Licence Area Plan - Katanning (Radio) - October 1996

The Determination articulates several discrete and concrete regulatory concepts that drive implementation and compliance.

Licence area concept and ABS basis. Licence areas are defined by listing ABS collection districts and shires, with population figures taken from the 1991 Census (see Attachments 1.1, 2.1, 3.1). The instrument therefore treats ABS spatial units as the legal geography for service availability. That has two consequences embedded in the text: (1) licence holders and the ABA have a shared, fixed reference for coverage obligations; and (2) the population baseline for planning is the 6 September 1991 census.

Service categories and statutory linkage. The Determination distinguishes service categories: National, Commercial, Community, and Open Narrowcasting (Schedules One-Three). The Schedules state that service licence numbers are allocated where appropriate and note that the Broadcasting Services Act 1992 requires service licences only for Commercial and Community services. This sets a statutory division: commercial and community services carry a discrete administrative identifier (SL numbers) and thus sit under the service-licensing regime of the Act; national and open narrowcasting services are recorded but not assigned service licence numbers in this Determination.

Transmitter by transmitter technical envelope. For each transmitter the Determination provides a transmitter specification number (TS numbers) and a detailed technical specification in the attachments. Key parameters are:

• Emission band and mode (MF-AM for medium frequency AM; VHF-FM for FM).
• Carrier frequency (kHz or MHz).
• Output radiation constraints: for AM this Determination uses maximum Carrier Modulation Field (CMF) expressed in volts (e.g. 450 V, 225 V) at 0 degrees elevation; for FM it gives maximum Effective Radiated Power (ERP) in watts or kilowatts and, where specified, maximum antenna height (e.g. 125 m for Mt Latham 96.3 MHz).
• Nominal transmitter locations and Australian Map Grid references (Zone 50 Easting and Northing). Each attachment repeats the constraint that the CMF at all elevations is not to exceed the specified CMF at 0 degrees elevation for all azimuth angles for AM transmitters , this is the document's own radiated-field compliance rule for AM.

Reference to Technical Planning Guidelines. Every attachment includes "Site Tolerance: Refer to Technical Planning Guidelines." The Determination therefore delegates detailed planning tolerances and unspecified implementation parameters to the Technical Planning Guidelines. That links the plan to a separate technical regime rather than embedding complete engineering rules in the Determination.

Cross-referencing between Schedules and Attachments. The Schedules list services, service licence numbers (where required), the number of transmitters, transmitter specification numbers, and the identifying number of the Attachment where the technical specification is given. The Attachments contain the transmitter engineering data. That structure makes the legal effect of the Determination manifest by cross-reference: the operative permissions and constraints for a transmitter derive from the specified TS number and its Attachment.

Population and geographic scope. The Determination is explicit about which towns and shires each licence area serves and provides population counts for each ABS unit. For example, the commercial licence area in Attachment 1.1 totals 17,097 persons across named shires and collection districts; community licence SL010069 covers Broomehill and Katanning shires with a total of 5,127 persons (Attachment 2.1); community licence SL010086 covers Wagin and Woodanilling shires with total 2,326 persons (Attachment 3.1). These figures are embedded in the plan and therefore form a baseline for coverage expectations or any statutory population tests in other parts of the broadcasting regime.

Operational distinction between categories. The Determination separates national services (which are recorded and have technical specs but no SL number in the plan), commercial services (which have SL numbers), community services (with SL numbers tied to smaller geographic licence areas and lower-power CMF/ERP limits), and open narrowcasting (also recorded without SL number). That distribution implies differing degrees of administrative oversight (commercial and community subject to a service-licensing requirement under the Act, national and open narrowcasting recorded in the plan but not assigned service licence numbers in the document).

In short, the Determination is a granular, transmitter-level instrument that fixes technical and geographic parameters for radio services in the Katanning area; it links to the Broadcasting Services Act 1992 for its statutory validity, and to ABS census geography and the Technical Planning Guidelines for implementation details.

Primary obligations and entitlements created by the Determination fall on defined categories of broadcasting entities and on particular geographic communities.

Licensees and prospective licensees. The Determination names specific service licence numbers for commercial and community services: SL010400 and SL010076 (commercial services listed in Schedule One); SL010069 and SL010086 (community services listed in Schedules Two and Three). Where a service licence number is shown, the entity holding that service licence (or applying for it under the Broadcasting Services Act 1992) is the primary addressee of the technical and geographic constraints in the corresponding Attachment. The Determination also records national services (no SL assigned in the document) and an open narrowcasting service (N/A for SL number in Schedule One), which affects whichever bodies operate those national or narrowcast services.

Transmitter owners and operators. Each transmitter specification is linked to a particular nominal site and TS number (for example TS10002343 at Wagin 558 kHz; TS10001902 at Mt Latham 96.3 MHz). Entities that own or operate the transmitter plant, tower sites or antennas must ensure engineering compliance with the Attachment parameters (carrier frequency, CMF/ERP, antenna height, emission mode, and Australian Map Grid reference). The document explicitly instructs reliance on Technical Planning Guidelines for site tolerance; that points to an operational interaction between transmitter operators and the technical planning regime.

Local populations and advertisers. The Determination identifies the communities that each licence area serves by ABS units and gives the population for those units (Attachments 1.1, 2.1, 3.1). For example, the commercial licence area covering multiple shires lists a total persons figure of 17,097. Radio services assigned by this plan will be available, technically, to those listed areas , advertisers, local organisations, and listeners in those ABS units are therefore affected by who is licensed to serve them and by the technical reach of the transmitters (ERP/CMF, antenna height, frequencies).

Regulators and planners. The Australian Broadcasting Authority is the issuing regulator and the author of the Determination. The document also makes explicit reference to the Technical Planning Guidelines for site tolerance and other unspecified planning details, which affects the technical staff and planners within the ABA and any other agencies or consultants who implement and monitor engineering compliance.

Third parties with infrastructure. Owners of land, towers, or mast sites at or near the specified coordinates may be affected where transmitters are nominally located "7 km NW of Katanning", "Mt Latham WAGIN", or other coordinates. Those third parties may be engaged in lease, access, planning approvals, or environmental assessment processes when facilities are installed or altered.

Entities not assigned SL numbers. The Determination records national services and an open narrowcast service without allocating service licence numbers within the document; however, it still specifies their transmitter technical parameters (Attachments 1.2, 1.3, 1.4, 1.5, 1.8). The operators of those services, whether government broadcasters (national) or narrowcasters, must observe the technical parameters even if the Determination does not show an SL number, because the plan prescribes the technical envelope for services to be available in the area.

Practitioners should note that the Determination uses ABS census units from 1991; the population and geographic definitions in this Determination therefore reflect the 1991 snapshot rather than later demographic changes. That temporal anchoring affects any analysis that depends on population thresholds or market size expressed in the plan.

Finally, the Determination explicitly limits its scope to radio broadcasting services in the listed bands and areas. Other spectrum users or services outside the broadcasting bands and outside the ABS-defined units are not covered by this instrument.

This Determination creates a set of operational rights (authorised service categories and corresponding transmitter parameters) and technical duties (adherence to the specified equipment, site and emission constraints). The instrument itself focuses on technical and geographic prescription; it does not set out broad commercial or programming duties, which remain within the Broadcasting Services Act 1992 and related instruments.

Rights conferred by the Determination. The plan authorises availability of specified categories of service in particular areas and identifies transmitter parameters that define lawful operation within the plan. Concretely:

• Right to operate the commercial service identified by the service licence number SL010400 from the transmitter specified TS10002337 at nominal location 7 km NW of Katanning, on carrier frequency 1071 kHz with maximum CMF 450 V (Attachment 1.6; Schedule One).
• Right to operate the commercial service SL010076 using transmitter TS10002151 at KATANNING, carrier 1359 kHz with maximum CMF 450 V (Attachment 1.7; Schedule One).
• Right to operate community services SL010069 and SL010086 within their respective licence areas and transmitter technical envelopes (Attachments 2.2 and 3.2; Schedules Two and Three).
• Rights for national and open narrowcasting services to operate the listed transmitters and frequencies recorded in the plan (Attachments 1.2, 1.3, 1.4, 1.5, 1.8) even though the plan records "N/A" for SL numbers in these categories; the plan includes the technical specifications for those transmitters.

Duties of licensees and operators. The Determination places clear technical duties on operators, by cross-reference to transmitter specification numbers and detailed attachments:

• Duty to operate within the indicated frequency band and mode for each transmitter (e.g. MF-AM or VHF-FM as specified in each Attachment).
• Duty to respect specified carrier frequencies (558 kHz, 1296 kHz, 96.3 MHz, 97.9 MHz, 1071 kHz, 1359 kHz, 1422 kHz, 1197 kHz, 693 kHz).
• Duty to maintain output radiation within the prescribed limits: for AM transmitters CMF constraints are given (for example 2.38 kV at 558 kHz, 1.1 kV at 1296 kHz, 450 V at 1071 kHz and 1359 kHz, 225 V for the community AM services), and the Attachments state that CMF at all elevations must not exceed the 0 degree elevation value for all azimuths; for FM transmitters the maximum ERP is prescribed (5 kW for 96.3 MHz national FM; 25 W for 97.9 MHz Kojonup FM).
• Duty to observe maximum antenna height where specified (e.g. 125 m at Mt Latham for 96.3 MHz).
• Duty to respect nominal transmitter site coordinates and the site tolerance rules as set out in the Technical Planning Guidelines ("Site Tolerance: Refer to Technical Planning Guidelines" appears in every Attachment).
• Duty to ensure the transmitter serves the general areas set out in the Schedules (each transmitter is associated with a "General Area Served by Transmitter" entry).

Procedural duties implicit in the structure. The Schedules explicitly record which categories require a service licence under the Broadcasting Services Act 1992: the explanatory paragraph in the Schedules states "the service licence number which has been allocated to the service, if appropriate (column two); N/A = Not Applicable, as the Broadcasting Services Act 1992 only requires service licences for Commercial and Community services." That creates a legal duty for commercial and community operators to secure and comply with a service licence under the Act; the Determination itself links those service licences to the technical parameters.

Delegated technical duties to guidelines. Repeated cross-reference to the Technical Planning Guidelines for site tolerance imposes a duty to consult and comply with those Guidelines for operational tolerances not fully specified in the Determination. The Determination therefore does not stand alone as a complete technical manual; operators are obliged to incorporate the Guidelines' tolerances into their compliance approach.

What the Determination does not itself impose. The document does not enumerate content or advertising duties, does not specify licence conditions that are normally the substance of a service licence under the Act, and does not list sanctions or enforcement procedures. Those matters remain in the broader statutory and regulatory framework (the Determination identifies the statutory basis in subsection 26(1) BSA but does not embed the full licensing apparatus).

Practical practitioner points. A legal or engineering adviser should treat the Determination as creating technical entitlements and constraints: licence-holders and transmitter operators have the right to operate within the plan’s parameters and a duty to adhere to the carrier frequency, ERP/CMF, antenna height, site location and Technical Planning Guidelines tolerances. Service licence-holders (commercial and community) also remain subject to any additional obligations embedded in their SL instrument under the Broadcasting Services Act 1992.

The Determination itself does not set out an enforcement or penalty regime. It is presented as a plan made under subsection 26(1) of the Broadcasting Services Act 1992, and therefore its enforcement and any penalties for non-compliance sit in the broader legal context of that Act and the ABA’s regulatory powers. The text contains no operational schedule of sanctions, fines, revocation mechanisms or dispute-resolution processes within the Determination itself.

What the Determination does specify that bears on enforcement:

• Technical compliance triggers: The Attachments set precise technical limits , carrier frequencies, maximum CMF for AM transmitters, maximum ERP for FM transmitters, maximum antenna height where given, and site coordinates. These technical constraints provide the basis for any enforcement action under the broadcasting regime: if a transmitter operates outside these parameters it would be technically non-compliant with the plan and therefore subject to regulatory inquiry or action under the overarching statutory framework (the Determination itself is silent on remedy mechanisms).
• Cross-reference to Technical Planning Guidelines: the Attachments repeatedly direct operators to "Refer to Technical Planning Guidelines" for site tolerance. That means enforcement will be linked to compliance with those Guidelines as well as with the numerical parameters in the Attachments. The Guidelines are therefore an enforcement touchpoint even though they are not included in this Determination.

What the Determination omits:

• No penalties enumerated: the plan does not specify penalties, suspension powers, or the ABA’s procedural steps to address non-compliance.
• No operational enforcement authority text: the instrument does not describe which ABA units or what technical monitoring regime will check compliance, nor does it specify reporting obligations for licensees or procedures for remediation.

Implications for practitioners:

• Enforcement is likely to proceed through the ABA’s statutory powers under the Broadcasting Services Act 1992 rather than through the Determination itself. Because the Determination references s. 26(1) of the Act, any immediate questions about sanctions, revocation of service licences or other enforcement measures must be resolved by reference to the Act and to licence instruments issued under it.
• For technical enforcement, the numerical parameters in the Attachments (CMF, ERP, antenna height, frequency, coordinates) and the site tolerance rules in the Technical Planning Guidelines constitute the operative compliance standard. Regulatory action for interference, unlawful emissions, or operation beyond the prescribed envelope would be grounded in failure to meet those technical specifications.
• Practitioners advising licensees should treat the Determination as the authoritative statement of permissible technical operation in the Katanning plan area but must also consult the Broadcasting Services Act 1992 and the licence instrument under which a commercial or community service operates to understand specific enforcement consequences and procedures.

In sum, while the Determination defines technical and geographic obligations that can be enforced, it does not itself describe enforcement mechanisms or penalties; these remain matters for the Broadcasting Services Act 1992 and related licence instruments and guidelines.

The Determination expressly situates itself within a statutory and technical framework by reference to a limited set of external instruments and authorities.

Statutory basis: Broadcasting Services Act 1992. The Determination is made by the Australian Broadcasting Authority under subsection 26(1) of the Broadcasting Services Act 1992 (the front page states "under subsection 26(1) of the Broadcasting Services Act 1992"). That clause is the statutory hook for the plan and thereby links its legal force to the powers and duties of the ABA established by that Act. The Determination itself does not reproduce or restate broader Act provisions (for example, it does not reproduce licensing procedures, sanctions, or content obligations from the Act). Consequently, the Determination functions as a technical/area instrument under the umbrella of the Act; interpretation or enforcement will require reference to the Act for procedural and sanctioning authority.

ABS Census definitions. Licence areas are defined using Australian Bureau of Statistics (ABS) geography and population figures from the Census of 6 September 1991 (Attachments 1.1, 2.1, 3.1). The Determination therefore interoperates with ABS spatial units and census data for its geographic definitions. Any later legal or administrative analysis that depends on the plan’s area boundaries must account for that ABS reference point; changes to ABS boundaries or later censuses do not appear in this document.

Technical Planning Guidelines. Each Attachment includes the repeated direction "Site Tolerance: Refer to Technical Planning Guidelines." The Determination therefore interacts with an external technical regime , the Technical Planning Guidelines , which will contain further technical procedures and tolerances relevant to siting, interference management and engineering compliance. The Guidelines are not included in the Determination and are therefore part of the implementing regulatory architecture that licence-holders must consult.

Service-licensing framework. The Schedules explain that the Broadcasting Services Act 1992 requires service licences for Commercial and Community services; the plan therefore interacts with the Act’s service-licensing regime by assigning service licence numbers for commercial and community services (SL010400, SL010076, SL010069, SL010086). The Determination records those service licence numbers and ties them to transmitter specs and licence areas, but it does not itself produce the service licence instrument that includes operational conditions, terms, and statutory obligations , those are separate instruments under the Act.

Spectrum management. The Determination specifies carrier frequencies, ERPs and CMFs for transmitters and specifies nominal transmitter sites with Australian Map Grid coordinates. Those specifications overlap with spectrum-management concerns, radio communications legislation (not cited in this Determination) and planning/engineering regimes managed by spectrum authorities. The Determination does not itself cite the Radiocommunications Act or spectrum licences; practitioners should note that the broadcast parameters here will need to be reconciled with national spectrum assignment and any coordination obligations (the Determination’s technical parameters are inputs to that ecosystem, but the document itself confines its references to the Broadcasting Services Act and the Technical Planning Guidelines).

Local planning and property law. Nominal transmitter locations and tower heights (for example, maximum antenna height 125 m for Mt Latham FM) will interact with local land-use planning, building approvals and lease arrangements for mast sites. The Determination does not address those approvals or property issues; it sets the technical envelope that must then be implemented within the local legal and planning framework.

In short, the Determination is an instrument that sits within and must be implemented alongside the Broadcasting Services Act 1992, the Technical Planning Guidelines, ABS census geography, and the practical realities of spectrum assignment and local planning. The Determination identifies which instruments and external rules it expects to rely on (s. 26(1) BSA, ABS, Technical Planning Guidelines) and thereby creates a set of interlocking compliance obligations that reach beyond the single document.

The Determination as provided contains a single date and no express history of amendments or prior versions. It is dated 4 October 1996 and is titled "LICENCE AREA PLAN - KATANNING (RADIO) - OCTOBER 1996." No textual amendments, supersessions, or later dates are noted within the document itself.

What the document records about change mechanisms:

• Statutory basis suggests amendment route. The Determination states it is made under subsection 26(1) of the Broadcasting Services Act 1992; the Act is therefore the legal vehicle for making, varying or revoking licence area plans. While the Determination does not recite the amendment procedure or any prior plans, its citation of s. 26(1) implies that amendments to the plan would be effected through the ABA's powers under the Act and according to any procedural requirements in the Act.
• No internal amendment log. There is no schedule or margin note recording subsequent changes, nor is there any explicit provision in the printed Determination indicating provisional, transitional or sunset arrangements for the transmitter specifications or licence areas.
• Static populations. The ABS population figures reflect the Census of 6 September 1991. The use of fixed historical census data in the document indicates that, absent an explicit amendment, the Determination's geographic and demographic references remain as published rather than dynamically updating to later census counts.

Practitioner implications:

• To determine whether the plan remains current or has been replaced, a user would need to consult the ABA record of determinations, subsequent determinations, amendments made under the Broadcasting Services Act 1992, or an updated version of the Licence Area Plan. That procedural route is not included in this Determination and therefore cannot be inferred from the text provided.
• Any operational changes to transmitter power, location, frequency, antenna height or other technical features would require amendment to the plan or a separate technical authorisation under the statutory framework; the Determination itself does not record any amendments or processes for unilateral operational variation by licensees.
• The absence of an amendment history in the text means that reliance on this Determination as the applicable instrument requires confirmation against the ABA’s current registers or public records to ensure no subsequent determinations or variations have superseded the 1996 plan.

In sum, the Determination is a single, dated instrument with no internal record of amendment; amendments would arise only through the statutory processes of the Broadcasting Services Act 1992 and associated ABA practice, none of which are contained in this document.

The Determination contains no litigation history, references to judicial or tribunal decisions, or citations of cases. It is a statutory instrument , a Licence Area Plan made by the Australian Broadcasting Authority , and the text does not purport to summarise or reference any disputes, challenges, or judicial interpretation.

What the absence implies for advisers:

• There is no litigation material embedded in the plan that would clarify contested interpretations of the plan’s parameters, the meaning of particular technical phrases, or the scope of the ABA’s authority under subsection 26(1) as applied in this instance.
• Any interpretation disputes, enforcement actions, or licence revocation matters arising from operation under this plan would need to be researched in the broader corpus of case law concerning the Broadcasting Services Act 1992, ABA determinations, and spectrum regulation. That case law is not included in the document, so users should not assume precedent or judicial gloss based on this Determination alone.
• Practitioners preparing to litigate or to assess litigation risk should treat the absence of litigation history in the Determination as a signpost to primary-source research: consult the ABA administrative records and the relevant court and tribunal decisions relating to the Broadcasting Services Act 1992 or to specific service licences like SL010400, SL010076, SL010069, or SL010086. None of that material is contained in the Determination itself.

Because the document lists no cases or legal challenges, the Determination functions as an administrative technical plan, not as an adjudicative or litigated text. Any litigation context must be found outside the document.

This Determination contains technical and structural details that can catch practitioners unaware if read casually. Below are concrete points to check and verify before acting on the plan.

Inconsistent labelling. Some Attachments contain label inconsistencies between the heading that names the "TECHNICAL SPECIFICATION - FM Radio" and the emission field that reads "Frequency Band & Mode MF-AM" and shows a carrier frequency in the kilohertz range (e.g. Attachment 1.7 appears under the "TECHNICAL SPECIFICATION - FM Radio" heading but lists "Frequency Band & Mode MF-AM" and Carrier Frequency 1359 kHz). These inconsistencies suggest either typographical errors or mislabelling in the document. Practitioners should not rely on the heading alone; they should read the emission line and carrier frequency to determine whether a transmitter is AM or FM. Cross-check with the transmitter specification number (TS10002151 in Attachment 1.7) and the Schedules entry to confirm intended mode.

Dual references to TS numbers in different formats. The Schedule One table in the initial part of the Determination uses transmitter specification numbers like TS002343, TS002345, TS001902, TS002216, TS002337, TS002151, TS002154, whereas the Attachments use TS10002343, TS10002345, TS10001902, TS10002216, TS10002337, TS10002151, TS10002154 etc. The discrepancy appears to be a formatting difference (leading zeros or a different prefix). Practitioners should match TS numbers carefully, recognising that TS10002343 corresponds to TS002343 in Schedule One, etc., rather than assuming they are distinct specifications.

CMF versus ERP metrics. The document uses CMF (Carrier Modulation Field) in volts for AM transmitters (e.g. 2.38 kV at 558 kHz, 450 V at 1071 kHz) and ERP in watts or kW for FM transmitters (e.g. 5 kW ERP at 96.3 MHz, 25 W ERP at 97.9 MHz). These are different engineering metrics; compliance obligations differ. Practitioners must ensure the appropriate technical unit is used in testing and reporting. The Attachments also state a consistent rule for AM transmitters: the CMF at all elevations is not to exceed the specified CMF at 0 degrees elevation for all angles of azimuth , a specific interpretive rule that constrains vertical radiation patterns.

Site tolerance delegation. Every Attachment directs users to "Refer to Technical Planning Guidelines" for site tolerance. The Determination therefore does not itself contain tolerances for allowable deviation in transmitter siting, antenna height variance, or permissible ERP/CMF variation. Practitioners should not assume any leeway from the Determination itself; they must consult the Technical Planning Guidelines for tolerances. The absence of those Guidelines in this document is a compliance risk if relied upon in isolation.

Population data vintage. Licence areas and population figures are taken from the ABS Census of 6 September 1991 (Attachments 1.1, 2.1, 3.1). If coverage obligations, market assessments or public interest analyses rely on contemporary population data, that temporal mismatch could produce erroneous conclusions. Treat the Determination's population figures as frozen at the 1991 census date.

Multiple transmitters serving the same general area. Schedule One lists multiple national transmitters (TS10002343, TS10002345, TS10001902) all with "General Area Served by Transmitter: Wagin." That means Wagin is served by multiple national transmitters across AM and FM bands. Practitioners should confirm coordination among those transmitters and consider interference scenarios when planning station operation, engineering modifications, or maintenance. The Determination prescribes each transmitter's independent technical envelope, but simultaneous operation by multiple transmitters in proximate locations may create practical coordination duties.

Nominal locations and map coordinates. The Attachments provide Australian Map Grid references (Zone 50 Easting Northing). These are the nominal locations for transmitters. The Determination requires site tolerance reference to the Technical Planning Guidelines; operators must verify that the actual site chosen falls within allowable tolerances for the named coordinates and that any local planning or environmental approvals are obtained.

Absence of enforcement detail. There is no list of sanctions, monitoring procedures or reporting obligations in the Determination. Practitioners cannot infer enforcement mechanics from the Determination alone; they must consult the Broadcasting Services Act 1992 and the license instrument.

Service licence number scope. The Schedules state that only Commercial and Community services require service licences under the Act; national and open narrowcasting services are entered as N/A for service licence number. Do not assume that "N/A" means no regulatory oversight; rather, it indicates no service licence number was required to be shown in the Determination under the BSA's rules as explained in the Schedule commentary. Operators of national services will still operate within the plan's technical parameters.

Always cross-check. Given the typographical and labelling inconsistencies, engineers and lawyers should cross-verify the TS numbers, carrier frequencies, modes, and coordinates against the ABA's official registers and the Technical Planning Guidelines before implementing changes or advising clients.

Compliance with this Licence Area Plan requires a layered approach: (1) respect the plan’s transmitter-level technical parameters and licence area definitions, (2) satisfy any service-licensing obligations under the Broadcasting Services Act 1992, and (3) implement engineering and planning measures consistent with the Technical Planning Guidelines and local regulatory requirements.

Concrete compliance steps derived from the Determination:

1. Confirm applicable service licence status.

   • For commercial services listed as SL010400 and SL010076 (Schedule One), verify the holder of those service licence numbers and the precise terms of the service licence under the Broadcasting Services Act 1992. The Determination notes that commercial and community services require service licences under the Act; ensure the service licence is current and review any additional conditions in the SL instrument.
   • For community services SL010069 and SL010086 (Schedules Two and Three), confirm community licence conditions and any community-specific obligations in the relevant service licence.
   • For national and open narrowcasting services listed as N/A for SL numbers, identify the operating body (for national services) or narrowcaster and confirm any other applicable authorisations outside the service-licensing regime.

2. Adhere to the transmitter specification numbers and attachments.

   • Map each transmitter you operate to the correct TS number and Attachment. For example, if you operate the Katanning commercial AM transmitter, use TS10002337 (Attachment 1.6) and ensure operation on carrier frequency 1071 kHz with maximum CMF 450 V, at the nominal location 7 km NW of Katanning with the Australian Map Grid coordinates provided.
   • Don’t rely on headings alone; confirm emission mode and carrier frequency lines in the Attachment (watch for label inconsistencies described in the Gotchas section).

3. Respect numerical technical limits and reporting/testing regimes.

   • For AM services, ensure measured CMF at all elevations does not exceed the specified CMF at 0 degrees elevation for any azimuth as the Attachments require. Establish measurement protocols to demonstrate that vertical and azimuthal radiation complies with the Attachment rule.
   • For FM services, ensure ERP does not exceed the maximum ERP given (e.g. 5 kW for national 96.3 MHz) and that antenna height does not exceed any maximum specified (e.g. 125 m for Mt Latham).
   • Maintain engineering records of transmitter output, antenna parameters and periodic field-strength surveys to demonstrate ongoing compliance.

4. Observe site tolerance and planning rules.

   • Obtain the Technical Planning Guidelines referenced in every Attachment and ensure the chosen mast site and installation are within the permitted site tolerance. The Determination defers to those Guidelines for site tolerance, so compliance requires consulting them and building their tolerances into installation and compliance checks.
   • Secure any necessary local planning, building approvals and land-access agreements for the nominal site coordinates listed in the Attachments.

5. Match service coverage to licence area definitions.

   • Use the ABS units and population figures in Attachments 1.1, 2.1, 3.1 to confirm the intended service area. Where coverage obligations or community commitments exist in the service licence, ensure programming and transmission meet the plan’s geographic scope. Remember that the Determination’s population figures are frozen to the 1991 census and do not update automatically.

6. Coordinate with other transmitters and spectrum users.

   • Several transmitters are nominally located to serve the same general area (e.g. multiple national transmitters for Wagin). Coordinate frequency use, maintenance windows and any engineering changes to avoid interference. Technical planning and the Technical Planning Guidelines will shape coordination duties.

7. Keep documentary evidence and seek ABA confirmation for changes.

   • Where a licensee proposes modifications to transmitter power, antenna height, or site location, these changes will likely require engagement with the ABA and possibly amendment to the licence area plan or to the licence instrument. The Determination itself gives no amendment procedure; follow the statutory routes in the Broadcasting Services Act 1992 and the ABA’s administrative processes.
   • Maintain a record of all technical tests, licence documents, correspondence with the ABA, and approvals from planning authorities. These documents will be essential if any regulatory compliance query arises.

8. Address typographical/inconsistency issues proactively.

   • If the Attachment labels or TS numbers appear inconsistent (see the Gotchas section), seek clarification from the ABA or the technical authority. Do not proceed on the basis of an apparent mislabel if the consequences would be non-compliant operation.

9. Integrate with broader regulatory regimes.

   • Ensure compliance with spectrum management and radiocommunications requirements outside the Determination if applicable. The Determination prescribes broadcasting parameters but does not explicitly document spectrum licences or radiocommunications authorisations; confirm those are in order.

10. Review and update compliance programmes periodically.

• Because the plan references 1991 census data and is dated 1996, periodically check the ABA’s public registers for superseding determinations or revisions. Continue to test transmissions and keep engineering and legal programmes aligned with any new determinations, changes to the Technical Planning Guidelines, or updates to the Broadcasting Services Act 1992 regime.

In practical terms, compliance is a function of aligning the licence-holder’s operational engineering with the exact TS attachment values (frequency, CMF/ERP, antenna height, coordinates), following the Technical Planning Guidelines for site tolerance, ensuring the correct service licence is held and current for commercial and community services, and documenting each step. Where ambiguity or inconsistency in the Determination exists, seek clarifying direction from the ABA rather than relying on ambiguous text.
