Peninsula Health Inc. stays in charge as the manager.\n*   **Lower Reserve, Camberwell:** Splits an old 'public gardens' reservation from 1885 into two parts:\n    *   One parcel (Crown Allotment 2145) is temporarily re-reserved for a State school.\n    *   The other parcel (Crown Allotment 2144) is temporarily re-reserved for public recreation, with the City of Boroondara as manager. Existing leases to Camberwell Primary School and the local tennis club are protected.\n*   **Geelong Foreshore:** Revokes old 'public purposes' reservations from 1873 on several parcels. This clears the way for past land titles and property dealings that had already happened to be legally recognised, without disturbing anyone's existing property rights or mortgages.\n*   **Coleraine Racecourse:** Revokes an 1883 reservation and two old Crown grants, then immediately re-reserves the land permanently as a racecourse site. The Coleraine Racing Club Inc. is appointed as the committee of management.\n\n**Why it matters:**\nThis is 'legislative housekeeping.' Old reservations often block modern land use even when everyone agrees the land should be used differently. Rather than going through lengthy administrative processes for each site, Parliament passes one Act to fix multiple historical legal hangovers. It ensures land titles are clear, protects existing tenants (like the school and tennis club in Camberwell), and lets public land serve current community needs."},"flash_summary":{"complexity_score":4,"scope_assessment":{"changed":false,"description":"This Act is narrowly targeted and implements the stated purpose in section 1: revoking particular historic Crown reservations and either re-reserving or clearing those parcels for new legal status. (See sections 3–19 and Schedule 1.)\n\n- The Act lists the exact parcels and instruments being revoked in Schedule 1 (eleven items) and then sets out the legal consequences for each group of parcels (Parts 2–5). Key mechanical effects are:\n  - Revoked land is taken to be “unalienated land of the Crown” and is freed from prior trusts, reservations and encumbrances (for example, s 4(a), s 7(a), s 10(a), s 15(1)(a), s 17(a)).\n  - Some revoked reserves are immediately re-reserved temporarily for a new public purpose (for example, Frankston land is taken to be temporarily reserved for hospital purposes at s 5(a); Camberwell allotments are temporarily reserved for State school purposes or public recreation at ss 8 and 11). Coleraine racecourse land is re-reserved permanently as a racecourse (s 18).\n  - Certain committees of management are revoked or continued/appointed to manage the land (for example, Peninsula Health remains committee for the Frankston land at s 5(b); City of Boroondara becomes committee for a Camberwell allotment at s 11(b); Coleraine Racing Club is made committee of management at s 19).\n  - The Act also expressly revokes particular Crown grants for Coleraine (s 16(2)–(3)), and in the Geelong foreshore part it authorises and treats as always authorised certain grants and title dealings (s 15(2)).\n  - Existing licences and agreements that apply to the Camberwell parcels are preserved and are not treated as breached by these changes (ss 12–13). Mortgagees/recorded interests for specified Geelong parcels are also protected (s 15(3)).\n  - The Registrar of Titles is required to make any entries or amendments necessary in the land register because of this Act (s 20).\n\n**Who is affected**\n\n- The Crown (state) — the legal status of specified Crown land parcels is changed (revoked, re-reserved or left available for dealing). (See Parts 2–5 and Schedule 1.)\n- Local or community managers and service bodies — committees of management (existing or newly appointed) are affected (ss 4(b)–(c), 5(b), 11(b), 19).\n- Specific local users/licensees — licences for Camberwell Primary School and Camberwell Junction Tennis Club are preserved (s 12) and section 13 prevents the revocation from automatically causing breaches or giving rise to termination rights.\n- Title-holders, mortgagees and anyone with recorded dealings in the Geelong parcels are explicitly protected from adverse effect (s 15(3)).\n- State agencies or beneficiaries of new reservations — e.g., Peninsula Health (hospital purposes), the State school system, City of Boroondara (public recreation management), and Coleraine Racing Club (racecourse management) are named or implied beneficiaries by the re-reservations (ss 5, 8, 11, 18–19).\n\n**Why this matters (mechanically and in trade-off terms)**\n\n- Changing a parcel from a long-standing public reserve to unalienated Crown land and then re-reserving or otherwise dealing with it changes who can use, manage and transact in that land. Freed land can be the subject of fresh Crown grants or other dealings once the legal encumbrances are removed (see s 4(a) and s 15(2)).\n\n- The Act is targeted: it names precise parcels and instruments (Schedule 1). The likely beneficiaries are concentrated (specific local bodies and agencies listed above), while any costs (for example loss of a particular reserve status) are geographically narrow and borne by local users or the public who used those reserves. The Act itself states its purposes (s 1): revocation and re-reservation at Frankston, Camberwell, Geelong and Coleraine.\n\n- Implementation tasks and risks are mainly administrative and technical: updating the Register of Titles (s 20), ensuring plan identification (e.g. LEGL./17-444 references in Schedule 1), and correctly carrying out temporary versus permanent re-reservations. Those steps create modest implementation risk (mapping/registration errors, timing of re-reservation) but the Act builds in protection for existing licences and recorded interests in several places (ss 12–13, s 15(3)).\n\n- The Act changes property and management rights rather than creating new regulatory regimes. It may enable different future uses (for example, new Crown grants or sale) where land is left unreserved, or lock in particular public functions where re-reserved. The immediate compliance burden on private parties is limited by the preservation clauses (ss 12–13) and the express non-affecting of existing dealings in the Geelong part (s 15(3)).\n\n**Who pays and who decides**\n\n- The State (Crown) is the central decision-maker in this Act — it enacts the revocations and re-reservations by statute (Parts 2–5 and Schedule 1). Operational decisions and costs flow to state agencies responsible for managing Crown land and to the Registrar of Titles for record changes (s 20).\n\n- Local committees of management or bodies named in the Act (Peninsula Health, City of Boroondara, Coleraine Racing Club) are assigned management roles or retain them (ss 5(b), 11(b), 19). Those bodies may incur management or operational costs thereafter.\n\n**Concise map to the statute**\n\n- Purposes: s 1\n- Frankston revocations and temporary re-reservation: ss 3–5; Schedule 1 items 1–3\n- Lower Reserve (Camberwell) revocations, temporary re-reservations, and licence preservation: ss 6–13; Schedule 1 items 4–5\n- Geelong foreshore revocations and protections for titles/dealings: ss 14–15; Schedule 1 items 6–9\n- Coleraine revocations, Crown grant revocations, and permanent re-reservation for racecourse: ss 16–19; Schedule 1 items 10–11\n- Registrar duties to update land records: s 20\n\n(References in parentheses are to the sections above.)"}},"importantCases":[],"_links":{"self":"/api/acts/land-revocation-of-reservations-act-2019","history":"/api/acts/land-revocation-of-reservations-act-2019/history","analysis":"/api/acts/land-revocation-of-reservations-act-2019/analysis","conflicts":"/api/acts/land-revocation-of-reservations-act-2019/conflicts","importantCases":"/api/acts/land-revocation-of-reservations-act-2019/important-cases","documents":"/api/acts/land-revocation-of-reservations-act-2019/documents"}}
