Land (Revocation of Reservations - Regional Victoria Land) Act 2016

Revocation of reservation or grant. The central mechanism is the revocation of one or more Orders in Council that had permanently reserved the land for a specific purpose (Mechanics’ Institute and Free Library at Burke’s Flat and Lake Charm; watering purposes at Campbelltown; experimental farm at Walpeup). For Burke’s Flat only, the Act also revokes Crown grant Volume 2308 Folio 562 (s 3(2)). Revocation is not by executive action; it is by direct statutory command. Each Part identifies the Order in Council by its gazettal date and page (see schedule 1). The revocation is immediate on the Act’s commencement.

Consequences of revocation. Upon revocation, the land is “taken to be unalienated land of the Crown.” This is a statutory fiction: the land is not physically repossessed; it is treated as if it had never been alienated or reserved. The phrase “freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests” is deliberately exhaustive (ss 4(a), 6(a), 9(a), 11(a)). It extinguishes any private or public rights that were appurtenant to the reservation, including any rights held by a committee of management, trustee, or any person claiming under a trust. The only exception is the grazing licence preserved under s 7 for one allotment at Campbelltown.

Unalienated Crown land. This term means the land is held by the Crown in right of the State of Victoria as part of the Crown’s absolute beneficial ownership, free from any prior dedication. The Crown may then decide to sell, lease, or reserve it for a new purpose under the Crown Land (Reserves) Act 1978 or the Land Act 1958. The Act does not mandate any particular future use; it merely removes the existing restrictions.

Preservation of licences. Section 7 creates a carve-out for a single grazing licence “granted under section 130 of the Land Act 1958 and in force immediately before the commencement of this Part” over Crown Allotment 70A1, Section 1, Parish of Campbelltown. That licence continues unaffected by the revocation. No other licences or interests are saved. This is a deliberate policy choice: the licence holder’s rights are not to be disturbed, whereas all other prior interests (including any informal permissions) are extinguished.

Role of the Registrar of Titles. Section 12 compels the Registrar of Titles to make “any recordings in or amendments to the Register” necessary because of the Act’s operation. The Register is kept under the Transfer of Land Act 1958. This section ensures that the Crown’s unencumbered title is recorded, removing any entries that reflected the former reservation or grant. For the Burke’s Flat land, which had a Crown grant, the relevant folio must be cancelled or amended to show the Crown as the unalienated proprietor.

The Act directly affects only a narrow set of parties. First, the Crown (the State of Victoria) is the immediate beneficiary: it regains unencumbered ownership of the four parcels. Second, committees of management and trustees appointed under the Crown Land (Reserves) Act 1978 lose their statutory appointments for the relevant land (ss 4(b)-(c), 6(b)-(c), 9(b)-(c), 11(b)-(c)). These would have been volunteers or local groups that managed the Mechanics’ Institute or watering reserve. Third, the grazing licence holder at Campbelltown is preserved in their rights, so they are not adversely affected. Fourth, any person who held an unregistered interest (such as a tenancy at will, a licence other than the preserved one, or an equitable claim) loses that interest because the Act discharges all “estates and interests.” The Act does not provide for compensation for the loss of such interests. Fifth, the Registrar of Titles is required to perform administrative tasks (s 12). Sixth, local councils and community groups that may have used the Mechanics’ Institute buildings or the research station may lose access if the Crown later disposes of the land. The Act does not specify any consultation or notification obligations to these groups before revocation. Seventh, the Department of Environment, Land, Water and Planning (or its successor) as the administering body for Crown land will now have the power to deal with the parcels without the former reservation constraints.

The Act has no direct effect on the general public or on taxpayers, except indirectly: if the land is sold, proceeds may flow to the Consolidated Fund, and if it is retained, maintenance costs shift from reserve management bodies to the Crown. For the Walpeup Agricultural Research Station land (about 1,034 hectares in total), the abolition of the experimental farm reservation removes the public purpose; any future use (such as sale to private agriculture) is now possible. This could affect neighbouring landholders if the land is sold to a private operator, but the Act does not itself change land use; it merely removes a constraint.

Duties of the Registrar of Titles. The only positive duty created by the Act is found in s 12: the Registrar of Titles “must make any recordings in or amendments to the Register” necessary because of the Act’s operation. This is a mandatory duty, not discretionary. The Registrar must act without further request from any party. The amendment may involve cancelling the Crown grant folio for Burke’s Flat, removing reserve notations for the other parcels, and updating the Crown’s interest. Failure to comply would be a breach of statutory duty, but no specific penalty is provided; enforcement would be by way of judicial review or mandamus.

Rights of the grazing licence holder. The holder of the grazing licence over Crown Allotment 70A1 at Campbelltown has a right to have that licence preserved (s 7). The licence continues on its existing terms and is not extinguished by the revocation of the reservation. This is the only private right that survives the Act. The section uses “Nothing in section 6 affects”, which means that the general discharging provision in s 6 does not apply to that licence. The licence holder does not need to apply for renewal or confirmation; the Act itself affirms the licence’s continuity.

Extinguished rights of committees and trustees. Before the Act, committees of management and trustees had certain powers and duties under the Crown Land (Reserves) Act 1978 in relation to the reserved land. Those appointments are revoked “to the extent that it relates to that land” (ss 4(b)-(c), 6(b)-(c), 9(b)-(c), 11(b)-(c)). Former committee members and trustees have no further rights to manage, occupy, or access the land. They also have no right to compensation for loss of office or for any improvements they may have made.

Crown’s right to deal with the land. Once the reservations are revoked, the Crown holds the land as unalienated Crown land. The Crown then has the full range of powers under the Crown Land (Reserves) Act 1978 and the Land Act 1958 to sell, lease, license, or reserve the land for a new purpose. The Act imposes no restrictions on that future dealing. The Crown could sell the land to a private developer, transfer it to a council, or reserve it for a different public purpose. No public consultation is required by this Act.

No private right of action. The Act creates no new rights for private parties to challenge the revocation or the subsequent disposal of the land. A person who loses access to a Mechanics’ Institute library or to the research station has no statutory cause of action under this Act. The only potential avenue is through administrative law if the Crown acts beyond power, but that would rely on other statutes, not on this Act.

The Act contains no penalty provisions. It does not create any offences. There is no provision for fines, imprisonment, or infringement notices. Enforcement is therefore limited to ensuring compliance with the duties imposed. The only duty is on the Registrar of Titles (s 12). If the Registrar fails to amend the Register, a person with an interest (such as the Crown or a potential purchaser) could seek a court order compelling the Registrar to act. That would be by way of judicial review in the Supreme Court of Victoria under the Administrative Law Act 1978 or via an application for mandamus. There is no express mechanism in the Act for enforcing the preservation of the grazing licence. If the Crown or a third party were to act inconsistently with the licence, the licence holder could enforce their rights under the Land Act 1958 or under the terms of the licence itself. The revocation of committee of management and trustee appointments is automatic and does not require enforcement; those persons simply cease to hold office. If a former committee member continued to occupy the land after revocation, they would be a trespasser, and the Crown could seek an ejectment order. Similarly, any person who claimed an interest that was discharged by the Act (e.g., a party claiming under a trust) would have no legal basis to resist the Crown’s ownership. The Act is structured to be self-executing: it does not rely on any enforcement agency or compliance regime. The absence of penalties is consistent with the Act’s character as a narrow, clarifying piece of land administration.

The Act interacts with several Victorian statutes, primarily the Crown Land (Reserves) Act 1978, the Land Act 1958, and the Transfer of Land Act 1958.

Crown Land (Reserves) Act 1978. The Act directly overrides the reservation mechanism of the 1978 Act. Under that Act, permanent reservations of Crown land are typically made by Order in Council and can be revoked by subsequent Order in Council. Here, the revocation is done by statute rather than by executive instrument. The Act also revokes any regulations made under s 13 of the 1978 Act that applied to the reserved land (ss 4(d), 6(d), 9(d), 11(d)). Those regulations dealt with management and use of the reserves. Once revoked, the land is no longer subject to those specific regulatory regimes. The 1978 Act continues to apply to the land after revocation in a different capacity: the land becomes unalienated Crown land and will be managed under the general provisions of that Act and the Land Act 1958 unless and until it is further dealt with.

Land Act 1958. The Act preserves a grazing licence granted under s 130 of the Land Act 1958 over the Campbelltown land (s 7). This confirms that the Land Act 1958’s licensing regime continues to apply to that licence. The revocation of the reservation does not affect the licence. For the other parcels, any licences or leases that may have existed are not preserved. The Act does not mention any other provisions of the Land Act 1958, but the general law under that Act will govern any future dealings with the land.

Transfer of Land Act 1958. Section 12 imposes a duty on the Registrar of Titles to amend the Register under that Act. The Register is the Torrens title system. The amendments would remove any encumbrances or notations related to the reservations and the Crown grant. For the Burke’s Flat land, which had a Crown grant (Volume 2308 Folio 562), the revocation of the grant means that the folio must be amended to show the Crown as proprietor of unalienated land. There is no requirement for a new certificate of title to be issued; the existing folio may be cancelled or modified.

No interaction with planning laws. The Act does not override the Planning and Environment Act 1987. Any future development of the land will still require planning permits and comply with local planning schemes. The revocation only removes the statutory reservation; it does not change the zoning or overlay controls. Similarly, the Native Title Act 1993 (Cth) may be relevant: the Act does not extinguish native title; it merely revokes reservations. The Crown’s acquisition of unencumbered ownership could affect native title claims, but that interaction is not addressed in the Act.

No interaction with the Public Records Act 1973 or other archives. The Act does not require any record-keeping about the previous reservations. The historical Orders in Council remain in the government gazette; the Act merely terminates their legal effect.

The Act has not been amended. The Table of Amendments (endnote 2) states: “There are no amendments made to the Land (Revocation of Reservations - Regional Victoria Land) Act 2016 by Acts and subordinate instruments.” The Act remains in its original form as passed in 2016. It is version 001, current as at 1 May 2017. There are no amendments not in operation (endnote 3). The Act is a standalone piece of legislation that has not been repealed or modified. Its ongoing effect is static: it revoked the reservations and that revocation is permanent. There is no sunset clause. The Act will remain on the statute book indefinitely unless repealed, but its operative provisions have been spent: the revocations have occurred, and the Registrar of Titles has presumably updated the Register. The Act is now of historical and evidentiary significance but no longer requires any ongoing action. The absence of amendments reflects the narrow, one-off nature of the legislation.

There is no mention of any litigation in the Act or its endnotes. The endnotes contain no entries for explanatory details (endnote 4). There is no known litigation arising from this Act. The Act was designed to avoid litigation by clearly stating the consequences of revocation and by preserving the one grazing licence. The fact that the Act extinguishes all trusts and interests without compensation could theoretically give rise to a claim under the Victorian Charter of Human Rights and Responsibilities Act 2006 if a person could show they had a proprietary interest that was taken without just terms. However, the Act’s language is absolute, and no Charter statements appear in the text. The second reading speech (not in the source but referenced in the endnotes) may have addressed human rights compatibility, but the source does not reproduce it. The grazing licence holder would not be affected. Committees of management and trustees are volunteers without property rights in the land. Therefore, the litigation risk is low. The Act appears to have been implemented without legal challenge, which is consistent with its consensual or uncontroversial nature. If any litigation did occur, it would likely be in the context of a dispute over whether a particular interest was extinguished (e.g., a lease that was not registered). But given the act’s broad discharge language, a court would likely hold that all non-preserved interests are extinguished. Because no such cases are reported in the source, the litigation history is effectively nil.

Several features of the Act may catch practitioners off guard. First, the breadth of the discharge clause. Section 4(a) says the land is “freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests.” This is absolute. If there was an unregistered lease, a right of way, or a licence to use the land (other than the one preserved grazing licence at Campbelltown), it is extinguished. A person relying on an informal arrangement with the previous committee of management has no standing after commencement. The Act contains no savings for any other interests. This could be a trap for a farmer who had an informal agistment licence on the Walpeup research station land, or for a local historical society that stored items in the Mechanics’ Institute building.

Second, the Act does not require any notice to be given to affected parties. There is no obligation on the Crown to inform the committees of management, trustees, or any third party that their rights are being revoked. A committee might only discover its dissolution when the Crown asserts ownership or sells the land. This imposes a burden on those parties to monitor legislative changes.

Third, the preservation of the grazing licence at Campbelltown under s 7 is specific to one licence over one allotment. The Act does not preserve any other licences that may exist on the same allotment or on the other parcels. So if there were multiple licences (e.g., a watering licence and a grazing licence), only the grazing licence under the Land Act 1958 is saved. A licence under a different statutory provision or a common law licence would be extinguished.

Fourth, the Act revokes the Crown grant for the Burke’s Flat land (s 3(2)). This means that the land’s title history is altered: the grant is nullified, and the land reverts to unalienated Crown land. The Registrar must amend the Register. A purchaser relying on a title search after the Act must check that the amendments have been made. If the Registrar has not yet acted, the record may still show a Crown grant, which no longer has legal effect. A conveyancer could be misled.

Fifth, the Act provides no transitional period. The provisions take effect on commencement (1 May 2017). There is no grace period for the committee of management to wind up its affairs or for users of the land to vacate. As soon as the Act commences, the appointments are revoked and the trusts are discharged. Anyone remaining on the land without a preserved licence becomes a trespasser instantaneously.

Sixth, the Act does not state what happens to any buildings or improvements on the land. The former Mechanics’ Institute building at Burke’s Flat likely belonged to the Crown as part of the freehold. The revocation does not change ownership of the building. But if a committee had constructed improvements using its own funds, those improvements may now be forfeit without compensation because any trust or interest is discharged. The Act does not address fixtures.

The Act imposes virtually no compliance burden on private parties. The only statutory duty is on the Registrar of Titles, who must update the Register (s 12). That is a government responsibility. For anyone else, compliance is essentially passive: do not assert any rights that have been extinguished.

If you were a committee of management member or trustee for any of the four parcels, your appointment is automatically revoked. Your compliance obligation is to cease acting in that capacity immediately upon the Act’s commencement (1 May 2017). You must not make any decisions, incur any expenses, or hold any meetings as if you still had authority. If you held land or keys, you should surrender them to the Department of Environment, Land, Water and Planning (or the equivalent land administration body). You have no entitlement to notice; you are expected to know the law. If you had custody of records or funds belonging to the reserve, you should transfer them to the Crown.

If you had a licence or permit over any of the land (other than the preserved grazing licence at Campbelltown), your permission is extinguished. You must vacate the land and cease any authorised use. Contact the department to discuss whether you can obtain a new licence now that the land is unalienated Crown land. Do not assume that the Crown will automatically reissue the licence. You may need to apply under the Crown Land (Reserves) Act 1978 or the Land Act 1958.

If you hold the preserved grazing licence over Crown Allotment 70A1 at Campbelltown, you do not need to do anything. Your licence continues as before. However, you should confirm with the Registrar of Titles and the department that the licence is recorded and remains in effect. Keep a copy of this Act in case a third party challenges your right.

If you are a potential purchaser of any of the land (if it is later sold by the Crown), ensure that the Registrar has amended the Register under s 12. A title search should show the Crown as the unalienated proprietor, free of any former reservation notations. If the amendments have not been made, you should require the vendor (the Crown) to complete the recordings before settlement. The Act provides no mechanism for a private party to force the Registrar to act, but you can request the department to expedite the process.

If you are a lawyer or conveyancer advising a client on a transaction involving or adjacent to this land, confirm the current status of the land with the Registrar. The Act is still in force, but its operative work is done. The land may now be subject to sale or lease under general Crown land legislation. Check the Planning and Environment Act 1987 regime for any restrictions on use.

In summary, compliance is straightforward: the Act either extinguishes your rights or preserves them explicitly. If you are not the grazing licence holder, your rights are gone; act accordingly. If you are the government, complete the Register amendments. There is no reporting, no form to file, and no fee to pay.
