The community licence is stated to be available for allocation immediately after the Plan is published in the Commonwealth Gazette.\n- For every listed service the Plan either records an allocated service licence number (for commercial and community services) or marks it Not Applicable (for national and open narrowcasting services), and it specifies the transmitter sites, frequencies, polarisation, antenna heights, maximum effective radiated power (ERP) or carrier mast field (CMF) values, and the general area served by each transmitter. (See Schedules One and Two and Attachments 1.2–1.24 and 2.2.)\n\n**Who is affected**\n\n- Broadcasters: commercial and community licensees named in the Plan (two commercial licences: SL010335 and SL010320; one community licence: SL010328) must operate in accordance with the technical specifications in the attachments. National and open‑narrowcasting services are recorded as available but do not require service licences under the Act.\n- Potential entrants: the community licence is explicitly available for allocation (first opportunity after Gazette publication). Other parties wanting to provide services in the same bands will be constrained by the frequency, power and pattern limits set here.\n- Spectrum planners and engineers: the Plan imposes detailed transmitter siting, frequency and radiation‑pattern constraints they must follow.\n- Local communities: the Plan defines the geographic licence areas using Australian Bureau of Statistics (ABS) area codes and population counts (Attachments 1.1 and 2.1), which affects which service area a licence covers.\n\n**How it works mechanically**\n\n- The ABA uses its statutory power to nominate the categories of services to be available in the Esperance area and to attach technical specifications to each transmitter. Those technical specifications include carrier frequency, emission mode (AM or FM), antenna height, ERP (for FM) or Carrier Mast Field (CMF) values and, where relevant, directional CMF tables (for AM). The Plan cross‑references Technical Planning Guidelines for site tolerance.\n- For commercial and community services the Plan records service licence numbers. For national and open‑narrowcasting services it records the transmitter technical specs but marks service licence number as N/A because the Broadcasting Services Act 1992 does not require service licences for those categories.\n- The Plan also identifies specific transmitter nominal locations (e.g. Wireless Hill, Condingup Peak) by Australian Map Grid coordinates so that transmitters must conform to the listed geographic and technical parameters.\n\n**Official rationale (as stated)**\n\n- The Plan is made to ensure the identified national, commercial, community and open narrowcasting radio services are available in the Esperance licence area. The community service is signalled as available for immediate allocation after Gazette publication.\n\n**Testing the official rationale against costs, incentives and trade‑offs**\n\n- Who pays: assigned commercial and community licensees will pay the capital and operating costs of equipment, site access, ongoing maintenance and compliance with the specified technical constraints (Attachments 1.2–1.24 and 2.2). The Plan itself does not fund the services; it allocates spectrum and technical parameters.\n- Who decides: the ABA decides the allocation and technical caps in the Plan. Subsequent allocation of the community licence (SL010328) will follow the statutory allocation processes (the Plan states availability on Gazette publication).\n- Behaviour the Plan changes: licensees must design transmitter installations to meet the specified frequencies, ERP/CMF and antenna parameters; entrants must time their applications and technical designs to fit the Plan’s constraints; spectrum use by others is limited by the Plan’s assignments and protective technical limits (e.g. AM directional minima, FM ERP caps).\n- Effects on private enterprise and competition: the Plan creates legal entitlements (service licences) that give those licensees rights to serve the specified licence areas (concentrated benefit to those licensees). The technical limits (frequencies, ERPs, antenna heights and directional patterns) constrain the geographic reach of each service and thus influence local market size and competition. National and open‑narrowcasting services are recorded without requiring service licences, which reduces administrative barriers for those categories but they still must meet the technical specs recorded here.\n- Compliance and implementation risks: the Plan requires transmitter construction and tuning to precise technical values (including a detailed CMF sector table for the AM transmitter and specific ERP limits for FM sites). That introduces execution risk (engineering, site acquisition, maintenance) and ongoing compliance monitoring. The Plan also references external Technical Planning Guidelines (site tolerance), so compliance depends on following those separate technical documents.\n- Opportunity costs and substitution effects: spectrum and transmitter parameters fixed by this Plan reduce the ability to re‑use those frequencies for alternative services unless the Plan is varied. Small towns are served by low‑power FM repeaters (e.g. 25–50 W), while larger hubs use higher ERP; this allocation pattern determines where economic investment in local broadcast services is viable.\n- Concentrated benefits v. diffuse costs: the direct beneficiaries are the named licence holders and the audiences who receive the broadcasts. The costs of enforcing technical constraints and the foregone alternative uses of the frequencies are spread across regulators, other prospective broadcasters and the general public.\n\n**Practical consequences to note (by section/attachment)**\n\n- Schedules 1 & 2 and Attachments 1.2–1.24 and 2.2 fix precise operating frequencies and transmitter parameters that determine coverage footprints (e.g. FM 102.3 MHz at 5 kW from Wireless Hill; AM 747 kHz at Shark Lake with a specified directional CMF table). These are the enforceable technical constraints for radio operations in the licence area.\n- Attachment 1.1 and 2.1 list ABS area codes and population counts that define the geographic scope of the commercial and community licences respectively.\n- The community licence (SL010328) is stated to be available for allocation immediately after the Plan’s Gazette notice, which creates a time window for allocation consistent with the ABA’s statutory process.\n\n**Bottom line**\n\nThis Plan legally records which radio services are to be available in the Esperance area and prescribes the exact technical conditions under which those services must operate. That creates firm engineering constraints for broadcasters, defines the territorial reach of commercial and community licences, and determines the immediate availability of a community licence for allocation. The regulatory effect is operational and technical rather than financial: it shapes who can broadcast to which places and how strong or directional their signals may be."},"kimi_summary":{"content_quality":"ok","complexity_score":4,"scope_assessment":{"changed":false,"description":"This is a standard technical planning instrument made under the Broadcasting Services Act 1992. It remains focused on its original purpose: specifying radio broadcasting technical parameters for the Esperance licence area. The document allocates frequencies and transmitter specifications across commercial, national, community, and narrowcasting categories — exactly what Licence Area Plans are designed to do. There is no evidence of scope creep beyond the original intent of spectrum planning for this region."},"complexity_factors":["Highly structured but repetitive format with 24 separate attachments containing similar technical fields","Extensive use of technical terminology (CMF, ERP, azimuth, Australian Map Grid references) requiring specialist knowledge to interpret","Cross-referencing between schedules, attachments, and external Technical Planning Guidelines","Precise numerical specifications (frequencies to 1 decimal place, coordinates to nearest metre, power levels varying from 25W to 5kW)","Multiple service categories with different regulatory treatments (commercial require service licences; national and narrowcasting marked 'N/A')","Geographic complexity with 15 distinct transmission sites serving specific towns and regions"],"plain_english_summary":"This document is a **Licence Area Plan** made by the Australian Broadcasting Authority (now the Australian Communications and Media Authority) in September 1996. It sets out the technical rules for radio broadcasting in the Esperance region of Western Australia.\n\n**What it does:**\n- **Plans radio coverage** for the Esperance area, specifying exactly what radio services must be available and where.\n- **Allocates frequencies** and technical specifications (like transmitter power, location, and coverage patterns) for different types of radio stations.\n\n**Who it affects:**\n- **Commercial radio stations** (2 services with multiple transmitters covering Esperance and surrounding towns like Ravensthorpe, Lake Grace, and Eucla)\n- **National broadcasters** (8 services — these are the ABC and SBS networks)\n- **Community radio** (1 service for Esperance town)\n- **Open narrowcasting services** (4 services — special-purpose radio like tourist or information radio)\n- **Broadcasters and the public** in the Esperance region, defining who can broadcast on which frequency and with what technical equipment.\n\n**Why it matters:**\nThis plan prevents radio stations from interfering with each other by ensuring each service uses a specific frequency at a specific power level from a specific location. It guarantees that people in Esperance and surrounding areas (including remote towns like Eucla and Hopetoun) receive radio services, and it creates the legal framework for licensing broadcasters in that region.\n\n**Key details:**\n- **Commercial services** use both AM (747 kHz) and FM frequencies, with multiple small transmitters to cover outlying towns.\n- **National services** include ABC Radio National, ABC Local Radio, ABC Classic FM, Triple J, and SBS Radio, distributed across the region.\n- **Community radio** (103.9 FM) is reserved for local community use.\n- **Technical specifications** include precise geographic coordinates, antenna heights, power levels (measured in watts or kilowatts), and radiation patterns (which directions the signal travels)."}},"importantCases":[],"_links":{"self":"/api/acts/licence-area-plan-esperance-radio-september-1996","history":"/api/acts/licence-area-plan-esperance-radio-september-1996/history","analysis":"/api/acts/licence-area-plan-esperance-radio-september-1996/analysis","conflicts":"/api/acts/licence-area-plan-esperance-radio-september-1996/conflicts","importantCases":"/api/acts/licence-area-plan-esperance-radio-september-1996/important-cases","documents":"/api/acts/licence-area-plan-esperance-radio-september-1996/documents"}}
