312A Continuing indemnity insurance
(1) An insurable legal practitioner who is issued with a practising
certificate on the basis that the practitioner is, or will be, the holder
of an approved indemnity insurance policy for the period of the
practising certificate must—
(a) take all reasonable steps to ensure that the policy continues in
force during the period; and
(b) if the policy stops being in force for part of the period, obtain a
replacement policy for that part of the period.
(2) A failure of a legal practitioner to comply with subsection (1) can be
unsatisfactory professional conduct or professional misconduct.
(3) The relevant council may suspend the legal practitioner’s local
practising certificate while the failure by the practitioner to comply
with the requirement continues.
