Land (Revocation of Reservations) Act 2019

The Act works through a small set of recurring legal concepts drawn from Crown land law and the Torrens title system. Those concepts, and how this statute uses them, are:

• Reservation and revocation: The Act revokes historic Orders in Council that created permanent reservations (see s3, s6, s9, s14). On revocation, the land is treated as unalienated Crown land (s4(a), s7(a), s10(a), s15(1)(a), s17(a)). The statutory text uses express language to clear "trusts, limitations, reservations, restrictions, encumbrances, estates and interests" from the land upon revocation.

• Temporary reservation: Where Parliament wants an interim arrangement, it re-creates a temporary reservation under s4(1) of the CLRA 1978 for a stated purpose. Examples: Frankston land is taken to be temporarily reserved for hospital purposes and Peninsula Health Inc. continues as committee of management (s5); Crown Allotment 2145 is temporarily reserved for State school purposes (s8); Crown Allotment 2144 is temporarily reserved for public recreation and the City of Boroondara is committee of management (s11).

• Permanent re-reservation: For Coleraine Racecourse land, the Act revokes prior reservations and grants and immediately takes the land to be permanently reserved under s4(1) of the CLRA 1978 as a site for a racecourse (s18).

• Committees of management and trustees: The Act revokes existing committee and trustee appointments to the extent they relate to revoked land (for example s4(b)-(c), s7(b)-(c), s10(b)-(c), s15(1)(b)-(c), s17(b)-(c)). In specific instances Parliament replaces or confirms committees: Peninsula Health Inc. (s5(b)), City of Boroondara (s11(b)), and Coleraine Racing Club Inc. (s19).

• Validation of prior dealings and titles: Part 4 (Geelong Foreshore) validates particular Crown grants and certificates of title and declares that subsequent recordings of interests or dealings "are taken to always have been authorised" for the purposes of s8 of the CLRA 1978 (s15(2)(a) to (f)). Part 4 also expressly states that nothing done by virtue of that Part affects holdings, mortgages, dealings or trustee appointments in respect of particular listed lands (s15(3)(a) to (d)).

• Revocation of Crown grants: The Act revokes specified Crown grants for Coleraine (s16(2)-(3)) and specifies that certain land ceases to be subject to an older statute’s reservation (s16(4)). That approach is more than the mere revocation of an Order in Council; it removes the operation of registered Crown grants and revokes prior statutory reservation.

• Register amendments: The Registrar of Titles has a specific statutory duty to make any recordings or amendments to the Register kept under the Transfer of Land Act 1958 necessary because of the Act (s20).

• Preservation of contractual rights: The Act preserves two licences in the Lower Reserve Camberwell Division, by expressly providing that revocation does not affect those licences (s12) and that actions under the Division do not place parties in breach or constitute defaults under those licences (s13).

These concepts are applied in a parcel-specific way. The schedule identifies original instruments and purposes, enabling the reader to trace which historical reservation instrument is being revoked and what replaced it. Where Parliament intended to protect existing private interests it said so in clear terms, otherwise the general rule of discharge of encumbrances applies.

The statutory changes affect a defined set of stakeholders; the Act specifies many of them. Key affected parties are:

• Committees of management and trustees: Existing committees and trustees with functions under the CLRA 1978 or predecessor instruments are affected directly by revocation clauses. Sections such as s4(b)-(c), s7(b)-(c), s10(b)-(c) and s17(b)-(c) revoke appointments to the extent they relate to the revoked land. Conversely, s5(b), s11(b) and s19 appoint or confirm particular committees as the new or continuing managers.

• Crown title holders and the Crown: The Crown is the residual legal owner of unalienated land. The Act converts certain reserved land into unalienated Crown land (see s4(a), s7(a) etc) and, for Coleraine, revokes Crown grants (s16(2)-(3)) and re-reserves as Crown land for a racecourse (s18). The Crown, through statutory officers such as the Minister responsible for Crown land and the Registrar of Titles, bears administrative responsibilities.

• Local government and public authorities: The City of Boroondara becomes the committee of management for Crown Allotment 2144 (s11(b)). Peninsula Health Inc., an incorporated health authority, continues as committee for the Frankston land (s5(b)). Local authorities thereby inherit duties and liabilities associated with committee-of-management status under the CLRA 1978.

• Licensees and occupiers: Two licenses are expressly preserved in the Camberwell Division: the licence dated 7 February 2018 between the City of Boroondara and Camberwell Primary School; and the licence dated 3 August 2015 between the City of Boroondara and Camberwell Junction Tennis Club Incorporated (s12). Section 13 ensures that the statutory changes do not constitute breaches, defaults, fulfil conditions allowing termination, or release parties from obligations under those licences.

• Registered proprietors, mortgagees and other title-holders: For parts of the Geelong Foreshore (items 7, 8 and 9), the Act expressly protects existing holdings, mortgages, encumbrances and dealings (s15(3)(a) to (c)). For other parcels, notably Coleraine where Crown grants are revoked (s16(2)-(3)), and for parcels where the Act states the land is "freed and discharged" (s4(a), s7(a), s10(a), s17(a)), the statutory effect may alter or extinguish interests that are not expressly preserved. The Registrar is directed to make amendments to the Register (s20) to reflect the legal changes.

• Developers, lessees, adjoining landowners and members of the public: Temporary reservations for hospital purposes, State school, and public recreation (s5(a), s8, s11(a)) change land-use legal status, which can affect planning, development and use. Users of the Geelong foreshore area and patrons of Coleraine Racecourse are indirectly affected by the change in management arrangements and reservation status.

• Legal and financial advisers: Because the Act revokes Orders in Council and certain Crown grants, lenders and their counsel will need to check the Register and any instruments listed in Schedule 1 (for example Crown grant volumes in s15(2) and s16(2)-(3)) to determine whether security interests remain and to instruct the Registrar as necessary.

The Act itself lists specific named entities and instruments for protection: Peninsula Health Inc. is continued as committee (s5(b)); the City of Boroondara is committee for certain Camberwell land (s11(b)); Camberwell Primary School and Camberwell Junction Tennis Club are licence-holders specifically preserved (s12); Coleraine Racing Club Inc. is appointed committee for Coleraine racecourse land (s19). Mortgagees and other registered interest-holders over Geelong Foreshore lands are protected by s15(3). For other parcels, the absence of an explicit preservation clause is itself consequential for those who hold rights or interests over those parcels.

The Act creates, terminates and preserves particular duties and rights. The statutory text is the source of the duties, not implied policy.

Duties and rights created or confirmed by the Act

• Committee-of-management powers and duties under the CLRA 1978: Where the Act appoints a body as committee of management, that body inherits the statutory rights and duties that the CLRA 1978 confers on committees of management for reserves of the given purpose. The Act confirms Peninsula Health Inc. continues as committee for the temporarily reserved Frankston land (s5(b)); the City of Boroondara is committee for Crown Allotment 2144 (s11(b)); Coleraine Racing Club Inc. is committee for the re-reserved racecourse land (s19). The specific statutory duties attached follow from the CLRA 1978 provisions referenced (for example s14 of the CLRA 1978 is invoked in s5 and s11) rather than from this Act itself.

• Registrar of Titles obligation: Section 20 imposes a specific duty on the Registrar of Titles to make any recordings or amendments in the Register under the Transfer of Land Act 1958 necessary because of the operation of this Act. That is a positive statutory administrative duty.

Rights and presumptions effected by revocation

• Return to unalienated Crown land freed of encumbrances: The Act repeatedly declares that on revocation the affected land is "taken to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (see s4(a), s7(a), s10(a), s15(1)(a), s17(a)). That statutory formula gives the Crown a clean legal slate for the parcel unless the Act provides otherwise.

• Preservation of specified licences and non-termination: For Camberwell, the licences specified in s12 are preserved and s13 asserts that nothing in that Division is to be regarded as placing a person in breach of those licences, or as constituting a default, or as fulfilling any condition entitling termination, or as releasing obligors from obligations. In short, the Act grants licence continuity and prevents the statutory change from being used by a licensor or third party to treat a licence as breached or terminated.

• Validation of earlier grants and dealings: For parts of the Geelong Foreshore, s15(2) authorises and states that particular Crown grants and certificates of title "are taken to always have been authorised" for the purposes of s8 of the CLRA 1978, and s15(2)(d)-(f) validate the recording of interests or dealings subsequent to those grants and certificates. That creates a retrospective validation right that protects parties who relied on those grants or certificates.

Duties and rights removed or limited by revocation

• Revocation of committee and trustee appointments: The Act expressly revokes appointments of committees of management and trustees to the extent they relate to the revoked land (for example s4(b)-(c), s7(b)-(c), s10(b)-(c), s15(1)(b)-(c), s17(b)-(c)). Where the Act does not name a replacement committee the statutory effect is removal of the committee’s prior legal functions.

• Revocation of Crown grants: Section 16 revokes specified Crown grants (Volume 1513 Folio 520 and Volume 4060 Folio 980). Revocation of a Crown grant is a direct statutory removal of a previously conferred title. The Act deals with the legal consequences by re-reserving Coleraine land as a site for a racecourse and appointing Coleraine Racing Club Inc. as committee (s18-s19), but the effect on mortgages and third-party rights depends on the text of the Act; no provision in Part 5 mirrors the protective language found in s15(3) for Geelong.

Limitations within the Act

• Parcel-specific scaffolding: The Act itself does not create novel offences, compensation mechanisms, or administrative appeal rights. It instead relies on existing statutory regimes: the CLRA 1978 for reservation, management and committee functions; and the Transfer of Land Act 1958 for register amendments, via the Registrar’s duty (s20). Where Parliament intended to preserve or validate particular private rights it did so clearly in relevant sections; elsewhere the default of discharge applies.

The Act therefore establishes targeted statutory duties for public officers (Registrar, relevant Ministers) and modifies rights of committees, trustees, licence-holders and registered interest-holders by explicit textual commands.

The Act contains no express penalty provisions, criminal offences, fines or infringement schemes. Its enforcement and effect are primarily administrative and property-law based. The text confines itself to altering title and management status; it does not create a new enforcement regime.

Administrative enforcement mechanisms and duties

• Registrar of Titles: Section 20 creates a duty for the Registrar of Titles to make any recordings or amendments in the Register under the Transfer of Land Act 1958 necessary as a result of the Act. Enforcement of that duty will be by normal public-law mechanisms applicable to statutory officers and public entities, including administrative review channels or judicial review where applicable. The Act does not specify timeframes or penalties for non-compliance by the Registrar.

• Operation through CLRA 1978: The Act relies on the CLRA 1978 for the operation of temporary and permanent reservations and committee-of-management appointments (s5 refers to s4(1) and s14 of the CLRA 1978; s11 refers to s14(2) of the CLRA 1978; s18 and s19 refer to s4(1) and s14(2) respectively). Any enforcement of duties or remedies in relation to committee conduct, reserve management, or misuse of reserved land will be governed by the CLRA 1978 and related regulations rather than by this Act. The Act does not create new remedies; it changes the legal status that triggers existing remedies in the CLRA 1978.

• Protection of contractual rights: Sections 12 and 13 in Division 2 of Part 3 create a statutory bar on construing the revocation or subsequent actions under that Division as constituting breach or default under the two listed licences, or as fulfilling conditions enabling termination or release. The practical enforcement mechanism for those protections would be private-law dispute resolution and remedies under contract law, backed by the statutory text.

Absence of express penalties

• No penal sanctions: Because the Act contains no penalties, any contraventions of obligations that follow from the new reservation status are enforced through the framework of existing laws that govern the relevant conduct: for example the CLRA 1978, the Transfer of Land Act 1958 and ordinary civil law (contracts, property, equitable remedies). The Act itself does not prescribe enforcement agencies or sanctioning powers.

Consequences for third parties

• Effects on registered security: For Geelong parcels the Act explicitly preserves mortgages and encumbrances (s15(3)(b)). For other parcels, particularly where Crown grants are revoked (s16(2)-(3)), the Act extinguishes or discharges prior interests unless they are otherwise preserved by the Act. Parties who are mortgagees, lessees or contractors will need to treat the Act as a statutory change that could alter their legal position, and enforcement or remedies will be ordinary civil actions unless CLRA 1978 provides a particular remedy.

In short, enforcement under this Act is implemented by administrative action (register amendments, committee appointments) and by existing statutory and civil-law remedies. The Act does not create criminal sanctions or a new regulatory enforcement apparatus.

The Act operates by reference to, and in interaction with, other statutes, principally the Crown Land (Reserves) Act 1978 and the Transfer of Land Act 1958, and it also engages historical instruments and local Acts.

Primary interlocking statutes

• Crown Land (Reserves) Act 1978 (CLRA 1978): The Act repeatedly invokes the CLRA 1978 for reservation and committee-of-management mechanics. Sections of this Act that are invoked include s4(1) (the head power to reserve land for particular purposes), s8 (which concerns dealings for reserved land; s15(2) expressly references s8), and s14/14(2) (committee-of-management appointment provisions) , see s5, s8, s11, s15(2) and s19. The practical consequence is that the substantive duties, powers and liabilities attached to committees of management and reservations will be governed by the CLRA 1978. Legal practitioners must therefore read this Act alongside the CLRA 1978 to understand ongoing powers and obligations.

• Transfer of Land Act 1958: Section 20 directs the Registrar of Titles to make any recordings or amendments to the Register under the Transfer of Land Act 1958 necessary because of this Act. The interplay here is administrative and Torrens-based: the Registrar will apply the changes to the real property register, which can alter registered titles, create or remove caveats, and record new reservations or committee appointments.

• Coleraine Race-course Act 1901 and Statute Law Revision Act 1984: Section 16(4) specifically declares that specified land ceases to be subject to the reservation imposed by section 3 and Schedules to the Coleraine Race-course Act 1901 as in force immediately before its repeal under the Statute Law Revision Act 1984. The Act therefore interacts with historical statutory reservations and cancels their continued effect to the extent specified.

Other interactions and priorities

• Validation and retrospective authorisation: For Geelong Foreshore lands, s15(2) does two things relevant to statutory interaction. First, it authorises the issue of particular Crown grants and certificates of title specified by volume and folio. Second, it declares those instruments to be "taken to always have been authorised" for the purposes of s8 of the CLRA 1978, thereby creating a statutory validation that interlocks with the CLRA 1978’s requirements for dealings in reserved land. This is a direct, retrospective interaction between this Act and the CLRA 1978. It also affects any legal challenge to the validity of earlier dealings, as Parliament has declared them authorised ab initio.

• Preservation or extinguishment of third-party rights: The Act expressly preserves certain licences at Camberwell (s12 and s13) and protects dealings and encumbrances for certain Geelong parcels (s15(3)). For other parcels, notably Coleraine, the revocation of Crown grants (s16) together with the blanket "freed and discharged" language (s17(a)) may override or extinguish existing interests unless preserved elsewhere. That has direct interaction with the operation of mortgage law and registered interests under Torrens principles and may require the Registrar to cancel or amend entries.

• Administrative sequencing and discretion: The Act requires the Registrar to make amendments (s20), but it does not specify the sequencing or the manner in which the Minister or Department will administratively reconfigure the land. The CLRA 1978 contains administrative processes and discretion for reservation and committee management that will be engaged after this Act takes effect. Practitioners should read this Act as a statutory trigger that modifies the starting point for CLRA 1978 administration.

Matters not within the Act

• Planning and local government instruments: The Act does not itself change planning controls, zoning, or local government land-use instruments. However, changing a parcel from reserved land to unalienated Crown land, or altering the reservation purpose, can affect future planning processes. Those interactions will be governed by planning statutes and local planning schemes, not by this Act directly.

• Compensation regimes: The Act contains no express compensation provision for extinguished interests. If compensation might be claimed under other statutes or constitutional principles, that interaction is not addressed in the text and would need to be assessed under separate legal frameworks.

In practise, understanding the Act’s legal effect requires reading it together with the CLRA 1978 and the Transfer of Land Act 1958, and with specific Crown grants and instruments cited in Schedule 1.

The version provided is Version No. 001, and the Endnotes contain the official amendment history statements.

Key chronological points in the Act’s legislative history as recorded in the Endnotes and the Act text are:

• Assent and commencement: The Act was assented to on 3 December 2019 (Endnotes, item 1). The Endnotes and s2 signal that the Act came into operation on proclamation or, if not proclaimed beforehand, on 27 August 2020. The Endnotes state that the Act came into operation on 17 March 2020 by Special Gazette No. 122 of 11 March 2020, page 1 (Endnotes, item 1).

• Second reading speech: The Endnotes list the Minister’s second reading speech dates: Legislative Assembly 11 September 2019 and Legislative Council 29 October 2019. Those speeches are part of parliamentary history and explanation but are not operative text.

• Amendments: The Endnotes include a "Table of Amendments" which states there are no amendments made to the Land (Revocation of Reservations) Act 2019 by Acts and subordinate instruments (Endnotes, item 2). The "Amendments Not in Operation" section records that this version does not contain amendments that are not yet in operation (Endnotes, item 3). The "Explanatory details" section notes "No entries at date of publication" (Endnotes, item 4).

• Style and interpretive notes: The Endnotes include standard references to the Interpretation of Legislation Act 1984 concerning headings, examples, punctuation and provision numbers (Endnotes, item 1). Those are editorial and interpretive; they do not change the substance of the Act but affect statutory interpretation.

There are therefore no recorded textual amendments to the Act as at Version No. 001. The Act’s lifetime amendments, if any, would be recorded in later consolidated versions; the provided material explicitly states none exist at the time of this version. For practitioners advising clients, the relevant dates to note are assent (3 December 2019) and the commencement date given (17 March 2020), and the absence of subsequent amendments within the published version.

The Act text and the endnotes do not record any litigation history. The Schedule, the Part structure and the Endnotes include no case citations, no judicial decisions, and no recorded disputes. The Act does not itself list or reference any cases.

Consequently, there is no statutoryly supplied litigation precedent, and the Act’s operation as a property and administrative law instrument means litigation risk will derive from circumstances outside the statute: for example, claims by parties who contend their rights were extinguished by the revocation of reservations or Crown grants; disputes over interpretation of committee-of-management duties under the CLRA 1978 in the new configurations; or challenges to registrar actions under the Transfer of Land Act 1958.

Because the statute contains explicit protections for certain parcels and licences (s12, s13, s15(3)), those protections narrow potential litigation grounds for those particular parties. For parcels where the Act effects revocation and removal of encumbrances without express preservation (for example Coleraine where Crown grants are revoked under s16(2)-(3) and the land is then re-reserved under s18), affected parties may have fewer statutory protections and might consider judicial review or other remedies, but no case law is recorded in the Act.

Practitioners should therefore treat the Act as a legislative instrument that may give rise to private litigation in the usual way if parties assert property or contractual rights that they consider impaired. Because the Act provides parcel-specific language protecting some parties and not others, any litigation record will necessarily be fact-specific and will need to be sought in external court and tribunal databases and not in the Act text.

This Act uses sparse but consequential drafting. A number of pitfalls and practical risks arise from its particular choices; the Act’s text is the source for each point.

1. "Freed and discharged" language extinguishes prior interests unless expressly preserved.
The repeated formulation that land is "taken to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (see s4(a), s7(a), s10(a), s15(1)(a), s17(a)) operates as a statutory clearing provision. Where the Act does not expressly preserve particular interests, those interests may be extinguished as a matter of statutory effect. Compare s15(3), which expressly protects holdings and mortgages for certain Geelong parcels. The differential treatment across parcels is a critical operational difference.

2. Differential protections: Geelong vs Coleraine and others.
Part 4 (Geelong Foreshore) expressly validates certain Crown grants and certificates of title and shields interests, mortgages and dealings (s15(2) and s15(3)). Part 5 (Coleraine) revokes Crown grants (s16(2)-(3)) and then re-reserves the land (s18), but does not include an explicit preservation clause for existing mortgages or dealings akin to s15(3). That creates a material asymmetry: holders of interests in Geelong are protected; holders of interests in Coleraine may not be. Practitioners should check the Register and the specific nature of any security instruments in Coleraine before relying on continuity of rights.

3. Retroactive validation clause in s15(2).
Section 15(2)(a) to (f) states that specific Crown grants and certificates of title "are taken to always have been authorised" for the purposes of s8 of the CLRA 1978 and validates subsequent recordings of interests or dealings. That language is retrospective and may bar challenges to past dealings that would otherwise be contestable for lack of prior statutory authorisation. This has the practical effect of taking away a potential ground for challenge for persons who might have argued earlier dealings were unauthorised. For anyone seeking to challenge a historical transaction over those Geelong parcels, s15(2) is a statutory bar to that theory of attack.

4. Registrar’s administrative sequencing and timing risk.
Section 20 requires the Registrar to make necessary recordings and amendments. The Act does not set deadlines or transitional processes. Delay, errors or inconsistent entries in the Register could create uncertainty for purchasers and lenders. Parties should seek precise confirmation from the Registrar as to the nature and timing of changes and consider caveats where appropriate.

5. Temporary reservation changes ongoing rights and management.
Sections 5, 8 and 11 create temporary reservations for particular public purposes and appoint committees of management in some cases. Temporary reservation status shifts legal control and could affect planning and operational uses, with uncertain duration and reversion pathways determined by the CLRA 1978 procedures. Licensees preserved by s12-s13 have protections, but other users may see changes to occupier rights.

6. Revocation of Crown grants is final unless protected.
Revoking a Crown grant is a powerful statutory instrument. Section 16 revokes two Crown grants by volume and folio for Coleraine. That action removes the statutory title conferred by those grants; where the Act does not add a savings clause, registered rights flowing from those grants may no longer have legal effect. Practitioners should verify whether any encumbrances were recorded and whether s17 or s20 effectuate any administrative adjustments intended to protect those parties. The Act’s silence on compensation is also relevant.

7. Contractual consequences are limited by s13.
For the two Camberwell licences the Act includes an express provision that nothing in the Division places any person in breach or constitutes a default under those licences (s13). Parties who are not those licence-holders cannot rely on s13; the protection is narrow and parcel-specific.

8. No compensation or dispute-resolution mechanism in the Act.
The statute contains no compensation scheme or-specific remedy for interests extinguished by the revocations. Any claim for compensation or equitable relief must be pursued under separate statutory or common-law avenues, subject to the Act’s text (for example, validation clauses may limit arguments about invalidity). Practitioners should consider whether other statutes provide compensation rights and whether judicial remedies such as equitable relief are available.

9. Intersection with planning and local government regimes is not addressed.
Changing reservation status does not of itself change planning controls, but it may affect what the Crown or committee of management seeks to do with a parcel. A client should not assume a change in reservation equals a permitted use under the planning scheme. Coordination with planning authorities and reviewing local planning instruments is necessary.

10. Practical drafting gaps require operational checks.
The Act expects administrative follow-through (Registrar amendments, committee notifications, regulatory instruments under s13 of CLRA 1978) but gives little procedural detail. That creates implementation risk: parties need to check how the relevant Minister and Department plan to operationalise the change and should monitor the Register and any Government Gazette notifications closely.

These are not legal conclusions beyond the text. They are consequences and operational risks that flow from the particular drafting choices the Parliament made in this Act.

For practitioners advising clients affected by the Act, compliance is primarily administrative and transactional. Below is a parcel-specific checklist plus general steps and verification actions grounded in the Act’s provisions.

Immediate verification steps (apply to all affected land in Schedule 1)

1. Check the Register and cited instruments.

• Verify current entries for the parcels listed in Schedule 1, including any registered Crown grants, certificates of title, mortgages, caveats or dealings. Note the specific volumes and folios cited in s15(2) and s16(2)-(3). The Act directs the Registrar to amend the Register (s20), but verification is the starting point.

2. Confirm whether the Registrar has recorded amendments and what those amendments are.

• Use the Transfer of Land Act 1958 Register to confirm changes implemented under s20. Keep copies of the Registrar’s notations and dates for client records.

3. Review relevant committee-of-management status.

• For Frankston: confirm Peninsula Health Inc. continues as committee of management (s5(b)). For Crown Allotment 2144: confirm City of Boroondara is committee (s11(b)). For Coleraine: confirm Coleraine Racing Club Inc. is committee (s19). Obtain written confirmation from the administering authority where possible.

Parcel-specific actions

Frankston (items 1-3; Part 2)

• Confirm temporary reservation for hospital purposes under s5(a) and continued committee-of-management status for Peninsula Health Inc. under s5(b). Check any operational arrangements or licences Peninsula Health holds and ensure those are recorded with the Registrar if necessary.

Lower Reserve, Camberwell (items 4-5; Part 3)

• For Crown Allotment 2145: confirm temporary reservation for State school purposes under s8. Notify the State education authority or Department if the school is to occupy or operate on the land.
• For Crown Allotment 2144: confirm temporary reservation for public recreation under s11(a) and City of Boroondara’s committee status under s11(b).
• For licence-holders listed in s12 (Camberwell Primary School and Camberwell Junction Tennis Club): confirm licences remain in force and that s13 protects against using this statutory change as a contractual default. Notify parties of continuity and update any internal property registers.

Geelong Foreshore (items 6-9; Part 4)

• Confirm the Registrar has recorded authorisations and validated titles as directed by s15(2). For practitioners representing lenders or purchasers, note s15(3) protects holdings, mortgages and dealings in respect of items 7-9; nevertheless confirm registration entries.
• If acting for parties who might have challenged past dealings, record that s15(2) provides retrospective authorisation for the deals and consult on practical remedies if rights are affected.

Coleraine Racecourse (items 10-11; Part 5)

• Confirm the revocation of Crown grants in s16(2)-(3) has been recorded by the Registrar under s20. If representing mortgagees, consider whether security survives and whether any transitional administrative measures are in place.
• Confirm re-reservation under s18 and appointment of Coleraine Racing Club Inc. as committee under s19. Where necessary, obtain written confirmation from the administering authority regarding the club’s responsibilities under the CLRA 1978.

Administrative and procedural compliance

• Update client title registers and risk registers: For all affected clients, update internal property records to reflect the Act’s changes and maintain copies of the relevant Gazette and Registrar entries.

• Liaise with the Registrar and Crown land administrators: Obtain written confirmation from the Registrar of Titles of the specific amendments made pursuant to s20. Where the Registrar’s office requires forms or evidence to implement the changes, comply promptly.

• Consider registering protective instruments where appropriate: If a client holds an interest not expressly preserved by the Act and wishes to protect possible remedies, consider lodging caveats or seeking other protective entries in the Register pending Registrar action or litigation outcomes. Legal advice on the utility and risk of such steps should be sought.

• Engage with committees of management and local authorities: If a client is likely to transact with or occupy the land, confirm which body is now committee of management and obtain that body’s position on leases, licences and management policies.

Contract and licence compliance

• For licence-holders listed in s12: advise that the Act preserves their licences and that s13 limits treating the revocation as a contractual breach or default. Confirm whether any administrative re-execution, novation or consent is required by the committee of management or the Registrar.

• For contracts referencing old reservations: Where agreements, easements or licences reference the prior reservation instrument or committee, consider whether novation, amendment or acknowledgement is required to reflect the new committee or reservation. This is a transactional formality often required by financing or development conditions.

Risk management and contingency planning

• For parties whose interests are not expressly preserved: prepare for possible loss of title or encumbrance. Evaluate alternative protections, such as negotiation with the Crown for compensatory arrangements or steps to secure replacement interests.

• For lenders: undertake title re-checks and advise on the immediate position of security. Lenders with security affected by revocation should engage counsel promptly to assess remedies.

• Documentation: maintain a file note linking the parcel to the exact Schedule 1 item, the original Order in Council referenced, the relevant section(s) of this Act, and the revised register entry.

Finally, because the Act interacts directly with the CLRA 1978 and the Transfer of Land Act 1958, ensure that compliance and any ongoing obligations are coordinated with counsel or officers familiar with those statutes. The Act is administrative and property-law focused; compliance therefore falls to registering changes, confirming committee appointments, and managing downstream contractual consequences.
