412 Dismissal of complaint
(1) After finishing an investigation of a complaint against an Australian
legal practitioner, the relevant council may dismiss the complaint if
(a) there is no reasonable likelihood that the practitioner will be
found guilty by the ACAT of either unsatisfactory professional
conduct or professional misconduct; or
(b) it is in the public interest to dismiss the complaint.
(2) After finishing an investigation of a complaint against an employee
of a solicitor, the relevant council may dismiss the complaint if
satisfied that there is no reasonable likelihood that the employee will
be found guilty by the ACAT of unsatisfactory employment conduct.
