Liquor Control (Kadjina Restricted Area) Regulations 2020

The regulations operate by a well-defined set of statutory mechanisms: declaration, offence-creation, notice, police seizure and disposal, and sunset. Each is institutionally situated in the Act by express references.

Declaration: Regulation 4 declares the Kadjina Aboriginal Community a restricted area "for the purposes of section 175(1a) of the Act." The instrument does not restate s 175(1a); it uses that head of power in the Act to bring the two lots within the Act’s restricted-area regime. The precise land parcels are listed in reg 3(a) and (b).

Offence structure: Regulation 6 creates a single pair of criminal prohibitions: (a) bringing liquor into, or causing liquor to be brought into, the Kadjina Aboriginal Community; and (b) possessing liquor in the Kadjina Aboriginal Community (reg 6(1)(a)-(b)). The penalties are statutory pecuniary fines, tiered by status of the offender. If the offender is a licensee, a manager of licensed premises or a director of a corporate licence-holder, the fine is $5,000; for any other person it is $2,000 (reg 6(1) penalty; reg 6(2) defines the higher tier application).

Notice requirement: Regulation 5(1) imposes a positive duty on the Director of Liquor Licensing to "take all reasonable steps" to cause notices to be posted at each place where a "customary access route" enters the Kadjina Aboriginal Community, and to keep those notices posted while the declaration remains in force. Notices must describe the offences set out in regulation 6 and specify the penalties for those offences (reg 5(1)(a)-(b)). Regulation 5(2) carves out that failure to comply with that posting duty does not invalidate the declaration made in regulation 4.

Seizure and disposal: Regulation 7 grants police operational authority to seize any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under regulation 6, and to dispose of that container "as soon as is practicable." The regulation explicitly states this power operates "despite section 155(4) and (5) of the Act" (reg 7). The text therefore disapplies or modifies the effect of those provisions of the Act for the purposes of these regulations; the regulations do not reiterate the content of s 155(4) and (5).

Temporal scope: Regulation 8 fixes a statutory period of effect: unless sooner repealed, the regulations have effect until the close of 10 October 2035. The compilation table and marginal note record that regulation 8 was amended by SL 2025/169 r. 4 (reg 8; compilation table).

Integration with other regulations: Part 5 amends the Liquor Control Regulations 1989 by inserting a reference to these regulations (reg 10). Specifically, regulation 27(4) of the 1989 Regulations has had the Table expanded to include the entry "Liquor Control (Kadjina Restricted Area) Regulations 2020 regulation 6(1)". The functional consequence within the 1989 Regulations is not restated in these Regulations; the amendment creates an internal cross-reference.

Defined terms: The regulations define "Kadjina Aboriginal Community" (reg 3). They do not define "customary access route" or other terms within the instrument; the duty to post notices refers to customary access routes without an express definition.

Institutional actors and decision points: The Director of Liquor Licensing makes operational decisions about where to post notices and must take "all reasonable steps" to do so (reg 5(1)). Police have discretion to seize and to dispose where there are reasonable grounds (reg 7). Penalties are monetary fines that the courts will impose following conviction for offences in reg 6.

Compliance triggers: A person triggers criminal liability by bringing liquor into, causing liquor to be brought into, or possessing liquor within the defined parcels (reg 6(1)). The status of the person (licensee/manager/director v other) changes the magnitude of the pecuniary sanction (reg 6(2)).

The regulations are therefore a compact set of measures that change behaviour (no liquor introduction or possession), attach differentiated monetary sanctions depending on regulatory status, require public notice at access points, and give Police immediate seizure and disposal powers overridden from certain Act subsections.

The instrument affects a circumscribed set of actors, both private and public, in clearly delineated ways.

Residents, visitors and passers-by to the Kadjina Aboriginal Community: Any person who brings liquor into, causes liquor to be brought into, or possesses liquor in the two specified lots may commit an offence under regulation 6(1)(a)-(b) and be subject to the prescribed fines (reg 6). The heightened fine tier does not apply to most visitors; for most individuals the maximum fine is $2,000 (reg 6(1) penalty).

Licensees, managers of licensed premises and directors of corporate licence-holders: These persons are singled out for a higher pecuniary penalty. Regulation 6(2) expressly applies to "an offence under subregulation (1) committed by a licensee, a manager of licensed premises or a director of a body corporate that holds a licence." In those cases the penalty for the offence is $5,000. That creates differential legal exposure for persons who hold liquor licences or manage licensed premises even where the breach is the same factual act of bringing or possessing liquor in the community.

Commercial carriers and suppliers: While the regulations do not expressly name carriers or suppliers, the prohibition on "causing liquor to be brought into" the community (reg 6(1)(a)) reaches persons who arrange transport or delivery. That may affect freight contractors, taxi drivers, local retailers delivering to the area or others involved in supply chains. The regulations do not create an express prima facie defence for carriers; carriers may be exposed if their conduct falls within "causing liquor to be brought into" the area.

Police: Members of the Police Force are granted operational powers under regulation 7 to seize and to dispose of opened or unopened containers of liquor suspected on reasonable grounds to be the subject of an offence under regulation 6. The regulation requires seizure and disposal to be carried out "as soon as is practicable." Police officers will be decision-makers on the reasonable grounds question and on the timing and manner of disposal (reg 7).

Director of Liquor Licensing: The Director has an administrative duty to cause notices to be posted at each place where a "customary access route" enters the Kadjina Aboriginal Community and to keep them posted while the area remains restricted (reg 5(1)). The obligation is phrased as taking "all reasonable steps" to cause posting and maintenance. However, the regulations expressly state that failure to comply with that duty does not invalidate the declaration in regulation 4 (reg 5(2)), which limits the legal exposure of the Director in a way that keeps the underlying prohibition in force regardless of signage.

Courts and enforcement agencies: The courts will impose fines following convictions for offences under reg 6. The regulations do not specify other sanctions, diversion, or alternative penalties; pecuniary fines are the prescribed maximums (reg 6).

Other statutory instruments and regulatory administrators: The Part 5 amendment inserts a reference to these regulations into the Liquor Control Regulations 1989 (reg 10). That will affect how enforcement or ancillary provisions in the 1989 Regulations refer to or treat the offence in reg 6(1), depending on the content of the existing Table in reg 27(4). The regulations themselves do not reproduce reg 27(4)'s wider operation.

Local community institutions and governance: The regulations apply to all persons irrespective of local governance arrangements. The source defines the community by cadastral parcels (reg 3) rather than by reference to community governance or membership, so the prohibitions are territorial (place-based) rather than person- or status-based beyond the licence-holder penalty tier.

In short, the instrument places criminal and pecuniary exposure on any person who brings or possesses liquor in the two specified lots; it increases exposure for licence-holders and persons tied to licensed premises; it places a signage duty on the Director of Liquor Licensing; and it grants Police seizure-and-disposal powers. The legal incidence of the penalties is therefore concentrated on those who enter or operate in the two cadastral parcels, with enforcement power concentrated in Police and administrative duties placed on the Director (regs 3-7, 10).

This instrument creates a small set of enforceable duties and implicitly affects rights by criminalising conduct and authorising disposal of property.

Duties created by the regulations

• Duty not to introduce or possess liquor: The central obligation is on persons to refrain from bringing liquor into, causing liquor to be brought into, or possessing liquor within the Kadjina Aboriginal Community (reg 6(1)(a)-(b)). The duty is territorial and continuous while the regulation remains in force.
• Duty on Director of Liquor Licensing to post notices: Regulation 5(1) requires the Director to "take all reasonable steps" to cause notices to be posted at each place where a customary access route enters the community, and to keep those notices posted while the area remains restricted. The notices must describe the offences in regulation 6 and specify the penalties (reg 5(1)(a)-(b)). The duty is procedural and preventive in aim.
• Administrative discretion and obligation on Police: Regulation 7 places operational duties on Police to seize containers suspected on reasonable grounds and to dispose of them as soon as practicable. That is an operative enforcement duty with a timing requirement.

Monetary sanctions and criminal procedure

• Pecuniary penalties: Regulation 6 prescribes fines as the penalty for contravention. The level depends on the offender’s status: $5,000 for a licensee, manager of licensed premises or director of a corporate licence-holder; $2,000 for other persons (reg 6(1) penalty; reg 6(2)). The regulations do not specify alternative sanctions, imprisonment, or other administrative sanctions; they prescribe fines only.

Rights affected or implicated

• Right to possess property: The regulations authorise Police to seize and dispose of opened or unopened containers of liquor suspected on reasonable grounds to be the subject of an offence under reg 6 (reg 7). The disposal power will affect the ability of a person to recover or retain the seized property. The regulation requires disposal "as soon as is practicable," which places an operational time constraint on Police action.
• Procedural protections implicit in "reasonable grounds": Regulation 7 conditions seizure and disposal on the existence of "reasonable grounds" to suspect the container is the subject of an offence under reg 6. That phrase imports an objective standard for seizure decisions, though the regulation does not stipulate additional procedural safeguards, return mechanisms, or compensation rules.
• Notice and fairness: The Director’s obligation to post notices at customary access routes is a preventive transparency measure intended to inform entrants of the offences and penalties (reg 5(1)). However, the regulations also state that failure to post does not invalidate the declaration (reg 5(2)), which limits the protective effect of non-compliance by the Director on a person’s exposure to liability.
• Differential liability for licence-holders: The regulations impose heavier financial penalties on licensees, managers and corporate directors (reg 6(2)). That treats regulated persons differently from others with respect to the same prohibited conduct. The regulations do not supply a rationale within the instrument; they create the differential exposure as a legal fact.

Delegation, discretion and enforcement mechanics

• The Director’s obligation is framed as taking "all reasonable steps" to cause posting. That phrase requires an exercise of administrative judgement as to what steps are reasonable in the circumstances. The regulations do not prescribe minimum content beyond stating that the notices must "describe the offences set out in regulation 6" and "specify the penalties for those offences" (reg 5(1)).
• Police discretion is central to enforcement. Regulation 7 places the onus on Police to form reasonable grounds for suspicion before seizing and disposing of containers; timing and disposal method are within Police operational control, subject to the "as soon as is practicable" requirement.

Interplay with the Act and other instruments

• The declaration uses s 175(1a) of the Act as its enabling head (reg 4). The regulation 7 seizure power operates "despite" s 155(4) and (5) of the Act, indicating an intentional regulatory override or modification of those subsections' effect for these regulations (reg 7). The Part 5 amendment inserts a reference to reg 6(1) in regulation 27(4) of the Liquor Control Regulations 1989 (reg 10), bringing the offence into the internal cross-reference framework of the older regulations.

In practical effect, the duties are straightforward: do not bring or possess liquor in the defined lots; expect signage at customary access points; expect Police powers of seizure and disposal; regulated persons must take extra care because of higher fines. The instrument sets the enforcement rules and the institutional roles, leaving operational judgments to the Director and to Police within the bounds stated (regs 5-7).

The regulations specify pecuniary penalties and assign enforcement functions principally to Police and the Director of Liquor Licensing. The text sets out the maximum fines, the persons against whom the higher penalties apply, and an express mechanism for seizure and disposal.

Specified penalties

• Two-tier pecuniary regime: Regulation 6(1) creates the offence and attaches penalties that operate by reference to subregulation (2). For offences under reg 6(1):
  • Where subregulation (2) applies (that is, the offender is a licensee, manager of licensed premises or a director of a body corporate that holds a licence), the prescribed penalty is a fine of $5,000.
  • In any other case, the prescribed penalty is a fine of $2,000.
• The regulations do not provide for imprisonment, disqualification, licence suspension, injunctive relief or other non-pecuniary penalties within the instrument; they limit the regulatory sanction to monetary fines (reg 6).

Enforcement authorities and their powers

• Police seizure and disposal: Regulation 7 authorises a member of the Police Force to seize and, "as soon as is practicable, dispose of" any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under regulation 6. The regulation expressly states this operates "despite section 155(4) and (5) of the Act" (reg 7). That language indicates an intention to disapply or modify the operation of those subsections of the Act in relation to these regulations. The practical effect is to empower Police to not only seize but dispose promptly of seized containers without being constrained by the particular limits that s 155(4) and (5) would otherwise impose, at least insofar as these regulations are concerned.
• Procedural standard: The seizure power is gated by the "reasonable grounds" standard. That imposes an objective threshold for lawful seizure. The regulations do not list what will count as reasonable grounds; operationally, that assessment rests with the seizing officer and ultimately with the courts on review.
• Timing and disposal obligations: The requirement to dispose "as soon as is practicable" places an operational timing obligation on Police. The regulations do not detail disposal methods, record-keeping requirements, notice to owners, retention periods, or compensation protocols.
• Director’s signage duty: Regulation 5(1) imposes an administrative duty on the Director of Liquor Licensing to take all reasonable steps to cause notices to be posted and kept posted at customary access route entry points. Notices must describe the offences and specify penalties. The Director’s role is preventive and informational rather than punitive.
• Non-invalidating failure to post: Regulation 5(2) provides that a failure to comply with the posting duty does not invalidate the declaration in regulation 4. That limits the degree to which procedural non-compliance by the Director will provide a defence or procedural relief to an accused person.

Enforcement mechanics and likely outcomes

• Quick disposal reduces evidentiary recovery: Because Police may dispose of seized containers "as soon as is practicable," there is a reduced likelihood that an accused will be able to recover the physical container for evidentiary, commercial or sentimental purposes. Disposal may also shorten the window for contesting seizure and seeking return.
• Practical enforcement focus: The location-specific nature of the prohibition concentrates enforcement at entry points and within the cadastral parcels. Officers exercising the seizure power will need to form reasonable grounds in situ and may act to remove liquor from circulation quickly.
• Court-imposed monetary penalties: The regulations provide the penalty framework; courts will calculate and impose fines following conviction. The regulations do not specify non-conviction disposals such as infringement notices or administrative penalties; the text only prescribes fines as the penalty for the offence. How courts exercise sentencing discretion for actual contraventions is governed by the Act and general criminal sentencing principles, which these regulations do not recapitulate.

Limitations and evidence considerations

• "Reasonable grounds" creates evidential threshold: Seizure must be based on reasonable grounds; officers will need to document their reasons to support both seizure and disposal decisions if challenged.
• Lack of detailed procedural protections: The regulations do not set out return procedures, compensation or appeal mechanisms against seizure and disposal. That absence leaves those matters to other parts of the Act, general law, or administrative practice, none of which are reproduced in these regulations.

In summary, enforcement under the instrument is two-part: preventive (signage duties) and reactive (Police seizure and disposal, criminal prosecution with pecuniary fines). The higher monetary exposure for licence-holders is a notable enforcement lever (reg 6). The seizure-and-disposal power is immediate and operational, and it is expressly made to operate notwithstanding s 155(4) and (5) of the Act (reg 7).

The regulations are expressly made under the Liquor Control Act 1988 and reference provisions of the Act. They also amend the Liquor Control Regulations 1989 by inserting a cross-reference. The instrument interacts with the Act in limited, specified ways.

Enabling and modifying operation of the Act

• Enabling head: The declaration of the restricted area is expressly for the purposes of section 175(1a) of the Act (reg 4). The regulations do not reproduce the text of s 175(1a) but rely on it as the statutory foundation for declaring locations to be restricted areas.
• Seizure power versus Act subsections: Regulation 7 authorises Police to seize and dispose of containers "despite section 155(4) and (5) of the Act." That phrasing denotes that to the extent s 155(4) and (5) of the Act otherwise restrict or direct seizure or disposal powers, reg 7 changes their operation for the containers suspected of being the subject of an offence under reg 6. The regulations do not set out the content of s 155(4) and (5); they simply carve out an exception or override in favour of the express power in reg 7.

Interaction with Liquor Control Regulations 1989

• Part 5 amends the Liquor Control Regulations 1989: Regulation 10 inserts, in regulation 27(4) of the 1989 Regulations, an entry referencing "Liquor Control (Kadjina Restricted Area) Regulations 2020 regulation 6(1)". The insertion is administrative and creates an internal cross-reference within the 1989 Regulations. The exact operational consequence depends on the existing text and structure of reg 27(4) of the 1989 Regulations, which is not reproduced in these regulations. The amendment ensures that the offence is captured by any processes or tables that depend on reg 27(4)'s entries (reg 10).

Territorial and cadastral precision

• The regulations define the Kadjina Aboriginal Community by cadastral lot references (reg 3). That method ties the regulatory effect to land titles rather than to community membership, customary law or other governance instruments. Any interaction with land law, title, or native title is not addressed in the text; the regulations simply operate on the named lots.

Procedural and evidential interactions not specified

• The regulations do not restate broader prosecutorial, evidential or defence provisions from the Act. They do not set out special court procedures, alternative penalties or review rights beyond the fines and seizure/disposal powers specified. Therefore, interactions with criminal procedure law, evidentiary rules, and general rights are left to the Act and general statutory framework, which are not reproduced here.

Notice and administrative interaction

• The Director of Liquor Licensing must take reasonable steps to post notices at "customary access routes" (reg 5(1)). The regulations do not define "customary access route" and do not cross-reference other instruments for that definition. That leaves an administrative interpretative question as to what constitutes a customary access route for placement of notices.

Amendments and temporal interaction

• Regulation 8 sets an expiry date (closes on 10 October 2035), after which the regulations cease to have effect unless renewed or saved by other legislative action (reg 8). That interacts with any longer-running obligations or licences by creating a finite regulatory window.

Consequential and collateral interaction

• Because the regulations criminalise possession and introduction of liquor in the defined area, they will interact practically with transport, retail and hospitality businesses that might otherwise supply liquor into or across those parcels. However, the instrument does not directly regulate those businesses beyond imposing liability where those actors cause liquor to be brought into the area (reg 6(1)(a)). Any licences or contractual obligations affected would interact with these regulations indirectly, by altering the legal environment where operations occur.

In summary, the regulations sit as a localised extension of the Act’s restricted-area powers, modify certain Act seizure/disposal provisions by express override, and add the new offence into the 1989 Regulations’ cross-reference table. The regulations are territorial, rely on the Act as their statutory base, and leave procedural, evidential and many definitional matters to the broader legislative framework or administrative interpretation (regs 3-7, 10).

The instrument includes a short recorded amendment history in the Notes and compilation table. The regulations were made in 2020 and later amended in 2025. The compilation notes identify what changed and when.

Original enactment and commencement

• The Liquor Control (Kadjina Restricted Area) Regulations 2020 were published as SL 2020/218 on 6 November 2020. Regulations 1 and 2 (citation and commencement particulars) commenced on their publication date, 6 November 2020; all other regulations came into operation the following day, 7 November 2020 (compilation table; r 2(a)-(b)).

Subsequent amendment

• The compilation table and a marginal note indicate that the regulations were amended by SL 2025/169, published 2 October 2025. For that instrument, regulations 1 and 2 commenced on 2 October 2025 and the other regulations commenced on 3 October 2025 (compilation table). The Notes state that "Regulation 8 amended: SL 2025/169 r. 4." The marginal note to regulation 8 records that amendment history (reg 8 note).

Nature of the amendment

• The text explicitly records that r 8 was amended by SL 2025/169 r. 4. Regulation 8 sets the period during which these regulations have effect and fixes expiry at the close of 10 October 2035. The annotation shows the 2025 instrument altered or confirmed the temporal operation of the regulations; the compilation table lists both the original 2020 regulations and the 2025 instrument. The precise wording of the 2025 amendment is not reproduced beyond the marginal note and the compilation table entry, but the entry makes clear the drafters updated regulation 8 in 2025.

Compilation table entries

• The compilation table records two citations:
  • The Liquor Control (Kadjina Restricted Area) Regulations 2020 (SL 2020/218) published 6 Nov 2020, with r 1 and 2 commencing 6 Nov 2020 and other regulations commencing 7 Nov 2020.
  • The Liquor Control (Kadjina Restricted Area) Regulations 2025 (SL 2025/169) published 2 Oct 2025, with r 1 and 2 commencing 2 Oct 2025 and other regulations commencing 3 Oct 2025.

Other notes and expiry

• The "Other notes" section records that the regulations expire at the close of 10 October 2035 (see r 8). That expiry is part of the instrument’s built-in temporal limitation and has been maintained in the compilation notes.

Effect on other instruments

• The instrument itself also amends the Liquor Control Regulations 1989 (Part 5, regs 9-10), with regulation 10 inserting an entry in regulation 27(4) of the 1989 Regulations to include "Liquor Control (Kadjina Restricted Area) Regulations 2020 regulation 6(1)". This amendment is part of the original instrument and is recorded in the compilation as part of the 2020 instrument; no subsequent history for that amendment is recorded.

No recorded repeals or judicial alterations in the instrument

• The compilation notes and the text do not record any repeal, revocation or judicial decision altering the substance of the 2020 Regulations other than the 2025 amendment to regulation 8. There is no entry in the compilation table for repeal or discontinuance beyond the expiry date recorded in regulation 8.

Practical consequence for users

• Practitioners relying on these regulations should note the recorded amendment to regulation 8 and the expiry date of 10 October 2035, and consult the 1989 Regulations for any operational effects of the reg 27(4) insertion. The compilation table provides commencement dates for the original instrument and the 2025 amendment and should be used when addressing temporal application of obligations and liabilities (compilation table; r 8 note; regs 9-10).

In short, the instrument was made in 2020 and was formally amended in 2025 with at least the temporal provision (r 8) being altered; its entries into the Liquor Control Regulations 1989 were part of the original package and remain recorded in the compilation notes.

The regulations themselves do not record any litigation or judicial consideration. The text, compilation table and notes contain no references to cases, appeals, or court decisions affecting the instrument.

What the instrument records

• There are no named cases or judicial orders cited in the regulations or the accompanying Notes. The compilation table records enactment and amendment instruments only (SL 2020/218 and SL 2025/169). There is no internal reference to any litigation, declaratory relief, injunctions, or judicial interpretation. The instrument thus presents as an unlitigated statutory instrument within the record contained in the source.

Implications for research and advice

• Because the regulations do not include litigation or decision-history, practitioners should not assume any particular judicial construction has been applied to the key phrases in the instrument such as "customary access route," "reasonable grounds," "causes liquor to be brought into," or the interpretation of the penalty-tiering provision. Those interpretive questions remain to be resolved in context by courts if and when disputes arise.
• The absence of litigation history in the instrument does not mean that disputes will not occur. The regulations create enforcement powers and criminal offences that could generate contested issues in practice, particularly around:
  • The meaning and scope of "customary access route" for the purposes of the signage duty in reg 5(1).
  • The application of "reasonable grounds" for seizure and the adequacy of police procedure under reg 7.
  • The scope of "causes liquor to be brought into" in reg 6(1)(a), including whether third-party carriers or intermediaries fall within that prohibition.
  • The effect of regulation 5(2) stating that failure to post notices does not invalidate the declaration, and whether such failure might nevertheless be adduced by a defendant as a mitigating circumstance or in arguments about procedural fairness.
  • The application of the higher penalty tier in reg 6(2) to licence-holders and the circumstances that constitute an offending act by a licensee, manager or director.

Recommended approach for practitioners

• If an immediate matter arises under these regulations, prosecution, seizure, challenge or compliance issue, practitioners should search court databases, tribunal records and administrative decisions beyond this instrument for any instances of enforcement or judicial review. The regulations themselves do not supply that history.
• When advising clients in the Kadjina area or dealing with carriers and licence-holders whose operations could interact with the defined lots, assume that interpretive questions remain open absent any reported judicial authority referenced in the instrument.

To summarise, the regulations as published contain no litigation history. Key interpretive and procedural issues evident from the text remain to be tested in courts or tribunals and are not resolved or referenced in the instrument itself.

Several practical and legal pitfalls arise on the face of the instrument. These are not normative judgements but concrete points where the regulations create uncertainty, enforceable obligations, or operational friction.

Undefined or vague terms left to operational interpretation

• "Customary access route" is used in regulation 5(1) without definition. The Director must post notices at "each place where a customary access route enters the Kadjina Aboriginal Community." The absence of a statutory definition means the identification of where notices must be placed is an administrative, factual question. That creates scope for disagreement between the Director, local community members, and other parties about which entry points are "customary" for the purpose of posting (reg 5(1)). Practitioners should note that the posting duty’s execution will therefore require factual inquiry and record-keeping to show what steps were taken.

Signage failure does not invalidate the declaration

• Regulation 5(2) provides that a failure to comply with the posting duty does not invalidate the declaration in regulation 4. This limits a technical defence that might otherwise be available to an accused person who was not adequately notified. Practically, it means people can be prosecuted for the offences in reg 6 even if notices were not posted at all customary access routes. The legal effect is that notice is administratively required but not a condition precedent to the declaration’s legal force (reg 5(2)).

Broad reach of "causes liquor to be brought into"

• The prohibition on "causing liquor to be brought into" the community (reg 6(1)(a)) is wide in potential scope. It may reach suppliers, carriers, drivers or even people who arrange or facilitate transport into the area. There is no express carve-out for commercial carriers or bona fide carriers acting without knowledge. That breadth can expose third parties to enforcement risk unless the conduct is carefully managed and legal advice is sought.

Differential penalties for licence-holders

• Licensees, managers of licensed premises and directors of corporate licence-holders face a higher penalty ($5,000) than other persons ($2,000) for the same prohibited conduct (reg 6(2)). That raises compliance stakes for those parties and could motivate different operational responses, such as contractual prohibitions on deliveries or stronger diligence about what staff and contractors carry. The regulations do not spell out whether vicarious liability principles will apply, so licence-holders should be alert to potential direct exposure.

Seizure and disposal without detailed safeguards

• Regulation 7 authorises Police to seize and dispose of opened or unopened containers of liquor suspected on reasonable grounds of being the subject of an offence. Disposal is to occur "as soon as is practicable." The regulations do not specify notice to owners, retention periods, record-keeping, or remedies for wrongful seizure or disposal. This creates practical risks:
  • Rapid disposal may frustrate attempts to recover property or to preserve evidence.
  • Absent statutory return procedures in the regulations, property owners may have to rely on other parts of the Act or common law remedies to recover losses.
  • The "despite s 155(4) and (5)" language indicates the regulations alter other Act protections, but the reader must consult the Act to understand what is being modified (reg 7).

Temporal limit and policy expiry

• The regulations expire at close of 10 October 2035 unless sooner repealed (reg 8). Any long-term planning, licences, or contractual arrangements that intersect with the Kadjina area must factor in that temporal limitation. The 2025 amendment to r 8 is recorded, so practitioners should track further amendments that may shorten or extend the duration.

Cross-references and administrative integration

• The insertion into the Liquor Control Regulations 1989 (reg 10) creates cross-referential obligations or captures the offence within any processes tied to regulation 27(4) of the 1989 Regulations. Without reproducing reg 27(4), it is not possible from this instrument alone to see all administrative consequences; practitioners must inspect the 1989 Regulations to determine what the insertion changes procedurally.

Potential evidentiary and operational friction at entry points

• Enforcement concentrated at entry routes raises practical enforcement questions: how will Police distinguish between lawful transit and possession offences, especially where vehicles or carriers pass through the area? The regulations do not provide clear procedural guidance for inspections, searches, or consent to search. The "reasonable grounds" standard will be central but fact-dependent (reg 7).

No transitional or grandfathering exceptions

• The regulations do not provide exemptions for residents, returning community members, medical or religious uses, or predetermined exceptions. The absence of such exceptions in the text means that, absent other statutory provisions elsewhere, the prohibition applies generally to all persons who enter or are present in the defined parcels with liquor (reg 6). Practitioners should not assume innate exceptions exist within the instrument.

Record-keeping and evidential burden for Director

• The Director must take "all reasonable steps" to cause notices to be posted (reg 5(1)). Administrative records evidencing the steps taken, photographs, dates and locations, communications with local bodies, will be relevant if the Director’s compliance is in issue. Although failure to post does not invalidate the declaration, proof that notice was attempted may still be relevant in defence or mitigation contexts.

In short, the main "gotchas" are the undefined terms that leave scope to contest notice placement and seizure reasonableness, the non-reliance of the declaration on proper posting, the broad "causing to be brought into" language, the heavier penalty tier for licence-holders, and the rapid disposal power with minimal procedural detail. These create practical compliance, evidentiary and operational challenges that require attention from affected persons and enforcement bodies (regs 3-7, 10).

Compliance requires actions by different actors: residents and visitors, licence-holders and managers, carriers/suppliers, the Director of Liquor Licensing, and Police. The regulations specify core prohibitions and duties; compliance is therefore an exercise in avoidance, notification, documentation and operational process.

Practical steps for residents, visitors and passers-by

• Avoid bringing liquor into the two specified lots. The central compliance rule is territorial: do not bring liquor into, cause liquor to be brought into, or possess liquor in the Kadjina Aboriginal Community (reg 6(1)(a)-(b)). When entering the area, ensure vehicles, personal effects and companions do not carry liquor.
• If carrying liquor inadvertently, remove it before entry or return it to a lawful place outside the defined parcels to avoid being in possession within the area.
• Pay attention to posted notices at entry points; they must describe the offences and specify the penalties (reg 5(1)). Even though failure to post does not invalidate the declaration, actual posted notices will inform individuals of the prohibition and reduce the risk of accidental non-compliance.

Actions for licensees, managers and directors

• Implement strict internal controls to prevent staff, contractors and patrons from bringing liquor into the Kadjina lots. The penalty for an offence committed by a licensee, manager or director is higher ($5,000) (reg 6(2)). That creates a need for heightened diligence.
• Update employee policies and contracts to prohibit transportation of liquor into the specified parcels and to require reporting and checks. Train staff, especially those involved in deliveries, transport or remote operations, on the territorial prohibition and the consequences.
• For corporate licence-holders, ensure directors and officers are briefed and that corporate policies address delivery routes and third-party contractors who might cause liquor to be brought into the area.

Guidance for carriers, suppliers and transporters

• Adjust supply chain operations to avoid delivering liquor into the specified lots. If a contract or order might cause liquor to be brought into the area, obtain clear instructions to reroute or refuse such deliveries.
• Implement dispatch checks and driver briefings that map out the cadastral lots and provide an operational checklist for avoiding the area. Given the broad language "causes liquor to be brought into," ordinary carriers should treat any delivery destination within the two lots as prohibited unless they hold advice confirming otherwise.

Director of Liquor Licensing compliance

• Take "all reasonable steps" to cause notices to be posted at each place where a customary access route enters the Kadjina Aboriginal Community and keep them posted while the area remains a restricted area (reg 5(1)). Reasonable steps may include consulting local maps, community representatives and on-site verification.
• Document actions taken: records of notices posted (photographs, coordinates), communications with local authorities and schedules for maintenance. Although failure to post does not invalidate the declaration (reg 5(2)), good administrative records will reduce dispute risk and demonstrate diligence.
• Define "customary access routes" operationally for the purpose of posting: consult with local community representatives to identify customary entry points and log the rationale for selection.

Police operational compliance

• Ensure seizure actions are based on "reasonable grounds" and that these grounds are recorded contemporaneously. Regulation 7 requires seizure and disposal only where there are reasonable grounds to suspect the container is the subject of an offence under reg 6.
• Follow internal Police protocols for the disposal of seized items while observing the "as soon as is practicable" requirement. Recording the method of disposal and chain of custody will be important if seizure or disposal is later contested.
• Be mindful that regulation 7 operates "despite" s 155(4) and (5) of the Act. Police should confirm how the regulation interacts with broader Act requirements and internal guidelines to avoid procedural errors.

Record-keeping and evidence

• Individuals and businesses should maintain records evidencing steps taken to avoid contravention. For businesses, that includes delivery logs, driver instructions, staff training records and policies that expressly prohibit delivering or carrying liquor into the area.
• The Director’s office should keep posting logs, photographic proof of notice content and location, and evidence of any maintenance or replacement of signage.

Anticipating enforcement and preparing defences

• Preserve evidence that you did not "cause" liquor to be brought into the area if accused. For example, proof that a carrier acted without your instruction or that liquor was removed prior to entry may be relevant.
• If a licence-holder is charged, preparatory records demonstrating steps taken to prevent contraventions (policies, instructions, staff training) may be useful mitigation evidence in court.

Practical checks and mapping

• Use cadastral references in regulation 3 (Lot 9 DP 238001, LR3011/45; Lot 60 DP 238001, LR3011/50) to map the boundary precisely and inform routing decisions. Confirm on-the-ground entry points and customary routes with local community representatives.
• Ensure signage is visible, accurate and maintained at customary access routes, including replacement where necessary.

Legal advice and escalation

• If there is any uncertainty about whether a planned activity causes liquor to be brought into the restricted area, obtain legal advice. Because the regulation’s scope is territorial and enforcement can lead to seizure and disposal, early legal review is advisable for businesses and licence-holders who operate in nearby areas.
• If Police action occurs (seizure and disposal), document the interaction, obtain particulars of the grounds for seizure and seek early legal advice if the seizure appears unlawful or the disposal raises potential compensation issues.

In summary, compliance requires three concurrent practices: avoid introducing or possessing liquor in the designated parcels, maintain and document preventive processes (especially for licence-holders and carriers), and ensure that administrative actors (the Director and Police) perform their duties with contemporaneous records. The regulations create clear prohibitions and enforcement powers; practical compliance is achieved through route-mapping, staff training, contractual controls and evidence-rich administrative actions (regs 3-7).
