The document rests on a small set of drafting and planning concepts that determine how it works in practice.

Licence Area Plan as statutory instrument: The plan is a Determination under the Broadcasting Services Act 1992 (subsection 26(1) is named) and is thus an instrument made by the then-Australian Broadcasting Authority (ABA) setting out allocations and technical specifications for broadcasting services in a defined licence area (Determination (1)-(3)). The plan’s legal effect flows from that statutory base; the text itself does not reproduce the Act but identifies the enabling power.

Service categories and pairing to licences: The plan distinguishes service categories , National, Commercial, Community , and lists carrier frequencies for each category in Schedule One. Where a service licence exists, the plan records the service licence number (for example, SL3182 at 90.9 MHz; SL3069 at 89.3 MHz) and associates each licence with a specific transmitter specification number (e.g., TS3182001). Several National services are included but are shown with “N/A” for service licence number (Schedule One), reflecting that national services are listed without individual commercial/community licence identifiers in this instrument.

Transmitter technical specifications: Each transmitter is governed by its Technical Specification (TS) sheet attached to the plan (Attachments 1.2-1.13). Those sheets specify carrier frequency, polarisation, maximum antenna height, nominal site location, site tolerance referral to Technical Planning Guidelines, and detailed output radiation pattern expressed as maximum ERP by precise bearing or sector. For example, Attachment 1.6 (TS3182001) for 90.9 MHz sets a maximum antenna height of 22 m and sectorised maximum ERPs from 1 kW to 25 kW across different bearings.

Licence area defined by ABS collection districts: Rather than a free-form map, the geographical extent of GOLD COAST RA1 is expressed in Attachment 1.1 by a list of place names and Australian Bureau of Statistics (ABS) collection district identifiers (CDs), some of which are in Queensland and some in New South Wales (Attachment 1.1). Using ABS CDs provides a precise, census-based footprint for regulatory purposes but implicitly ties the LAP to an external statistical geography that can be updated by the ABS independently of the LAP.

Amendment and variant logic: The plan expressly contemplates amendment; clause (3) states that references to schedules and attachments include amended versions. The tables at the end record variations (February 2003 and Variation No.1 of 2005), and the table of amendments indicates which attachments or Schedule One entries were added, amended, or repealed by those variations (Notes). The compilation header records ACMA’s preparation date and the range of amendments included.

Risk and advisory framing: The Disclaimer is a core conceptual element. It frames frequency availability as dependent on theoretical interference predictions, warns of uncertainty because of topography and other data limits, advises prospective applicants and existing broadcasters to take independent technical advice, and disclaims liability by the Minister, ABA, Commonwealth and officers for interference outcomes (Disclaimer). The plan therefore positions itself as authoritative on allocations but limited in warranty and reliant on technical compliance and external advice.

Operational constraints and sectorised ERP: The division of ERP by bearing or sector is a key operational constraint. Maximum ERP is not a single limit but varies by azimuthal sector for a given transmitter. This permits shaping of coverage and interference management but requires licensees to adhere to directional ERPs in practice (see attachments, e.g., Attachments 1.6-1.13).

Reference to external technical guidance: The attachments repeatedly refer to “Site Tolerance: Refer to Technical Planning Guidelines”, signalling that compliance with the LAP’s TS sheets is to be read alongside separate technical planning guidance administered by the regulator. That cross-reference imports administrative standards and discretion located outside the plan text itself (Attachments).

The instrument affects several defined groups directly and other parties indirectly.

Licensees named in Schedule One: The most direct and immediate effect is on entities holding the service licences noted in Schedule One. Commercial licence holders recorded include SL3182 (90.9 MHz), SL4173 (92.5 MHz), SL1150463 (102.9 MHz); community licence holders include SL3069 (89.3 MHz), SL1150707 (94.1 MHz), SL1150709 (105.7 MHz), SL1150708 (107.3 MHz). Those licence-holders are bound to operate within the technical specifications associated with their TS numbers (Schedule One; Attachments). The technical specification numbers tie licence conditions to specific engineering constraints.

National broadcasters and government spectrum users: The plan lists five national services (88.5, 90.1, 91.7, 97.7, 95.7 MHz) with “N/A” for service licence numbers (Schedule One). These entries affect national broadcasting operations by designating spectrum for national services within the same geographic footprint, and they allocate specific TS numbers and transmitter parameters for those national services (Attachments 1.2-1.5 and 1.13).

Prospective applicants and aspirant broadcasters: The Disclaimer addresses prospective applicants directly, instructing them to obtain independent technical or specialist advice concerning applications and operation of broadcasting equipment (Disclaimer). Prospective entrants therefore must factor the plan’s allocations, technical constraints and the acknowledged interference uncertainties into business, engineering and licensing strategies.

Existing broadcasters and third parties: Existing broadcasters are called out explicitly in the Disclaimer, which tells them to take all reasonable steps to be satisfied that their frequency will operate at prescribed levels before changing technical operating conditions. That imposes a compliance and due-diligence duty on incumbent operators contemplating operational changes.

Regulator and technical planners: The ABA (and its successor, ACMA, which prepared the compilation) are decision-makers for making and amending the plan (Determination (1); compilation note). The plan’s reference to the Technical Planning Guidelines indicates that technical planners within the regulator, and external technical consultants, will be involved in assessing site tolerances, interference predictions and any changes to technical parameters.

Service area residents and consumers: The licence area defined by ABS CDs and place names (Attachment 1.1) means residents and businesses within those CDs are affected by which services are available and by the predicted coverage patterns the ERP sectors generate. Where the plan authorises higher ERP in particular bearings, consumers and advertisers in those bearings can expect stronger signal coverage; conversely, lower ERP sectors may produce weaker reception.

Co-ordination counterparties: Given cross-border (QLD/NSW) ABS collection districts are included, state and local planning authorities and cross-jurisdictional parties (e.g., tower site owners, landholders at Mount Tamborine or Lower Beechmont) are affected through planning, access, and co-location arrangements implicit in the nominal transmitter locations recorded in the attachments.

Technical advisors and engineers: The plan’s technical detail , sector-specific ERP, antenna heights, polarisation, nominal locations and site tolerances , directly imposes tasks on broadcast engineers and consultants who must ensure installations and operations meet the TS parameters and respond to the plan’s disclaimers and Technical Planning Guidelines.

Indirectly affected parties include other spectrum users whose interference environment may change because the LAP frames allocations and ERP limits; however, interference risk is expressly acknowledged and not warrantied by the plan (Disclaimer).

The plan sets out obligations in the form of technical constraints and administrative references, and it implicitly confers rights to use frequencies subject to those constraints.

Obligations to operate within technical specifications: The clearest duties for licence-holders are to operate consistent with the transmitter Technical Specifications identified for their service licence number (Schedule One; Attachments 1.2-1.13). Those specifications define maximum antenna heights, polarisation, carrier frequency, and for each azimuthal sector a maximum Effective Radiated Power (ERP). For example, SL3182 at 90.9 MHz must observe the ERP limits by sector in TS3182001 (Attachment 1.6). Operating beyond those specified maxima would place a licence-holder in breach of the technical constraints embodied in the LAP.

Duty to account for amendments: Clause (3) of the Determination states a reference to a schedule or attachment includes a reference to a schedule or attachment as amended from time to time. This creates a continuing duty on licensees to monitor for and comply with amendments and variations because the applicable TS may be changed by later instrument (Determination (3); Notes/Table of Instruments).

Due diligence and advisory duty (practical, not a statutory sanction): The Disclaimer instructs both prospective applicants and existing broadcasters to obtain independent technical advice and to take reasonable steps to be satisfied that frequencies will operate at prescribed levels before making changes or competing for spectrum availability. While phrased as advice, it functions as regulatory guidance that courts or the regulator could refer to when assessing whether a licensee took reasonable precautions (Disclaimer).

Rights to operate within the licence area and frequencies allocated: The plan confers the practical right to operate the listed services in the Gold Coast RA1 on the indicated frequencies and under the associated TS parameters; that right takes the form of a binding allocation under the Broadcasting Services Act power exercised by the ABA (Determination (1)-(2); Schedule One). For entities holding the listed service licences, the LAP read with the licence confers the entitlements to use the frequency subject to technical limits.

Reference to external guidelines and tolerances: The attachments repeatedly reference “Site Tolerance: Refer to Technical Planning Guidelines”. This allocates to the regulator an administrative role to set tolerances and to judge whether specific operations fit within permitted site tolerances. Licence-holders therefore have a duty to observe both the LAP TS entries and the Technical Planning Guidelines cross-referenced (Attachments).

No warranty and limited liability claim: The Disclaimer removes a warranty and disclaims liability by the Minister, ABA, Commonwealth and officers for interference, which has an operational consequence: licensees bear the practical risk and the cost of any interference mitigation, and cannot rely on statutory indemnity in the instrument itself (Disclaimer). The plan therefore shifts the practical costs of interference to operators and prospective applicants.

Obligation to respect sectorised ERP: The sector-specific ERP limits create a compliance duty finer than a single power cap. A licence-holder must meet these directional limits in practice, which may require directional antennas, careful antenna pattern verification, and monitoring to ensure azimuthal ERP does not exceed specified maxima for any bearing sector (Attachments).

Duty to respect geographic licence area: The plan defines the licence area by ABS CDs and place names (Attachment 1.1). Licensees must observe that the service is to be available to the area defined; this affects planning of studio-to-transmitter links, promotional and advertising reach claims, and obligations under licence conditions tied to service area.

What the plan does not itself prescribe: The LAP does not include statutory penalties or administrative enforcement steps within its text. It does not specify licence conditions beyond technical limits; enforcement mechanisms and broader licence conditions derive from the Broadcasting Services Act regime and the individual service licences (the plan references the enabling Act but does not include enforcement provisions itself).

The Licence Area Plan document itself sets technical allocations and guidance but does not articulate specific penalties or an enforcement regime within its text. The plan is a Determination under the Broadcasting Services Act 1992 (Determination (1)); enforcement, compliance monitoring, and civil or administrative penalties are matters that are handled under the broader broadcasting legislative and licensing framework rather than the plan text. The instrument therefore performs an allocative and technical specification role without embedding detailed sanction rules.

What the plan records and what it omits:

• The plan records the technical limits and attaches TS numbers to service licences and frequencies (Schedule One; Attachments 1.2-1.13). Those TSs operate as binding technical prescriptions for the licensed services.
• The plan expressly disclaims liability for interference and warns of theoretical prediction limits, but it does not say what specific remedial steps or fines the regulator will impose for a breach of a TS (Disclaimer).
• Clause (3) says references to schedules and attachments include amended versions; it does not state a penalty for failing to comply with an amended attachment (Determination (3)).

Practical enforcement mechanisms, as implied by the document structure:

• Compliance monitoring and enforcement would be exercised by the regulator with authority under the Broadcasting Services Act and licensing instruments (the Determination cites the Act as the power source). The plan leaves enforcement mechanics to that broader legal framework rather than articulating them within the LAP.
• Technical Planning Guidelines are referenced for site tolerance. Those guidelines typically contain criteria and administrative processes that the regulator uses to determine compliance and to approve deviations; the attachments’ repeated cross-reference therefore imports an enforcement layer administered through the Technical Planning Guidelines (Attachments). The document itself does not reproduce those guidelines or enforcement steps.

Consequences for operators and applicants:

• Because the Disclaimer disclaims liability and warns operators to obtain independent technical advice, a licensee who operates outside the TS constraints or who fails to verify that their operation will meet prescribed levels risks regulator action under the Broadcasting Services Act regime or licence conditions (practical risk indicated by the Disclaimer and the Act reference).
• The sectorised ERP limits and antenna-height maxima in the TSs are operational constraints that are commonly enforced by technical audits, interference complaints processes, and, if necessary, notices or directions from the regulator. None of those enforcement steps are specified in the text of the LAP itself; therefore parties must look to the Broadcasting Services Act, licence conditions, and Technical Planning Guidelines for procedural and sanctioning rules.

Absence of litigation or sanction details in the instrument: The instrument’s Notes and Tables list the making and amendment dates and the attachments changed by variations, but they do not record any enforcement actions, penalties imposed, or compliance notices. The compilation also does not include a litigation history or enforcement register. Users should therefore rely on the Act and regulator’s published enforcement policies for specifics about sanctions.

In short, the LAP imposes binding technical duties but does not itself set out penalties; enforcement is administered via the broader statutory and administrative framework referenced by the plan, and parties should consult the Broadcasting Services Act and the Technical Planning Guidelines for the applicable enforcement tools and processes.

The plan is an instrument made under and operating within the structure of the Broadcasting Services Act 1992. It expressly cites that Act as the enabling statute for the Determination (Determination (1)). Beyond that, the plan cross-references and relies upon external technical and administrative instruments which interact with the plan in practice.

Primary statutory relationship:

• Enabling statute: The plan is made under subsection 26(1) of the Broadcasting Services Act 1992 (Determination (1)). That places the plan within the statutory licensing and regulatory framework of the Act. The plan’s allocations and specifications therefore have legal effect insofar as they derive from and are exercised under the powers conferred by that Act.

Cross-reference to Technical Planning Guidelines:

• Each Technical Specification sheet includes “Site Tolerance: Refer to Technical Planning Guidelines”. That cross-reference imports a layer of external technical rules and potentially discretionary administrative standards into the interpretive fabric of the plan (Attachments 1.2-1.13). Those Guidelines are not reproduced in the LAP; to understand permissible site tolerances and technical assessment criteria, one must consult the external Technical Planning Guidelines administered by the regulator.

Relationship with service licences:

• The plan ties frequencies to service licence numbers (e.g., SL3182, SL3069, SL1150463). Those service licences individually carry conditions and legal obligations under the Broadcasting Services Act regime. The LAP therefore interacts with licence instruments: it defines the technical envelope within which licence conditions operate. Compliance and enforcement actions for licence breaches will be governed by the Act and the licence instruments rather than the LAP text alone.

Administrative evolution and amendments:

• The plan records that it was amended by a February 2003 variation and Variation No. 1 of 2005 (Notes/Table of Instruments). These variations alter attachments and Schedule One entries, as recorded in the Table of Amendments. The LAP therefore interacts procedurally with the statutory amendment processes under the Broadcasting Services Act, and any subsequent changes are the product of statutory amendment procedures rather than unilateral operator action.

Geographic interplay with state boundaries:

• The licence area uses ABS collection districts and place names, and the list includes collection districts in both Queensland and New South Wales (Attachment 1.1 includes “NSW CD …” entries). That geography means the LAP’s footprint crosses state boundaries; while broadcasting is regulated at the national (Commonwealth) level under the Broadcasting Services Act, the practical operation of transmitter sites, planning approvals and land-use matters may involve state and local regulation (planning, environmental approvals) of tower sites. The LAP itself does not address state or local planning approvals but the inclusion of New South Wales CDs indicates cross-jurisdictional coverage.

No standalone statutory penalties in the LAP:

• As noted earlier, the plan does not embed its own penalty or enforcement regime; the enforcement interaction is therefore with the broader legal framework (the Broadcasting Services Act, individual service licences, and administrative guidelines). Parties must reconcile obligations across those instruments.

Liability and administrative immunities:

• The Disclaimer disclaims liability by the Minister for Communications, Information Technology and the Arts, the ABA, the Commonwealth of Australia, or its officers, servants or agents for interference outcomes. That statement interacts with common-law and statutory liability frameworks by asserting a governmental policy position on liability for interference in the context of allocating frequencies. It does not, on its face, alter statutory liability rules but signals the regulator’s position about warranty and indemnity.

In sum, the LAP is a statutory allocation instrument that must be read and implemented in conjunction with the Broadcasting Services Act, licence instruments for the named service licence numbers, the Technical Planning Guidelines the LAP references for site tolerances, and any applicable state and local planning laws that affect transmitter site works.

The instrument includes a documented amendment record and a chronological table of instruments showing initial making and later variations. The compilation header states it was prepared by the Australian Communications and Media Authority on 18 July 2013, taking into account amendments up to Licence Area Plan - Gold Coast Radio - Variation No. 1 of 2005.

Key dates and recorded variations (as set out in the Table of Instruments and Notes):

• Original Determination: The Licence Area Plan - Gold Coast Radio - December 2000 was determined by the Australian Broadcasting Authority on 21 December 2000 (Determination). The Table of Instruments records the date of notification in Gazette or registration as 10 January 2001 (see F2005B00758) and the date of commencement as 10 January 2001.
• Variation - February 2003: A Licence Area Plan - Gold Coast Radio - Variation - February 2003 appears in the Table of Instruments, with date of notification 12 March 2003 (see F2005B00759) and date of commencement 12 March 2003. The Table of Amendments at the end indicates that several attachments were repealed and added or otherwise amended by the February 2003 variation (Notes).
• Variation No. 1 of 2005: The Table of Instruments records Licence Area Plan - Gold Coast Radio - Variation No. 1 of 2005 with date of notification 19 April 2005 (see F2005L00885) and date of commencement recorded as 14 April 2005 in the table. The Table of Amendments lists specific provisions and attachments affected: Clause (1) and Clause (2) were amended by var. No.1 of 2005; Clause (3) was added by var. No.1 of 2005. The Schedule 1 and various Attachments were amended, added or repealed by the February 2003 variation and by Variation No.1 of 2005; the Table of Amendments gives a line-by-line map of which attachments were rep., ad., or am.
• The Notes show particular attachments were repealed in the Feb 2003 variation and replacements or additions were made in the 2003 and 2005 variations (Notes to Licence Area Plan - Table of Amendments entries such as “Attachment 1.8 rep. var. Feb 2003; ad. var. No.1 of 2005”, “Attachment 1.8.1 ad. var. Feb 2003”, etc.).

Operational effect of amendments:

• The table of amendments shows that technical specifications have been the subject of change over time , some attachments were repealed and replaced, and some were added. That means the specific transmitter parameters applicable to a licence-holder at any point depend on the current version of the attachment as amended. Clause (3) reaffirms that references to schedules and attachments include amended versions, making it central to compliance that operators consult the current instrument history (Determination (3); Notes/Table of Amendments).

Compilation statement:

• The compilation itself is dated 18 July 2013 and states it takes into account amendments up to Variation No.1 of 2005. It therefore incorporates amendments recorded to that date; any amendments after Variation No.1 of 2005 would not be reflected in this compilation and must be checked by users against the regulator’s current registers.

Administrative references and document trail:

• The tables list Federal Register of Legislation identifiers (e.g., F2005B00758, F2005B00759, F2005L00885) for the original and variant instruments; these references provide a concrete trail to the formal notices and gazette entries by which the plan and its variations were published.

In short, the LAP has an amendment history recorded in the instrument; licensees and advisers must use the clause that references amended schedules (Determination (3)) together with the table of amendments to identify which attachment text applies at any time. The compilation’s cut-off (Variation No.1 of 2005) is recorded, so users must confirm whether further amendments post-2005 exist when advising clients.

The Licence Area Plan compilation itself contains no record of litigation or judicial decisions. The instrument records its making, notification, and amendment history, but it does not include or cite any cases, tribunal decisions, or enforcement proceedings. The text provides no account of disputes, appeals, or court judgments concerning the plan or any of the service licences listed.

Implications for users:

• Because the LAP and its compilation do not record litigation, practitioners must not assume an absence of disputes; they must check court, tribunal and ACMA records separately if litigation or administrative review is relevant to a matter. The LAP compilation’s scope is technical and administrative; litigation records are outside its content.
• The plan’s Notes and Table of Instruments provide Federal Register of Legislation references for the original and variant instruments (e.g., F2005B00758; F2005B00759; F2005L00885). Those identifiers are the proper starting points for tracing the legislative instrument history and for checking whether any legal challenges or judicial commentary exist in associated public records. The LAP itself does not assert or summarise litigation.

Practical consequence: For legal or due diligence work that requires knowledge of dispute history, consequences for licence enforcement, or precedent about interpretation of such LAPs, practitioners must consult external sources: ACMA regulatory decisions, administrative tribunal files, Federal Court or High Court judgments, or other public registers. None of those materials are contained in this instrument.

This LAP contains several features and drafting choices that can create practical pitfalls for licence-holders, prospective applicants and advisers. The following “gotchas” are drawn directly from the instrument’s terms and structure.

Sectorised ERP complexity: Many of the attachments specify maximum ERP on a sector-by-sector basis rather than a single overall power limit (for example, Attachment 1.6 TS3182001 for 90.9 MHz specifies ERPs ranging from 1 kW to 25 kW across different bearings). Compliance therefore requires precise antenna radiation pattern design, verification and ongoing monitoring. A licence-holder who treats the TS as a single maximum ERP risks exceeding sector maxima even if an overall average appears compliant.

Multiple technical specifications for the same carrier frequency: The plan shows instances where a single carrier frequency has more than one technical specification attachment or where attachments with similar frequencies were amended or replaced (see Attachments 1.8 and 1.8.1; Attachments 1.10 and 1.10.1; Attachments 1.11 and 1.11.1; Attachments 1.12 and 1.12.1). Advisers must confirm which attachment version is operative for a given licence at the relevant date. Clause (3) indicates amended attachments supersede prior ones (Determination (3)), and the Table of Amendments shows which were repealed or added.

Cross-jurisdictional licence area: Attachment 1.1 lists ABS collection districts that include New South Wales CDs as well as Queensland ones (multiple “NSW CD …” entries). Practitioners must not assume the licence area is strictly within Queensland; transmitter siting, planning approvals, and service delivery may involve cross-border issues, and marketing/advertising claims about coverage should account for the officially defined area.

Reliance on theoretical interference predictions and limited warranty: The Disclaimer makes plain that frequency availability is “to a large extent, based on theoretical interference predictions” and that the ABA “cannot warrant” that licensed use will be free from interference (Disclaimer). Operators who assume interference-free operation are mistaken; the instrument puts the onus on operators to obtain independent technical advice and to accept residual interference risk.

No penalty text in the instrument: The LAP does not set out enforcement mechanisms or penalty regimes. Practitioners must look to the Broadcasting Services Act, licence instruments and Technical Planning Guidelines for enforcement mechanics. Failing to do so risks misunderstanding practical consequences of non‑compliance.

Site Tolerance is external: Every TS entry refers to “Site Tolerance: Refer to Technical Planning Guidelines”. This means part of the operational legality of a site depends on interpretation of external guidelines. Operators changing sites or technical parameters must make submissions to or seek rulings from the regulator on tolerances rather than assuming a fixed tolerance within the LAP itself.

Multiple nominal transmitter sites and differing antenna heights: The plan lists nominal locations at Lower Beechmont, Mount Tamborine and the NTL Broadcast Site with differing maximum antenna heights (e.g., 32 m vs 63 m vs 22 m). A change in transmitter installation, antenna height or polarisation may have knock-on interference impacts and may require regulatory approval; operators should not unilaterally alter these parameters.

Attachments amended or repealed across variations: The Table of Amendments identifies multiple attachments as repealed and re-added across 2003 and 2005 variations. Advisers must check which specific attachments were repealed or substituted for legal and engineering compliance. For example, Attachment 1.8 was repealed in Feb 2003 and added back in No.1 of 2005 , the applicable technical specifications could thus differ materially depending on which version applies.

Compilation cut-off risk: The compilation records it takes into account amendments up to Variation No.1 of 2005 and is dated 18 July 2013. Users must verify whether later amendments or replacements exist after Variation No.1 of 2005. Relying on this compilation alone without checking the regulator’s current instrument register risks missing later changes.

Liability disclaimer practical effect: The explicit disclaimer of liability by the Minister, ABA and Commonwealth suggests that in the event of interference or coverage shortfalls, the instrument itself will not provide a statutory indemnity. Parties should plan commercially for mitigation costs rather than expecting indemnity from government.

Taken together, these “gotchas” make it essential that technical, legal and commercial advisers read the relevant attachment(s) carefully, confirm which attachment version is current for the particular licence, and consult the Technical Planning Guidelines and regulator for ambiguities before making engineering or commercial commitments.

Compliance with the LAP is a combination of (i) observing the technical parameters set out in the attachments and Schedule One, (ii) monitoring amendments and the current operative attachments, and (iii) following the practical steps indicated in the Disclaimer and the cross-referenced Technical Planning Guidelines. Below is a practical compliance checklist grounded in the instrument’s text.

1. Confirm which attachment is operative for your licence:

   • Use Schedule One to identify your service licence number and the associated TS number (e.g., SL3182 → TS3182001) (Schedule One).
   • Check the plan’s Table of Amendments and the regulator’s instrument register to confirm whether the attachment has been amended, repealed or replaced (Notes/Table of Instruments). Clause (3) makes clear that references include amended versions (Determination (3)).

2. Operate strictly to the Technical Specification (TS) sheet:

   • Use the nominal location, maximum antenna height, polarisation, carrier frequency, and the sector-by-sector maximum ERP figures in the relevant attachment as the binding technical envelope (Attachments 1.2-1.13).
   • Ensure antenna type and orientation produce the required directional pattern so that ERP in each bearing sector does not exceed the stated maxima (Attachments, e.g., TS3182001, TS10013951). This will typically require pattern testing and certified measurements.

3. Consult and comply with Technical Planning Guidelines for site tolerances:

   • Each attachment references “Site Tolerance: Refer to Technical Planning Guidelines” (Attachments). Obtain and study those Guidelines to determine permissible variances from the nominal site coordinates, permissible mechanical tolerances, and any administrative processes for applying for tolerances or changes.
   • Where an installation is close to site tolerance limits, seek regulatory pre-approval rather than risk non-compliance.

4. Obtain independent technical advice and perform due diligence:

   • The Disclaimer explicitly advises prospective applicants and existing broadcasters to obtain independent technical or specialist advice (Disclaimer). Commission propagation studies, interference assessments, and site surveys before making applications or technical changes.
   • For proposed changes to transmitter location, antenna height, or ERP, prepare technical justifications and coordinate with the regulator to obtain any required approvals.

5. Monitor and manage interference risk:

   • Treat frequency availability as based on theoretical interference predictions and assume residual interference risk exists (Disclaimer). Implement monitoring and fault-response procedures so that interference complaints can be investigated and mitigated swiftly.
   • Keep records of measurements and rectification steps to demonstrate proactive compliance if a regulator inquiry arises.

6. Track amendment history and regulatory notifications:

   • Because clause (3) pulls in amended schedules and attachments, set up a regulatory watch to capture variations published in the Federal Register of Legislation and in the regulator’s gazette entries (Notes/Table of Instruments).
   • Before making any operational or commercial commitments that rely on coverage or frequency availability, confirm the current operative version of the LAP and any relevant TS.

7. Coordinate land-use, planning and tower access:

   • Nominal transmitter locations (e.g., Mount Tamborine, Lower Beechmont, NTL Broadcast Site) implicate state and local planning regimes for site works. Obtain necessary local approvals and co‑location agreements and ensure any physical changes conform to planning approvals and the LAP’s TS parameters.

8. Communicate coverage claims carefully:

   • Use the ABS-defined licence area (Attachment 1.1) as the authoritative basis for marketing or commercial claims about service reach. Because coverage in practice depends on ERP sectorisation and topography, avoid definitive statements not supported by measured coverage maps grounded in the TS parameters.

9. Seek regulatory clarification for ambiguous cases:

   • Where the TS or the Technical Planning Guidelines leave uncertainty (for example, overlapping sector edges or where two TS entries for the same frequency were amended), request written clarifications from the regulator. The LAP does not itself resolve interpretive questions beyond recording TS numbers and noting site tolerances.

10. Budget for interference and compliance costs:

• Because the plan disclaims governmental warranty and liability for interference (Disclaimer), include contingency for mitigation and technical remediation costs in the business case for any new or altered service.

In short, compliance is a technical exercise anchored by the TS attachment for the licence, a procedural exercise of monitoring and responding to amendments, and a commercial exercise of allocating risk management resources for interference and regulatory engagement. The instrument’s cross‑references to the Broadcasting Services Act and to the Technical Planning Guidelines mean that full compliance requires consulting those external instruments and liaising with the regulator where necessary.
