(1) This part is made under the Act, section 166(4).

Note—

The Act, section 166(4) enables regulations about matters for which costs assessment rules may be made. The Act, section 93 sets out the matters for which costs assessment rules may be made and a reference to section 93 in this part should be read with section 166(4).

(2) For this part, an application by the designated local regulatory authority under the Uniform Law, section 284 for an assessment of costs charged or claimed by the respondent to a complaint is taken to be an application for assessment of costs.

(3) For an application referred to in subsection (2)—

(a) Division 2, other than section 37, does not apply to the application, and

(b) a reference in section 37 to the law practice to which the costs are payable is taken to be a reference to the respondent to the complaint.
