Licence Area Plan - Esperance (Radio) - September 1996

The Determination rests on a small set of recurring concepts and structural mechanisms. Each concept is expressed in the document and determines a concrete legal or technical effect.

Licence categories and availability

• The plan distinguishes categories of service: Commercial, National, Open Narrowcasting and Community. Schedule One lists commercial, national and open narrowcasting services to be available in the licence area; Schedule Two lists a community service (Schedule One; Schedule Two).
• Availability is a declared outcome: the ABA "makes this plan ... Eight national ... two commercial ... four open narrowcasting ... One community" (opening paragraph). That is, the Determination specifies which categories of broadcasting are to be available in the geographic area.

Service licences and statutory requirement

• The Schedules include a note that the Service Licence Number column will be N/A where the Broadcasting Services Act 1992 does not require service licences for that category (Schedules description: "N/A = not applicable, as the Broadcasting Services Act 1992 only requires service licences for commercial and community services"). Concretely, the Determination shows service licence numbers for commercial and community services and records "Not applicable" for national and open narrowcasting services.

Transmitter specifications and attachments

• The plan breaks down each service into individual transmitters. For each transmitter the Schedule records a transmitter specification number (TS numbers) and an attachment where detailed technical specifications are provided (Schedule One columns; see Attachments for the details).
• Attachments contain technical parameters: emission mode and band (e.g. MF‑AM, VHF‑FM), carrier frequency (e.g. AM 747 kHz in Attachment 1.2; FM 102.3 MHz in Attachment 1.3), polarisation (where applicable, generally "Mixed"), maximum antenna height (e.g. 82 m at Wireless Hill in several attachments), and maximum effective radiated power (ERP) at all azimuths (various watt or kW values).

Geographic delimitation and population

• Licence areas are defined in terms of Australian Bureau of Statistics areas as at the 1991 Census; Attachments 1.1 and 2.1 list ABS area codes or named shires/localities together with population numbers and a total persons figure (Attachment 1.1 Total Persons 15379; Attachment 2.1 Total Persons 7541).

Technical planning interface

• Multiple attachments instruct "Site Tolerance: Refer to Technical Planning Guidelines". Those cross-references indicate that certain matters of siting and tolerance are governed by external technical planning documents rather than exhaustively in the Determination itself.

AM-specific parameters

• For the AM transmitter (Attachment 1.2: MF‑AM at 747 kHz), the plan specifies an output radiation pattern by bearing/sector with maximum CMF values and provides special conditions (e.g. "CMF on 128°T, 254°T and 326°T to be in the range 150V to 200V"; and "Directions of minimum CMF to be within plus or minus 2° of 128°T, 200°T, 254°T and 326°T").

Co‑location and site reuse

• Several services (national, commercial, community and open narrowcasting) specify the same nominal transmitter site, notably "R/T Site Wireless Hill ESPERANCE" with AMG coordinates 51 397600 6251000 and antenna height 82 m, used for multiple FM services (Attachments 1.3, 1.15, 1.16, 1.21 and 2.2). That indicates the plan anticipates multiple services sharing collocated infrastructure subject to the specified frequencies and ERP limits.

Allocation timing

• The community licence is to be made available for allocation immediately after the Gazette notice confirming the plan, a timing rule that controls when applications/allocation processes may begin (opening paragraph: "The community radio broadcasting service referred to in Schedule Two is to be available for allocation immediately after publication of the notice in the Commonwealth of Australia Gazette...").

Document as technical and administrative instrument

• The Determination operates largely as a technical and administrative instrument rather than a code of conduct or penalty schedule. It prescribes what is to be available and the technical limits for transmitters; it does not set out licensing procedures, fees, sanctions or enforcement mechanisms within its text.

All of the above concepts are explicitly present in the text of the Determination, Schedules and Attachments.

The Determination specifies concrete effects on defined groups. The key affected parties and how they are affected are shown directly in the instrument.

Licensed broadcasters (commercial and community)

• Commercial broadcasters: two commercial radio broadcasting services are identified (Schedule One: entries with Service Licence Numbers SL010335 and SL010320). These service licences exist under the Broadcasting Services Act 1992 as required, and the Determination prescribes exact transmitter specifications to which those commercial services must conform (Attachments 1.2-1.12 give frequencies, carrier modes, ERP and antenna height parameters). The schedule therefore constrains the technical operation and geographic reach of those commercial service licences.
• Community broadcaster: a single community radio broadcasting service is set out in Schedule Two with Service Licence Number SL010328 and TS004991 (Attachment 2.2). The Determination further states that the community service is to be available for allocation immediately after gazettal (opening paragraph). That affects prospective community applicants because it sets when allocation may commence.

National broadcasting entities

• National services are listed without service licence numbers (Schedule One entries marked N/A), with transmitter specification numbers and attachments (e.g. Attachments 1.14-1.20 and others). These entries indicate which national services (for example, ABC/ SBS-style network services, though the Determination does not name agencies) are to be available in the area and the technical parameters for their transmitters.

Open narrowcasters and narrowcasting operators

• Four open narrowcasting radio services are included in Schedule One (N/A service licence numbers). Attachments 1.21-1.24 provide frequencies, antenna heights and maximum ERP values, which determine the technical envelope within which open narrowcasting operators must operate.

Transmitter site owners, tower operators and technical planners

• Each attachment gives precise AMG coordinates, site names and maximum antenna heights (e.g. Wireless Hill AMG zone 51 Easting 397600 Northing 6251000; max antenna height 82 m in several attachments). Entities that own or manage the physical sites, or that construct and maintain transmitters, are affected because the Determination fixes allowable equipment and siting tolerances (and refers to technical planning guidelines for site tolerance).

Regulators and allocation administrators

• The ABA (making the plan) and any successor regulatory bodies are affected as they must administer allocations and ensure compliance with the plan. The Determination instructs allocation of the community service "immediately after publication of the notice in the Commonwealth of Australia Gazette", directing timing for allocation administrators.

Local communities and listeners within ABS areas

• The plan defines licence areas in ABS terms and population counts (Attachment 1.1 lists population totals for Esperance (S) and Ravensthorpe (S) and various CD units, totaling 15,379; Attachment 2.1 totals 7,541 for the community licence area). Those residents are parties whose geographic access to specific categories of service is being legislatively guaranteed.

Technical planning document authors

• The repeated instruction "Site Tolerance: Refer to Technical Planning Guidelines" means those drafting or interpreting technical planning guidelines will be relied upon to set tolerances and apply them in conjunction with the Determination.

Entities not required to hold a service licence

• The Schedule notes that national and open narrowcasting services are recorded with service licence numbers N/A "as the Broadcasting Services Act 1992 only requires service licences for commercial and community services". The Determination therefore affects operators differently depending on their category: commercial and community services are subject to service licensing requirements under the Act; national and open narrowcasting services are not so recorded in the plan.

All references in this section are taken from the Determination, Schedules and Attachments, including the opening paragraph and the explanatory note beneath the Schedules.

The Determination sets out specific duties (technical and administrative) and confers availability rights as to which services must or may be offered in the licence area. The instrument itself is prescriptive on several concrete points.

Duty to make services available

• The ABA declares the availability of specified services for the Esperance region: eight national, two commercial and four open narrowcasting services, plus one community service (opening paragraph; Schedule One; Schedule Two). This creates a planning duty for the regulator to ensure technical capacity and allocations conform to the plan.

Duty to conform to transmitter technical specifications

• For each transmitter the Determination prescribes technical parameters in attachments: emission type (MF‑AM or VHF‑FM), carrier frequency (e.g. 747 kHz AM, 102.3 MHz FM), polarisation, maximum antenna height, maximum ERP, and for AM the CMF patterns and special conditions (Attachments 1.2-1.24 and 2.2). Operators of the listed services must therefore deploy transmitters consistent with those technical specifications. The document repeatedly instructs "Site Tolerance : Refer to Technical Planning Guidelines", signalling a duty to interpret site tolerance in accordance with the external guidelines.

Duty to allocate the community service at a specified time

• The community radio broadcasting service in Schedule Two is "to be available for allocation immediately after publication of the notice in the Commonwealth of Australia Gazette stating that the Esperance radio licence area plan has been made" (opening paragraph). Administrators must therefore open allocation processes once the gazette notice is published; prospective community licence applicants have the right to apply post-gazettal.

Right to operate within the prescribed technical envelope

• Entities assigned in the plan (commercial, national, open narrowcasting and the community service once allocated) have the right to operate within the frequencies, ERP and antenna-height limits specified. For example, Attachment 1.3 entitles the commercial FM service SL10320 to broadcast on 102.3 MHz with maximum ERP 5 kW and maximum antenna height 82 m at the Wireless Hill site. That is a defined operational entitlement so long as the operator complies with the other regulatory requirements applicable under the Act.

Duty to respect AM directional minima and CMF ranges

• The AM service in Attachment 1.2 lists a detailed output radiation pattern with maximum CMF values by bearing and special conditions: CMF on 128°T, 254°T and 326°T to be in range 150V to 200V, directions of minimum CMF to be within ±2° of specified bearings (Attachment 1.2 Notes and Special Conditions). Any AM operator or planner must ensure the station's radiation pattern meets those constraints.

Duty to use specified transmitter sites or to adhere to their AMG coordinates

• Each attachment provides a nominal site location and AMG coordinates (e.g. Shark Lake, Wireless Hill, Condingup Peak), which imposes a duty on operators to use the listed sites or to observe the coordinates as the reference for siting and coverage calculation. The site tolerances are to be determined with reference to Technical Planning Guidelines.

Duty differences by service category

• The Schedule explicitly notes that service licences are only required for commercial and community services under the Act (Schedules explanatory paragraph). This imposes different administrative duties across categories: commercial and community services must hold service licences, while national and open narrowcasting services are recorded as N/A for service licence numbers, reflecting the statutory scheme referenced by the Determination.

Rights implied by availability declarations

• The plan's statement that services "are to be available" implies rights of allocation and use of the designated spectrum consistent with the specified transmitter parameters. For example, the community service SL010328 has a promised opportunity to be allocated immediately after gazettal (opening paragraph).

Administrative duty to publish and implement

• The Determination itself was made on 26 September 1996 and instructs publication in the Commonwealth Gazette as a step tied to allocation (opening paragraph). This creates an administrative duty on the Authority to give the public notice and to follow through on allocation timing.

The Determination does not contain explicit provisions on fees, sanctioning, or enforcement; the duties and rights described above are those established directly by the plan and by its cross-reference to the Broadcasting Services Act 1992 as the empowering statute.

The Determination itself does not set out penalties, specific enforcement mechanisms, or infringement schedules. The instrument is a licence area plan and technical specification package; it establishes availability of services, transmitter parameters and allocation timing, but it does not articulate sanctions. The document’s structure and content indicate the following concrete points about penalties and enforcement as can be read from the text:

No penalties within the Determination text

• The Determination contains no provisions imposing monetary penalties, suspension regimes, infringement notices or criminal offences. It does not describe enforcement procedures or outline remedial steps for non‑compliance within its text.

Implicit connection to the Broadcasting Services Act 1992

• The plan is made under subsection 26(1) of the Broadcasting Services Act 1992 (opening paragraph). That statutory reference indicates that matters of compliance, enforcement and sanctions will be governed by the Act and associated regulatory instruments rather than by this Determination. The Determination therefore presupposes that enforcement mechanisms relevant to licence compliance will come from the empowering Act and other regulatory instruments.

Regulatory implementation and administrative responsibilities

• The Determination mandates availability and technical requirements and thus creates compliance obligations (see "Key duties and rights"). Enforcement of those technical and licensing obligations would, logically and legally, fall to the ABA or successor regulator under the statutory scheme. The Determination itself, however, does not specify the methods by which the ABA would monitor compliance, issue directions, or apply sanctions for breach of the plan.

No enforcement detail for technical planning guidelines

• Multiple attachments state "Site Tolerance: Refer to Technical Planning Guidelines". The Determination therefore implies that additional, externally authored technical planning instruments contain operational detail, and possibly enforcement or certification procedures. Those Guidelines are not appended to the Determination, and no enforcement detail is supplied in the Determination text about how site tolerances will be policed.

Allocation timing without enforcement terms

• The Determination requires that the community service be available for allocation immediately after Gazette publication. It does not specify allocation procedures, application evaluation criteria, or remedies if allocation processes are delayed or contested. Those procedural enforcement and remedial matters would be handled outside the Determination, under the Act and under the ABA’s procedural rules.

Summary

• Concretely, the Determination prescribes what must be available and what technical parameters apply but does not itself provide a schedule of penalties or a detailed enforcement regime. For any legal or regulatory sanctions, the relevant provisions will be those in the Broadcasting Services Act 1992 and the ABA's operational rules, which the Determination invokes as its statutory basis but does not reproduce in text. All statements here are drawn from the Determination’s text, which contains no penalty or enforcement clauses.

The Determination is an instrument made under statute and therefore must be read in the statutory and regulatory context the document itself references. The plan’s text and notes indicate specific legal cross‑references and functional interactions.

Empowering statute: Broadcasting Services Act 1992

• The Determination is made "under subsection 26(1) of the Broadcasting Services Act 1992" (opening paragraph). That establishes the Determination’s legal source. As a statutory instrument, the plan’s effect and enforceability are dependent upon the powers and enforcement mechanisms provided by the Act, even though those mechanisms are not reproduced in the Determination.

Service licence requirement distinctions set by the Act

• The Schedules include an explanatory note: "N/A = not applicable, as the Broadcasting Services Act 1992 only requires service licences for commercial and community services." This shows that the Determination interacts with the Act’s classification of services and its regime for when service licences are required. Concretely, commercial and community services listed in the plan have service licence numbers; national and open narrowcasting services are marked "Not applicable."

Technical Planning Guidelines as subsidiary instruments

• Several attachments instruct "Site Tolerance : Refer to Technical Planning Guidelines". Those Guidelines are external to the Determination and likely operate as subsidiary technical materials that interpret or operationalise aspects of the plan. The Determination therefore interacts with regulatory technical guidance documents, delegating specific siting tolerances and planning details to those documents.

Commonwealth Gazette as administrative step

• The Determination requires the community service to be made available for allocation "immediately after publication of the notice in the Commonwealth of Australia Gazette stating that the Esperance radio licence area plan has been made" (opening paragraph). This links the Determination to administrative law processes relating to public notification under Commonwealth practice and possibly to timeframes or rights that arise upon gazettal.

ABS census area definitions as geographic legal reference

• The Determination defines licence areas in terms of Australian Bureau of Statistics (ABS) areas and census counts as at 6 August 1991 (Attachments 1.1 and 2.1). That links the plan to ABS-defined geographic units rather than to ad hoc mapping or municipal boundaries, which affects how legal descriptions of licence areas will be interpreted and contested.

Interaction with spectrum allocation and technical regulation

• By specifying frequencies, ERP, antenna heights, and for AM the CMF pattern and special conditions, the Determination intersects with the body of law and regulation governing spectrum management, radiofrequency interference and technical compliance. While the Determination provides the local plan parameters, the enforcement of spectrum rights and technical compliance will be governed by the Act and any spectrum management instruments that implement the Act.

Allocation and licensing procedures outside the plan

• The plan identifies which services are to be available and when the community licence may be allocated, but it does not include the procedural rules for licence application, assessment, transfer, or revocation. Those procedures are matters for the broader statutory regime (the Broadcasting Services Act 1992) and the ABA’s administrative rules.

No expressed interaction with other Commonwealth or state statutes within the Determination

• The Determination does not itself reference other Commonwealth or Western Australian statutes (for example planning, environmental, or heritage law) nor does it embed external permitting requirements into its text. Practical deployment of transmitters, however, may require compliance with other legal regimes, but such interactions are not articulated in the Determination.

All interactions noted above are taken from the Determination’s opening paragraph, the Schedules explanation note, the multiple attachments and the instructions regarding Gazette publication and Technical Planning Guidelines.

The Determination text supplied contains a single dating and adoption entry and no recorded subsequent amendments. The concrete facts in the instrument on this point are:

• The document states: "(Determined by the Australian Broadcasting Authority on 26 September 1996)" immediately after the opening paragraphs. That is the only date and adoption statement included in the text.
• There are no further sections in the Determination that record amendments, revocations, superseding determinations, or notes indicating changes after 26 September 1996.
• Attachments and Schedules are presented as integral parts of the Determination as at that date. No amendment notes are appended to any Schedule or Attachment in the provided text.

Implications for users relying on this Determination

• Because the document as presented does not record any amendments, readers should treat the instrument as representing the state of the licence area plan as made on 26 September 1996. The Determination itself does not indicate later changes, reissues, or updates in the provided text.
• The plan repeatedly references external material (the Broadcasting Services Act 1992, and Technical Planning Guidelines). Those external instruments may have been amended after 1996, potentially changing the legal or technical context in which this Determination operates; however, the Determination does not record such changes internally.

Administrative detail about availability timing is fixed in the Determination

• The timing instruction for the community service , that it "is to be available for allocation immediately after publication of the notice in the Commonwealth of Australia Gazette stating that the Esperance radio licence area plan has been made" , is tied to the gazettal step recorded on the date stated. That timing instruction is specific and is not presented as conditional on any subsequent amendment history.

No amendment log in the material provided

• Practitioners should therefore note that this document, as given, contains no amendment history or subsequent modification. Any use of the Determination for current compliance, allocation or enforcement purposes would require checking the authoritative register of instrument amendments, the ABA or successor regulator records, and the Gazette for later notices. The Determination as supplied only indicates the original making date and contains no internal amendment trail.

All statements in this section are drawn from the Determination text which contains no further amendment record beyond the 26 September 1996 determination line.

The Determination’s text contains no references to litigation, court proceedings, tribunal decisions, or judicial review outcomes. The concrete evidentiary facts in the document on this point are:

• The instrument itself is a plan and contains no narrative about legal challenges, appeals, or disputes. There are no case citations, no references to determinations under challenge, and no internal records of judicial outcomes.
• No attachment, schedule or note refers to litigation, stay orders, injunctions, or contested allocation processes.

Implications for legal research

• Because the Determination contains no litigation history, practitioners cannot infer any court or tribunal treatment of this particular instrument from the text provided. If litigation or administrative review occurred in relation to the plan, those events are not recorded here and must be sought through other sources such as court records, tribunal archives, or ABA (or successor body) administrative files.
• The Determination does show administrative actions that might be the subject of litigation (for example, the allocation of a community licence after Gazette publication). The text does not supply any details on disputes arising from allocations, technical parameter enforcement, or licencing decisions.

Practical next steps for counsel or compliance officers

• If a practitioner needs to know whether this Determination was ever litigated, they must check external records: court databases, tribunal decisions, and the ABA/registrar archives. The Determination itself provides no evidence that litigation exists.
• Any legal risk assessment or litigation strategy must therefore rely on external case law and administrative records; the Determination supplies the factual baseline (what was prescribed, when it was made) but not any history of contestation.

All of the above follows directly from the absence of litigation references in the Determination text and attachments provided.

The Determination contains several concrete drafting, numbering and cross‑reference details that may cause downstream confusion or operational error if treated uncritically. The following items are drawn from the text and attachments and are matters to watch for in practice.

Inconsistent service licence number formatting across Schedules and Attachments

• Schedule One lists commercial Service Licence Numbers as SL010335 and SL010320 (Schedule One table). However, the text in Attachment 1.2 lists "Service Licence Number : SL10335" (without the zero) and Attachment 1.3 lists "Service Licence Number : SL10320". A practitioner should note the inconsistency in formatting and verify the authoritative service licence number in the ABA register or the Gazette notice rather than rely on a single mention in the attachments. The Determination itself contains these differing representations.

Transmitter specification number formats vary

• In Schedule One many transmitter specification numbers are shown as TS001341, TS004947, etc., while attachments list specification numbers with a slightly different pattern (e.g. Attachment 1.2 lists "Specification Number : TS10001341" with an extra '10' prefix whereas Schedule One shows TS001341). These differences suggest either typographical variation or differing internal numbering schemes; practical users must confirm the correct TS reference when seeking or cross‑referencing the technical attachment.

Service Licence N/A marked for national and open narrowcasting services

• The Schedule explanatory note states that N/A appears where the Act does not require a service licence. That is a legal distinction under the Broadcasting Services Act 1992. Practitioners should not treat "N/A" as an absence of regulatory constraint. National and open narrowcasting services still have detailed technical specifications in the attachments and may be subject to other statutory or regulatory controls even if a service licence number is not shown in the Schedule.

Site Tolerance references external guidelines

• Almost all attachments state "Site Tolerance : Refer to Technical Planning Guidelines". The Determination therefore does not set explicit numeric tolerances for sites within its text. Operators must obtain and follow the Technical Planning Guidelines referenced; failure to do so will create compliance gaps. The Guideline document is not part of the provided text.

AM radiation pattern special conditions

• Attachment 1.2 contains an AM radiation table with maximum CMF values and a special condition: "CMF on 128°T, 254°T and 326°T to be in the range 150V to 200V" and that minimum CMF directions be within ±2° of certain bearings. Implementers must account for those precise directional constraints when designing AM antenna systems; small angular errors could breach the Determination’s specified constraint.

Co‑location of multiple services at Wireless Hill and other sites

• Several services have the same nominal site (for example, Wireless Hill at AMG 51 397600 6251000) with multiple FM frequencies and maximum ERP up to 5 kW (Attachments 1.3, 1.15, 1.16, 1.21 and 2.2). Co‑location raises practical issues in antenna placement, intermodulation, and site licensing. The Determination does not supply site layout or segregation details; planners must coordinate to ensure technical compatibility consistent with the specified frequency and ERP parameters.

Population base dates

• Licence areas are defined in terms of ABS areas at the Census of 6 August 1991 (Attachments 1.1 and 2.1). That means population counts and area descriptors are fixed to that census. Any subsequent demographic change is not reflected in the Determination; licence area boundaries or population-based entitlements tied to census data may be out of date if relied on without checking whether the plan has been superseded.

Different ERP and antenna-height caps across services

• The Determination prescribes specific maximum ERP values that vary widely, from 25 W, 50 W, 200 W and 1 kW up to 5 kW. Practitioners should not assume uniform power allowances across the licence area; each transmitter attachment must be read to determine the applicable cap.

No procedural detail on allocation or dispute resolution in the plan

• The Determination instructs that the community service be made available for allocation on gazettal but does not specify allocation processes or dispute resolution procedures. Applicants or stakeholders should not assume the plan contains procedural rights beyond the gazettal timing instruction.

Typographic variations in AM vs FM labels and numeric fields

• Some attachments use "MF‑AM" and "VHF‑FM"; others vary in labelling and number formatting. Care is required when extracting machine-readable data or when integrating these specifications into database systems to avoid mismatches.

All "gotchas" above are drawn directly from inconsistencies and cross‑references present within the Schedules and Attachments of the Determination as supplied.

Compliance with the Determination requires attention to the plan’s specific technical prescriptions, to allocation timing for the community service, and to the cross‑referenced external documents and statutory regime. The following concrete steps, grounded in the Determination text, outline what must be done.

1. Confirm authoritative service licence identifiers

• Verify the correct service licence numbers for commercial and community services in the ABA (or successor regulator) register and the Commonwealth Gazette. The Determination contains inconsistent formatting (Schedule One shows SL010335 and SL010320 while Attachments show SL10335 and SL10320). Cross‑check the official licence register rather than relying on a single instance in the attachments (see Schedule One; Attachment 1.2 and 1.3).

2. Adhere strictly to transmitter attachment parameters

• For each transmitter you operate or plan to operate, implement equipment so that emission mode, carrier frequency, polarisation, maximum antenna height and maximum ERP match the attachment for that transmitter. Example concrete items: Attachment 1.3 (commercial FM) specifies 102.3 MHz, mixed polarisation, maximum antenna height 82 m, maximum ERP 5 kW. Attachment 1.2 (commercial AM) specifies 747 kHz MF‑AM with detailed CMF maxima and directions.

3. Implement AM directional and CMF special conditions exactly

• If operating or installing the AM transmitter (Attachment 1.2), ensure the CMF maxima and minima directions and magnitudes are met. Special Condition: "CMF on 128°T, 254°T and 326°T to be in the range 150V to 200V". Ensure antenna tuning and phasing deliver the specified pattern and that minimum CMF directions are within ±2° of 128°T, 200°T, 254°T and 326°T.

4. Observe site coordinates and follow Technical Planning Guidelines

• Use the AMG coordinates given in each attachment as the nominal siting reference (e.g. Wireless Hill AMG zone 51 Easting 397600 Northing 6251000). For site tolerances and permitted variance from the nominal position, "Refer to Technical Planning Guidelines" as specified in each attachment. Obtain the Technical Planning Guidelines and apply their siting tolerances and procedures in conjunction with the Determination.

5. Comply with allocation timing and application procedures for community licence

• The community service (Schedule Two and Attachment 2.2, Service Licence SL010328) "is to be available for allocation immediately after publication of the notice in the Commonwealth of Australia Gazette". Ensure applications for the community licence are only made after the relevant Gazette notice, and follow the allocation process and any application forms or criteria set by the ABA or successor body.

6. Respect the service-category licence rules under the Act

• The Schedules explain that "the Broadcasting Services Act 1992 only requires service licences for commercial and community services." Ensure commercial and community operations have the appropriate service licence as required by the Act; for national and open narrowcasting services, confirm what authorisations (if any) are required under the Act or under separate statutory regimes, since the Plan marks those service licence numbers as N/A but still provides technical parameters.

7. Coordinate co‑located services

• At sites used by multiple services (e.g. Wireless Hill hosts multiple FM frequencies and both national and commercial services), coordinate antenna placement, filters, intermodulation mitigation and physical cabling to ensure each service can legally operate within its specified frequency and ERP envelope. The Determination provides individual frequency/ERP parameters but not site layout rules.

8. Record and monitor ERP and antenna-height compliance

• Maintain technical documentation and monitoring records demonstrating compliance with maximum ERP and antenna‑height limits specific to each attachment (for example, Salmon Gums FM in Attachment 1.12 has maximum ERP 1 kW, max antenna height 70 m).

9. Use ABS definitions for licence-area boundaries when assessing coverage obligations

• When determining whether a proposed transmitter serves the licence area, use the ABS area descriptors listed (Attachments 1.1 and 2.1 give ABS codes and population totals; e.g. Attachment 1.1 Total Persons 15,379). Any claims or obligations linked to the licence area should be tested against those ABS descriptors.

10. Maintain proof of compliance with Technical Planning Guidelines and the Act

• Because the Determination refers to external technical guidance and rests on the Broadcasting Services Act 1992, keep contemporaneous evidence that you have complied with the relevant Technical Planning Guidelines and applicable licence conditions under the Act. The Determination itself does not prescribe enforcement steps; regulators will rely on documentation from licensees when assessing compliance.

11. Resolve numbering or typographical discrepancies before implementation

• Due to observed inconsistencies in TS and SL numbering between Schedules and Attachments, seek written clarification from the regulator or consult the official Gazette notice to avoid implementing the wrong transmitter specification or applying the wrong service licence identifier.

12. Keep the Determination on file as the technical baseline for operations

• The plan sets the technical envelope; operators should retain the Determination and its attachments as the authoritative technical baseline for the Esperance licence area. Any changes, reassignments or variations must be confirmed by subsequent Determinations or by the regulator.

All steps above are derived from the technical and administrative content of the Determination, Schedules and Attachments. Practitioners should not rely solely on the Determination for compliance obligations that are the subject of the Broadcasting Services Act 1992 or of the Technical Planning Guidelines; those documents control enforcement and detailed planning tolerances referenced by the Determination.
