Licence Area Plan – Horsham Radio

The plan rests on a small set of organising concepts that drive its legal and technical effect: licence areas, service categories, frequency allocations, transmitter specifications, coverage footprints, protective planning values, and cross-references to external technical rules.

Licence area: The plan uses two licence-area labels, HORSHAM RA1 and HORSHAM RA2. Attachment 1.1 lays out RA1 in terms of Australian Bureau of Statistics collection districts (ABS CDs) defined at the 1996 Census (Attachment 1.1). Attachment 2.1 does the same for RA2 (Attachment 2.1). The plan therefore ties legal coverage to a historical ABS geography rather than to modern local government area names or postcodes; the labels RA1 and RA2 are the plan’s internal identifiers (Schedule One; Schedule Two).

Service categories: The instrument distinguishes four service categories: national, commercial, community and open narrowcasting (Schedules One and Two). Each category is treated uniformly in the schedule entries , that is, the category label is recorded alongside the frequency and transmitter specification number. The legal consequences of being a “national” versus “commercial” or “community” service are not spelled out in the plan; the plan’s role is to allocate frequencies and list transmitter parameters for those categories.

Frequency allocation and transmitter specification: For every listed service, the plan records a frequency (MF-AM or VHF-FM) and links that frequency to a transmitter specification number (for example TS4029001 for 594 kHz AM at Attachment 1.2; TS10010638 for 102.9 MHz FM at Attachment 1.20). The attachments contain the technical data: AMG grid coordinates, polarisation, maximum antenna height, maximum ERP (for FM) or maximum CMF (for AM), and where applicable sectorised ERP values or coverage radii. That pairing , frequency + TS number + attachment , is the plan’s operational core.

Coverage footprints and advisory notes: Several attachments supply explicit coverage geometry. Open narrowcasting services often have circular coverage radii specified (e.g. TS10004792 , Ararat open narrowcasting: 5 km radius; Attachment 1.17; TS6485001 , Warracknabeal: 10 km radius , Attachment 1.19; TS10010638 , Horsham open narrowcasting: 20 km radius , Attachment 1.20). Several attachments include advisory notes that the transmission is planned to be protected to a minimum median field strength of 66 dBuV/m against interference from other broadcasting services (see Attachments 1.10, 1.12, 1.15, 1.17, 1.18, 1.21). Attachment 1.3 contains a special condition requiring the Australian Broadcasting Corporation to manage mutual interference between Parliamentary News Network services in Horsham and Bendigo.

Cross-references to external technical rules and instruments: Many attachments state “Site Tolerance: Refer to Broadcasting Services (Technical Planning) Guidelines 2017”. Clause (4)(b) and (c) make clear that references to other legislative instruments are to be read as those instruments “in force from time to time”, and that schedules and attachments are to be read as amended from time to time. The endnotes make explicit that the plan was registered and later varied (see Endnote 3).

Technical measures and units used: The plan uses standard radio-engineering measures: carrier frequency (kHz or MHz), maximum effective radiated power (ERP) in watts or kilowatts for FM services, maximum centre - or carrier - magnitude factor or CMF for AM services, antenna heights in metres, and polarisation (mixed). Sectorised ERP is used where directional patterns are required (for example TS1137118 at Attachment 1.10 gives 250 W on some sectors and 25 W on others). AM output patterns for TS4159001 (Attachment 1.11) are recorded as CMF values at angular sectors.

Temporal and amendment logic: Clause (4)(a)-(c) states that schedules/attachments and references are to be treated as updated when the referenced documents are amended; the endnotes record the instrument’s registration (9 June 2002) and later a variation in 2017 (Variation to Licence Area Plan - Horsham (Radio) - 2017 (No.1), registered 24 March 2017, commenced 25 March 2017), and a consequential amendment instrument for the technical guidelines (Broadcasting Services (Technical Planning) Guidelines (Consequential Amendments) Instrument 2017 (No.1), registered 29 September 2017, commenced 30 September 2017) (Endnote 3).

Put simply, the plan does not regulate programming, advertising or service content; it allocates spectrum and prescribes technical parameters and protective planning values for particular frequencies and transmitter sites within defined ABS-based licence areas. The plan presumes enforcement and detailed technical tolerance rules are set out in and administered through the referenced transmitter specifications, service licences (for example SL4159, SL10308, SL1150779) and technical guidelines.

Directly affected parties are identified in the text by service licence numbers, transmitter specification numbers and the named nominal transmitter sites. The instrument therefore has a clearly delimited set of stakeholders.

Licensed broadcasters: The plan lists specific commercial service licence numbers that are associated with the transmitter specifications: SL4159 and SL10308 are listed as the commercial radio service licences for HORSHAM RA1 (Attachment 1.1 and Schedule One entries). SL1150779 is the community radio service licence identified in Schedule Two and Attachment 2.2. Those licence numbers point to existing licence instruments external to the plan; the plan’s purpose is to specify the frequencies and technical parameters that those licences will operate within. Licensees who hold SL4159 or SL10308 will need to operate within the TS parameters shown (for instance SL4159’s FM operations at 96.1 MHz TS1137118 , Attachment 1.10; SL4159’s AM operation at 1089 kHz TS4159001 , Attachment 1.11). The community licence SL1150779 is recorded as providing 96.5 MHz (TS6489001) to Horsham with 500 W ERP and 87 m max antenna height (Attachment 2.2).

National broadcasters and the ABC: Schedule One lists eight national services (frequencies include 594 kHz AM TS4029001 , Attachment 1.2 , and multiple FM frequencies such as 89.3 MHz TS6490001 , Attachment 1.3). Attachment 1.3 contains an explicit special condition requiring the Australian Broadcasting Corporation to “manage any mutual interference between Parliamentary News Network services in Horsham and Bendigo.” That places a specific operational duty on the ABC for the Parliamentary News Network services named in the attachment.

Open narrowcasters and small commercial or community operators: Five open narrowcasting services are set out in Schedule One with TS numbers and coverage radii or maximum ERPs set in the attachments (e.g. TS10004792 Ararat 92.9 MHz 50 W with a 5 km radius , Attachment 1.17; TS10010638 Horsham 102.9 MHz 2 kW with a 20 km radius , Attachment 1.20). Those entries affect narrowcasters seeking to use those frequencies and define their coverage limits.

Infrastructure and transmission site operators: The nominal transmitter locations name commercial infrastructure operators and sites: Broadcast Australia site at the corner of Henty Hwy and Dooen School Rd, Telstra Radio Terminals at Mt Arapiles and One Tree Hill Rd Ararat, Ace Radio sites, and various BA/Telstra-related sites (Attachments 1.2 through 1.21). Those operators must observe the site tolerances and the technical parameters recorded in the TS attachments. The plan therefore affects tower owners, site operators and the entities that manage power and antenna installations at those coordinates.

Local markets and advertisers: The plan defines licence areas by ABS 1996 collection districts (Attachment 1.1 and 2.1). Advertisers, media buyers and competition regulators that rely on licence-area definitions to calculate market reach, audience share or media diversity will be affected because the plan fixes which services are assigned to which ABS CDs and what technical footprint each transmitter is allowed. Users dependent on up-to-date local government area boundaries will be affected by the plan’s use of historical ABS geographic units.

Regulatory and technical agencies: While the instrument itself does not name the regulator, it is made under s 26(1) of the Broadcasting Services Act 1992; the plan cross-references the Broadcasting Services (Technical Planning) Guidelines 2017 for site tolerances. Those guidelines and the Act are the operational framework regulators use to implement and enforce the plan’s technical and geographical allocations.

Listeners and consumers: The plan affects what radio services are “to be available” in the Horsham licence areas (clauses (2)-(3)). For particular communities this will fix which national, commercial, community and narrowcasting services can be expected, and which frequencies will be used.

Third-party technical suppliers and consultants: Anyone advising on coverage modelling, interference studies or transmitter parameter compliance will need to use the TS numbers and the attachments as the canonical technical specification. The plan’s frequent referral to the Broadcasting Services (Technical Planning) Guidelines 2017 means engineers must consult both the plan and the external Guidelines.

Secondary effects on competition and market entry: Because the plan lists a finite number of frequencies assigned to categories in a defined area, potential entrants must plan around the listed allocations. For example, two commercial licences are recorded in RA1 (SL4159, SL10308): new commercial entrants will face the plan’s allocation constraints, and narrowcasters have explicit small‑area allocations (open narrowcasting) that are not readily expandable beyond the stated coverage radii and ERPs in the attachments.

Geographic precision and mapping practitioners: The plan’s licence areas are defined by ABS collection district codes from the 1996 Census. Anyone mapping the plan to modern geographies must reconcile those historical ABS codes to current mapping layers. That reconciliation task affects legal counsel, planners and compliance officers who prepare licence applications, audience reach reports or regulatory filings.

In sum, the plan affects three groups most directly: (1) licence-holders and prospective operators named by service licence numbers and TS numbers; (2) infrastructure/site operators and technical engineers who must implement the transmitter parameters; and (3) market actors and regulators relying on the plan’s licence-area definitions for market analysis, interference protection and entry decisions.

The plan specifies technical allocations and operational constraints rather than prescriptive, standalone statutory duties or civil rights. Within the document, the following duties, limits and entitlements are encoded.

Entitlement to operate on specified frequencies in defined areas: The plan states that specified categories of broadcasting services “are to be available” in the areas described (clauses (2)-(3); Schedule One; Schedule Two). Practically this creates an entitlement framework: listed frequencies are allocated for use by the named category in the specified licence area, subject to the associated transmitter specification. For example, the plan records that a community radio service (SL1150779) is to be available at 96.5 MHz in HORSHAM RA2 with TS6489001 (Schedule Two; Attachment 2.2). Similarly, commercial service SL10308 is listed with multiple transmitters (e.g. 101.3 MHz TS10008172 for Horsham , Attachment 1.13).

Technical limits that must be observed: Each transmitter attachment prescribes parameters that will be operative constraints on licensees. Those technical limits include maximum ERP (for FM services), maximum antenna height, polarisation and, for AM services, CMF values by sector (for AM carrier degrees) (see Attachments 1.2-1.21). For example, TS6490001 (Attachment 1.3) prescribes 89.3 MHz at the Broadcast Australia Dooen site with maximum ERP 20 kW and maximum antenna height 180 m; TS6489001 (Attachment 2.2) prescribes 96.5 MHz community FM at 500 W ERP and 87 m antenna height.

Obligation to refer to technical planning guidelines: Multiple attachments state “Site Tolerance: Refer to Broadcasting Services (Technical Planning) Guidelines 2017”. That creates an operational duty on implementers to follow the external Guidelines’ tolerance and planning rules when designing and operating facilities. Clause (4)(b) explicitly ties references to other legislative instruments to their current text. Licence-holders therefore must ensure compliance with the Guidelines as they change over time.

Duty to manage certain interference relationships: The plan assigns one discrete operational duty: Attachment 1.3’s special condition requires the Australian Broadcasting Corporation to manage mutual interference between Parliamentary News Network services in Horsham and Bendigo. That is a specific duty allocated by the plan to the ABC for specified services; it is recorded as a condition of the transmitter specification for 89.3 MHz TS6490001.

Protective planning values that constrain interference tolerance: Several attachments include advisory notes that transmissions “are planned on the basis that they will be protected to a minimum median field strength level of 66 dBuV/m against interference from other broadcasting services” (for example Attachments 1.10, 1.12, 1.15, 1.17, 1.18, 1.21). These advisory notes are statements of planning intent: they set a protective field strength level to be used in interference assessment and in coordination between services. The plan thereby creates a technical expectation that the minimum median field strength will be a metric used in operational protection and coordination.

Limits on coverage for narrowcasting services: Where the plan supplies explicit coverage radii for open narrowcasting entries, operators are constrained to those radii. Examples: TS10004792 (Ararat open narrowcasting 92.9 MHz) coverage is a 5 km radius (Attachment 1.17); TS6485001 (Warracknabeal 100.5 MHz) is specified with a 10 km radius (Attachment 1.19); TS10010638 (Horsham 102.9 MHz) with a 20 km radius (Attachment 1.20). Those radii function as de facto limits on the permissible service footprint under the plan.

Interaction with service licences and transmitter specifications: The plan’s practical effect depends on the interplay between the plan entries, the service licence instruments (the plan references SL4159, SL10308, SL1150779) and the transmitter specifications (the TS numbers). The plan does not itself reproduce the full licence conditions; therefore, the rights to broadcast and the precise duties of broadcasters must be read with the corresponding service licences and technical planning Guidelines.

Interpretive rule duty: Clause (4)(a)-(c) creates an ongoing interpretive duty: schedules and attachments are referenced “as amended from time to time” and other instruments are to be read as in force. That is a standing obligation to remain updated with amendments to the plan, transmitter specifications and referenced Guidelines.

What the plan does not do within its own text: It does not set out licensing processes, fee obligations, programming obligations, sanctions or enforcement mechanisms in detail. It also does not purport to create property rights in spectrum; it records the allocation of services, frequencies and technical parameters, with the operationalised rights and obligations to be found in the service licences and the Broadcasting Services Act framework.

In short, rights under the instrument are chiefly technical and territorial: permission to use specified frequencies at specified sites and technical parameters in the listed licence areas. Duties are primarily technical and coordination-oriented: operate within the recorded ERP/CMF/antenna constraints, conform to the Broadcasting Services (Technical Planning) Guidelines for site tolerances, manage noted interference relationships (Attachment 1.3), and accept the plan’s amendment mechanics (clause (4)).

The plan itself is silent about specific penalties and enforcement mechanisms. The text makes allocations and sets technical specifications; it does not, within its published content, create discrete offence provisions or enforcement sanctions. The instrument instead situates technical obligations and references within the broader statutory and regulatory framework.

Where enforcement sits in the legal architecture: The instrument is made under subsection 26(1) of the Broadcasting Services Act 1992, and it repeatedly cross-references the Broadcasting Services (Technical Planning) Guidelines 2017 for site tolerance. Those external instruments and the Broadcasting Services Act contain the statutory enforcement powers, administrative sanctioning authority and licence-compliance regime that will give the plan operational force. The plan’s clause (4)(b) instructs readers to treat references to other legislative instruments “as in force from time to time”, signalling that enforcement resides in the referenced instruments rather than in the plan’s text.

Operational enforcement mechanisms likely to be invoked (as implied by the plan’s structure): enforcement will be exercised through the service licences associated with specific entries (service licence numbers are recorded in the schedules , for example SL4159, SL10308, SL1150779). The service licences (not reproduced here) are the legal instruments that impose licence conditions, non-compliance remedies and administrative penalties. Transmitter specifications (the TS numbers recorded in the plan) are technical instruments that set the parameters an operator must meet; non-compliance with a TS may trigger action under licence conditions and the Act. The Broadcasting Services (Technical Planning) Guidelines 2017 set the technical tolerance regime used to determine whether a site or transmitter is operated within permitted tolerances; breach of those tolerances will be assessed against the licence conditions and the regulator’s enforcement powers.

Protective planning values and enforcement: Several attachments declare transmissions “are planned on the basis that they will be protected to a minimum median field strength level of 66 dBuV/m against interference from other broadcasting services” (Attachments 1.10, 1.12, 1.15, 1.17, 1.18, 1.21). Those statements are planning-level protections that would be operationalised by engineering coordination and, where necessary, by regulator decisions about interference disputes. The plan itself does not say what remedy follows if those protective levels are not met; remedies would flow from the service licence and the regulatory enforcement framework of the Broadcasting Services Act and associated instruments.

What is not in the plan: The document does not name the regulator nor set out appeal routes, fines, suspension powers, or specific procedural rules for dispute resolution. It does not specify criminal offences, civil penalties or administrative fines. It does not itself revoke or suspend licences. For any enforcement or penalty questions, the plan points users to the Broadcasting Services Act 1992 (the plan is expressly made under s 26(1)), the Broadcasting Services (Technical Planning) Guidelines 2017 (site tolerances) and the service licences referenced in Schedule One and Schedule Two.

Practical implications for compliance and enforcement risk: Because the plan establishes technical parameters and lists specific licence numbers and TS numbers, the immediate enforcement risk for an operator is non-compliance with the technical parameters recorded (ERP, CMF, antenna height, coordinates) or with the external Guidelines. Any such non-compliance would be judged against the operator’s underlying service licence and the statutory powers exercised under the Broadcasting Services Act. For interference incidents, the plan’s advisory values (66 dBuV/m minimum median field strength) and Attachment 1.3’s special condition on ABC interference management will be relevant factual and policy inputs to a regulator’s assessment.

In short, the plan defines technical allocations and expectations; it does not itself carry separate penalty clauses. Enforcement and penalties are supplied by the broader legislative instruments and the service licences that operate in conjunction with the plan.

The plan is an instrument embedded in a statutory and regulatory network. The instrument’s text sets out multiple express cross-references and dependencies.

Primary statutory basis: The plan is expressly made under subsection 26(1) of the Broadcasting Services Act 1992 (BSA). That statutory citation is used several times in the plan (opening line and reiterated elsewhere). Because the plan is made under the BSA, its operation, interpretation and any challenge to it will be framed by the powers, procedures and administrative arrangements established in the Act. The plan itself does not reproduce those Act provisions in full; it records the allocation and the technical schedule under authority of s 26(1).

Acts Interpretation and legislative drafting rules: The plan’s notes direct readers to the Acts Interpretation Act 1901 for references to Commonwealth Acts (Note 1) and to subsection 13(1) of the Legislation Act 2003 for the application of the Acts Interpretation Act 1901 to legislative instruments (Note 1). Clause (4) further instructs how references to schedules and attachments and to other instruments are to be read. Those cross-references establish that the plan should be interpreted in light of standard Commonwealth legislative interpretation rules and in the context of other instruments.

Broadcasting Services (Technical Planning) Guidelines 2017: Many attachments specifically instruct “Site Tolerance: Refer to Broadcasting Services (Technical Planning) Guidelines 2017”. The plan therefore relies on those Guidelines to define allowable deviations, technical tolerance margins and planning procedures for transmitter sites and antenna installations. The plan does not replicate the Guidelines; it references them as authoritative for site tolerances and presumably for some interference planning parameters.

Service licences and transmitter specification instruments: The plan lists service licence numbers (for example SL4159, SL10308, SL1150779) and transmitter specification numbers (TS numbers). Those instruments are separate legal instruments that will contain conditions, operative permissions, application processes and technical detail. The plan’s interaction with those licences is that it supplies the high-level allocation and links the licences to specified TS numbers; the legal effects and duties owed by a licensee are ultimately set out in its service licence and the Act. The plan, per clause (4)(a), treats schedules and attachments “as amended from time to time”, which affects how the licences and TS instruments interact over time.

Planning and interference protection metrics: Several attachments include advisory notes about the intended minimum median field strength (66 dBuV/m) for protection against interference. The plan thus references operational standards that are commonly used in interference analysis; decision-making about interference will therefore involve the plan’s stated protective values together with the technical Guidelines and the licence conditions.

Registration and amendment history as statutory events: Endnote 3 lists registration and commencement dates for the plan (Licence Area Plan - Horsham Radio - December 2001; registered 9 June 2002; Variation to Licence Area Plan - Horsham (Radio) - 2017 (No.1) registered 24 March 2017, commenced 25 March 2017; Broadcasting Services (Technical Planning) Guidelines (Consequential Amendments) Instrument 2017 (No. 1) registered 29 September 2017, commenced 30 September 2017). These recorded entries show how the plan has been varied and how automatic cross-references to other instruments were updated in 2017.

Administrative coordination and licence area definitions: The plan defines licence areas by ABS collection districts from the 1996 Census. That means administrative interactions with state or local government boundaries, modern ABS geographies or market assessments will require reconciliation across instruments and datasets. The plan’s ABS-based definition is legally operative for the plan but may diverge from contemporary administrative mapping used by other laws (planning, local government ratings, emergency service coverage, advertising market definitions). That divergence creates an interaction problem between the plan and non‑broadcast regulatory instruments that use different area definitions.

What the plan does not do: It does not displace the BSA or the Broadcasting Services (Technical Planning) Guidelines. It does not independently create licence conditions or enforcement rules. The plan prescribes allocations and technical specs; the integrated operation of those allocations within the broader regulatory architecture is achieved through the referenced licences and Guidelines.

In practical terms, anyone acting under the plan needs to consult (a) the Broadcasting Services Act 1992 for statutory powers and regulator authority; (b) the specific service licences listed by number for licence conditions; (c) the transmitter specifications (TS numbers) for detailed technical obligations; and (d) the Broadcasting Services (Technical Planning) Guidelines 2017 for site tolerance and engineering rules. The plan is a node in that network: authoritative on allocations and technical attachments, but dependent on other laws and instruments for enforcement, interpretation and administrative procedure.

The plan includes an explicit endnote record of its registration and variation history. The Endnote 3 table (Legislation history) provides the key entries that document when the plan and its consequential instruments were registered and commenced.

Initial registration: The instrument is titled “Licence Area Plan - Horsham Radio - December 2001” and was registered on 9 June 2002 under file reference F2005B00811 and commenced on 9 June 2002 (Endnote 3, first row). That entry establishes the plan’s original formalisation as a legislative instrument.

Subsequent variation: A variation titled “Variation to Licence Area Plan - Horsham (Radio) - 2017 (No.1)” was registered on 24 March 2017 (file reference F2017L00303) and commenced on 25 March 2017 (Endnote 3, second row). The presence of a 2017 variation indicates the plan has been updated since its 2002 registration. The plan itself indicates interpretive rules that schedules and attachments are referenced “as amended from time to time” (clause (4)(a)), so this 2017 variation would have been incorporated in that manner.

Technical Guidelines consequential amendment: The Broadcasting Services (Technical Planning) Guidelines (Consequential Amendments) Instrument 2017 (No.1) was registered on 29 September 2017 (file reference F2017L01299) and commenced on 30 September 2017 (Endnote 3, third row). This entry suggests the 2017 variation work included consequential amendments to the technical planning Guidelines to ensure coherence with the plan and other instruments.

Endnote structure and content: Endnotes 1-4 in the plan provide further meta-information on the compilation, explanation of abbreviations and the way amendments are recorded. Endnote 3 contains the legislation history entries just described; Endnote 4 is said to provide amendment history at the provision level, although the plan text included here does not reproduce a section-by-section amendment log beyond the Legislation history table in Endnote 3.

Effect of clause (4) on amendment reading: Clause (4)(a)-(c) makes the schedules, attachments and external instruments dynamically referable. This means the plan itself delegates amendment mechanics: if the schedules or referenced instruments are amended, the plan’s operative content is to be read with those amendments. For legal practitioners, that means a completed compliance check requires consulting the current versions of the schedules and the external transmitter specification instruments.

Practical implication: To determine the plan as currently operative, a user needs to consult (a) the formally registered plan and its attachments as published on the Federal Register of Legislation; (b) any variation instruments (the 2017 variation in particular); and (c) the Broadcasting Services (Technical Planning) Guidelines as in force. The endnotes alert readers to where and when those changes occurred; they do not, however, summarise the substantive content of the 2017 variation within the plan text provided.

No further amendment entries in the text: Beyond the entries in Endnote 3, the text supplied does not list additional subsequent amendments. If there have been later variations after 2017, they are not shown in the presented Endnote 3. The plan’s clause (4) nevertheless anticipates that schedules and attachments may be amended and should be read as amended.

In short, the plan originated in late 2001/registered 2002 and was formally varied in 2017; consequential amendments to the technical Guidelines were registered in 2017. Practitioners should check the Federal Register of Legislation for any further variations post‑2017 and for the current text of the transmitter specifications and service licences referenced.

The instrument as provided contains no reference to litigation, judicial determinations or case citations. The plan’s text, attachments and endnotes list administrative registration and amendment history (Endnote 3), but do not identify any court challenges, determinations or tribunal decisions.

What the document records and what it omits: The plan records its registration dates and amendment instruments (Endnote 3) but does not claim or summarise any litigation about the plan’s validity, application or interpretation. There are no case names, no citations to judicial authorities and no references to administrative review outcomes in the plan text supplied.

Implication for researchers: If litigation or administrative disputes have arisen in relation to this plan, they are not referred to in the instrument itself. Researchers seeking litigation history therefore must search external case law databases, tribunal records and regulator decisions. The plan points to specific licence numbers and transmitter specification numbers (for example SL4159, SL10308, SL1150779; TS4029001, TS10008172, TS6489001 etc.). Those identifiers can be used as search keys in ACMA decision registers, Federal Court and Administrative Appeals Tribunal databases to locate any enforcement or dispute decisions that involved the licence-holders or transmitter sites listed.

No cases named in the instrument: The plan does contain an internal note about the Acts Interpretation Act 1901 and the Legislation Act 2003 for interpretative purposes (Note 1), but that is not litigation history. The lack of stated judicial history within the plan means that any asserted judicial precedent about interpretation or enforcement is outside the instrument’s own record.

Practitioner takeaway: Do not rely on the plan’s text for litigation history. To compile litigation history relating to the Horsham licence area plan, search external sources (ACMA decision notices, AAT appeals, Federal Court judgments) using the plan’s licence numbers and TS identifiers as search terms.

The plan contains several technical and administrative features that create traps for the unwary. These are concrete, source-grounded issues you should check before relying on the plan for compliance, business decisions, licensing applications or interference mitigation.

1. Licence-area definitions use ABS 1996 collection districts. The plan defines HORSHAM RA1 and RA2 using Australian Bureau of Statistics collection districts from the 1996 Census (Attachment 1.1; Attachment 2.1). That is a dated spatial reference base. Market analyses, emergency planning, mapping and licence‑area comparisons that use modern ABS definitions, current local government boundaries or postcodes will not align automatically. Practitioners must perform a mapping reconciliation; do not assume municipal names in the plan match current administrative boundaries.

2. Multiple uses of the same nominal frequency in proximate locations. The schedule lists the same frequency in different contexts (for example 92.9 MHz appears under both SL4159 in Nhill (TS1137100) and as an open narrowcasting entry in Ararat (TS10004792)). Each entry has its own TS number and site specifics: the narrowcast Ararat service has 50 W and a 5 km radius (Attachment 1.17); SL4159’s Nhill FM is 2 kW at TS1137100 (Attachment 1.12). These overlapping frequency uses mean interference coordination and protection values (for example 66 dBuV/m) are critical. Do not assume identical frequencies at different sites are interchangeable; check the TS parameters and advisory notes.

3. Protection level advisory notes are planning, not guarantees. Several attachments state transmissions are planned to be protected to a minimum median field strength of 66 dBuV/m against interference (Attachments 1.10, 1.12, 1.15, 1.17, 1.18, 1.21). These are planning conventions set out as advisory notes. The plan does not itself specify the remedial steps or automatic remedies where that protection level is not achieved , remedies flow from the service licences and the regulatory regime. Treat the 66 dBuV/m figure as the operative planning metric, not an absolute enforcement remedy within this plan.

4. The plan delegates site tolerances to external Guidelines. Every attachment repeats “Site Tolerance: Refer to Broadcasting Services (Technical Planning) Guidelines 2017.” That means the plan intentionally keeps detailed tolerance and margin rules in a separate instrument. If your compliance check relies only on the plan’s numbers (ERP, height, coordinates), you will miss the tolerance regime that determines acceptable deviations and the procedures for changing sites or antennas.

5. Special condition imposes a specific operational duty on ABC. Attachment 1.3 imposes a requirement that the Australian Broadcasting Corporation “manage any mutual interference between Parliamentary News Network services in Horsham and Bendigo.” That is a named operational duty and can create practical obligations (coordination, retuning, transmitter configuration changes) for the ABC. If advising the ABC or competitors, flag this explicit clause.

6. Sectorised ERP patterns and AM CMF detail matter. Several TS attachments specify sectorised ERP values (e.g. TS1137118 Attachment 1.10 sector 0°T-180°T = 250 W vs 180°T-270°T = 25 W) or detailed AM CMF by precise angular sectors (TS4159001 Attachment 1.11). Licence‑holders must ensure antenna patterns and phasing meet those sectorised values precisely. Small deviations can change service footprints and interference patterns.

7. Multiple transmitters under one licence number. SL4159 and SL10308 have multiple transmitter entries across towns (SL4159 has entries at 96.1 MHz Ararat TS1137118; 1089 kHz Horsham TS4159001; 92.9 MHz Nhill TS1137100). Licence‑holders must track each TS and its attachment; compliance obligations are transmitter‑site specific as well as licence‑wide.

8. Open narrowcasting coverage radii are small and explicit. Several open narrowcast entries have explicit circle radii (5 km, 10 km, 20 km). Exceeding those radii or effectively serving a larger contiguous area can change the legal character of the service and raise enforcement risk. Model coverage carefully: TS10004792 Ararat is 5 km radius; TS10010638 Horsham is 20 km radius (Attachments 1.17 and 1.20).

9. The plan is dynamic by reference. Clause (4)(a) says schedules and attachments include references to those documents “as amended from time to time.” That means the plan’s operative content may change when attachments or external TS instruments are varied. Users must check the current Federal Register of Legislation entries for the latest text and for any consequential amendments (see Endnote 3).

10. No content or programming rules in the plan. The plan is strictly technical and spatial: it does not set programming obligations, advertising rules, community participation requirements or content quotas that might be relevant to community or commercial licensees. Those obligations - if they exist - will be in the service licences or in the Broadcasting Services Act provisions. Do not conflate the plan’s technical allocations with programme-level regulatory obligations.

In practice, the principal implementation risk stems from three sources: (a) failing to consult the Broadcasting Services (Technical Planning) Guidelines for tolerances; (b) not reconciling the plan’s ABS 1996 boundaries to current geographies; and (c) misreading advisory planning metrics such as the 66 dBuV/m protection level as an automatic statutory remedy rather than as a planning target to be operationalised through licence conditions and regulator coordination. Each of these is documented directly in the plan’s attachments and notes.

Compliance under this plan requires a mix of legal, technical and administrative steps: confirm the applicable licence, conform to the transmitter specification (TS), follow the Broadcasting Services (Technical Planning) Guidelines for site tolerances, and manage interference relationships noted in the attachments.

1. Identify the operative service licence(s) and TS numbers. Start by matching your operation to the plan’s Schedule entries. Commercial operators should confirm whether their activities fall under SL4159 or SL10308 (Schedule One; Attachment 1.1). Community operators should confirm SL1150779 (Schedule Two; Attachment 2.2). For each frequency or transmitter you intend to use, note the transmitter specification number (TSxxxxxxx) recorded in the schedule (for example TS10008172 for 101.3 MHz in Horsham , Attachment 1.13).

2. Implement the transmitter specification precisely. Each attachment records nominal location (AMG coordinates), carrier frequency, emission mode, polarisation, maximum antenna height and maximum ERP or CMF patterns. Compliance requires that the installed antenna, transmitter power and pattern do not exceed those parameters and that sectorised ERP values match the defined output radiation pattern (e.g. TS1137118 sector values in Attachment 1.10; TS4159001 AM sector CMF values in Attachment 1.11). If your planned installation would differ, prepare a formal variation application through the service licence process or the regulator as required.

3. Consult the Broadcasting Services (Technical Planning) Guidelines 2017 for site tolerances. The attachments repeatedly state “Site Tolerance: Refer to Broadcasting Services (Technical Planning) Guidelines 2017.” The Guidelines define allowable coordinate tolerances, antenna height adjustments, and the technical planning procedures for changes. Before migrating or adjusting a site, consult the Guidelines to avoid a breach of the site tolerance rules that are not fully set out in the plan.

4. Respect coverage radii and narrowcasting limits. If operating an open narrowcasting service, make sure your predicted field strength contours align with the plan’s stated coverage radii (e.g. 5 km for TS10004792 Ararat, 10 km for TS6485001 Warracknabeal, 20 km for TS10010638 Horsham). If your equipment or mounting would extend coverage beyond the stated radius, you must seek approval or adjust operations to match the plan.

5. Use the 66 dBuV/m planning metric in interference studies. Several attachments record that transmissions are planned to be protected to a minimum median field strength level of 66 dBuV/m against interference (see Attachments 1.10, 1.12, 1.15, 1.17, 1.18, 1.21). Use that metric when modelling protection contours and when preparing coordination correspondence with other broadcasters. Remember that the plan treats this as an advisory planning parameter; remedying interference will depend on licence terms and regulator decisions.

6. Observe specific operational conditions (e.g. ABC interference duty). If your operation involves services flagged with specific conditions, implement the required measures. The ABC is explicitly required to manage mutual interference between Parliamentary News Network services in Horsham and Bendigo (Attachment 1.3). If you are the ABC or a party whose operations could interact with those services, document coordination steps and retain records demonstrating interference management efforts.

7. Coordinate with site owners and infrastructure operators. The plan names nominal transmitter sites (Broadcast Australia, Telstra Radio Terminals, Ace Radio sites, Grain Silo sites). Ensure you have the requisite site leases, structural approvals and local permits to install antennas and feedlines consistent with the TS parameters. Site owners may impose their own constraints that need reconciling with the TS.

8. Map licence-area definitions for commercial and regulatory purposes. Licence areas are defined by ABS CDs from the 1996 Census (Attachment 1.1, Attachment 2.1). If you are preparing audience estimates, compliance certificates or market definitions, map those ABS CD codes onto current geographies and document the methodology. Regulatory filings that require coverage maps should include the underlying ABS CD reconciliation to avoid disputes about what area the licence covers.

9. Keep track of variations and the current Federal Register versions. Clause (4) makes schedules and attachments subject to amendment; Endnote 3 records a 2017 variation. Confirm you are using the current instrument as published on the Federal Register of Legislation and check for any subsequent amendments to the plan, to the transmitter specification instruments, or to the Broadcasting Services (Technical Planning) Guidelines.

10. Document engineering work and remediation steps. Where interference issues arise, maintain detailed engineering reports that reference the TS number, the plan’s stated protective field strength, contour maps (showing 66 dBuV/m contours where relevant), and any coordination correspondence with neighbouring licence-holders. This evidentiary trail will be important should any regulator inquiry or licence-condition enforcement action arise.

11. Read licence conditions in the corresponding service licence instruments. The plan does not reproduce the service licence conditions that impose licence-holder duties and the regulator’s enforcement options. Before acting rely on the service licence instrument issued under the Broadcasting Services Act that corresponds to the licence number in the plan (SL4159, SL10308, SL1150779). Ensure that any conditions in the service licence are met in addition to the TS parameters in the plan.

12. If proposing change, pursue the appropriate administrative route. If you need to vary a transmitter site, change ERP, alter antenna height, or seek a new frequency assignment, begin by consulting the Broadcasting Services (Technical Planning) Guidelines and the regulator’s procedures for licence variations. The plan’s clause (4)(a) suggests that attachments and TS instruments can change; however, the administrative route is governed by the regulator’s licence variation process and the Broadcasting Services Act.

13. Legal review for contractual and regulatory risk. For commercial transactions (sale of a station, infrastructure sharing agreements, or new network deployments), obtain a legal review that cross-checks the plan’s ABS-based licence area, each relevant TS, advisory protection levels and how these elements interact with the service licence terms.

In practice the compliance pathway is: (i) identify the relevant schedule entry and TS number; (ii) confirm the current text of the TS and any recent variations on the Federal Register; (iii) model predicted coverage contours against the stated ERP/antenna heights and 66 dBuV/m planning metric; (iv) consult the Broadcasting Services (Technical Planning) Guidelines for site tolerances and procedural requirements; (v) coordinate with neighbouring licence-holders and site operators as required by the plan (including Attachment 1.3 obligations); and (vi) ensure alignment with the applicable service licence conditions and the regulator’s administrative procedures.

Careful record‑keeping, engineering verification, and a proactive approach to coordination and amendment tracking will materially reduce compliance risk.
