at least 50 kilometres from their usual residence for at least one night, intend to stay away for less than 12 months, not be on a regular journey between residence and work or education, be travelling for leisure/business/visiting or similar reasons, and not usually be a resident in any community declared a restricted area (regulation 3). Failure to satisfy any single element means the tourist exception does not apply. Casual day-trippers, people on regular commuting journeys, persons staying less than one night, or persons travelling more than 12 months would not qualify.

Consumption ban for tourists (except Well 33): Even if a traveller satisfies the tourist test, regulation 7(3) requires that the tourist “does not consume the liquor in his or her possession” while in the community and that the tourist “continuously maintains possession” until they leave. The requirement to “continuously maintain possession” is a practical evidentiary obligation that can be difficult to prove in the field: how does a traveller demonstrate continuous possession while sleeping, when using communal facilities, or when securing vehicles? The instrument does not define “continuously” and enforcement officers will apply the standard based on the facts.

Well 33 narrow exception: Regulation 8 permits tourists using the Well 33 camping grounds to possess and consume alcohol while on those grounds. That exception is location-specific (Well 33 coordinates in regulation 3) and does not extend to adjacent land or to other camping grounds. Tourists must be physically on the specified coordinates to rely on the consumption permission.

“Brings liquor into” captures supply chains: The prohibition on “bringing liquor into” the community (regulation 7(1)(a)) can capture supply activities by drivers, carriers, hosts, or commercial suppliers. A licence-holder delivering goods to a property inside the restricted area may be exposed to the $5,000 fine if they fall within the licensee/manager/director class (regulation 7(2)). There is no express allowance for lawful deliveries for non-alcoholic purposes.

Posting requirement uncertainty and non-invalidity: The Director must take “all reasonable steps” to post notices at customary access routes (regulation 6(1)). The instrument does not define “customary access route”. Uncertainty about which entry points qualify could result in incomplete posting. Yet regulation 6(2) eliminates the ability to invalidate the declaration if posting is imperfect; a person prosecuted cannot rely on lack of notice to challenge the declaration’s legality, though lack of notice might be relevant in mitigation.

Police disposal without compensation safeguards: Regulation 9 permits police to seize and “as soon as is practicable, dispose of” containers suspected on reasonable grounds to be involved in an offence, and does so “despite” s 155(4) and (5) of the Act. The instrument does not provide an express mechanism for owners to reclaim property or for compensation if containers are lawfully seized but improperly disposed. Practically, once disposed, containers cannot be used as evidence or reclaimed.

Evidential difficulties and enforcement discretion: Several key concepts (reasonable grounds; continuous possession; customary access route; all reasonable steps) are standards that require discretion by officers or administrators. That discretion can produce inconsistent enforcement across entry points and officers. Individuals may find it hard to anticipate how these standards will be applied in practice.

Temporal limit and planning risk: The regulations expire at the close of 3 May 2028 (regulation 10). Businesses, communities and enforcement agencies must plan for the sunset, but amending regulations have adjusted the expiry previously. There is a risk of regulatory uncertainty if sunset dates are moved or if the instrument is repealed.

Licensee-specific higher fine: Licensees, managers and directors face a $5,000 fine while other persons face $2,000 (regulation 7(2)). The larger fine may incentivise licence-holders to be especially cautious about transporting or permitting liquor into the area, but it may also create compliance costs and insurance exposures.

Geodetic coordinates: The use of GDA2020 coordinates for the 50 km radius means legal determinations of whether a person is inside the area are technically precise but can require GPS-capable evidence. In remote areas GPS variance and device accuracy could become contentious in prosecutions.

Overlap with other restricted-area declarations: The tourist definition explicitly excludes persons usually resident in any community declared a restricted area under s 175(1a) of the Act (regulation 3(e)). Persons moving between multiple restricted areas or residing in other declared communities could be excluded from the tourist exception even if their circumstances are otherwise like a tourist.

No internal remedies in the regulations: The instrument does not specify administrative review or compensation mechanisms for seized or disposed containers. Affected persons must rely on general statutory or common law remedies outside the regulations.

These points show that compliance is fact-sensitive, depends on precise location and travel arrangements, and rests heavily on discretionary standards applied by the Director and police. Practitioners should advise clients to document travel plans, maintain continuous possession where necessary, avoid transporting liquor into the 50 km radius unless on Well 33 and qualifying as a tourist, and to engage with administrative authorities about posting where relevant.

Compliance under these regulations requires both pre-travel planning for individuals and operational processes for regulators, licence-holders and commercial carriers. The essential compliance steps and practical measures follow directly from the text.

For travellers who may be “tourists”:

• Check the tourist definition in regulation 3 carefully. To rely on the tourist exemption, ensure that: your stay is at least one night at a place at least 50 km from your usual residence; you intend to be away for less than 12 months; you are not travelling on a regular journey between residence and work/education; you are travelling for holiday, leisure, business, visiting friends/relatives or a similar reason; and you are not usually a resident in a community already declared a restricted area (regulation 3).
• Do not consume liquor while inside the restricted area unless you are a tourist on the Well 33 camping grounds (regulation 7(3); regulation 8). If relying on the tourist exemption outside Well 33, you must not consume the liquor in your possession (regulation 7(3)(b)).
• Maintain continuous possession of the liquor until you have left the Kunawarritji Aboriginal Community (regulation 7(3)(c)). Practically, this means keeping liquor under your control, in your vehicle or on your person, and avoiding handing it to others to hold while inside the area. Keep contemporaneous evidence (dates, GPS logs, accommodation receipts) that show your travel distance and duration to support the tourist status if contested.

For tourists using Well 33:

• If you will be staying on the Well 33 camping grounds as defined by the GDA2020 coordinates (regulation 3), you may possess and consume alcohol while on the grounds (regulation 8). Ensure you understand the defined coordinates and remain within them to rely on the consumption permission.

For licence-holders, managers and corporate officers:

• Avoid bringing liquor into the restricted area. Regulation 7(2) imposes a $5,000 fine for licence‑connected actors who commit an offence under regulation 7. Implement internal compliance checks for deliveries, staff travel and events that might involve movement of liquor into the 50 km radius.
• For licensed supplies destined near but not inside the restricted area, verify delivery locations with precise GPS coordinates compared to the specified centre point in regulation 3 to avoid inadvertent entry.

For carriers and businesses:

• Implement routing and delivery controls to ensure consignments do not enter the restricted area. Use mapping tools to enforce a 50 km buffer from the GDA2020 coordinates in regulation 3.
• Consider contractual clauses for carriers and customers stipulating liability for breach of the regulations and require customers to confirm whether delivery addresses fall within the restricted area.

For the Director of Liquor Licensing and local administrative offices:

• Identify and map “customary access routes” into the community and take “all reasonable steps” to cause notices to be posted and kept posted at each such entry point, describing the offences and penalties (regulation 6(1)). Document the steps taken (photographs of signs, dates of posting, maintenance logs) to evidence that all reasonable steps were taken.
• Given regulation 6(2), maintain records of efforts made to post notices even though failure to post will not invalidate the declaration.

For police and enforcement bodies:

• Apply the “reasonable grounds” standard when determining whether a container is suspected to be the subject of a regulation 7 offence before seizing (regulation 9). Retain contemporaneous records of the grounds for seizure and of the disposal decision and timing, particularly given the “as soon as is practicable” disposal requirement.
• Ensure disposal actions are carried out consistently and in accordance with local record-keeping policies to mitigate later civil claims regarding property.

Documentation and evidence:

• Individuals and businesses should retain travel records, receipts, GPS logs, accommodation confirmations and any other evidence that supports claims of tourist status, distance of travel, and continuous possession. Such documentation will be relevant in any enforcement or legal challenge.

Risk management and insurance:

• Licence-holders and carriers should review insurance and indemnity arrangements to address risk of fines or losses arising from enforcement actions. Training for staff who operate near the boundary should be provided.

Legal advice and dispute handling:

• Where a seizure or fine occurs, seek prompt legal advice to understand procedural avenues for contesting the penalty or seeking return or redress for disposed property, recognising the regulation’s displacement of s 155(4) and (5) of the Act (regulation 9).

Operationally, compliance is location-dependent and fact-sensitive. The most straightforward compliance strategies are avoidance (do not bring liquor into the 50 km radius), careful trip planning for travellers who desire to carry liquor (meet tourist criteria and maintain continuous possession), and internal controls for licence-holders and carriers to prevent inadvertent breach. Documentation of steps taken to comply will be crucial if enforcement issues arise.
