The Determination organises spectrum allocation for the Nambour area around several core concepts set out in the schedules and attachments.

Allocation by service category and status: Schedule One and Schedule Two list services by category (National, Commercial, Community) and include a Status column. The Determination explains the Status labels: Licensed (service already licensed), Available (new licence available for allocation), Proposed (transmitter for an existing broadcasting service licence), Alternative (alternative channel proposed for licensed service), and Reserved (capacity reserved for a national or community service in accordance with Ministerial notification). The Determination emphasises that the Status column does not itself form part of the licence area plan decision (Schedules explanatory text).

Licence versus technical elements: The document distinguishes the service licence number and the transmitter technical specification. The service licence number is shown in column four where one has been allocated; the Determination notes that N/A appears for national services because the Broadcasting Services Act 1992 requires service licences only for commercial and community services (Schedules explanatory text). The transmitter technical specification number (column five) and the attachment number (column six) identify the set of technical constraints that will govern each transmitter.

Technical specification as regulatory device: Each Attachment (1.2-1.7 and 2.2-2.3 where applicable) sets out the technical specification for a transmitter. That specification records:

• nominal transmitter site name and Australian Map Grid reference (e.g., TV Translator Site Dulong Lookout, Reference 56 491040 7054115 for TS3016002; Broadcast Site Bald Knob, Reference 56 491799 7036600 for TS10008223),
• carrier frequency (centre frequency of channel),
• frequency band and mode (VHF-FM),
• polarisation (mixed),
• maximum antenna height (34 m for national, 40 m for commercial),
• output radiation pattern specified as maximum ERP by bearing sectors (for example, national services TS3016002, TS4179002, TS4236001: 0°T-220°T 20 kW, 220°T-350°T 4 kW, 350°T-360°T 20 kW; commercial services TS10008223 etc show more granular sector powers).

Site tolerance and Technical Planning Guidelines: Every technical specification includes the note "Site Tolerance: Refer to Technical Planning Guidelines", which means that the attachment defers to an external set of planning rules for exact site variation and construction tolerances.

Geographic definition by ABS collection districts: Licence areas are defined by Australian Bureau of Statistics collection districts as at the 6 August 1996 Census. Attachment 1.1 and Attachment 2.1 list the CD codes and names that make up the commercial and community licence areas for Nambour. The use of Census CD boundaries is the mechanism by which the Determination fixes the regulatory extent of each licence area.

Risk allocation via disclaimer: The Determination contains explicit risk allocation language. It states the ABA takes reasonable care in assigning frequencies but cannot warrant that licensed use will be free from interference, warns about theoretical nature of interference predictions, and disclaims liability on behalf of the Minister, ABA, Commonwealth and their officers for licensed use that is not free from (or causes) interference. It also advises obtaining independent technical advice.

Formal source: The instrument is expressed as a Determination under subsection 26(1) of the Broadcasting Services Act 1992, so its legal status is that of a plan made under the BSA; the Determination records that it "makes this plan for broadcasting services in the Nambour area of Queensland, under subsection 26(1) of the Broadcasting Services Act 1992" (opening paragraph).

In sum, the main concepts are: (1) categorical allocation of spectrum slots by service type and status; (2) binding transmitter technical specifications identified by specification numbers and attachments; (3) geographic licence areas fixed by ABS CDs; (4) reliance on Technical Planning Guidelines for tolerances; (5) a formal disclaimer on interference prediction limits and liability.

The Determination names several classes of actors and affects them in distinct ways.

The Australian Broadcasting Authority (ABA): the ABA is the decision-maker that made the plan under s 26(1) BSA 1992 (Determined by the Australian Broadcasting Authority on 21 December 2000). The ABA therefore determines which services are to be available in the area and the technical parameters for transmitters. The ABA’s operational role is visible in the issuance of technical specification numbers (TSxxxxx) and attachment numbers for each transmitter.

Existing national broadcasters: three national radio broadcasting services are listed as "Licensed Reserved" (88.7, 89.5, 90.3 MHz) with Service Licence No recorded as N/A because the Broadcasting Services Act 1992 does not require service licences for national services (Schedule One; Attachments 1.2-1.4). Existing national broadcasters operating at these frequencies will be governed by the technical specifications in the attachments (site, ERP sectors, antenna height).

Existing commercial broadcasters: the schedule shows commercial services with Service Licence Nos SL10307 and SL4184 (91.9 MHz and 92.7 MHz) marked as Licensed; these licensees are required to operate in accordance with the technical specifications TS10004669 and TS4184601 (Attachments 1.6, 1.7). The Determination therefore directly constrains transmitter parameters and coverage for those operators.

Aspirant commercial and community broadcasters: the schedules show "Available" slots for a commercial service at 91.1 MHz (SL1150116, TS10008223) and two community services at 104.9 MHz and 106.5 MHz (SL1150113; SL1150720). These entries indicate that new licences may be available for allocation; prospective applicants are specifically addressed in the Disclaimer where the ABA recommends they obtain independent technical advice before competing for spectrum availability. The presence of service licence numbers in the Schedules for Available entries indicates a numbering convention in the Plan, but the Determination makes clear the Status column does not itself form part of the licence area plan decision (Schedules explanatory text).

Technical advisers, broadcast engineers and equipment suppliers: the plan’s technical specifications (carrier frequencies, polarisation, antenna heights, ERP by azimuth sector, map grid references) are directly relevant to engineers who must design transmitter systems and to consultants preparing licence applications. The Determination explicitly instructs both existing broadcasters and aspirant broadcasters to obtain independent technical or specialist advice concerning applications and operation (Disclaimer).

The Minister for Communications, Information Technology and the Arts and Commonwealth officers: the Disclaimer references the Minister and Commonwealth of Australia, noting that no liability is accepted by them for interference outcomes. This places the Ministerial office in a named, but limited-liability, relationship to the determinations.

Local communities and advertisers: while not named in the Determination, the allocation of national, commercial and community services and the technical parameters affecting coverage will affect which audiences can receive services and thus who can be reached by commercial broadcasters and community operators. Licence area boundaries are defined by ABS collection districts (Attachment 1.1 and 2.1), so residents in those CDs fall within the regulatory licence areas.

Regulatory interface parties: the Determination refers to the Technical Planning Guidelines and, by defining frequencies and ERPs, interacts with spectrum management regimes and international coordination practices (the Determination notes that interference can originate within Australia or overseas). Parties responsible for co-ordination (e.g., those managing transmitter sites and international frequency coordination) are therefore implicated.

In practical terms the Determination affects who may operate services in the specified frequencies within the ABS-defined licence areas, the technical design choices available to operators (ERP, antenna height, radiation pattern, polarisation), and the applicant behaviours required (seek technical advice, verify predicted coverage). The document both grants availability status for certain licences and constrains operations via prescriptive technical specifications.

The Determination sets out a set of prescriptive technical rights and de facto duties for licence-holders and applicants; it also includes advisory duties that are addressed to both existing and aspirant broadcasters.

Rights established by the plan:

• Availability and allocation rights: the Determination declares that particular services are "to be available" in the Nambour area: three national and three commercial broadcasting services in Attachment 1.1 (Schedule One) and two community broadcasting services in Attachment 2.1 (Schedule Two). Entities entitled to a licence (where the licence is available and subsequently allocated) obtain the right to operate a broadcasting service in the specified licence area and on the specified transmitter frequency subject to compliance with technical specifications.
• Technical entitlement to specified spectrum: for each transmitter the Determination provides a technical specification number and attachment that fixes carrier frequency, maximum antenna height, polarisation and maximum ERP by azimuth sector (for example, TS10008223 sets 91.1 MHz with sector ERPs of 10 kW, 750 W, 5 kW, 10 kW across defined bearings). A licence-holder therefore has an entitlement to operate within those specified technical bounds.

Duties and constraints appearing in the Determination:

• Operate within technical specifications: the technical specifications in Attachments 1.2-1.7 form the prescriptive parameters for transmitters (carrier frequency, VHF-FM mode, polarisation, max antenna height, ERP by sector). The plan requires that services use the broadcasting services bands and the characteristics in the Schedules and Attachments describe the services that are to be available in the area (opening paragraphs; Attachments).
• Site tolerance compliance: each technical specification includes "Site Tolerance: Refer to Technical Planning Guidelines", which obliges operators to apply the Technical Planning Guidelines when locating and installing transmitters. The Determination therefore imposes an obligation to respect site tolerance rules external to the Determination itself.
• Pre-change verification: the Disclaimer expressly requires "Existing broadcasters should take all reasonable steps to be satisfied that their frequency will operate at the prescribed levels before making changes to its existing technical operating conditions." This is an obligation advised by the ABA to existing licensees.
• Pre-application verification: the Disclaimer places an advisory duty on prospective applicants: "Aspirant broadcasters should take all reasonable steps to be satisfied that their frequency of interest will operate at the prescribed levels before competing for spectrum availability." This instructs applicants to do technical due diligence before applying.
• Independent technical advice: the Determination advises prospective applicants to obtain independent technical or specialist advice concerning applications and the operation of broadcasting equipment. This is framed as a recommendation, but it functions as an expected pre-condition for meaningful compliance.

Limits and caveats on rights:

• Frequency and status not determinative of licence rights: the Schedules explanatory text states that the Status column does not form part of the licence area plan decision and that the frequency shown is the centre frequency of the channel. Practically, this means that the listing of a frequency or a Status label in the schedule is not by itself the full legal basis for a licence right; the act of licensing and licence conditions will be determined under the Broadcasting Services Act 1992 and related processes.
• No warranty of interference-free operation: the Determination explicitly disclaims any warranty that licensed use will be free from interference and disclaims liability on behalf of the Minister, ABA and Commonwealth for licensed use that is not free from (or causes) interference (Disclaimer). This reduces the remedial rights available against the ABA or relevant Minister for interference problems traceable to the predictive limits inherent in the Determination.

Operational consequences linked to duties and rights:

• Licence-holders must plan and operate transmitters within the sectoral ERP limits and antenna heights specified in the relevant attachment (e.g., commercial TS10004669, TS4184601 and TS10008223 list exact ERP for respective bearings). Failure to operate within those parameters would put a licence-holder outside the technical specification set by the plan and likely subject them to enforcement under the BSA and licence conditions (the Determination itself does not set out enforcement, see next sections).
• Applicants have a duty of technical due diligence before bidding or applying for available licences and should factor interference uncertainty and site constraints into project plans and financial modelling.

In short, the Determination creates technical entitlements to spectrum and explicit operational constraints defined in the attachments; it places explicit advisory duties on both existing and aspirant broadcasters to validate the technical feasibility of operation; and it limits recourse against the Commonwealth and ABA by disclaiming liability for interference.

The Determination itself does not set out penalty regimes or enforcement mechanisms in statutory form. It functions as a plan and technical specification instrument under subsection 26(1) of the Broadcasting Services Act 1992 and provides the technical and geographic parameters that licences will reference, but it is silent as to specific penalties, infringement procedures or administrative sanctions.

What the Determination does include relevant to enforcement:

• Prescriptive technical constraints: the Attachments set definitive technical parameters for transmitter operation (carrier frequency, ERP by sector, antenna height, polarisation, site coordinates and a reference to site tolerances in the Technical Planning Guidelines). Those technical specifications are elements that, in practice, would be enforced through licence conditions and spectrum management instruments administered under the Broadcasting Services Act and associated licences. The Determination therefore identifies the facts that enforcement would examine (whether transmission is within authorised ERP sectors, antenna height limits, frequency tolerance, site location tolerance).
• The Status column and service licence numbers: the Schedules show which services are Licensed, Available or Reserved. Where the Plan records a service as Licensed, the licensee’s continued operation would ordinarily be governed by the service licence and licence conditions issued under the Broadcasting Services Act. Compliance and enforcement of those licence conditions are not detailed in this Determination.
• Advisory obligations: the Determination requires neither criminal penalties nor administrative fines in its text; rather, it advises existing broadcasters and aspirants to take reasonable steps and to obtain technical advice (Disclaimer). This is framed as guidance rather than a penalty-linked rule.

What is not in the Determination and therefore relevant to enforcement risk:

• No explicit penalty clauses: the Determination contains no express monetary penalties, suspension powers, or prescribed remedial steps applicable directly under the instrument. There is no text specifying enforcement timelines, infringement notice mechanisms, or review rights within the Determination itself.
• Enforcement bodies and processes not described: the Determination does not enumerate the process by which breaches of the technical specifications are to be identified, notified, contested or rectified. It does not specify appeal channels or administrative review for disputes arising under the Plan.

Implication for practitioners:

• Enforcement and penalties applicable to operations that contravene the technical parameters or licence conditions will derive from the Broadcasting Services Act 1992, the service licences themselves and other applicable regulatory instruments and administrative processes, not from the Determination’s text. The Determination should be treated as specifying the technical parameters and the geographic scope that enforcement authorities will use as a baseline when assessing compliance under the broader legislative and licensing framework.
• Where the Determination designates frequencies as Available, allocation processes and the imposition of licence conditions (including enforcement mechanisms) will occur through the statutory licensing channels provided by the Act and administrative practice.

In short, the Determination supplies the technical and geographic criteria that feed enforcement, but it does not itself establish penalties or procedural enforcement regimes; those are external to and operate in tandem with the Determination under the Broadcasting Services Act 1992 and the licence instruments that flow from it.

The Determination expressly situates itself within the statutory framework of the Broadcasting Services Act 1992 and refers to external planning and administrative inputs. It therefore interacts functionally with other legal instruments and administrative practices.

Statutory basis: the Determination is made under subsection 26(1) of the Broadcasting Services Act 1992. That statutory origin means the Plan operates as a Determination under the Act and must be read and applied in the context of rights, obligations and processes created by the Broadcasting Services Act. The Determination itself repeatedly references that connection, including the note explaining why national services have "N/A" in the Service Licence No column because the Broadcasting Services Act 1992 only requires service licences for Commercial and Community services (Schedules explanatory text).

Licence regime interaction: the Determination lists Service Licence Numbers for commercial and community services where applicable. The Determination’s schedules and attachments provide the technical parameters that will be referenced in the service licences issued under the Broadcasting Services Act. Therefore licence terms, renewal, transfer, and any conditions or enforcement will occur through the service licence instruments issued under the Act; the Plan supplies the technical baseline for those licences.

Technical Planning Guidelines: each technical specification directs readers to "Refer to Technical Planning Guidelines" for Site Tolerance. Those Guidelines are an external instrument that sets planning tolerances, presumably produced by the regulatory authority. The Determination therefore defers detailed implementation tolerances to the Technical Planning Guidelines and must be applied in conjunction with them.

Australian Bureau of Statistics definitions: licence areas are defined by reference to ABS collection district boundaries as at the 1996 Census (Attachment 1.1 and 2.1). This makes the Determination interact with ABS geographic definitions and suggests that administrative boundary changes, later censuses, or local government changes could affect geographic interpretation if not updated. Practitioners must therefore map current geography against the 1996 CD list when advising clients.

Ministerial and Commonwealth roles: the Disclaimer names the Minister for Communications, Information Technology and the Arts and the Commonwealth, and disclaims liability on their part. The Determination’s references show that ministerial notification can affect capacity reservation (Schedules: Reserved = capacity reserved for a national or community service in accordance with Ministerial notification). Thus ministerial decisions under the Act can alter reserved capacity.

Spectrum and interference regimes: the Determination warns interference can originate within Australia or overseas, which implicitly links the Plan to international frequency coordination arrangements (for which there are separate instruments and treaties outside the Determination). While the Determination does not itself implement international coordination rules, its operation will require conformity with national spectrum management practices and cross-border coordination when applicable.

Administrative allocation processes: the Schedule shows some services as "Available" and others as "Licensed". Allocation of Available slots will occur through administrative processes established by the Broadcasting Services Act and the regulatory body. The Determination does not itself run auctions, lotteries or comparative processes but provides the inventory of what is available and the technical baseline for allocations.

Environmental, planning and land-use law: the Determination identifies specific transmitter sites and maximum antenna heights. Erection or modification of towers and transmitter facilities will typically require compliance with planning laws, environmental approvals, land access and lease arrangements under State and local law. The Determination does not address those statutory regimes; practitioners must therefore coordinate with State/local planning and environmental law obligations when implementing the technical specifications.

In summary, the Determination interacts with:

• the Broadcasting Services Act 1992 for statutory licensing, allocation and enforcement;
• the Technical Planning Guidelines for site tolerances and detailed planning rules;
• ABS geographic definitions for licence area boundaries;
• ministerial notification mechanisms for Reserved capacity; and
• other administrative, technical and land-use laws in practice (spectrum management, international coordination, planning and environmental laws), which are not set out in the Determination but are functionally relevant to implementation.

The Determination itself bears a single formal date and signature context: "Determined by the Australian Broadcasting Authority on 21 December 2000" and is repeatedly labelled "Licence Area Plan - Nambour - December 2000". The document does not include any express amendment record, version history, or subsequent modification entries within the text provided.

What the source records:

• The date of the Determination: December 2000, determined 21 December 2000 (opening paragraph).
• No amendment log: there is no express amendment history, re-determinations, replacement text, or revocation statements in the material provided.
• Duplicate printing: the provided material contains repeated blocks of the same Determination text (several pages reproduce the same content). These repetitions appear to be layout duplications rather than substantive amendments.

Consequences for practitioners:

• Treat the Determination as the original December 2000 plan unless there is a separate, later instrument (not provided here) that expressly amends, replaces or revokes it.
• Because the Determination refers to ABS collection districts as at the 6 August 1996 Census and to other external instruments (Technical Planning Guidelines), subsequent changes to those references (later census boundaries; updated Technical Planning Guidelines) may have altered the practical operation of the Plan even if the Plan itself was not formally amended. The Determination text does not record such changes.
• If an implementation or compliance question depends on current law, verification should be done against the current register of determinations and the regulator’s public records because this document, as provided, does not indicate subsequent amendments or current status.

The Determination’s silence on amendment events means the only reliable amendment history in the source is the original making on 21 December 2000. Any later modifications or revocations are not documented here and must be located in contemporaneous regulatory records outside this document.

The Determination contains no litigation history and names no judicial or tribunal decisions. The text does not reference any court challenges, administrative appeals, or dispute resolution outcomes relating to this licence area plan.

What the document states and what it omits:

• No cases or legal references: the Determination refers only to the Broadcasting Services Act 1992 (subsection 26(1)) as its statutory source. It does not cite any case law, legal precedent, tribunal decisions, or judicial reviews.
• No recorded disputes: there is no record in the document of objections, contested allocations, or legal challenges to the plan or to the technical specifications annexed.
• No enforcement or litigation guidance: the Determination is silent on procedural avenues for dispute resolution, appeal mechanisms or litigation pathways in relation to decisions it embodies.

Implications for research and practice:

• If litigation or administrative review occurred relating to this Determination after 21 December 2000, those materials are not reflected in the text provided and would need to be sourced from court records, tribunal databases or ABA/departmental archives.
• Practitioners assessing legal risk should search for subsequent case law, judicial review proceedings or administrative appeals involving the Nambour licence area plans, the specific Service Licence Nos listed (SL10307, SL4184, SL1150116, SL1150113, SL1150720), or the ABA’s determinations for the period in question; none of those litigations, if any, are recorded in the Determination itself.

In short, the instrument as provided contains no litigation history and does not identify any judicial or administrative proceedings about this plan. Any litigation history must be sought in external legal databases and agency records.

The Determination contains several items that frequently cause confusion or operational risk in practice. These are concrete features from the text and attachments that advisers and operators should note.

Status column is not determinative: The Schedules state that the Status column "does not form part of the licence area plan decision and is included for reference only." Practitioners sometimes treat "Available" or "Licensed" labels in such schedules as legally determinative. The Determination explicitly warns that the Status column is for reference only. That means whether a licence is actually allocated, or the precise legal effect of a status, must be confirmed with the licensing authority and the underlying service licence instrument.

Frequencies shown are centre frequencies and not absolute channel limits: The Frequency column is described as showing the centre frequency of the channel. Engineers and compliance officers must not assume those numbers represent lower and upper channel edges; transmitter tuning and spectral masks must follow the technical specification and applicable planning guidelines.

Service Licence Number ambiguity: The Schedules include Service Licence Numbers in column four for some entries that are marked "Available." The explanatory text states the service licence number is shown where one "has been allocated to the service, if appropriate" and that national services are N/A because the BSA requires licences only for commercial and community services. The presence of a Service Licence No in the schedule does not automatically mean an operational licence exists in all senses; confirm with the issuing authority whether the number denotes a formal licence, reservation, allocation-in-waiting, or simply a registry number.

Technical Planning Guidelines external dependence: each attachment says "Site Tolerance: Refer to Technical Planning Guidelines." The Determination therefore relies on another document for critical tolerances and implementation rules. Failure to consult those Guidelines can lead to non-compliant site placement, incorrect ERP calculation, or other technical non-conformity.

ERP sectoral constraints and antenna height: the Attachments specify ERP by azimuth sectors (for example, national services TS3016002: 0°T-220°T 20 kW; 220°T-350°T 4 kW; 350°T-360°T 20 kW). Small deviations in antenna pattern or height can materially alter coverage and interference footprint; practitioners must verify actual antenna radiation patterns against the attachment sector limits. The attachment also prescribes "Maximum antenna height" (34 m for national, 40 m for commercial). Exceeding that maximum or installing antennas with incorrect vertical patterns can breach the specification.

Geographic definitions tied to historic census boundaries: licence areas are defined by ABS collection districts at the 1996 Census. Administrative and demographic boundaries change; if a client relies on present-day local government boundaries, they must map current areas to the 1996 ABS CD list in Attachment 1.1. This is a common source of error when tendering or preparing coverage analyses years after the specified census.

Interference prediction uncertainty and limited recourse: the Disclaimer stresses the theoretical nature of interference predictions and disclaims liability for interference outcomes. Licence-holders and applicants should not assume the ABA or Minister will compensate for unexpected interference. That creates contingent operational and commercial risk , e.g., unexpected coverage deficits , that should be factored into feasibility studies and financial models.

International/interference origin note: the Disclaimer notes interference can originate overseas as well as in Australia. Users should therefore factor in cross-border coordination risk where relevant. The Determination does not itself provide mechanisms for international coordination.

No penalties or enforcement mechanics in the Determination: licensees sometimes look to Determinations for procedural enforcement rules; this document contains no specific enforcement procedures, penalties, or infringement notice mechanisms. Enforcement will be handled under licence terms and the Broadcasting Services Act regime external to the Determination.

Redundancy/repetition in the document: the provided text repeats large blocks of the Determination. Practitioners should rely on the authoritative copy (the single formal Determination dated 21 December 2000) rather than unlabelled duplicates which could produce transcription errors.

Conclusion for risk management: verify current licence status with the regulator, obtain the Technical Planning Guidelines, commission independent technical modelling using the exact attachment ERP sector values and antenna heights, confirm exact legal effect of any Service Licence Number appearing in the schedule, and map present-day geography to the 1996 ABS CD list before advising clients or investing.

This section lists practical, source-grounded steps to comply with the Determination and mitigate the risks identified in the document. Each step is referenced to the relevant part of the Determination text.

1. Confirm current legal status and licence existence

   • The Schedule’s Status column is for reference only (Schedules explanatory text). Before relying on a label such as "Available" or "Licensed", confirm with the ABA (or successor regulator) whether a service licence has been formally issued, amended or revoked and whether any subsequent determinations have modified the Plan. Do not assume the presence of an SL number in the schedule alone proves an active service licence.

2. Obtain and apply the Technical Planning Guidelines

   • Each technical specification directs "Site Tolerance: Refer to Technical Planning Guidelines" (Attachments 1.2-1.7). Obtain the current Technical Planning Guidelines and apply them to determine site tolerances, exact coordinates allowances, and permitted variation. Compliance with the attachments depends on correct application of these Guidelines.

3. Work to the technical specification attachment relevant to the transmitter

   • For each transmitter, comply with the stated carrier frequency, polarisation, maximum antenna height, and the output radiation pattern (sectorised maximum ERP). Example: TS10008223 (Attachment 1.5) prescribes 91.1 MHz, mixed polarisation, maximum antenna height 40 m, and ERP sectors 0°T-150°T 10 kW; 150°T-210°T 750 W; 210°T-250°T 5 kW; 250°T-360°T 10 kW. Design antenna patterns and transmitter power to keep radiated energy within these sector limits.

4. Commission independent technical analysis before changes or application

   • The Determination advises "Existing broadcasters should take all reasonable steps ... before making changes" and "Aspirant broadcasters should take all reasonable steps ... before competing for spectrum availability" (Disclaimer). Commission propagation modelling, field strength predictions and interference studies that use the specified antenna heights, ERP sectoring and the exact map grid references in the Attachment.

5. Map licence area boundaries using the 1996 ABS collection districts

   • Licence areas are defined by ABS CDs as at 6 August 1996 (Attachment 1.1, Attachment 2.1). Use those CD codes to determine whether a given service area falls within the plan’s licensed territory. Where modern administrative or demographic boundaries are relevant to commercial decision-making, translate 1996 CD boundaries into current GIS boundaries.

6. Factor in interference uncertainty and develop contingency plans

   • The Determination explicitly notes interference predictions are theoretical and that the ABA cannot warrant interference-free operation (Disclaimer). Incorporate contingency plans into operational and financial modelling: backup transmitter sites, signal enhancement strategies, complaint-handling procedures, and budgeted remediation for unforeseen interference mitigation.

7. Verify site and land-use approvals

   • The technical attachments identify nominal transmitter sites (e.g., Dulong Lookout, Bald Knob) and antenna height limits. Installing or modifying transmitter infrastructure will likely trigger State/local planning approvals, environmental compliance and site lease consents. Obtain the necessary planning permits and landowner agreements before construction, and ensure tower construction meets the antenna height maxima in the attachments.

8. Prepare documentation for licence application or variation

   • Where applying for an Available licence, prepare technical briefs referencing the relevant TS number and attachment, propagation maps that show compliance with ERP sectoring, and documentation that demonstrates adherence to the Technical Planning Guidelines. Include evidence of independent technical advice and field strength predictions as recommended in the Disclaimer.

9. Coordinate with spectrum management and international frameworks where necessary

   • The Determination observes interference can originate from overseas. If cross-border coordination could be relevant (coastal areas, shared frequency use), consult the appropriate national coordination procedures and any international obligations in your technical dossier.

10. Keep records and seek regulatory confirmations

    • Keep a clear audit trail: copies of the Determination (attachments and TS numbers), technical studies, correspondence with the ABA, and approvals. Before operational changes, seek written confirmation from the regulator or the Technical Planning Guidelines administrators that the proposed changes remain within the permitted site tolerances and ERP sector parameters.

11. If in doubt, engage specialist counsel and broadcast engineers

    • The Determination anticipates technical complexity and explicitly recommends independent specialist advice for applicants and existing broadcasters (Disclaimer). Use both legal and engineering specialists when interpreting sectorised ERPs, map grid coordinates, and licence area boundaries to avoid non-compliance.

12. Monitor for regulatory changes

    • The Determination as supplied shows no amendment history. Nevertheless, regulatory instruments can be superseded. Monitor the regulator’s publications and the status of the Broadcasting Services Act 1992 instruments to ensure the Determination remains current or to identify any subsequent revisions that would change allocations, technical limits or site tolerances.

Checklist summary (practical immediate actions):

• Confirm current licence status with regulator (do not rely solely on the Status cell in Schedules).
• Obtain Technical Planning Guidelines and apply site tolerance rules.
• Commission propagation/interference studies using the specified TS parameters.
• Verify planning approvals and land access for the nominated site coordinates.
• Prepare application materials referencing TS numbers and ABS CD-based licence area.
• Budget for interference contingencies and technical mitigation.
• Retain independent technical and legal advisers and document regulator confirmations.

Following the Determination’s explicit instructions and cross-referencing the attachments and Technical Planning Guidelines will materially reduce compliance risk and align operations with the parameters that the ABA set out in the Licence Area Plan , Nambour Radio , December 2000.
