105 Prohibition on representations that corporation is
incorporated legal practice etc
(1) A corporation commits an offence if—
(a) the corporation represents or advertises that the corporation is
an incorporated legal practice in the ACT; and
(b) the corporation has not given notice under section 104 (1)
(Notice of intention of corporation to start providing legal
services).
(2) An offence against subsection (1) is a strict liability offence.
(3) A person commits an offence if—
(a) the person is a director, officer, employee or agent of a
corporation; and
(b) the person represents or advertises that the corporation is an
incorporated legal practice in the ACT; and
(c) the corporation has not given notice under section 104 (1).
(4) Subsection (3) does not apply if the person has a reasonable excuse.
(5) A reference in this section to—
(a) a corporation representing or advertising that the corporation is
an incorporated legal practice; or
(b) a person representing or advertising that a corporation is an
incorporated legal practice;
includes a reference to the corporation or person doing anything that
states or implies that the corporation is entitled to engage in legal
