138 Obligations of legal practitioner partner relating to
misconduct—multidisciplinary partnerships
(1) Each of the following can be unsatisfactory professional conduct or
professional misconduct by a legal practitioner partner of a
multidisciplinary partnership:
(a) unsatisfactory professional conduct or professional misconduct
of an Australian legal practitioner employed by the partnership;
(b) conduct of any other partner (other than an Australian legal
practitioner) of the partnership that adversely affects the
provision of legal services by the partnership;
(c) the unsuitability of any other partner (other than an Australian
legal practitioner) of the partnership to be a member of a
partnership that provides legal services.
(2) A legal practitioner partner of a multidisciplinary partnership must
ensure that all reasonable steps available to the partner is taken to deal
with any unsatisfactory professional conduct or professional
misconduct of an Australian legal practitioner employed by the
partnership.
