Lands (Miscellaneous Matters) Act 1984

The statute revolves around a small set of legal concepts and statutory devices. These concepts structure who decides, what property rights change, and which statutory regimes are displaced.

• Permanent reservation revocation. Section 3 revokes Orders in Council and proclamations that created permanent reservations for the lands listed in Schedule Part I. The Act operates directly on the statutory instruments listed in the Schedule; the revocation strips the lands of that reserved status.

• Statutory repeal and extinguishment. Section 3(2) expressly repeals provisions of another Act (the South Melbourne (Roman Catholic Orphanage) Lands Act 1969). Section 5 is wider and operates "Notwithstanding anything to the contrary in any Act" to deem specified lands to be unalienated Crown land and to free and discharge them from "all trusts encumbrances reservations limitations and restrictions whatsoever and from every estate or interest therein." That is an express statutory extinguishment clause: it annihilates pre‑existing property estates, interests and encumbrances that previously affected the listed parcels.

• Revocation of Crown grant. Section 4 revokes a specific Crown grant recorded in a historic register. A Crown grant ordinarily creates a proprietary interest; the Act revokes that grant specifically.

• Ministerial sale power with Governor in Council confirmation. Section 6(1) confers on the Minister the power to sell a specified parcel (Schedule Part II) to the corporation of the City of Port Melbourne on price and terms determined by the Minister. Section 6(2) then requires the Governor in Council to grant fee simple to the corporation once purchase price is paid in full. The mechanism separates the commercial negotiation (Minister) from the conveyancing act (Governor in Council).

• Governor in Council lease power, with statutory override. Section 7(1) authorises the Governor in Council to grant a lease of the land in Schedule Part III for the purpose of a caravan park, expressly "Notwithstanding anything to the contrary in the Crown Land (Reserves) Act 1978 or any other Act." The lease must comply with section 134 of the Land Act 1958, and the term cannot extend beyond 31 December 2006 (s 7(2)). The statute therefore authorises a purpose‑specific lease and limits its duration.

• No compensation rule. Section 8 is absolute and bars compensation by the Crown for any act done under or arising out of the Act. That cuts off statutory or equitable compensation claims that might otherwise be asserted against the Crown in relation to the revocations, revocations of grants, extinguishments, sales or leases effected under this Act.

• Specificity by Schedule. The Schedule names parcels and instruments: Part I lists lands in South Melbourne (5329 square metres under the 1969 Act) and two allotments in the City of Geelong (allotments 1D and 1E, about 455 square metres each, reserved by Orders in Council in 1913 and 1915 respectively). Part II and Part III identify parcels in Port Melbourne and Frankston respectively as the subject of sale and lease powers, accompanied by hatched plans (plans not reproduced in the text here).

Taken together, the Act uses express statutory authority to convert reserved or privately‑affected land back into unalienated Crown land, then provides for transfer (sale to a municipal corporation) or lease (for caravan park use) under tight ministerial and Governor in Council controls and with an explicit bar on Crown compensation.

The Act identifies a tightly circumscribed set of affected parties by deed and statute; effects are concentrated rather than diffuse.

• Holders of interests recorded against the parcels listed in the Schedule. Section 5 declares those lands (Schedule Part I and parts shown in Part II) to be unalienated Crown land and extinguishes "every estate or interest therein" and discharges "all trusts encumbrances reservations limitations and restrictions whatsoever." Practitioners acting for any party who claims a recorded interest over the listed parcels must note that the Act itself purports to extinguish those interests as a matter of statute (s 5). That includes parties who held interests under the Orders in Council or under the 1862 Crown grant expressly revoked by s 4.

• The corporation of the City of Port Melbourne. Section 6 confers an option for sale in favour of that municipal corporation: the Minister may sell the hatched Part II land to that corporation at price and terms the Minister thinks fit (s 6(1)). Upon payment the Governor in Council grants fee simple (s 6(2)). The corporation is the designated transferee; no competing transferees are mentioned.

• The Minister and the Governor in Council. Decision authority is concentrated in the Minister (who sets price and terms for the Part II sale) and in the Governor in Council (who must execute the fee simple grant when payment is made and who may grant the caravan‑park lease for Part III land, in accordance with Land Act s 134) (s 6(1)-(2), s 7(1)). Administrative responsibility lies with these Crown officers.

• Potential lessees and operators of a caravan park. Section 7(1) authorises a lease for the stated purpose (caravan park, including erection of buildings) to be granted by the Governor in Council. A private operator seeking to occupy the Part III land would therefore be subject to whatever lease terms the Governor in Council fixes under the Land Act 1958 regime and the statutory condition that the lease must terminate not later than 31 December 2006 (s 7(2)).

• Public bodies with duties tied to prior reservations. The 1969 South Melbourne Act had referenced the Department of Health and a "site for public purposes" (Schedule Part I). Those public interests and any statutory duties arising under previous Instruments are directly affected because the Act revokes the governing reservation and repeals the 1969 Act provisions that gave statutory effect to that reservation (s 3(2), Schedule Part I).

• Persons or entities who might otherwise claim compensation. Section 8 removes Crown liability for compensation "in respect of any act matter or thing done under or arising out of this Act." Any person who would expect compensation for loss arising from the revocations, grant revocation, sale or lease under this Act will find an express statutory bar in s 8.

The Act does not create open rights for third parties to buy the Part II land, nor does it create ongoing statutory personal rights for prior interest‑holders in the affected parcels. It centralises decision-making in Crown ministers and the Governor in Council, and allocates direct benefit to the corporation of the City of Port Melbourne (sale) and prospective lessees under a caravan‑park lease (subject to grant terms and duration limits).

The Act creates a small set of affirmative powers, compulsory extinguishments and limitations rather than a broad compliance regime. Translating the text into duties and rights for players yields the following.

Duties and obligations

• Minister: the statute gives the Minister a discretionary power to sell the Part II land to the corporation of the City of Port Melbourne "at a price and on terms and conditions which he thinks fit" (s 6(1)). The duty is largely one of decision; there is no statutory procedure specified for consultation, valuation, public notice or competitive tender. The Minister must, if the sale is effected and payment is made in full, take procedural steps to have the Governor in Council grant fee simple (s 6(2)). The Act does not prescribe a statutory form of conveyance but the Governor in Council is mandated to grant fee simple upon full payment (s 6(2)).

• Governor in Council: has two concrete roles. First, upon payment in full of the purchase price for the Part II land, the Governor in Council must grant the land in fee simple to the City corporation (s 6(2)). Second, the Governor in Council "may in accordance with the provisions of section 134 of the Land Act 1958 grant a lease" of the Part III land for caravan‑park purposes (s 7(1)). The Governor in Council's discretion is subject to the statutory constraint that any lease ends no later than 31 December 2006 (s 7(2)). There is no duty in the Act to grant a lease; the Governor in Council may grant one in accordance with Land Act procedures.

• Corporation of the City of Port Melbourne: has the right to be the specific transferee under s 6. That right is conditional: the Minister must choose to sell and the corporation must pay the purchase price in full to trigger the Governor in Council's obligation to grant fee simple (s 6(1)-(2)). The Act does not oblige the City corporation to purchase.

• Parties with interests previously recorded: have no statutory protection or right to compensation in respect of acts done under this Act; s 5 extinguishes their interests and s 8 bars compensation claims against the Crown for acts under or arising out of the Act.

Rights created or preserved

• Crown rights: the Act reasserts Crown title in the specified parcels by deeming them unalienated Crown land (s 5). That is a reinstatement of Crown dominion, free from trusts and encumbrances.

• Municipal ownership right: the City corporation obtains a statutory pathway to acquire fee simple in the Part II land, but only conditional on Ministerial sale and full payment (s 6(1)-(2)).

• Lease right for caravan park: third parties can obtain possession only if the Governor in Council grants a lease under s 7(1) in accordance with the Land Act. The Act permits the erection of buildings as part of that authorised use.

Limitations and constraints

• Extinguishment of pre‑existing estates and interests: s 5 is a limitation on private rights , it expunges "every estate or interest therein". Those limitations operate irrespective of whether the prior estates were equitable or legal, registered or unregistered, given the statute's "notwithstanding anything to the contrary in any Act" framing.

• No compensation: s 8 limits remedies against the Crown for loss arising from the Act; it extinguishes compensation expectations.

• Temporal limit on leases: s 7(2) binds any lease to terminate by 31 December 2006, fixing a maximum outer boundary to possible occupation rights.

Procedure and compliance duties are not elaborated in the Act: there are no detailed administrative steps, valuation methods, notice requirements or public consultation processes prescribed. The Minister's power is exercised "at a price and on terms and conditions which he thinks fit" (s 6(1)), thereby leaving procedural choice to ministerial discretion and to applicable statutes or conventions external to this Act, such as the Land Act 1958 processes invoked for leases.

This Act contains no penal provisions, civil penalty regimes, or administrative fines. Its enforcement is structural: the statutory language effects property status changes and creates or extinguishes rights by operation of law. Consequences and enforcement mechanisms are therefore indirect and operate through property and administrative practice rather than by punitive sanction.

Key enforcement‑by‑operation points

• Statutory revocation and extinguishment are self‑executing. Sections 3 and 5 operate to revoke Orders in Council, repeal a provision of the 1969 Act and to reclassify lands as unalienated Crown land freed from "all trusts encumbrances reservations limitations and restrictions whatsoever and from every estate or interest therein." That is not an enforcement regime requiring regulatory action; it is an express statutory alteration of legal title and interests. The "enforcement" of these changes occurs when the relevant land titles, registers or departmental records are updated to reflect the new status.

• Conveyance and grant follow commercial completion. Section 6(2) requires the Governor in Council to grant fee simple to the City corporation once the purchase price is paid in full. Enforcement of that obligation is a ministerial/Governor in Council act: once the condition (payment) occurs the statutory duty arises to execute the grant. In practice that means the relevant Crown land department will be required to issue the necessary instruments to vest fee simple.

• Lease grant follows Land Act procedures. Section 7(1) ties the exercise of the lease power to the provisions of section 134 of the Land Act 1958. The Land Act is the procedural vehicle for such leases; compliance with whatever application, advertising, approval and form requirements exist under s 134 (not reproduced in this Act) will govern practical execution and hence "enforcement" of lease terms.

• No compensation removes remedial claims. Section 8 eliminates the Crown's compensation exposure for acts or things done under or arising out of the Act. Practitioners should note that, as this Act stands, statutory claims for compensation against the Crown arising from its operation are expressly barred. There is no alternative enforcement route in this Act that provides compensation or restitution.

Absence of penalties

• There are no contraventions, fines, injunction clauses or criminal offences in the Act text. Compliance is therefore anchored in administrative practice, the duties of the Minister and Governor in Council, and the operation of property law following statutory revocations and grants.

Dispute resolution

• The Act does not prescribe dispute resolution mechanisms for third parties contesting the revocations or claimed extinguishments. Any judicial contest would therefore proceed under the general law; the Act itself contains the primary legal command (for example s 5's extinguishment clause). Section 8 will be a statutory defence to monetary claims against the Crown for acts taken under the Act.

For practitioners, enforcement questions will centre on executing the statutory steps (sales, payments, grants, leases), updating registers, and, where contested, litigating the validity or effect of the Act's provisions in ordinary courts. The Act itself supplies no enforcement penalties nor administrative sanctions.

The Act expressly modifies, overrides, invokes and repeals provisions of other statutes and instruments. Interaction is limited in scope but legally significant.

Express overrides and repeals

• General statutory override. Section 5 operates "Notwithstanding anything to the contrary in any Act" to reclassify the listed lands as "unalienated lands of the Crown" and to free them from "all trusts encumbrances reservations limitations and restrictions whatsoever." That language is an express parliamentary override: it operates to displace inconsistent provisions in other Acts, to the extent of the inconsistency, for the lands specified.

• Repeal of prior Act provisions. Section 3(2) repeals section 5 and the First Schedule of the South Melbourne (Roman Catholic Orphanage) Lands Act 1969. That removal alters the statutory framework that had previously designated certain South Melbourne land as a site for public purposes in accordance with the 1969 Act.

• Orders in Council and proclamations revoked. Section 3(1) revokes the Orders in Council referred to in Part I of the Schedule "and any other Order in Council or proclamation affecting lands" insofar as they relate to those lands. That seeks to remove the effect of earlier executive instruments that reserved the lands, thereby changing the operative statutory/regulatory fabric.

Invoking other statutes

• Crown Land (Reserves) Act 1978. Section 7(1) grants the Governor in Council power to grant a lease "Notwithstanding anything to the contrary in the Crown Land (Reserves) Act 1978 or any other Act of law." The Act therefore disapplies inconsistent provisions of the Crown Land (Reserves) Act 1978 for the specific lease authorised, permitting an action that might otherwise have been inhibited by that Act.

• Land Act 1958 s 134. Section 7(1) requires that any lease be granted "in accordance with the provisions of section 134 of the Land Act 1958." The Act therefore ties the exercise of the Governor in Council's discretion to the procedural and substantive requirements contained in s 134 of the Land Act 1958. The Lands (Miscellaneous Matters) Act 1984 does not reproduce those requirements, but makes compliance with them a precondition to the lease.

Limits to interaction

• The Act does not specify how registries, local government planning laws, building approvals, or other regulatory schemes outside the Land Act and Crown Land (Reserves) Act 1978 are to be reconciled with the sales or leases. For example, while s 7(1) authorises erection of buildings as part of the caravan park use, the Act does not state whether building approvals or planning controls are disapplied; therefore, normal planning and building controls would remain relevant unless otherwise modified by separate instruments. The Act is silent on these interactions.

Compensation and other remedies

• Section 8 interacts negatively with other statutory compensation schemes by providing an express bar: "No compensation shall be payable by the Crown in respect of any act matter or thing done under or arising out of this Act." Where other statutes provide remedies or compensation for acquisition or extinguishment of interests, s 8 is a direct statutory statement extinguishing Crown liability for compensation under this Act's operations.

Historical instruments and registers

• The Act revokes a specific Crown grant recorded in the Register of Miscellaneous Grants. That revocation will interact with land title records and historic registers; the Act requires administrative persons to update registers to reflect revocation (s 4). Section 3(1) lists Government Gazettes that recorded the earlier reservations; repeal of the Orders in Council will require updating the official records.

Practical consequence

• The Act uses express statutory primacy to convert reserved or granted titles back to Crown land, displace prior statutory and executive instruments for the identified parcels, and to channel disposals through Ministerial and Governor in Council mechanisms while invoking the Land Act's procedural requirements for leases. It leaves in place the Land Act procedural framework for leases and the standard operation of any other statutes not expressly overridden.

The Act is a short, self-contained instrument. The endnotes in the text supplied provide the authoritative amendment record up to the version date of 14 February 2000.

• Commencement and assent. The Act was assented to and came into operation on 8 May 1984; section 2 and the endnotes confirm that commencement was on the day of Royal Assent (s 2; Endnote 1).

• Amendments. The endnotes state "There are no amendments made to the Lands (Miscellaneous Matters) Act 1984 by Acts and subordinate instruments." The legislative version provided is therefore the original Act as enacted on 8 May 1984, with no recorded amendments up to the publication date of the version (Endnote 2).

• Explanatory details. The endnotes note that there were "No entries at date of publication" under Explanatory Details (Endnote 3). The explanatory memorandum or equivalent is therefore not reproduced here.

Implications of the stable history

• The absence of subsequent amendments in the official endnote suggests the Act's substantive provisions , the revocations, the Crown grant revocation, the deeming of land to be unalienated Crown land, the Ministerial sale power, the Governor in Council lease power (with the 2006 lease end date), and the no‑compensation clause , remain as enacted in 1984 in the version provided.

• The fixed term for leases under s 7(2), which ends no later than 31 December 2006, is part of the original enactment and has not been amended according to the recorded amendment history. That limit was therefore time‑bound from enactment.

Practitioners should nevertheless confirm that no subsequent legislative or regulatory instruments (not recorded in the endnotes here) have been enacted after the publication date that interact with these provisions, and should check the current consolidated statute database for any later changes.

The supplied version of the Act includes no references to judicial decisions or litigation arising under the Act. The Schedule and endnotes do not list any cases or reported proceedings. Two points arise from the source material:

• No cases named in this text. The Act and its endnotes do not cite any judicial decisions, and the legislative documents provided here do not include a litigation history section.

• Implications for research. For any party seeking to understand how courts have interpreted the revocation, extinguishment or the no‑compensation clause, independent doctrinal research beyond the Act text will be required. The Act itself provides the statutory commands; the text does not disclose whether those commands were contested or litigated.

Given the absence of litigation references in the source supplied, this note records that the Act, as presented, has no litigation history set out in the text. Practitioners who require case law should consult court databases and consolidated legislative histories beyond the present instrument.

The Act is terse but contains several provisions that create practical risks and traps for those dealing with the affected lands. These are concrete operational and legal points to watch.

• Absolute extinguishment language (s 5). Section 5 declares specified lands to be "unalienated lands of the Crown" and frees them "from all trusts encumbrances reservations limitations and restrictions whatsoever and from every estate or interest therein." That statutory language is broad and immediate. Practitioners should note that statutory extinguishment is not qualified by compensation or transition arrangements; prior equitable or legal interests listed against the land are purged by the Act.

• No compensation (s 8). The Act contains an express bar on Crown compensation for "any act matter or thing done under or arising out of this Act." Parties who would otherwise expect compensation as a remedy will find s 8 an explicit statutory exclusion. This raises practical risk for former interest‑holders; there is no statutory fallback in this Act.

• Minister sets price and terms (s 6(1)). The Minister has complete discretion to fix the price and terms for the sale to the City of Port Melbourne "which he thinks fit." The Act does not require a market valuation, public tender, or ministerial reasons to be published. That discretion is a point of operational risk and may be politically sensitive; the Act does not prescribe process safeguards.

• Sale restricted to a single transferee (s 6(1)). The sale power is confined to the "corporation of the City of Port Melbourne." No open market disposal is authorised. That concentrates the potential benefit in a single municipal entity.

• Conditional grant of fee simple (s 6(2)). The Governor in Council is required to grant fee simple only once the purchase price is paid in full. Partial payments or other arrangements do not trigger the mandated grant; the payment condition is a strict precondition.

• Lease term limit (s 7(2)). Any lease granted under s 7 must end no later than 31 December 2006. Although the Act authorises "including the erection of buildings," the temporal cap restricts long‑term investment horizons. Note that the date specified is in the past relative to the present; the statutory cap remains as enacted unless amended.

• Interaction with Land Act procedures (s 7(1)). Leases must be granted "in accordance with the provisions of section 134 of the Land Act 1958." The Lands (Miscellaneous Matters) Act does not reproduce those procedural rules; failing to apply Land Act procedures correctly would risk invalid grants.

• Records and plans not reproduced. The Schedule refers to hatched plans for Part II and Part III land and cites Government Gazette entries for earlier Orders in Council. The text supplied does not reproduce the plans. Practitioners must inspect the official plans and gazette notices referenced in the Schedule to identify precise boundaries and rights.

• Repeal of 1969 Act provisions (s 3(2)). Repeal of section 5 and the First Schedule of the South Melbourne (Roman Catholic Orphanage) Lands Act 1969 removes statutory protections or designations that previously applied. Parties relying on those prior statutory designations should not assume continuity of status.

• No procedure for contesting extinguishment specified. The Act does not set out procedural routes for parties to challenge the extinguishment or seek declaratory relief. Any challenge must proceed through ordinary court processes under general law.

• Potential disconnect with planning/building regulation. Although s 7 contemplates erection of buildings for caravan‑park use, the Act is silent on planning and building approvals. Ordinary planning and building law may still apply; the Act does not displace those regimes expressly.

These "gotchas" arise directly from the Act's text. They are operational and legal points where parties should exercise caution and obtain documentary verification before acquiring, developing, or advising on the affected parcels.

Compliance under this Act is mainly an exercise in executing the statutory steps properly, observing procedural preconditions in related statutes, and ensuring records are updated. Below are concrete compliance actions tailored to the parties identified by the Act.

For the Minister (when contemplating sale under s 6)

• Identify the Part II parcel precisely by consulting the Schedule and the referenced hatched plan. If the plan is not appended, obtain the official plan and Government Gazette references to determine boundaries.

• Determine whether the lands in Part II have been duly declared unalienated Crown land under s 5; ensure departmental registers reflect the extinguishment of prior interests and the revocation of applicable Orders in Council (s 3(1), s 5).

• Decide whether to exercise the discretion to sell to the corporation of the City of Port Melbourne "at a price and on terms and conditions which he thinks fit" (s 6(1)). Although the Act does not require a valuation, procurement or public notice process, it is prudent to document the basis of pricing and terms to support administrative transparency and to reduce risk of subsequent dispute.

• Prepare a conditional sale agreement that requires full payment of the purchase price to trigger the statutory obligation for the Governor in Council to grant fee simple (s 6(2)). Ensure the conveyancing instrument is compatible with Crown land transfer practice and any required sign‑offs.

• Coordinate with the Governor in Council's office and Crown land registry to ensure that upon receipt of full payment the grant of fee simple is executed promptly, as s 6(2) mandates grant when purchase price is paid in full.

For the Governor in Council (in relation to grants and leases)

• On receipt of confirmation of full payment for the Part II sale, execute the grant of fee simple to the corporation of the City of Port Melbourne in accordance with s 6(2).

• If considering a lease for Part III land, ensure all steps required by s 134 of the Land Act 1958 are satisfied before executing the lease. Confirm that the intended lease purpose is caravan park use and that the lease term ends not later than 31 December 2006 (s 7(1)-(2)).

• Ensure any lease instrument records the permitted use and building permissions explicitly, and is consistent with other statutory requirements (for example, any Land Act procedural approvals).

For the corporation of the City of Port Melbourne

• Confirm the identity and boundaries of the Part II land from official plans referenced by the Schedule.

• Engage with the Minister's office to agree price and terms and ensure finances are available to complete purchase, since the Governor in Council's duty to grant fee simple is conditional on full payment (s 6(2)).

• Ensure the corporation's board/council resolves to acquire the land and that internal authorisations exist to pay the purchase price and accept the grant.

• Plan for the obligations and liabilities that will attach on receipt of fee simple (maintenance, rates, planning obligations, etc), noting the Act extinguishes prior encumbrances but does not address planning, building or municipal duties outside the transfer mechanics.

For prospective lessees/operators of a caravan park (Part III)

• Apply for a lease only by following procedures mandated by s 134 of the Land Act 1958 (s 7(1)); do not assume the Lands (Miscellaneous Matters) Act substitutes for Land Act procedures.

• Recognise the lease term is subject to statutory termination by 31 December 2006 (s 7(2)). Structure investment and financing accordingly; long‑term capital investments may be constrained by the temporal cap.

• Obtain any necessary planning and building approvals separate to the lease grant; the Act permits erection of buildings as part of the caravan park purpose but does not itself waive planning or building requirements.

For prior interest‑holders or claimants

• Recognise that s 5 extinguishes "every estate or interest" in the specified parcels and s 8 bars compensation "in respect of any act matter or thing done under or arising out of this Act." Challenge to those provisions would need to be through ordinary legal proceedings; the Act contains no internal compensation mechanism.

Administrative and recordkeeping steps for all parties

• Update Crown land registers and the Register of Miscellaneous Grants following revocation of the 1862 grant (s 4) and revocation of Orders in Council (s 3(1)).

• Check Government Gazettes cited in the Schedule for historical notices (see Schedule entries for Government Gazettes referenced for the Geelong reservations), and obtain the hatched plans referenced in Parts II and III.

• Document the legal basis for all transfers and leases, including the statutory sections relied upon (ss 3-7), and keep a clear paper and electronic trail evidencing payment, ministerial decisions, and Governor in Council grants.

• Be aware of the statutory non‑compensation provision (s 8) when advising clients: there is no statutory entitlement to compensation for loss arising from the Act.

Practical counsel

• Because the Act delegates much procedural discretion to the Minister and the Governor in Council and invokes Land Act procedures for leases, close coordination with the Crown land administrative authority is required to ensure steps are compliant.

• Prior to acquisition or investment, obtain the official plans and confirm that the intended use (sale to City, caravan park lease) aligns with municipal and planning regimes.

Following the steps above aligns transactional execution with the Act's mechanical commands and with the procedural requirements it places on other statutes that it invokes.
