What it does
This instrument, the Liquid Fuel Emergency (Activities,Essential Users) Determination 2019, is a ministerial determination that lists, by activity, a set of services to be treated as the activities "determined for the purposes of paragraph 11(1)(d) of the Act" (see s 6). The instrument is made by the Minister for Energy, Angus Taylor, and is expressly made under subsection 11(3) of the Liquid Fuel Emergency Act 1984 (s 3). Its operative content is concise: it identifies seven categories of activities (ambulance service; corrective service; fire or rescue service; police service; public transport service; State Emergency Service or an equivalent organisation; taxi service) and thereby replaces the prior instrument of the same kind from 2008 by repealing it in full (Schedule 1).
Mechanically, the instrument performs three tasks:
- It declares its name (s 1).
- It sets out a conditional commencement arrangement that ties its effect to registration and to the commencement of the Liquid Fuel Emergency Guidelines 2019 (s 2). The table in s 2 states that the whole instrument commences on the later of: the start of the day after the instrument is registered, and immediately after the commencement of the Liquid Fuel Emergency Guidelines 2019; and it adds that the provisions will not commence at all if the latter event does not occur.
- It substitutes a new list of activities for the purposes of paragraph 11(1)(d) of the Liquid Fuel Emergency Act 1984 (s 6), and repeals the 2008 Determination (Schedule 1).
The instrument contains a single defined term, "Act", which is defined to mean the Liquid Fuel Emergency Act 1984 (s 5). The instrument otherwise relies on the Act for its legal context; it does not reproduce paragraph 11(1)(d) or the Guidelines it references. In short, the 2019 Determination is an activity-based listing instrument made under the delegated power in s 11(3) of the Act; its legal effect is triggered only if, and when, the companion Guidelines commence and the instrument is registered (s 2), and it supplants the prior 2008 instrument (Schedule 1).
