467 Duty of council to report suspected offences
(1) This section applies if a council suspects on reasonable grounds, after
investigation or otherwise, that a person has committed a serious
(2) The council must—
(a) report the suspected offence to the chief police officer or other
appropriate prosecuting authority; and
(b) make available to the chief police officer or authority the
information and documents relevant to the suspected offence in
its possession or under its control.
(3) The obligation under subsection (2) (b) continues while the council
holds the relevant suspicion.
serious offence means an offence—
(a) for an offence committed in Australia—that is punishable by
imprisonment for at least 1 year; or
(b) for an offence committed outside Australia—that would be, if it
had been committed in the ACT, punishable by imprisonment
for at least 1 year.
