140N Variation of licence to operate as activity provider or tour operator on Crown land (1) The holder of a tour operator licence may apply to the Minister or a person authorised by the Minister for a variation of the licence or a condition of the licence. (2) On receiving the application under subsection (1), the Minister or person authorised by the Minster may vary the licence or condition in accordance with the application. (3) A variation made by the Minister or person authorised by the Minister under subsection (2) has effect on the Minister or person authorised by the Minister giving written notice of the variation to the licence holder. (4) The Minister or a person authorised by the Minister may vary a tour operator licence, or vary a condition of that licence, of his or her motion if the Minister or the authorised person is of the opinion that a variation is required. (5) A variation made by the Minister or a person authorised by the Minister under subsection (4) has effect on the Minister or authorised person giving written notice of the variation to the licence holder. (6) On and from 1 July 2023, in relation to land in the Great Ocean Road coast and parks, a reference to the Minister or a person authorised by the Minister in this section is a reference to the Great Ocean Road Coast and Parks Authority, regardless of whether or not the Great Ocean Road Coast and Parks Authority has been appointed as land manager.
