64 Amendment, suspension or cancellation of local
practising certificate—failure to show cause etc
(1) The relevant council may amend, suspend or cancel a local practising
certificate if the holder—
(a) is required by section 61 (Holder of local practising certificate—
show-cause event) to give the council a written statement or
notice relating to a matter and has failed to give a written
statement or notice in accordance with that requirement; or
(b) has given a written statement in accordance or section 61 but the
council does not consider that the holder has shown in the
statement that, despite the show-cause event concerned, the
holder is a fit and proper person to hold a local practising
(2) For this section only, a written statement accepted by the relevant
council under section 61 (3) is taken to have been given in accordance
with section 61.
(3) The relevant council must give the holder an information notice about
the decision to amend, suspend or cancel the certificate.
(4) However, if the relevant council considers that the holder has shown
in the statement mentioned in subsection (1) (b) that, despite the
show-cause event concerned, the holder is a fit and proper person to
hold a local practising certificate, the council must, by written notice,
tell the holder about its decision.
