Licence Area Plan - Muswellbrook (Radio) - October 1998

This determination deploys a set of technical and administrative building blocks relevant to spectrum allocation and local broadcasting supply. The main concepts in the document are:

• Service categories. The plan distinguishes four categories: National, Commercial, Community and Open Narrowcasting. These categories appear throughout the Schedules and attachments as the organising principle for availability and technical specification (SCHEDULE ONE and SCHEDULE TWO). The document expressly notes that service licence numbers are "Not applicable" for national and open narrowcasting services because the Broadcasting Services Act 1992 requires service licences only for Commercial and Community services (explanatory note in Schedules).
• Licence areas defined by ABS Collection Districts. The boundaries of the licence areas (Muswellbrook RA1 and RA2) are specified by lists of ABS Collection District codes (Attachments 1.1 and 2.1). That is the legal/geographic basis used in the plan; applicants and licence-holders must map those CDs to their coverage and audience reach considerations.
• Status labels versus plan decision. The Schedule includes columns labelled "Status" and "Frequency" that the plan flags as additional information "accurate as at the date of publication." Critically, the plan states the status column "does not form part of the licence area plan decision and is included for reference only," meaning those labels (Licensed, Available, Proposed, Reserved) are informative but not the operative legislative content of the plan.
• Technical specification entries (TS numbers). Each transmitter is assigned a TS number (for example TS4021001 for AM 1044 kHz, TS7663001 for FM 98.1 MHz). The attachments set out mandatory technical parameters for each TS number: site coordinates, carrier frequency, polarisation, maximum antenna height, ERP by azimuth or maximum ERP "at all angles of azimuth," and for AMs detailed CMF output radiation by bearing. These TS entries are the technical constraints tied to the services the plan makes available.
• Reserved capacity. The plan records capacity that is "Reserved" for national or community services in accordance with Ministerial notification (explained in the Status Column definitions). A reservation is an administrative mechanism that removes capacity from general allocation and preserves it for specified public or community services.
• Special conditions and inter-temporal adjustments. Attachments include special conditions that alter how a TS operates or replaces earlier specifications. For example, Attachment 1.9 notes TS10008761 (FM 96.9 MHz) "will replace TS 5657003" (FM 102.5 MHz) with a footnote explaining the reason is to overcome an intermodulation problem. Open narrowcasting attachments specify coverage radii measured from AMG co-ordinates.
• Link to Technical Planning Guidelines. Several entries state "Site Tolerance : Refer to Technical Planning Guidelines" and Attachment 2.2 expressly disapplies "Minimum Level of Service Requirements, as detailed in the Technical Planning Guidelines clauses 38 and 39" to the specified community transmitter. The plan therefore operates together with technical planning rules outside the determination document itself.

These concepts combine an administrative allocation (which categories and what status is attached to channels) with detailed technical constraints (frequency, ERP, antenna height, radiation patterns, coverage radii) and a mapping of geographical licence area via ABS Census collection districts. The TS numbers provide discrete, enforceable technical descriptions for each transmitter that a licensee or prospective licensee must follow. The plan interlocks with Ministerial reservations and the Technical Planning Guidelines, and it records both current licences (with service licence numbers for Commercial and Community services) and capacity made available for allocation or reserved for national or community services.

The determination identifies and affects multiple classes of actors by name, category or functional role. The document itself is the operative instrument of the Australian Broadcasting Authority and implicitly directs or constrains the behaviour of the following groups.

• Existing commercial licensees identified by service licence number. The Schedule records two commercial service licence numbers: SL4125 (AM 981 kHz, TS4125001) and SL7663 (FM 98.1 MHz, TS7663001, and also associated proposed transmitter 102.7 MHz for Merriwa, TS10007859). Those licensees are specifically identified and have assigned technical specifications and nominal transmitter sites in the attachments. The plan therefore binds those licensees to the listed TS parameters for their transmitters and records any proposed additional transmitters associated with the same licence (e.g. SL7663 proposed 102.7 MHz in Merriwa).
• Prospective commercial and community applicants. The Schedules list services that are "Available" for new allocation (for example some national channels are "AvailableReserved", open narrowcasting channels marked "Available", community services marked "Available" but with service licence number SL1150038 showing allocation). Prospective licensees need to consult the Schedules and attachments to determine what frequencies and technical parameters are available and what geographic area the licence would cover (ABS CD lists).
• National service operators and the Commonwealth. Several services are marked National and some are "Reserved" for national or community services in accordance with Ministerial notification. National services are listed as N/A for service licence numbers because they are not subject to the same service licence requirement; the plan reserves capacity for them, affecting how other applicants can obtain channels.
• Community broadcasting organisation SL1150038. Schedule Two lists the community service SL1150038 with two FM transmitters (101.7 MHz for Muswellbrook, TS10005073; 107.3 MHz for Murrurundi, TS10007786). The attachment for 101.7 MHz specifically notes an exemption from Minimum Level of Service Requirements (Technical Planning Guidelines clauses 38 and 39).
• Open narrowcasters and narrowcasting applicants. Two open narrowcasting channels are specified in Schedule One (103.3 MHz TS10005071 in Muswellbrook and 98.5 MHz TS10008589 in Murrurundi) with ERP limits and coverage radii. Open narrowcasting operators must observe these technical constraints and the specified coverage radii where applicable.
• Radio-engineering and frequency planners. The attachments give precise AML/Australian Map Grid coordinates and technical parameters (ERP, antenna heights, polarisation, radiation patterns), which are input constraints for planning, installation and interference assessment. The plan directs what equipment configurations and transmitter sites are permissible by reference to the TS numbers.
• Local populations within the ABS collection districts listed. The licence area definitions (Attachment 1.1 and Attachment 2.1) identify which ABS Collection Districts are in the RA1 and RA2 licence areas. Anyone analysing market reach, audience metrics, advertising catchment, or community representation will need to map those CDs to localities. The plan therefore affects where services are authorised to provide content and which populations are within licence areas.
• Spectrum regulators and infrastructure providers. The ABA (now superseded by later entities, but at the time the decision-maker) is the making authority. The plan affects coordination with other spectrum users and infrastructure owners by prescribing sites and ERPs that affect interference footprints and site engineering requirements.

Who decides: the document states the Australian Broadcasting Authority made the determination on 8 October 1998 under s 26(1) of the Broadcasting Services Act 1992. What the document obliges: the attachments supply the technical constraints for transmitters; the Schedules identify which services are "Licensed", "Available", "Proposed" or "Reserved" and provide frequencies and TS reference numbers as of publication date.

Who pays and fee matters: the determination itself records service licence numbers for certain services but does not state licence application fees or licence fee regimes. The Schedules note that service licences are required for Commercial and Community services under the Broadcasting Services Act 1992, but the plan contains no fee schedules or financial obligations. Therefore the document affects applicants and licensees through allocation and technical constraints but does not by itself specify monetary charges.

This determination creates a set of technical duties and administrative information that shape rights to operate broadcasting transmitters in the Muswellbrook area. The document itself is not a licence for every listed service; instead it informs allocation and technical compliance. The key duties and rights implicit or stated in the text are as follows, grounded in the document wording.

Duties (technical and operational)

• Operate within the technical specifications assigned to a transmitter's TS number. Each attachment provides mandatory parameters for that TS number: nominal site coordinates (AMG), carrier frequency, emission band and mode, polarisation, maximum antenna height and maximum ERP or output radiation pattern. For example, the commercial FM 98.1 MHz transmitter (TS7663001, Attachment 1.12, nominal location Mount Arthur) has maximum antenna height 16 m and an ERP pattern: 0°T-110°T 20 kW, 110°T-145°T 10 kW, 145°T-360°T 20 kW. An operator running a transmitter must adhere to those constraints.
• Respect AM radiation patterns where specified. The AM technical specifications (TS4021001 for 1044 kHz and TS4125001 for 981 kHz) list "Output Radiation Pattern" as CMF values by bearing, which the document supplies as the technical baseline for radiation shaping. Operators of those AM services must conform to the stated maximum CMF values by azimuth.
• Comply with site tolerances and Technical Planning Guidelines. Multiple attachments state "Site Tolerance : Refer to Technical Planning Guidelines." In addition, Attachment 2.2 notes that Minimum Level of Service Requirements (clauses 38 and 39 of the Technical Planning Guidelines) do not apply to a specific community specification. Consequently, TS compliance duties are interdependent with the Technical Planning Guidelines to which the attachments refer.
• For open narrowcasting entries that include a coverage radius special condition (Attachments 1.14 and 1.15), operate within the specified coverage radius measured from the listed AMG co-ordinates (10 km for TS10005071; 20 km for TS10008589).

Rights and entitlements recorded or implied

• Existing licence-holders retain their listed status and can rely on the plan to record their assigned technical specifications and service licence numbers where applicable. For example, SL4125 is recorded as Licensed (AM 981 kHz, TS4125001) and SL7663 as Licensed (FM 98.1 MHz, TS7663001).
• Prospective applicants have guidance on what is available. The Schedules mark available channels (for example open narrowcasting 103.3 MHz and 98.5 MHz), and where a service is "Available" a new licence may be allocated, subject to the licensing regime under the Broadcasting Services Act 1992 (the plan notes that "The frequency shown is the centre frequency of the channel" and provides availability status as at publication).
• Reserved capacity for national or community services preserves those channels for their intended categories. The Status Column definitions state "Reserved : capacity reserved for a national or community service in accordance with Ministerial notification." This is an administrative right on behalf of national/community services to occupy those channels and a corresponding denial of availability to other categories for those reserved frequencies.

What the plan does not do

• The determination does not itself create a service licence for every listed service. The Schedules include "N/A" for service licence numbers where the Broadcasting Services Act 1992 does not require a service licence (for example national and open narrowcasting entries are marked N/A). The plan therefore distinguishes between naming and technically specifying a transmitter and the administrative act of granting a licence where statutory licence requirements apply.
• The plan does not include enforcement mechanisms or penalties within its text. It supplies technical specifications and status information but does not include the statutory or administrative enforcement text that would be located in the Broadcasting Services Act 1992, licence instruments or other regulatory documents.

Operational consequences for rights and duties

• Where a TS entry states it "will replace" an earlier TS (Attachment 1.9 says TS10008761 will replace TS5657003), the replacement creates a technical transition duty for operators and an entitlement to rely on the updated technical spec once in force. The plan records that identification.
• Where Minimum Level of Service Requirements are expressly disapplied for a community TS (Attachment 2.2), the operator of that community transmitter has a reduced duty in respect of those specific MLS clauses, changing the compliance baseline for that TS.

In short, the determination sets binding technical parameters for transmitters tied to TS numbers, defines which channels are available or reserved for particular service categories, and records licence numbers for those commercial/community services that already have a service licence. It does not itself grant all licences nor set out enforcement penalties in the document text.

The determination text contains no express penalty provisions, enforcement processes or sanction schedules. It is an allocation and technical specification instrument: it identifies services, frequencies, service licence numbers where applicable, TS numbers and exact technical parameters for transmitters, but it does not contain provisions describing how non-compliance is to be penalised or which statutory enforcement powers will be exercised.

The document therefore performs a descriptive and prescriptive technical role rather than an enforcement role. Practical enforcement and penalties relevant to operation of the specified services would be found in the Broadcasting Services Act 1992 and in licence instruments issued under that Act, not in the determination itself. The determination does, however, create a clear compliance baseline in two ways:

• Technical baseline for compliance. Each TS attachment lists precise technical parameters (AM radiation patterns in CMF values by bearing; FM maximum ERP, polarisation and maximum antenna height; nominal AMG transmitter coordinates; coverage radii for specified open narrowcasting services). Operators who hold licences that refer to these TS numbers must conform operationally to those parameters or otherwise seek administrative approval for changes. Non-conformance with a TS specified by a licence or licence area plan would create a regulatory non-compliance issue under the licensing regime, but the plan does not itself define sanctions.
• Administrative status signals. The Schedules label services as "Licensed", "Available", "Proposed", "Reserved" and expressly state that these status labels "do not form part of the licence area plan decision and is included for reference only." While the labels inform potential applicants and operators of current allocations, they are not themselves enforcement instruments. Enforcement would proceed through the ABA's licensing and regulatory tools under the Broadcasting Services Act 1992.

Because no enforcement regime is set out in this determination, users of this document should therefore take the following source-grounded points as relevant implementation facts:

• If an entity intends to operate a transmitter, it must obtain any required service licence for Commercial or Community services under the Broadcasting Services Act 1992; the plan records existing service licence numbers where relevant (SL4125, SL7663, SL1150038) and marks other services as N/A because the statute does not require a service licence for all categories.
• Technical compliance will be judged against the TS numbers and the referenced Technical Planning Guidelines (the attachments repeatedly instruct "Site Tolerance : Refer to Technical Planning Guidelines"). The determination points users to those Guidelines for technical detail and tolerances, implicitly locating enforcement of technical parameters in the broader planning framework.
• Where the plan records a replacement TS (TS10008761 will replace TS5657003), failure to transition to the new specification or to continue to meet the stated radiation/ERP limits would create a discrepancy between operational parameters and the plan's technical baseline to which any regulator would refer when deciding compliance.

In sum, the plan establishes the technical and allocation baseline to which enforcement and penalties would be applied under the relevant statutory and licence frameworks, but it does not itself specify penalties or provide the enforcement machinery; any remedies, sanctions or formal enforcement actions are outside the text of this determination and lie in the broader regulatory regime referenced by the plan.

The determination explicitly situates itself within a broader statutory and technical regulatory framework and, by its own terms, depends on other instruments for full effect. The document states it was made under subsection 26(1) of the Broadcasting Services Act 1992, and repeatedly references the Technical Planning Guidelines and Ministerial notifications. The document therefore interacts with other laws and instruments in the following concrete ways.

• Broadcasting Services Act 1992 (statutory basis). The determination is made "under subsection 26(1) of the Broadcasting Services Act 1992." The Schedules additionally state that "N/A = Not Applicable, as the Broadcasting Services Act 1992 only requires service licences for Commercial and Community services." Those two references identify a direct interaction: the Act supplies the statutory power to make licence area plans and defines which categories require a service licence. Any licensing, enforcement, or fee rules deriving from the Act will apply in conjunction with this plan.
• Technical Planning Guidelines (operational technical standard). Multiple attachments instruct "Site Tolerance : Refer to Technical Planning Guidelines." Attachment 2.2 explicitly references "Minimum Level of Service Requirements, as detailed in the Technical Planning Guidelines clauses 38 and 39" and notes those clauses "do not apply to this specification." The plan thus depends on the Technical Planning Guidelines for clarifying site tolerance, minimum service levels and other technical engineering tolerances; the determination modifies the application of those Guidelines in specific instances (one community transmitter is expressly exempted from MLS clauses 38 and 39).
• Ministerial notification (reservation of capacity). The Status Column definition explains "Reserved : capacity reserved for a national or community service in accordance with Ministerial notification." That references another executive instrument , a Ministerial notification , as the source authorising reserve status. The plan therefore operationalises Ministerial decisions that set aside spectrum capacity for national or community services.
• Australian Bureau of Statistics (ABS) boundaries used as legal geographic definitions. The licence areas are defined in terms of ABS Collection Districts from the 1996 Census (Attachments 1.1 and 2.1). That cross-reference ties the licence area to census geography, meaning any legal or regulatory action requiring a definition of the "licence area" must adopt the ABS CDs as set out in the determination.
• Spectrum planning and interference coordination. The technical parameters provided (AM CMF radiation patterns by bearing, FM ERP and azimuthal ERP masks, maximum antenna heights, and coverage radii) are inputs into spectrum management and interference avoidance processes that involve other regulatory bodies and planning documents. While the determination does not name other spectrum agencies, the technical parameters are the kind of data global and national spectrum planners and adjacent channel operators use when coordinating transmitters and avoiding harmful interference.
• Engineering standards and measurement frameworks. The attachments use Australian Map Grid references and measure coverage radii from AMG coordinates, integrating the plan with national mapping and geodetic systems. This has knock-on effects when aligning planning approvals, local authority permits and tower siting decisions that rely on geographic coordinates.
• Licence instrument and conditions (external). The plan records service licence numbers for commercial and community services (for example SL4125, SL7663, SL1150038), but the content and detailed conditions of those licences are external to this document. That separation means the plan interacts with those licence instruments insofar as the licence instruments will refer back to the TS numbers and the geography listed here; conversely, any licence variation, suspension or revocation under the Broadcasting Services Act will modify obligations set out externally to this plan.

In sum, the determination is a node in an administrative and legal network: it is grounded in the Broadcasting Services Act 1992, it defers to and modifies application of the Technical Planning Guidelines in specific instances, it implements Ministerial reservation decisions, defines licence areas by referencing ABS 1996 Census collection districts, and supplies the technical data (TS numbers) that connect to spectrum management and licence compliance handled under other instruments. The plan by itself is not a complete regulatory code; it must be read together with the Act, the Technical Planning Guidelines and any applicable licence instruments and Ministerial notifications.

The text provided is a single licence area plan determination dated 8 October 1998 and does not include a running amendment log within the document. Where the document records changes or intended replacements, it does so in the attachments rather than in a formal amendment history section. The key amendment-like records within the determination are:

• Replacement of a technical specification. Attachment 1.9 records that Specification Number TS10008761 (FM 96.9 MHz) is listed as "ProposedReserved" in the Schedule and states as a "Special Condition : This technical specification will replace TS 5657003." TS5657003 is the earlier FM 102.5 MHz specification listed at Attachment 1.8. The footnote at the end of the document explains that FM 96.9 MHz "has been identified for use instead of FM 102.5 MHz to overcome a longstanding intermodulation problem." This constitutes an internal replacement of a TS specification recorded in the determination.
• Status "Proposed" and "ProposedReserved" entries. The Schedule shows certain transmitters as "Proposed" or "ProposedReserved" (for example, National 96.9 MHz is "ProposedReserved" in SCHEDULE ONE; Commercial 102.7 MHz for Merriwa is "Proposed" but listed under the service licence SL7663). These "Proposed" labels indicate anticipated future changes in the transmitter network, but the document also states status labels do not form part of the licence area plan decision and are provided for reference only. The presence of "Proposed" entries therefore signals planned additions but is not itself an amendment instrument.
• Special conditions modifying application of other rules. Attachment 2.2 contains the special condition: "Minimum Level of Service Requirements, as detailed in the Technical Planning Guidelines clauses 38 and 39, do not apply to this specification." That statement functions as a local exemption from those clauses for the specified community transmitter. It is an example of an amendment-like carve-out embedded in the attachment.
• No express historical amendments recorded. The document does not list earlier determinations amended by this instrument, nor does it include a schedule of amendments or dates of later modifications. The determination is a standalone instrument dated 8 October 1998, and the only internal record of change is the replacement of one TS by another as noted above.

If the user requires a formal amendment history (for example, subsequent determinations, revocations, or later versions of the licence area plan), that information is not present in the provided text. The plan as given shows one explicit internal replacement (TS10008761 replacing TS5657003) and various "Proposed" entries indicating planned changes. Any further amendment trace would need to be obtained from the ABA's procedural records, subsequent determinations, or consolidated legislative/regulatory compilations not present in this document.

The determination text contains no reference to litigation, court proceedings, or tribunal determinations. It does not cite any case law and includes no mention of disputes relating to the licence area plan, licence allocations, or transmitter technical specifications. The document is a regulatory administrative instrument that records allocations and technical parameters; it does not report or adjudicate disputes.

Consequently, within the four corners of this document there is no litigation history to summarise. For any external litigation history that may concern the Muswellbrook licence area, the specified service licence numbers (SL4125, SL7663, SL1150038), TS numbers or the ABS Collection District definitions provide search points that would need to be cross-checked against court or tribunal records, regulatory decisions, or later administrative documents. The determination itself, as provided, contains no litigation references, no claims of appeals, and no record of legal challenge.

If a practitioner requires litigation or administrative appeal history relevant to any of the services or licence-holders named in this determination, they will need to consult:

• Court and tribunal databases (Administrative Appeals Tribunal, Federal Court, state courts) for cases involving the ABA or the identified service licence numbers.
• ABA or successor agency records for internal review or appeal decisions.
• Administrative registers or public notices that record licence cancellations, disputes or enforcement actions after 8 October 1998.

None of those materials are included in the document under review, and the determination itself contains no litigation-related content.

The plan contains a number of technical, administrative and interpretive features that can cause practical pitfalls if overlooked. The following points are grounded in the document text and identify specific traps for practitioners, engineers, applicants and licence-holders.

• Status column is informational only. The Schedules explicitly state "The status of the service (column two) does not form part of the licence area plan decision and is included for reference only." Users who treat "Licensed", "Available", "Proposed" and "Reserved" as definitive legal entitlements without cross-checking the underlying licensing instruments or statutory allocation rules risk error. Always confirm licensing status with the regulator and the formal licence instrument rather than relying solely on the status column in this plan.
• Frequency column is the centre frequency only. The plan notes "The frequency shown is the centre frequency of the channel." Do not assume adjacent channel boundaries, guard bands, or precise channel bandwidths are specified; those matters are handled in planning guidelines or other allocations documents. Engineering work that needs bandwidth or channel masks must consult the Technical Planning Guidelines and spectrum allocation tables, not just the centre frequency listed here.
• TS numbers are the operative technical references. Each transmitter is specified by TS number. Licence conditions, engineering compliance checks and interference studies must reference the precise TS number in the attachments (for example TS4125001 for AM 981 kHz). Mis-matching TS numbers with frequencies or sites could create compliance failures.
• Site tolerance and Technical Planning Guidelines linkage. Several entries instruct "Site Tolerance : Refer to Technical Planning Guidelines" and Attachment 2.2 expressly removes the Minimum Level of Service Requirements clauses 38 and 39 from applying to one community TS. Practitioners cannot interpret the technical constraints in isolation; they must also consult the Technical Planning Guidelines to understand site tolerances, measurement methods and when MLS clauses apply or are disapplied.
• Coverage radius and narrowcasting limits. Two open narrowcasting transmitters have explicit 'coverage radius' special conditions (Attachment 1.14: 10 km for TS10005071; Attachment 1.15: 20 km for TS10008589, both measured from specified AMG co-ordinates). These are strict spatial limits; operators cannot rely on general ERP limits alone but must observe the coverage radii as part of the TS special conditions. Failure to measure from the stated AMG coordinates or to account for topography in coverage modelling could put an operator outside compliance expectations.
• Replacement of TS entries , transition risk. Attachment 1.9 notes TS10008761 (96.9 MHz) will replace TS5657003 (102.5 MHz) because 96.9 MHz was identified to overcome an intermodulation problem. Transitioning transmitters and notifying affected parties introduces operational and coordination tasks. If a licence-holder or operator fails to implement the replacement or coordinate with co-channel/adjacent services, they could inadvertently cause interference or fall out of alignment with the current plan.
• "Reserved" channels limit availability. The Status Column definition clarifies "Reserved: capacity reserved for a national or community service in accordance with Ministerial notification." That reservation mechanism removes capacity from the general pool and may constrain commercial or open narrowcasting applicants who might otherwise assume availability.
• AM radiation patterns are specified numerically. AM transmitter attachments give CMF values by bearing for each 10-degree sector. Accurate implementation requires engineers to program or physically configure radiation systems to meet those CMF maxima. Engineering tolerance and monitoring procedures are necessary to ensure compliance.
• ABS Collection District-based licence areas. Licence area boundaries are defined by ABS CDs from the 1996 Census. Practitioners must map licence obligations and advertising or programming obligations to those CD lists rather than to more colloquial locality definitions. Mismapping levels of service or community coverage to the wrong set of CDs could misstate the licence area.
• The plan does not state fees or licence application steps. Although service licence numbers are recorded where applicable, the determination does not contain fee schedules, application processes, or timelines for allocation. Users must consult the Broadcasting Services Act 1992 and the regulatory authority for fee and procedural details.
• Staleness risk. The plan is dated October 1998 and reflects frequencies and status "accurate as at the date of publication." Status and technical allocations can change; relying on this document without checking for subsequent determinations or amendments may produce incorrect assumptions about current availability or technical requirements.

These practical "gotchas" all come from explicit statements or structural features in the plan (e.g., status column caveat, coverage radii special conditions, cross-reference to the Technical Planning Guidelines, and the TS replacement note). They highlight where a practitioner must go beyond cursory reading: check the Technical Planning Guidelines, confirm current licensing status with the regulator, map ABS CDs correctly, and pay attention to TS special conditions and replacements.

Compliance is a two-stage task: (1) ascertain the regulatory and technical baseline created by the determination and its cross-referenced instruments, and (2) implement and document engineering and administrative measures to meet those baselines. The determination itself provides the key technical instructions; the plan repeatedly defers to the Technical Planning Guidelines and the Broadcasting Services Act 1992 for procedural and tolerance detail. The following steps are grounded in the document text and the attachments.

1. Confirm licensing category and necessity of a service licence.

   • For Commercial and Community services, check that a valid service licence exists or apply for one under the Broadcasting Services Act 1992. The Schedules record service licence numbers where applicable (SL4125, SL7663, SL1150038), but the plan also warns that the status column is for reference only and not part of the plan decision; therefore confirm with the regulator that a licence instrument has been issued and obtain a copy of the licence conditions.
   • For National and Open Narrowcasting services, note that service licence numbers are recorded as N/A where the Act does not require them; nevertheless operators must ensure they have whatever authorisations are required under the Act and related instruments.

2. Identify the exact TS number that applies to your intended transmitter and study the attachment.

   • Each transmitter is referenced by a TS number (e.g., TS4125001, TS7663001, TS10005071). Use that TS entry as the definitive technical specification for frequency, polarisation, maximum antenna height, ERP and any radiation mask or CMF figures. For AMs, follow the CMF by bearing values precisely (e.g., TS4125001 lists CMF values for 0°T to 350°T).

3. Map licence area boundaries to ABS Collection Districts.

   • If your obligations depend on the licence area (audience coverage, community representation obligations for a community broadcaster, advertising catchment), use the ABS CD lists in Attachment 1.1 (RA1) and Attachment 2.1 (RA2) to determine the legal boundaries. Do not rely on informal town boundaries.

4. Comply with site and technical tolerances via the Technical Planning Guidelines.

   • Numerous TS entries state "Site Tolerance : Refer to Technical Planning Guidelines." Obtain and apply the Technical Planning Guidelines for site tolerance information and measurement protocols. If a specific TS disapplies certain MLS clauses (Attachment 2.2 disapplies clauses 38 and 39 for TS10005073), treat that as a local modification but still consult the Guidelines where they apply.

5. Observe special conditions precisely.

   • Open narrowcasting TS numbers TS10005071 and TS10008589 include coverage radius special conditions: 10 km and 20 km measured from specified AMG coordinates, respectively. Plan engineering, antenna pattern shaping and transmitter siting to keep coverage within that radius as required.
   • If a TS is designated to replace another (TS10008761 will replace TS5657003), coordinate the change in advance and comply with any transition timeline or instruction from the regulator.

6. Configure and test transmitters against TS technical parameters.

   • For FM transmitters, set antenna height, polarisation and ERP as specified (for example TS10007775 104.9 MHz has maximum ERP 16 kW "At all angles of azimuth"; TS7663001 98.1 MHz has specific azimuthal ERP masks).
   • For AM transmitters, configure transmission systems so measured CMF outputs by azimuth do not exceed the listed maxima. Maintain measurement records to demonstrate compliance.
   • Ensure mapping and measurements use the Australian Map Grid coordinates given in the attachments.

7. Documentation and record-keeping.

   • Keep records of licence instruments, TS numbers, engineering designs, test results and measurements that demonstrate conformity with the TS entries and any applicable Technical Planning Guidelines. The plan will be used by the regulator as the technical baseline; documentary evidence is the primary defence in regulatory reviews.

8. Coordinate with co-channel and adjacent channel operators.

   • The plan includes multiple transmitters in proximate areas and some sites share nominal locations (Rossgole Lookout, Mt Helen, Banderra Downs, Mount Arthur). Coordinate where necessary to avoid intermodulation and other interference issues , the plan itself records that FM 96.9 MHz was identified to overcome an intermodulation problem affecting 102.5 MHz, so interference coordination is a live planning consideration.

9. Check for updates and confirmations with the regulator.

   • Because the Status and Frequency columns are accurate only as at the date of publication, consult the regulatory authority for any subsequent determinations, updated TS numbers, licence variations or revocations. Do not rely solely on the 1998 plan for current operational permissions.

10. Engage legal or engineering specialists where necessary.

• Where legal entitlement (licensing, reserved capacity) or detailed engineering (AM CMF masks, azimuthal ERP shaping, coverage contour modelling from AMG co-ordinates) is complex, obtain specialist input. The plan provides the authoritative technical parameters but the implementation requires both legal interpretation (licence conditions under the Broadcasting Services Act 1992) and precise engineering.

These steps are the concrete compliance sequence implied by the document. Practically, compliance entails confirming whether a service licence is required and held, implementing the TS technical parameters at the given AMG coordinates, observing any special conditions (coverage radius, exemption from MLS clauses), using the Technical Planning Guidelines to resolve tolerances, and maintaining documentary evidence. The determination connects administrative allocation with technical specifications; compliance requires treating both elements as co-dependent and consulting the regulator for any status or technical changes since the plan's publication.
