What it does
This instrument is a licence area plan, determined under subsection 26(1) of the Broadcasting Services Act 1992 (the instrument itself states that legal basis at Determination (1)). Mechanically, it fixes which radio broadcasting services, and on what frequencies, are to be available in the Port Hedland licence areas identified in the plan. Clause (2) prescribes that six national radio broadcasting services, two commercial radio broadcasting services and two open narrowcasting services are to be available in the area described at Attachment 1.1, and clause (3) prescribes that one community radio broadcasting service is to be available in the area described at Attachment 2.1. The technical characteristics and transmitter specifications for each listed service are set out in Schedule One, Schedule Two and the Attachments named in those schedules.
Schedule One identifies PORT HEDLAND RA1 and lists service category, frequency, service licence number (where applicable), transmitter specification number and which attachment contains further detail. Examples from Schedule One include a national service on 603 kHz (transmitter specification TS10001804, Attachment 1.2), commercial services on 1026 kHz and 94.1 MHz both under Service Licence No SL10342 (TS10001803 and TS1138050; Attachments 1.8 and 1.9), and open narrowcasting services on 92.5 MHz and 104.5 MHz (Attachments 1.13 and 1.14). Schedule Two lists PORT HEDLAND RA2 and shows a community service at 101.3 MHz with Service Licence No SL10343 and transmitter specification TS10000783 (Attachment 2.2).
Clause (4) sets interpretative rules for the plan: references to a schedule or attachment include that schedule or attachment as amended from time to time; references to other legislative instruments are to those instruments in force from time to time; references to other writings are to those writings as in force at the time the reference was included (clause (4)(a)-(c)). The plan also records that it was determined by the Australian Broadcasting Authority on 21 June 1996.
