13 References to conviction and quashing of conviction
(1) A reference in this Act to a conviction includes a reference to a
finding of guilt, or the acceptance of a guilty plea, whether or not a
conviction is recorded.
Note Found guilty is defined in the Legislation Act, dict.
(2) Without limiting subsection (1), a reference in this Act to the
quashing of a conviction for an offence includes a reference to the
quashing of—
(a) a finding of guilt in relation to the offence; or
(b) the acceptance of a guilty plea in relation to the offence.
(3) However, a reference in this Act to the quashing of a conviction for
an offence does not include a reference to the quashing of a conviction
if—
(a) a finding of guilt in relation to the offence remains unaffected;
or
(b) the acceptance of a guilty plea in relation to the offence remains
unaffected.
